    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/em&gt;&amp;nbsp;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data d'&amp;nbsp;1 de febrer de 2021, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“INFORME / PROPOSTA DE RESOLUCIÓ/RESOLUCIÓ D'ACCEPTACIÓ DE RENÚNCIA I REVOCACIÓ DE LA RESOLUCIÓ DE CONCESSIÓ&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&amp;nbsp;16 de juliol de 2015 es va publicar en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2016 (BOIB núm. 185), de 22 de juny de 2016 (BOIB núm. 81) i de 26 de juny de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.&lt;/em&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;L'article 21.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que «En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que «Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Atès tot això, es proposa fer la revocació total a causa de la renúncia de l'ajuda concedida pel beneficiari que s'indica en l'annex d'aquesta resolució.&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Resolució de 10 de juliol de 2015 del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.&amp;nbsp;Ordre del conseller d'Agricultura Medi Ambient i Territorri de 19 de febrer de 2015, per la qual s'extebeixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Proposta de resolució &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Per tot això, s'informa favorablement del desistiment i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Revocar l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;ajuda concedida en la resolució del vicepresident del FOGAIBA de dia &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;sete&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;mbre&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&amp;nbsp;de 2019, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;(R&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;14&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;), corresponent a l'expedient INEA2017_1/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;183 &amp;nbsp;i per l'import indicat en l'annex d'aquesta resolució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Notifi&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;car aquesta resolució &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a les persones interessades mitjançant la publicació en el Butlletí Oficial de les Illes Balears. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
