&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Resolució del conseller de Mobilitat i Habitatge de 27 de novembre de 2020 per la qual es convoquen les proves per a l’obtenció del certificat d’aptitud professional acreditatiu de la qualificació inicial dels conductors de determinats vehicles destinats al transport per carretera que s’han de dur a terme l’any 2021 a les illes de Mallorca, Eivissa i Formentera, publicada en el BOIB núm. 204, de 5 de desembre de 2020, estableix en l’apartat 1 de l’annex 2 els membres del Tribunal qualificador d’aquestes proves, restant pendent de nomenament el suplent de la presidència.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Des de la seva publicació, s’ha produït la jubilació d’un altre membre del Tribunal, per la qual cosa cal també, modificar-ne la composició.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Reial decret 1032/2007, de 20 de juliol, pel qual es regula la qualificació inicial i la formació contínua dels conductors de determinats vehicles destinats al transport per carretera (BOE núm.184, de 2 d’agost de 2007).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Modificar el punt 1 de l’annex 2 de la Resolució del conseller de Mobilitat i Habitatge de 27 de novembre de 2020, referent a la composició del Tribunal qualificador de les proves, en els termes següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;On diu:&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquesta Resolució —que exhaureix la via administrativa— es pot interposar un recurs potestatiu de reposició davant del conseller de Mobilitat i Habitatge, en el termini d’un mes comptador des de l’endemà d'haver-se publicat, d’acord amb els articles 123 i 124 de la Llei 39/2015, d’1 d’octubre, del procediment administratiu comú de les administracions públiques i l’article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l’Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;També s’hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos comptadors des de l’endemà de la publicació de la Resolució en el BOIB, d’acord amb l’article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
