&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En data 27 de novembre de 2020, la presidenta de l'Institut d'Indústries Culturals de les Illes Balears (ICIB) va dictar la Resolució per la qual es convoca la concessió de subvencions per a projectes culturals de l'any 2020 (BOIB núm. 201, de 28 de novembre).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Durant el termini de presentació de sol·licituds per optar a les subvencions esmentades, l'ICIB va rebre 35 sol·licituds.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Comissió Avaluadora prevista en l'apartat 11.2 de la convocatòria es va reunir el 23 de desembre de 2020 per examinar les sol·licituds presentades i va emetre l'acta que va servir de base per a la Proposta de resolució de la directora de l'ICIB, que es va publicar el 30 de desembre de 2020 a la pàgina web de l'ICIB, en les versions en llengua catalana i castellana.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. D'acord amb l'apartat 12.1 de la convocatòria, les persones interessades disposaven d'un termini de cinc dies hàbils per presentar al·legacions contra aquesta Proposta de resolució.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Dins el termini establert, s'han presentat les al·legacions següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.1. El Sr. Lleonard Muntaner Mariano, com a representant de Lleonard Muntaner Editor, SL, presenta una al·legació en què exposa que va formalitzar mitjançant el registre electrònic una sol·licitud per al projecte d'edició de l'obra Josep Campaner, la lucha contra el noma, de Miquel Sbert, en la traducció de Sebastià Portell, i que aquesta obra no figura en la Proposta de resolució.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.2. El Sr. Felipe Menéndez Fernández, com a representant de Contemporánea Music Conciertos &amp;amp; Festivales, AIE, presenta una al·legació en relació amb &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;l'expedient PROJ-26B/2020, en què, d'una banda, sol·licita conèixer els motius que justifiquen la seva puntuació i, d'altra banda, exposa que en la Proposta de resolució consta que la subvenció és denegada per manca de crèdit pressupostari i el seu departament administratiu ha calculat els imports de les adjudicacions i ha observat que queden més de 12.000&amp;nbsp;€ per adjudicar.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.3. El Sr. Roberto Menéndez, com a representant de Contemporánea Music, SL, presenta una al·legació en relació amb l'expedient PROJ-30B/2020, en què exposa que, tot i que el seu projecte està ubicat en el llistat de subvencions denegades de la Proposta de resolució, s'especifica que l'import concedit és de 20.000 €. També manifesta la preocupació per la puntuació obtinguda (36,56) i sol·licita informació sobre aquesta puntuació.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.4. El Sr. Josep Maria Pijuan Blanco, com a representant d'Ifeelbook Editors, SL, presenta una al·legació en què sol·licita que s'anul·li l'exclusió de l'expedient PROJ-34C/2020 i que s'accepti la sol·licitud esmentada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.5. El Sr. Felipe Menéndez Fernández, com a representant de Contemporánea Music Conciertos &amp;amp; Festivales, AIE, presenta una al·legació en relació amb l'expedient PROJ-31B/2020, en què exposa que, un cop analitzada detalladament la Proposta de resolució, han observat que a la «Modalitat B. Música» s'han concedit subvencions a un total de 6 projectes, entre els quals hi ha el Festival Géiser, i que són el cinquè projecte millor puntuat. Per això, sol·liciten explicacions sobre la quantia atorgada. També exposen que el seu projecte té un pressupost superior al de l'expedient PROJ-17B/2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Els tècnics de l'ICIB han comprovat que l'entitat Lleonard Muntaner Editor, SL, va presentar dues sol·licituds en el Registre de l'ICIB. Per error, l'ICIB no en va examinar una i no la va trametre a la Comissió Avaluadora perquè la valoràs.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Així mateix, es comprova que hi ha errors de transcripció en la versió castellana de la Proposta de resolució publicada en el web de l'ICIB, que afecten els expedients amb els números de referència PROJ-24A/2020, PROJ-30B/2020 i PROJ-31B/2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El 25 de gener de 2021 es va reunir la Comissió Avaluadora, la qual va acordar en l'acta que consta en l'expedient els punts següents:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Al·legació sobre l'expedient PROJ-26B/2020: comunicar a l'interessat la puntuació desglossada obtinguda.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Al·legació sobre l'expedient PROJ-30B/2020: atès que la sol·licitud aquest expedient ha estat denegada per manca de crèdit pressupostari, no hi ha de constar cap import concedit. A més, s'acorda comunicar a l'interessat la puntuació desglossada obtinguda.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Al·legació sobre l'expedient PROJ-31B/2020: esmenar en la Resolució l'import concedit que apareixia en la versió en castellà de la Proposta de resolució.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Pel que fa a l'al·legació referent al fet que el pressupost d'aquest projecte és superior al d'un altre: informar que l'apartat 3 («Dotació pressupostària») de les bases de la convocatòria estipula que el pressupost del projecte tan sols es tindrà en consideració en relació amb l'import concedit en el cas d'obtenir la mateixa puntuació dins una mateixa modalitat.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Al·legació sobre l'expedient PROJ-34C/2020: excloure aquest projecte d'acord amb el que estipulen les bases en l'apartat 2.3. La conjunció «i» no implica que el projecte hagi de reunir aquests dos requisits (ser projectes audiovisuals i ser projectes de naturalesa acadèmica), sinó que ambdós queden exclosos d'aquesta convocatòria, tant els projectes audiovisuals com els de naturalesa acadèmica.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;— Al·legació sobre l'expedient PROJ-36D/2020: excloure aquest expedient de la convocatòria atès que és la mateixa edició objecte de l'expedient PROJ-4D/2020 (encara que sigui en un altre idioma) i, per tant, es tracta d'un mateix projecte cultural (edició del llibre Josep Campaner, la lluita contra el noma, de Miquel Sbert). Com que tan sols varia l'idioma, s'acorda que es tracta del mateix projecte cultural que el de l'expedient PROJ-4D/2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. El personal de l'ICIB ha comprovat que les entitats beneficiàries compleixen els requisits que estableix la normativa per poder rebre subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. L'Ordre de la consellera d'Educació i Cultura d'1 de juliol de 2009 per la qual s'estableixen les bases reguladores de les subvencions en matèria d'educació i cultura (BOIB núm. 100, d'11 de juliol).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. L'article 20.h) dels Estatuts de l'ICIB, aprovats pel Decret 50/2018, de 21 de desembre, que disposa que la directora de l'ICIB és l'òrgan competent per concedir subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La Resolució de la presidenta de l'ICIB de 27 de novembre de 2020 per la qual es convoca la concessió de subvencions per a projectes culturals de l'any 2020 (BOIB núm.&amp;nbsp;201, de 28 de novembre).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprovar i concedir subvencions per l'import total de 256.500 € a favor dels beneficiaris que s'inclouen en els annexos 1, 2, 3 i 4.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autoritzar i disposar la despesa indicada per a cadascun dels beneficiaris amb càrrec al capítol 4 del pressupost de l'ICIB, amb els imports detallats en els annexos 1, 2, 3 i 4.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Excloure de la concessió de subvencions les sol·licituds que s'indiquen en els annexos 1, 2, 3 i 4.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Informar els beneficiaris que la justificació i el pagament de la subvenció s'han de fer d'acord amb el que disposa el punt 13 de l'annex de la Resolució de la presidenta de l'ICIB de 27 de novembre de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Publicar aquesta Resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquesta Resolució, que no exhaureix la via administrativa, es pot interposar un recurs d'alçada davant la presidenta de l'ICIB, en el termini d'un mes comptador a partir de l'endemà d'haver-se publicat, d'acord amb l'article 122 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article&amp;nbsp;58 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;
