ANTECEDENTS</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Que el 26 de setembre de 2018 i mitjançant RE núm. E2018000325 l'Ajuntament de Maó sol·licita al Consorci que iniciï les actuacions necessàries per a la prestació del servei de recollida integral de residus domèstics, ja sigui de forma mancomunada amb altres municipis o individualment. Actualment, el servei de recollida de la fracció resta el presta l'Ajuntament i i té com a data prevista de finalització el 31 de desembre de 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Que el 23 d'octubre de 2018 i mitjançant RE núm. E2018000351 l'Ajuntament des Castell sol·licita al Consorci que iniciï un estudi detallat de la possibilitat de la recollida mancomunada del servei de recollida integral de residus amb els municipis de l'entorn, elaborant els informes, estudis, projectes i qualsevol altra documentació que consideri necessària per a la prestació del servei mitjançant contractació externa amb tercers, així com per a la planificació, coordinació del servei i el control i seguiment de la seva execució. Actualment, el servei de recollida de la fracció resta el presta l'Ajuntament i té com a data prevista de finalització el 6 d'octubre de 2021.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Per la seva part, el consorci presta el servei públic de recollida selectiva de vidre, paper/cartó, envasos lleugers i plàstics agrícoles a la totalitat de l'illa de Menorca.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. D'acord amb l'establert a l'apartat 1.a) de l'article 3 dels Estatuts del Consorci, forma part de l'objecte principal del Consorci: «L'estudi, la programació i la prestació de serveis de gestió de residus els quals siguin competència dels ens integrants del Consorci. Als efectes d'aquests estatuts s'entendrà per gestió de residus: la recollida (que integra la classificació i emmagatzematge), el transport i el tractament (entès com qualssevol de les operacions de valorització i d'eliminació) i qualsevol altra activitat relacionada amb els residus, incloses les actuacions realitzades en qualitat de negociant o agent.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per la prestació del servei de recollida no separada de residus, serà necessària la formalització prèvia del corresponent conveni regulador. (...)»</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. Vists els treballs preliminars realitzats des del Consorci que estudien les alternatives possibles per aconseguir els objectius normatius respecte a la recollida separada, els quals conclouen que el millor model de recollida de residus per a Menorca ha de consistir en un sistema de recollida porta a porta que contempli les 5 fraccions (FORM, paper i cartó, vidre, envasos lleugers i resta), sistemes que permeten arribar a percentatges de recollida separada al voltant del 70%.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Que en data 20 de desembre de 2018 des del Consorci s'encomana a l'empresa CICLA CONSULTING SERVICES (Eduard Oliete Guiu - 44021762S) l'elaboració de part de la documentació preparatòria necessària per poder tramitar l'expedient de contractació del servei de recollida de residus a Maó i es Castell.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Que és voluntat de les parts assolir els objectius de reciclatge establerts tant a la normativa europea, estatal com autonòmica i local, motiu pel qual esdevé necessari redissenyar el servei conjunt de recollida de residus domèstics.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. Que l'Ajuntament de Maó, en sessió ordinària de la Junta de Govern Local celebrada el dia 09 de novembre de 2020, va aprovar aquest Conveni entre l'Ajuntament de Maó, l'Ajuntament des Castell i el Consorci amb l'objecte de gestionar el servei de recollida de residus en els termes municipals de Maó i Es Castell, mitjançant un sistema porta a porta de al manco cinc fraccions de residus.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">9. Que l'Ajuntament des Castell, en sessió ordinària del Ple, celebrat el dia 26 de novembre de 2020, va aprovar aquest Conveni entre l'Ajuntament de Maó, l'Ajuntament des Castell i el Consorci amb l'objecte de gestionar el servei de recollida separada de residus en els termes municipals de Maó i Es Castell, mitjançant un sistema porta a porta de al manco cinc fraccions de residus.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">10. Que el Consorci de Residus i Energia de Menorca, mitjançant acord de la Junta de Govern de data 19 de novembre de 2020, va aprovar aquest Conveni entre l'Ajuntament de Maó, l'Ajuntament des Castell i el Consorci amb l'objecte de gestionar el servei de recollida de residus en els termes municipals de Maó i Es Castell. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">11. Q<span style="color:#000000">ue segons els acords esmentats i en compliment del que estableix l</span>'article 68.1 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, formalitzen el present conveni d'acord amb els següents</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>PACTES</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Primer. Objecte</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'objecte d'aquest Conveni és regular i definir el marc de col·laboració entre el Consorci i els Ajuntaments de Maó i Es Castell per a la prestació, per part del Consorci, del servei de recollida de residus, mitjançant un sistema de recollida porta a porta que contempli com a mínim 5 fraccions (fracció orgànica, paper i cartó, vidre, envasos lleugers i resta) en els termes municipals de Maó i Es Castell, amb la finalitat d'aconseguir una major eficiència tècnica, econòmica i administrativa en compliment de les finalitats del Consorci.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La prestació del servei objecte d'aquest conveni per part del Consorci es duu a terme d'acord amb el que preveu el primer paràgraf de l'article 3.1.a) dels seus estatuts, i pel que fa a la recollida no separada de residus (fracció resta), pel que estableix el present conveni previst en el segon paràgraf de l'article 3.1.a) dels mateixos estatuts, referent a l'objecte principal del Consorci.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segon. Abast del servei de recollida de residus per part del Consorci</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'entendrà, en termes genèrics, per prestació del servei de recollida de residus, la prestació del següent:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- La contractació dels serveis i qualsevol altra tipus de contractació necessaris per a la prestació del servei.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Recollida Porta a Porta (en endavant PaP) de les cinc fraccions (paper i cartró, vidre, envasos lleugers, matèria orgànica i resta) a usuaris domèstics.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Recollida PaP de les cinc fraccions a usuaris comercials.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Recollida PaP de les cinc fraccions a usuaris industrials.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Recollida de les cinc fraccions mitjançant àrees d'aportació tancades.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Recollida de residus voluminosos.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Recollida de la fracció vegetal.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Repàs de rutes.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Rentat i manteniment dels elements de contenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Subministrament d'elements de contenció.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Construcció de les àrees d'aportació tancades.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Campanyes de comunicació.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'entendrà, en termes genèrics, per gestió del servei de recollida de residus, la prestació del següent:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Qualitat i control del servei de recollida.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tercer. Actuacions a realitzar i compromisos assumits pel Consorci</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Consorci de Residus i Energia de Menorca es compromet a dur a terme totes les actuacions que siguin necessàries per a la gestió del servei de recollida de residus en els termes municipals de Maó i Es Castell i, particularment, les següents:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) L'elaboració d'informes, estudis i projectes que siguin necessaris per a la prestació del servei, ja sigui a través de personal propi o per mitjà de contractació externa a un tercer.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) La prestació i gestió de manera directe o indirecte del servei conjunt de la recollida de residus domèstics. En cas de gestió indirecta, comprendrà la tramitació de tot l'expedient administratiu necessari per a la seva adjudicació i formalització, incloses les actuacions preparatòries. També comprendran la tramitació de les corresponents modificacions contractuals que s'hagin de realitzar, tot l'anterior de conformitat amb l'establert a la normativa aplicable en matèria de contractació de les administracions públiques. En qualsevol cas, els contractes que es formalitzin pel desenvolupament del servei s'hauran d'adaptar a les condicions econòmiques d'aquest conveni.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) La planificació, direcció i coordinació del servei, així com el control de la seva execució fins a la finalització i liquidació del contracte.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) La realització de manera directa o per mitjà de contractació externa de les prestacions accessòries o complementàries a les anteriors que siguin necessàries per a la realització de l'objecte del present conveni. En cas que comportin una despesa econòmica el repartiment del seu finançament es determinarà per acord de les parts mitjançant la signatura d'una addenda al present conveni.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) L'assumpció front a tercers dels drets i obligacions que correspondrien als ajuntaments signants, en tant que titulars del servei en les relacions jurídiques derivades de la prestació del servei que sorgeixen a partir de la data d'inici dels serveis vinculats a aquest conveni. A aquests efectes el Consorci tindrà condició de posseïdor dels residus recollits en els termes prevists a la legislació de residus i subscriurà els contractes i convenis que siguin procedents amb els sistemes integrats de gestió, amb les empreses recicladores o altres amb les que sigui procedent el lliurament de residus.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La present atribució de la gestió del servei al Consorci comprendrà la resolució dels recursos que es puguin plantejar en via administrativa derivats de la gestió dels serveis anteriors. No obstant l'anterior amb caràcter previ a la seva resolució s'haurà de sol·licitar informe a les entitats locals competents, en els termes establerts en els articles 79 i 80 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) L'aportació econòmica corresponent, que resulti dels ingressos provinents de la gestió de les fraccions de paper i cartó, vidre i envasos, recollits als municipis de Maó i Es Castell.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g) El subministrament d'informació del contracte i del seu desenvolupament als Ajuntaments afectats.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Quart. Actuacions a realitzar i compromisos assumits pels Ajuntaments</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Els Ajuntaments de Maó i Es Castell es comprometen a:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Participar en la preparació dels procediments d'aprovació i licitació per a la contractació del servei, així com en la tramitació en el seu cas de les seves modificacions posteriors.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Inspeccionar el servei quantes vegades considerin oportunes amb la finalitat de comprovar el seu bon funcionament i instar al Consorci que adopti les mesures que considerin necessàries pel bon funcionament del servei.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Posar a disposició del Consorci els mitjans materials subrogats que es llisten a l'annex I del present conveni, així com els contenidors i les corresponents fixacions i delimitacions existents, i autoritzar a aquest la seva utilització i conservació, per desenvolupar, directament o mitjançant tercers, les tasques necessàries per executar el servei de recollida de residus domèstics.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per mitjà del present conveni les administracions signants adscriuen al Consorci per a la prestació del servei objecte del present conveni els mitjans materials descrits en el paràgraf anterior, sense que suposi en cap cas la cessió de la seva titularitat.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Aprovar i implementar les ordenances municipals reguladores i fiscals necessàries pel bon desenvolupament del servei.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) Finançar el cost total del servei mitjançant les aportacions que s'acordin i procedir al pagament d'acord amb les previsions que estableix l'apartat segon del pacte cinquè del present conveni o de les possibles revisions que es puguin realitzar.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) Facilitar la informació que sigui requerida pel Consorci pel bon desenvolupament del servei.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Cinquè. Obligacions i compromisos de caràcter econòmic</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5è. Primer. Previsió de costos i ingressos per la gestió del servei</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) El pressupost per a la prestació del servei objecte d'aquest conveni, d'acord amb l'estudi econòmic elaborat pel Consorci, xifra en la quantitat màxima, per a la primera anualitat de prestació del servei, en 4.389.755,47 € (sense IVA) i la resta d'anualitats en 3.541.631,96 € (sense IVA), conforme el següent:</span></p> <table border="1" cellspacing="0" class="Table" style="border-collapse:collapse; Segon. Liquidació de les aportacions municipals per la prestació del servei</strong></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Facturació del servei per part del Consorci als Ajuntaments.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Ordinària: Els Ajuntaments transferiran mensualment i successivament al Consorci l'import corresponent a una dotzena part del cost anual previst per a la gestió del servei amb la finalitat de què aquest l'afecti al compliment de les obligacions derivades de la gestió del servei a mesura que es dugui a terme, prèvia presentació dels corresponents certificats o factures per part del Consorci. </span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La primera factura mensual coincidirà amb el mes de posada en funcionament del servei.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Extraordinària: Una volta aprovades les corresponents liquidacions anuals previstes en l'apartat "b" següent, el Consorci emetrà la factura de liquidació. L'import serà el resultant de la diferència entre l'import de la liquidació anual de l'exercici corresponent i la suma dels imports facturats conforme l'apartat anterior del mateix exercici.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Cost anual previst als efectes de facturació ordinària</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Als efectes d'emissió de la facturació mensual prevista en l'apartat "a" anterior, el cost anual previst aplicable durant el termini comprès des de l'inici de l'execució de la prestació fins el mes de desembre posterior a l'aprovació de la primera liquidació anual d'un exercici complert, serà el que figura pel primer any en l'apartat "d" del pacte 5è.primer d'aquest conveni.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pels exercicis posteriors, el cost anual previst aplicable als efectes de la facturació mensual prevista en l'apartat "a", serà el resultat de la última liquidació anual aprovada.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) Liquidació anual</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Consorci emetrà anualment una liquidació per la gestió del servei la qual correspondrà, amb caràcter general, al cost de la prestació del servei d'un any natural complert. La primera liquidació correspondrà al termini comprés entre l'inici de la prestació del servei i el 31 de desembre del mateix exercici.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Pel càlcul de la liquidació anual de cada ajuntament s'aplicarà la fórmula següent:</span></p> <p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>L = (A * B) - ( C – D), </strong>on:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">L: Liquidació anual de l'exercici</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A: Suma dels imports d'adjudicació dels lots de la contractació per l'execució del servei.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">B: Ajuntament de Maó 83,61%; Ajuntament des Castell 16,39%.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">C: Correspon a l'import resultant d'aplicar a la totalitat d'ingressos obtinguts per les fraccions d'envasos lleugers, paper i cartó i vidre procedents dels vuit municipis de Menorca, la part proporcional de les tones aportades per cadascun dels municipis de Maó i Es Castell sobre la totalitat de tones recollides dels vuit municipis, conforme el següent:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">C= c1 + c2 + c3</span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c1: total tones envasos lleugers recollides al municipi * ingrés total ecoembes / total tones envasos lleugers recollides a Menorca.</span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c2: total tones vidre recollides al municipi * ingrés total ecovidrio / total tones vidre recollides a Menorca.</span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c3: total tones paper i cartó recollides al municipi * ingrés total venda paper i cartó / total tones paper i cartó recollides a Menorca.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">D: Correspon a l'import resultant d'aplicar a la totalitat del cost per la gestió de les fraccions d'envasos lleugers, paper i cartó i vidre procedents dels vuit municipis de Menorca, la part proporcional de les tones aportades per cadascun dels municipis de Maó i Es Castell sobre la totalitat de tones recollides dels vuit ajuntaments, conforme el següent:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">D= d1 + d2 + d3</span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d1: total tones envasos lleugers recollides al municipi * cost gestió envasos / total tones envasos lleugers recollides a Menorca.</span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d2: total tones vidre recollides al municipi * cost gestió vidre / total tones vidre recollides a Menorca.</span></p> <p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d3: total tones paper i cartó recollides al municipi * cost gestió venda paper i cartó / total tones paper i cartó recollides a Menorca.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Emissió i pagament de factures.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per l'emissió i pagament de les factures resultants d'aquest conveni seran d'aplicació les normes generals de facturació de serveis i altres aportacions municipals, previstes en la base 6ena del pressupost general del Consorci.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) En cas que s'hagin de fer aportacions addicionals, ocasionades per modificacions contractuals o qualsevol altre motiu diferents als esmentats en els punts anteriors, aquestes es fixaran previ informe de la Comissió mixta de seguiment, mitjançant l'aprovació i posterior formalització d'una addenda al conveni, en què s'haurà de determinar l'aportació de cadascuna de les parts.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Sisè. Conseqüències aplicables en el cas d'incompliment de les obligacions assumides</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El conveni s'extingirà per l'incompliment de les actuacions que en constitueixen l'objecte o l'incompliment greu de les obligacions i compromisos assumits per part d'algun dels firmants.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aquest cas, qualsevol de les parts pot notificar a la part incomplidora un requeriment perquè compleixi en un termini determinat les obligacions o els compromisos que es consideren incomplerts. Aquest requeriment s'ha de comunicar a la comissió de seguiment, vigilància i control de l'execució del conveni i a les altres parts signants. Si, un cop transcorregut el termini indicat en el requeriment, l'incompliment persisteix, la part que el va adreçar ha de notificar a les parts signants la concurrència de la causa de resolució i el conveni s'entén resolt. La resolució del conveni per aquesta causa pot comportar la indemnització dels perjudicis causats si així s'ha previst.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Setè. Règim de modificació del conveni</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La modificació del contingut del conveni requerirà acord unànime de les parts i la formulació de la corresponent addenda.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Vuitè. Comissió mixta de seguiment, vigilància i control</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A partir de la signatura del conveni es constituirà una comissió mixta de seguiment, vigilància i control amb representants designats pels subjectes firmants en règim de paritat. La comissió esmentada s'ha de responsabilitzar del seguiment, vigilància i control de les accions derivades del conveni.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En particular correspon a la comissió:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Informar de les possibles variacions en les aportacions econòmiques de les parts, de conformitat amb el previst a l'apartat “g” del pacte cinquè.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Ser informada de les modificacions del contracte que es duguin a terme en execució del present conveni.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) La resolució de dubtes i les controvèrsies que puguin sorgir en l'aplicació d'aquest.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) Informar sobre la interpretació de les seves clàusules, així com l'informe dels protocols i annexos que es vulguin signar en desenvolupament d'aquest.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La comissió mixta de seguiment s'ha de reunir sempre que ho sol·liciti per escrit una de les parts. En la constitució de la comissió es designarà les persones que duran a terme les funcions de presidència i secretaria, que poden tenir un caràcter rotatori.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El règim de funcionament i adopció d'acords per al funcionament dels òrgans col·legiats és l'establert en la Llei 40/2015, d'1 d'octubre, de regim jurídic del sector públic.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Novè. Causes de resolució i denúncia</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest conveni s'extingirà per l'acompliment de les actuacions que en constitueixen l'objecte o perquè s'incorri en causa de resolució.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Són causes de resolució:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) El transcurs del termini de vigència, inclòs la pròrroga prevista.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) L'acord unànime de totes les parts.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">c) L'incompliment greu de les obligacions i compromisos assumits per part d'algun dels firmants.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En aquest cas, qualsevol de les parts pot notificar a la part incomplidora un requeriment perquè compleixi en un termini determinat les obligacions o els compromisos que es consideren incomplerts. Aquest requeriment s'ha de comunicar a la comissió de seguiment, vigilància i control de l'execució del conveni i a les altres parts signants. La resolució del conveni per aquesta causa pot comportar la indemnització dels perjudicis causats si així s'ha previst.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">d) La decisió judicial declaratòria de la nul·litat del conveni.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">e) La impossibilitat sobrevinguda legal o material de poder dur a terme l'objecte del conveni.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f) Per denúncia expressa de qualsevol de les parts per a separar-se de forma unilateral del conveni. En aquest cas s'ha de comunicar per escrit a les altres parts amb una antelació mínima de tres mesos; en qualsevol cas, les parts es comprometen a finalitzar el desenvolupament de les accions ja iniciades en el moment de la notificació de la denúncia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Desè. Efectes de la resolució del conveni</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El compliment i la resolució del conveni dona lloc a la seva liquidació a fi de determinar les obligacions i els compromisos de cadascuna de les parts.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Derivats dels compromisos financers, s'entendrà acomplert el conveni quan el seu objecte s'hagi realitzat en els termes i a satisfacció de totes les parts, d'acord amb les seves competències respectives, tenint en compte les regles següents:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Si de la liquidació resulta que l'import de les actuacions executades per alguna de les parts és inferior als fons que aquesta hagi rebut de la resta de parts del conveni per finançar l'execució esmentada, aquella ha de reintegrar a aquestes l'excés que correspongui a cada una, en el termini màxim d'un mes des que s'hagi aprovat la liquidació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si, un cop transcorregut el termini màxim d'un mes, esmentat en el paràgraf anterior, no s'ha produït el reintegrament, s'ha d'abonar a les parts esmentades, també en el termini d'un mes comptador d'aquest moment, l'interès de demora aplicable al reintegrament esmentat, que en tot cas és el que resulti de les disposicions de caràcter general reguladores de la despesa pública i de l'activitat econòmic financera del sector públic.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Si és superior, la resta de parts del conveni, en el termini d'un mes des de l'aprovació de la liquidació, han d'abonar a la part de què es tracti la diferència que correspongui a cadascuna, amb el límit màxim de les quantitats que cadascuna s'hagi compromès a aportar en virtut del conveni. En cap cas les parts del conveni tenen dret a exigir a la resta cap quantia que superi els límits màxims esmentats.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. No obstant això, si, quan concorri qualsevol de les causes de resolució del conveni, hi ha actuacions en curs d'execució, les parts, a proposta de la comissió de seguiment, vigilància i control del conveni o, si no n'hi ha, del responsable del mecanisme a què fa referència la lletra f) de l'article 49 de la Llei 40/2015, d'1 d'octubre, de regim jurídic del sector públic, poden acordar la continuació i acabament de les actuacions en curs que considerin oportunes, i establir un termini improrrogable per al seu final, un cop transcorregut aquest, se n'ha d'efectuar la liquidació en els termes que estableix l'apartat anterior.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Onzè. Qüestions litigioses i jurisdicció competent</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Les controvèrsies que puguin sorgir en la interpretació i l'aplicació dels pactes d'aquest conveni les ha de resoldre l'ordre jurisdiccional contenciós administratiu. No obstant això, les controvèrsies que es puguin plantejar sobre la interpretació i l'execució del conveni s'han de dirimir amb caràcter previ en el si de la comissió mixta de seguiment prevista en aquest conveni.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest conveni de col·laboració té naturalesa administrativa i de conformitat amb l'article 6.1 de la Llei 9/2017, de 8 de novembre, de Contractes del Sector Públic queda exclòs del seu àmbit d'aplicació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Dotzè. Vigència</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformitat amb l'article 49.h) de la Llei 40/2015, d'1 d'octubre, de regim jurídic del sector públic, el termini de vigència del conveni serà de quatre anys a partir de la data de formalització, més un període de pròrroga de quatre anys. Així doncs, la duració total del present conveni podrà ser de vuit anys. Aquesta pròrroga s'haurà d'aprovar un cop adjudicat el corresponent contracte per a la prestació del servei de recollida de residus.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Tot i així, quan hi hagi actuacions en curs d'execució, a proposta de la comissió mixta de seguiment, vigilància i control del conveni, es podrà acordar la continuació i acabament de les actuacions en curs que consideri oportunes, i establir un termini improrrogable per al seu final. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Transitòriament, mentre que no es disposi del corresponent contracte de gestió del servei de recollida de residus, mitjançant el sistema de recollida porta a porta que contempli al manco les 5 fraccions, els Ajuntaments continuaran sent responsables i prestant el servei de recollida no separada (fracció resta).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tretzè. Publicitat del conveni</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquest conveni s'ha de publicar en el Butlletí Oficial de les Illes Balears amb indicació dels acords dels òrgans competents de les administracions que el subscriuen.
