    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Convocatòria d'ajudes per al desenvolupament rural de l'illa de Menorca, relacionats directament o indirectament amb els àmbits agrari i/o ambiental, dins l'Estratègia de Desenvolupament Local Participatiu de Menorca, de data 22 de gener de 2018&amp;nbsp;especifica que la resolució es publicarà amb caràcter informatiu a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu&amp;nbsp;l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident en Matèria Agrària del FOGAIBA en&amp;nbsp;data 18&amp;nbsp;de gener&amp;nbsp;de 2021, va signar la següent resolució,&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;&amp;nbsp;“RESOLUCIÓ DE CONCESSIÓ&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1. E&lt;/em&gt;&lt;/span&gt;&lt;em&gt;n data 8 de febrer de 2018 es va publicar al BOIB núm 18 la convocatòria d'ajudes per al desenvolupament rural de l'illa de Menorca, relacionats directament o indirectament amb els àmbits agrari i/o ambiental, dins l'Estratègia de Desenvolupament Local Participatiu de Menorca pels anys 2018 i 2019. Aquesta convocatòria va patir dues modificacions publicades als BOIB 104 de 23 d'agost de 2018 i 119 de 27 de setembre de 2018&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. De conformitat amb l'apartat sisè de l'esmentada Resolució, els terminis de presentació de sol·licituds per als anys 2018 i 2019 van acabar els dies 15 de desembre de 2018 i 15 de desembre de 2019 respectivament i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7&lt;/em&gt;&lt;/span&gt;&lt;em&gt;&amp;nbsp;sol·licituds d'ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;3. Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Els interessats assenyalats a l'&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;Annex I adjunt han presentat, dins el termini establert i en la forma escaient, tota la documentació necessària prevista a la convocatòria, i s'ha comprovat que compleixen amb els requisits exigits per poder ser beneficiaris d'aquesta ajuda.&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;5. Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat de la convocatòria, als beneficiaris els hi correspon una ajuda màxima detallada a l' Annex I , després d'aplicar la deducció d'inversions i/o actuacions que no són elegibles per aquesta línia d'ajudes descrita a l' Annex II . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. Tenint en compte que el crèdit existent cobreix la totalitat de les peticions d'aquesta convocatòria no hi ha cap impediment per resoldre aquests expedients sense afectar el que disposa els apartats setè i vuitè de la convocatòria.&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;En data 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7&amp;nbsp;de novembre de 2020 el Servei d'Ajudes al Desenvolupament Rural ha emès informe favorable i proposta provisional de concessió d'ajuda als beneficiaris relacionats a l' Annex I . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;8. En data 20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de novembre de 2020 es notifica, mitjançant publicació a la pàgina web &lt;/em&gt;&lt;span style="color:null"&gt;http://www.caib.es&lt;/span&gt;&lt;a href="http://www.caib.es/"&gt;&lt;span style="color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;/a&gt;&lt;em&gt;, l'esmentada proposta provisional als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;9. A dia d'avui, i vist que l'interessat no ha fet cap al·legació a la proposta provisonal de resolució, el resultat és el que es mostra a l'Annex I.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- Convocat&lt;/em&gt;&lt;/span&gt;&lt;em&gt;òria d'ajudes per al desenvolupament rural de l'illa de Menorca, relacionats directament o indirectament amb els àmbits agrari i/o ambiental, dins l'Estratègia de Desenvolupament Local Participatiu de Menorca pels anys 2018 i 2019 publicada al BOIB núm 18 de 8 de febrer de 2018. Aquesta convocatòria va patir dues modificacions publicades als BOIB 104 de 23 d'agost de 2018 i 119 de 27 de setembre de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;- Conveni de col&lt;/em&gt;&lt;/span&gt;&lt;em&gt;·laboració entre el Fons de Garantía Agrària i Pesquera de les Illes Balears com a Organisme Pagador, l'adjunt a la Gerència del FOGAIBA com Autoritat de Gestió i el Grup d'Acció Local Associació Leader Illa de Menorca pel que s'estableixen les condicions per a l'aplicació de la mesura 19 del Programa de Desenvolupament Rural de les Illes Balears 2014-2020 de 26 de juny de 2017.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;- Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Llei 39/2015, de 1 d'octubre del procediment administratiu comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Pert tot aixó dict la següent&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Autoritzar i disposar la despesa assenyalada a cada un dels beneficiaris amb càrrec als pressuposts i percentatges de cofinançament detallats a l' Annex I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Determinar que, d'acord amb el que estableix la convocatòria de referència, les obligacions dels beneficiaris seran les indicades a l' Annex III&amp;nbsp;. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Notificar la resolució a cada un dels beneficiaris de l' Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Les obligacions del beneficiari seran les següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Realitzar les actuacions subvencionables en el termini comprès entre la data de la presentació de la sol·licitud d'ajuda i la finalització del termini d'execució assenyalat a la present Resolució de concessió (comptador des de la seva notificació).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Justificar les despeses subvencionables en la forma i els terminis determinats a la convocatòria i la present resolució de concessió.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Els requisits generals exigits per a l'obtenció de dita subvenció s'hauran de mantenir durant un període mínim de sis mesos comptats a partir de la data de concessió de l'ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;En cas d'inversions que comportin obra civil, instal·lacions i/o maquinària, mantenir la inversió objecte de subvenció i la seva destinació durant almenys cinc anys comptats des de la data del pagament de l'ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Sotmetre's a les actuacions de comprovació i control indicades per part de les administracions autonòmiques, estatal o comunitària, Intervenció General, Sindicatura de Comptes o altres òrgans de control intern o extern, així com també facilitar tota la informació que requereixin aquests organismes en relació a les ajudes concedides.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Designar un representant del FOGAIBA a les meses dels possibles expedients de contractació que es puguin derivar de les despeses auxiliables, així com remetre amb caràcter previ a la licitació, els plecs i la resta de documentació que conforma l'expedient, tal i com es disposa a les clarificacions tècniques adoptades pel Comitè de Desenvolupament Rural de la Unió Europea en la seva reunió de 19 d'octubre de 2016.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Complir les normes comunitàries, estatals i autonòmiques aplicables a la inversió de la qual es tracti, així com també la normativa de contractació pública i mediambiental.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;A més, s'hauran de complir les normes d'informació i publicitat previstes a l'annex III del Reglament d'execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Complir també amb l'establert a la Llei 9/2017, de 8 de novembre de Contractes del Sector Públic, per la qual es transposen a l'ordenament jurídic espanyol les Directives de el Parlament Europeu i de Consell 2014/23 / UE i 2014/24 / UE, de 26 de febrer de 2014.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;Aquestes obligacions s'entendran sense perjudici de l'obligació de complir amb la resta que preveu l'article 11 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, així com la resta que se'n derivin de la normativa estatal i comunitària d'aplicació.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;El règim jurídic aplicable per l'incompliment d'aquestes obligacions és el que preveu el Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, i comprèn des del reintegrament de l'ajuda i el pagament de l'interès de demora fins a la imposició de les sancions corresponents. En el cas d'incompliment de les obligacions anteriors s'aplicaran les reduccions previstes a la convocatòria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
