    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 21&amp;nbsp;de desembre&amp;nbsp;de 2018&amp;nbsp;per la qual es convoquen, subvencions per a la prevenció dels danys en boscos produïts per incendis, desastres naturals i catàstrofes, corresponents a&amp;nbsp;l'&amp;nbsp;any 2018, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 19&amp;nbsp;de gener&amp;nbsp;de 2021, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El 18 d'octubre de 2019, el vicepresident del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) va dictar Resolució de concessió (R5) d'ajudes per prevenció dels danys en boscos produïts per incendis, desastres naturals i catàstrofes, publicada en el Butlletí Oficial de les Illes Balears núm. 148, de 31 d'octubre de 2019, en relació amb l'ajuda concedida a l'empara de la Resolució del president del FOGAIBA de 21 de desembre de 2018, per la qual es convoquen, per el any 2018, subvencions per a inversions en la prevenció dels danys causats als boscos per incendis forestals, desastres naturals i catàstrofes. Entre altres persones beneficiàries hi ha&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;AGUSTÍ MERCADAL SINTAS&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;amb&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;NIF ***2769**,&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;núm. d'expedient PIFO2018_1/012, amb un termini d'execució de 12 mesos.&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. El 30 d'octubre de 2020, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;AGUSTÍ MERCADAL SINTAS, &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;va presentar una sol·licitud de pròrroga del termini d'execució (RGE 23457), exposant que amb motiu de&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;la crisi provocada per la COVID19 no ha pogut executar dins el termini establert les inversions previstes.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3&lt;/em&gt;&lt;/span&gt;&lt;em&gt;. L'apartat onzè, justificació i pagament de les ajudes, de la Resolució del president del FOGAIBA de 21 de desembre de 2018, estableix que el termini notificar i justificar la realització de les actuacions proposades és de 12 mesos, des del dia següent la data de notificació de la resolució de concessió de l'ajuda. Per raons justificades tal com baixes laborals i incidències greus que no siguin imputables al sol·licitant, els beneficiaris podran sol·licitar l'ampliació del termini de realització i justificació establert a la resolució de concessió. Aquesta sol·licitud s'haurà de presentar abans del termini d'execució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4&lt;/em&gt;&lt;/span&gt;&lt;em&gt;. La concessió de l'ajuda es va notificar el 31 d'octubre de 2019, per tant el termini màxim per a la justificació de la inversió proposada acabava el 1 de novembre de 2020 (12 mesos). El interessat va presentar la sol·licitud de pròrroga el dia 30 d'octubre de 2020, per tant dins de termini.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5&lt;/em&gt;&lt;/span&gt;&lt;em&gt;. D'acord amb l'apartat 2 de l'article 20 de l'Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020, regula que, amb caràcter excepcional i per raons degudament justificades, les persones beneficiàries de les ajudes podran sol·licitar l'ampliació o reobertura dels terminis establerts a la respectiva convocatòria, amb excepció del termini de presentació de sol·licituds. Aquesta sol·licitud s'ha de presentar abans del venciment del termini que es tracti.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. &lt;/em&gt;&lt;/span&gt;&lt;em&gt;El FOGAIBA pot acordar l'ampliació sol·licitada sempre que amb això no es perjudiquin drets de terceres persones. L'acord d'ampliació s'ha de notificar individualment a l'interessat i no és susceptible de recurs.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. Atès el Decret 64/2005, de 10 de juny, de creació del FOGAIBA; en virtut de l'Ordre de la consellera d'Agricultura i Pesca de 23 de desembre de 2005 es disposa que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8. Atès que la sol·licitud de la pròrroga s'ha presentat abans del venciment del termini de j&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ustificació de la realització de les actuacions i està degudament motivada&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, s'ha de concedir la pròrroga sol·licitada per un termini de 6 mesos, d'acord amb l'article 32.3 de la Llei 39/2015, de 1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Per tot això, s'informa favorablement i es proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en el termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
