    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En no haver-se presentat reclamacions durant el termini d'exposició al públic, queda automàticament elevat a definitiu l'Acord plenari provisional d'aquest Ajuntament sobre la modificació de l'Ordenança Fiscal reguladora de la taxa per recollida-transport i tractament-eliminació de residus, el text íntegre de la qual es fa públic en compliment de l'article 17.4 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel Reial decret Legislatiu 2/2004, de 5 de març.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;“…\...&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="color:black"&gt;ORDENANÇA FISCAL REGULADORA DE LA TAXA PER RECOLLIDA-TRANSPORT I TRACTAMENT-ELIMINACIÓ DE RESIDUS&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 1. Fonament legal, naturalesa i objecte&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l'article 106 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, i de conformitat amb el que es disposa en els articles 15 a 19 del Reial decret legislatiu 2/2004, de 5 de març, pel qual s'aprova el text refós de la Llei reguladora de les hisendes locals, l'Ajuntament de Santa Eulalia seguirà percebent la "Taxa per prestació del servei de recollida d'escombraries", que d'ara endavant passarà a denominar-se “Taxa per recollida-transport i tractament-eliminació de residus”, que es regirà per la present ordenança fiscal, les normes de la qual atenen al previngut en l'article 57 de l'esmentat Reial decret Legislatiu 2/2004, així com per l'establert per la Llei 25/1998, de 13 de juliol, de modificació de les prestacions patrimonials de caràcter públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 2. Fet imposable&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Constitueix el fet imposable de la taxa la prestació del servei, de recepció obligatòria, de recollida, transport, tractament i/o eliminació d'escombraries domiciliàries i residus sòlids d'habitatges, allotjaments i locals o establiments on s'exerceixen activitats industrials, comercials, professionals, artístiques i de serveis, i llocs d'amarrament en ports esportius. La taxa serà única però constarà de dos trams o conceptes: recollida-transport i tractament-eliminació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. A aquest efecte es consideraran residus sòlids domèstics els generats a les llars com a conseqüència de les activitats domèstiques i els generats en serveis i indústries que siguin assimilables als anteriors, tot això d'acord amb l'establert en l'article 3.b de la Llei 22/2011, de 28 de juliol, de residus i sòls contaminats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Tenint en compte el caràcter disseminat dels habitatges i locals situats al terme municipal de Santa Eulària des Riu, el servei de recollida domiciliària d'escombraries, a les zones no urbanes, es realitzarà als punts d'aportació establerts a tal fi situats en carreteres i vies principals. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 3.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Són subjectes passius contribuents les persones físiques o jurídiques i les entitats a què es refereix l'article 35.4 de la Llei 58/2003, de 17 de desembre, general tributària, que ocupin o utilitzin els habitatges i locals situats als llocs, places, carrers o vies públiques en què es presti el servei, ja sigui a títol de propietaris o d'usufructuari, arrendatari o fins i tot de precari. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. &lt;span style="color:black"&gt;Tendrà la consideració de subjecte passiu substitut del contribuent el propietari dels habitatges o locals, que podrà repercutir, si escau, les quotes satisfetes sobre els usuaris d'aquelles, beneficiaris del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 4. Responsables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Respondran del deute tributari els deutors principals al costat d'altres persones o entitats. A aquests efectes es consideraran deutors principals els obligats tributaris de l'apartat 2 de l'article 35 de la Llei 58/2003, de 17 de desembre, general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Excepte precepte legal exprés en contrari, la responsabilitat serà sempre subsidiària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En relació amb la responsabilitat solidària i subsidiària del deute tributari s'estarà a l'establert en els articles 42 i 43, respectivament, de la Llei 58/2003, de 17 de desembre, general tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 5. No subjecció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. No estaran subjectes a la taxa de recollida obligatòria d'escombraries aquells locals o habitatges de nova construcció sempre que pertanyin a la persona o entitat promotora de l'edificació i es trobin desocupats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Perquè la no subjecció faci efecte l'empresa promotora haurà d'estar al corrent de pagaments amb l'administració municipal i anualment aportar el justificant de pagament de l'activitat econòmica de promoció d'edificacions juntament amb la documentació necessària que acrediti que aquests immobles no figuren entre els béns del seu immobilitzat i una relació d'immobles venuts i en estat de venda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. No està subjecta a la taxa la prestació, de caràcter voluntari i a sol·licitud de la part interessada, dels serveis següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;a) Recollida de fems i residus no qualificats com a residus sòlids domiciliaris&lt;/span&gt; &lt;span style="color:black"&gt;urbans, restes de poda, residus d'indústries i residus específics de clíniques i laboratoris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;b) Recollida d'enderrocs d'obres en solars i locals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 6. Exempcions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Gaudiran d'exempció subjectiva aquells contribuents que obtenguin uns ingressos anuals inferiors al salari mínim interprofessional. Per gaudir d'exempció s'ha de dirigir la sol·licitud corresponent al Departament de Serveis Socials acreditant els ingressos i les condicions familiars. Vist l'informe de Serveis Socials l'alcalde o alcaldessa acordarà la concessió o denegació del benefici fiscal sol·licitat i es notificarà a la persona interessada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 7. Bonificacions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;7.1. Usuaris particulars&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&amp;nbsp;&lt;strong&gt;7.1.1. Jubilats i pensionistes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;I. Gaudiran d'una bonificació del 100% de la quota únicament aquells contribuents jubilats que acreditin que la mitjana dels ingressos dels membres que formen la unitat familiar no excedeixi del salari mínim interprofessional, vigent en cada exercici econòmic. Aquesta bonificació només s'aplicarà en el cas que tots els membres de la unitat familiar estiguin jubilats o siguin pensionistes &amp;nbsp;o percebin ingressos inferiors al salari mínim interprofessional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;II. Gaudiran d'una bonificació del 50% de la quota únicament aquells contribuents jubilats que acreditin que la mitjana dels ingressos dels membres que formen la unitat familiar no excedeix en 2,5 vegades l'últim valor publicat de forma oficial de l'indicador públic de renda d'efectes múltiples (IPREM), vigent en cada exercici econòmic. Aquesta bonificació només s'aplicarà en el cas que tots els membres de la unitat familiar estiguin jubilats o siguin pensionistes o percebin ingressos compresos entre el salari mínim interprofessional i l'IPREM.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;span style="color:black"&gt;Aquestes bonificacions s'aplicaran exclusivament a la quota de l'habitatge que constitueixi el domicili habitual de la persona interessada. &amp;nbsp; Per poder gaudir d'aquests bonificacions es requerirà: &amp;nbsp; Per poder gaudir d'aquesta bonificació, el subjecte passiu haurà de presentar la sol·licitud, degudament complimentada, entre l'1 de gener i el 31 de març, acompanyada de la documentació següent:&lt;em&gt; &amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Declaració dels ingressos obtinguts en l'exercici immediat anterior al de la meritació de la quota, referida a tots i cada un dels membres que formen la unitat familiar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;span style="color:black"&gt;Certificació de l'habilitat, caixer o pagador a través del qual percep la seua pensió, acreditativa de l'import total de les retribucions meritades en l'exercici immediat anterior al qual es refereix la quota, amb exclusió d'aquells que es concretin al plus o ajuda familiar. Aquest requisit es farà extensiu als ingressos que perceben els altres membres que formin la unitat familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;span style="color:black"&gt;La declaració de la persona interessada podrà ser comprovada per l'administració municipal. Si comprovades les dades pertinents s'advertís falsedat, automàticament es perdrà la bonificació obtinguda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. &lt;span style="color:black"&gt;Que estigui al corrent de pagaments amb l'Ajuntament de Santa Eulària des Riu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7.1.2. Famílies nombroses o monoparentals&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;S'estableix bonificació d'un 50% en la quota íntegra de la taxa per a aquells contribuents que tinguin la condició titular de família nombrosa o monoparental, sempre que reuneixin els requisits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&amp;nbsp;I. Estar en possessió del títol o document acreditatiu de família nombrosa o monoparental en vigor expedit per l'administració competent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;II. &lt;/span&gt;&lt;span style="color:black"&gt;Que els ingressos de la unitat familiar no superin en 2,5 veces l'últim valor publicat de forma oficial de l'indicador públic de renta d'efectes múltiples (IPREM).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;III. &lt;/span&gt;&lt;span style="color:black"&gt;Que el valor cadastral del bé immoble sigui inferior a 200.000 €&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;IV. &lt;span style="color:black"&gt;Que el domicili objecte de la sol·licitud sigui el domicili habitual. A tal efecte, s'entendrà per habitatge habitual, aquella unitat urbana d'ús residencial destinada exclusivament a satisfer la necessitat permanent d'habitatge del subjecte passiu. Es presumirà que l'habitatge habitual és aquell en el qual figura empadronat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#222222"&gt;V. &lt;/span&gt;&lt;span style="color:black"&gt;Estar al corrent de pagaments amb l'Ajuntament de Santa Eulària des Riu&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Per poder gaudir d'aquesta bonificació, el subjecte passiu haurà de presentar la sol·licitud, degudament emplenada, entre l'1 de gener i el 31 de març, juntament amb la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;span style="color:black"&gt;Títol o document acreditatiu de família nombrosa o monoparental en vigor expedit per l'administració competent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;span style="color:black"&gt;Certificat del Padrón Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. &lt;span style="color:black"&gt;Justificant d'ingressos del subjecte passiu i de la unitat familiar (còpia de la declaració de l'IRPF anterior a la sol·licitud o autorització per part del subjecte passiu i dels membres de la unitat familiar perquè l'Ajuntament pugui sol·licitar la declaració a l'AEAT).&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&amp;nbsp;&lt;strong&gt;7.1.3. ERTO i desocupats. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;S'estableix una bonificació d'un 50% en la quota per a aquells contribuents que, en la data de la meritació, compleixin amb els requisits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;span style="color:black"&gt;Que tots els membres de la unitat familiar en edat laboral reuneixin alguns dels requisits següents: &amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;1.&lt;span style="color:black"&gt;Siguin desocupats de llarga durada sense cobrament de prestació. &lt;/span&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; 2. &lt;span style="color:black"&gt;Es tracti de treballadors por compte aliè, inclosos en un ERTO. &lt;/span&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; 3. &lt;span style="color:black"&gt;Siguin treballadors per compte propi beneficiaris de la prestació&amp;nbsp; extraordinària per cessament de l'activitat reconeguda com a conseqüència de la COVID-19, sempre que aquesta constitueixi la totalitat dels ingressos de la unitat familiar.&lt;/span&gt; &amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; 4. &lt;span style="color:black"&gt;Quan siguin receptors de l'ingrés mínim vital o de la renta social garantida. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;span style="color:black"&gt;Que els ingressos anuals de la unitat familiar no superin en més de 2,5 vegades l'últim valor publicat de forma oficial de l'indicador públic de renda d'efectes múltiples (IPREM).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;span style="color:black"&gt;Estar al corrent de pagaments amb l'Ajuntament de Santa Eulària des Riu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. &lt;span style="color:black"&gt;Que el domicili objecte del tribut sigui el seu domicili habitual. A tal efecte, s'entendrà per habitatge habitual aquella unitat urbana d'ús residencial destinada exclusivament a satisfer la necessitat permanent d'habitatge del subjecte passiu. Es presumirà que l'habitatge habitual és aquell en el qual figura empadronat. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Aquesta bonificació tindrà vigència des de la data de concessió fins al final de l'any natural en el qual sigui concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Per poder gaudir d'aquesta bonificació, el subjecte passiu haurà de presentar la sol·licitud, degudament emplenada entre l'1 de gener i el 31 de març, juntament amb la documentació següent, segons el requisit que compleixin:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &lt;span style="color:black"&gt;En el cas de situació legal de desocupació, mitjançant certificat expedit per l'entitat gestora de les prestacions, en la qual figuri la quantia mensual percebuda en concepte de prestacions o subsidis per desocupació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;span style="color:black"&gt;En cas de treballadors per compte aliè inclosos en un ERTO, certificat de l'empresa o resolució de l'ERTO.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;span style="color:black"&gt;En el cas de cessament d'activitat dels treballadors per compte propi, resolució de la mútua de prestació extraordinària per cessament d'activitat (art. 17 RDL 8/2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. &lt;span style="color:black"&gt;Justificant d'ingressos del subjecte passiu i de la unitat familiar (còpia de la declaració de l'IRPF anterior a la sol·licitud o autorització per part del subjecte passiu i dels membres de la unitat familiar perquè l'Ajuntament pugui sol·licitar la declaració a l'AEAT).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e. &lt;span style="color:black"&gt;Certificat del Padró Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7.1.4 Usuaris de Deixalleries.&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Aquells usuaris residents al municipi que presentin tiquets de la Xarxa Insular de Deixalleries d'Eivissa amb un mínim de 15 entrades diferenciades de residus gestionats en les esmentades instal·lacions l'any anterior, com a justificant d'una correcta gestió dels residus exclosos de la gestió municipal, podran gaudir d'una bonificació de 20€ sobre la taxa de residus.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquesta bonificació serà aplicable a l'habitatge (categoria 11 del quadre de tarifes de l'article 8 de la present ordenança), no a cada particular sol·licitant. Tampoc serà d'aplicació a activitats.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Serà requisit obligatori per obtenir aquesta bonificació, no tenir deutes pendents amb l'Ajuntament de Santa Eulària des Riu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Per acollir-se a aquesta bonificació serà necessari presentar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. &amp;nbsp;Tiquets de la Xarxa Insular de Deixalleries d'Eivissa amb un mínim de 15 entregues de residus, a nom del titular del domicili o de l'arrendatari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;span style="color:black"&gt;Últim rebut d'IBI. En cas de ser arrendatari, haurà d'adjuntar-se el contracte d'arrendament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7.1.5. &lt;/strong&gt;Quan&lt;strong&gt; &lt;/strong&gt;concorrin les circumstàncies per poder gaudir de més d'una bonificació de les&lt;span style="color:black"&gt; fixades en l'apartat 7.1.1, 7.1.2 i 7.1.3 d'aquest article, el subjecte passiu només podrà optar per gaudir de la bonificació que li resulti més avantatjosa, i serà incompatible amb les altres bonificacions referides als punts anteriors i compatible amb la definida en el punt 7.1.4. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;7.2. Establiments d'organitzacions no governamentals amb fins socials i mediambientals.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Els establiments de beneficència radicats al terme municipal gaudiran d'una bonificació del 50% en la quota. Aquests establiments hauran d'acreditar adequadament la seua funció, i hauran de ser gestionats per organitzacions sense ànim de lucre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Per poder gaudir d'aquesta bonificació, el subjecte passiu haurà de presentar la sol·licitud, degudament emplenada entre l'1 de gener i el 31 de març&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;7.3. Productors singulars&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7.3.1.&lt;/strong&gt; Els productors singulars, definits segons les ordenances de residus, inclosos dins de les categories núm. 1, 2, 3, 4, 5, 6 i 8 del quadre de tarifes de l'article 8 de la present ordenança, podran gaudir d'una bonificació màxima del 20% de la quota relativa a la recollida i transport de residus, i una bonificació màxima del 80% de la quota de tractament i eliminació. No podran bonificar-se aquelles activitats o locals que romanguin tancades i no tinguin activitat econòmica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;7.3.2.&lt;/strong&gt; La bonificació a aplicar anirà en funció del % de volum contenidoritzat de recollida selectiva de les fraccions “envasos lleugers”, “paper i cartó”, ”fracció orgànica” i “vidre” (no computaran els cubs vacri 120L, si es disposa d'igloo 3000L propi). Únicament computaran per a aquells productors que comparteixin igloo), respecte del total de contenidors (selectiva + rebuig), d'acord amb la taula següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Estar degudament registrat com a productor singular, d'acord amb les ordenances de residus.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;span style="color:black"&gt;Disposar i utilitzar, d'acord amb les ordenances vigents i altra normativa d'aplicació, dels contenidors homologats necessaris de totes les fraccions de residus que generi l'activitat, inclòs el rebuig.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. &lt;span style="color:black"&gt;Notificar qualsevol canvi dels camps del registre de productor singular (titularitat de l'activitat, nombre de contenidors homologats i volum de cada un d'ells dels destinats a cada fracció, i altra informació relativa a l'activitat).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. &lt;span style="color:black"&gt;Presentar una declaració responsable, juntament amb la sol·licitud de bonificació, anualment, dins del període fixat en el punt 7.4 en la qual constin els mitjans dedicats a la gestió de residus, d'acord amb el model establert a tal fi. La presentació d'aquesta declaració té caràcter obligatori sempre que es gaudeixi de les bonificacions fiscals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e. &lt;span style="color:black"&gt;Presentar la còpia de la comunicació prèvia de petit productor de residus del Govern Balear. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f. &lt;span style="color:black"&gt;Complir estrictament les condicions de les ordenances de residus i neteja viària. Realitzar recollida selectiva en el moment en què el residu s'origina. Es denegarà la bonificació si es comprova que s'incompleix algun dels requisits i les obligacions recollides en les ordenances de residus i neteja viària, sens perjudici de l'expedient sancionador que del tal incompliment pugui derivar&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&amp;nbsp;&lt;strong&gt;7.4. &lt;/strong&gt;Les bonificacions fixades en els apartats 7.1, 7.2, 7.3 d'aquest article hauran de ser sol·licitades expressament per les persones interessades a les oficines municipals de l'Ajuntament de Santa Eulària des Riu, de la manera definida en cada subapartat, en el període comprès entre l'1 de gener i el 31 de març de l'any per al qual se sol·licita la bonificació. Així mateix, serà requisit indispensable per a totes les bonificacions definides en els apartats de l'article 7, no tenir deute contret amb l'Ajuntament de Santa Eulària des Riu. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En tots els casos en els quals la quota es determini a partir de l'element superfície, aquest es determinarà segons la superfície declarada en el projecte d'activitat, la superfície cadastral o, en defecte d'això, la superfície declarada a l'efecte d'impost d'activitats econòmiques (IAE).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 9. Meritació de la taxa i normes de gestió i cobrança (sistema general)&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. Es reportarà la taxa i neix l'obligació de contribuir des del moment en què s'iniciï la prestació del servei, entenent-se iniciada, atesa la seua naturalesa de recepció obligatòria, quan estigui establert i en funcionament el servei municipal de recollida d'escombraries domiciliàries als carrers o llocs on figurin els habitatges o locals utilitzats pels contribuents subjectes a la taxa. Una vegada iniciada la prestació del servei, la meritació es produirà l'1 de gener de cada any, i el període impositiu comprendrà l'any natural, excepte en els següents suposats:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.1. Quan s'iniciï la prestació del servei en el primer semestre, s'abonarà en concepte de taxa la quota anual íntegra. Si l'inici de la prestació té lloc en el segon semestre de l'exercici es liquidarà la meitat de la quota anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1.2. Si se cessa definitivament en l'ús de la prestació del servei durant el primer semestre de l'exercici serà procedent la devolució de la meitat de la quota anual. Si el cessament té lloc en el segon semestre, no serà procedent la devolució de cap quantitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Les devolucions es tramitaran amb l'expressa sol·licitud prèvia dels contribuents i, si escau, dels seus substituts, adjuntant el rebut original abonat, i hauran d'acreditar el cessament definitiu en l'ús de la prestació del servei en la forma següent: &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Si es tracta d'una activitat econòmica, mitjançant l'aportació de fotocòpia de la baixa censal, per cessament definitiu en l'activitat respecte de l'impost sobre activitats econòmiques. La sol·licitud haurà de contenir així mateix petició dirigida al Departament de Llicències interessant la conseqüent anul·lació de la llicència d'obertura de l'establiment. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;span style="color:black"&gt;Quan es tracti d'habitatges, mitjançant l'aportació de fotocòpia d'escriptura o document públic, acreditatius de la transmissió del domini de l'immoble gravat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Anualment es formarà un padró en el qual figuraran els contribuents afectats i les quotes respectives que es liquidin per aplicació de la present ordenança, el qual serà exposat al públic per un mes a l'efecte de notificació a les persones interessades i presentació de reclamacions, amb l'anunci previ en el Butlletí Oficial de les Illes Balears (BOIB) i tauler d'anuncis municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Transcorregut el termini d'exposició al públic, l'Ajuntament resoldrà sobre les reclamacions presentades i aprovarà definitivament el padró que servirà de base per als documents de cobrament corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Les baixes s'hauran de cursar abans de la finalització de l'anualitat, mitjançant notificació a l'Ajuntament, i tindrà efectes a partir de la següent. Els qui incompleixin tal obligació seguiran subjectes al pagament de l'exacció. La durada de la baixa no podrà ser inferior a dos mesos, i no s'entendrà, en conseqüència, com a baixa, la no ocupació o tancament temporal de qualsevol classe d'habitatge, comerç i indústria per un període inferior a l'abans assenyalat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les modificacions d'ordre físic (superfície, enderrocament, etc.), jurídic (canvi de titularitat, etc.) o econòmic (canvi d'ús o destinació, de classe o categoria, etc.) hauran de ser comunicats a l'administració municipal, i tindran efectes a partir de l'exercici següent a la de la comunicació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Les quotes liquidades i no satisfetes en el període voluntari es faran efectives per la via de constrenyiment, de conformitat amb les normes del Reglament general de recaptació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Es consideraran partides fallides o crèdits que no es poden cobrar (incobrables) aquelles quotes que no hagin pogut fer-se efectives pel procediment de constrenyiment, per a la declaració del qual es formalitzarà l'oportú expedient, d'acord amb el que preveu el Reglament general de recaptació vigent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Els supòsits d'activitats comercials o de tipus d'immobles no recollits de forma específica o genèrica en els epígrafs del quadre de tarifes de l'article 8 de l'ordenança podran ser objecte de concert fiscal per a la determinació de la quota, a requeriment de l'administració municipal als subjectes passius o els seus substituts; en cas de no subscriure's aquest concert es liquidarà la taxa per l'aplicació de la tarifa més anàloga de les existents en el quadre de tarifes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Podran subscriure's convenis de col·laboració i de caràcter fiscal amb entitats col·laboradores urbanístiques, entitats, institucions i organitzacions representatives dels subjectes passius de les taxes, amb la finalitat de regular el servei de recollida i tractament de residus urbans, així com el compliment de les obligacions formals i materials derivades de la taxa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Superfície tributable.- En els epígrafs on la fixació de quotes tingui com a base la superfície de l'immoble, aquesta es determinarà en la forma següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. En els locals comercials, en general, la superfície tributable, serà la total construïda de l'establiment i sumant, si escau, la superfície de la terrassa ocupada, encara que ho sigui temporalment, per útils, mercaderies o mobiliari que siguin objecte d'exposició al públic o usats per aquest. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. &lt;span style="color:black"&gt;En els habitatges particulars en general, la superfície tributable serà la total construïda de l'immoble que a tals efectes figuri en el Cadastre Immobiliari respecte de l'impost sobre béns immobles. Als habitatges rústics, la superfície tributable serà la total construïda de l'immoble que a tals efectes figuri en el Cadastre Immobiliari respecte de l'impost sobre béns immobles. S'exclourà del total, si escau, tots aquells elements destinats a usos o activitats de caràcter rústic, és a dir, que no puguin catalogar-se com a habitatge.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;ARTICLE 10. Infraccions i sancions&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;En tot el referent a infraccions i sancions, serà aplicable la Llei 58/2003, de 17 de desembre, general tributària, en concret els articles 181 i següents, i les disposicions que la desenvolupin. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;DISPOSICIÓ FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;La present ordenança fiscal, va ser aprovada pel Ple d'aquest Ajuntament en sessió ordinària celebrada el XX de XXXXXX de 20XX, i publicada en el BOIB número XX de data XX de XXXXXX de 20XX, i romandrà en vigor des de la data de publicació definitiva en el BOIB fins a la seua modificació o derogació expressa. …/…”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Contra el present Acordo, conforme a l'article 19 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel Reial decret Legislatiu 2/2004, de 5 de març, es podrà interposar pels interessats recurs contenciós-administratiu, en el termini de dos mesos comptats a partir de l'endemà al de la publicació d'aquest anunci en &lt;em&gt;el Butlletí Oficial de les Illes Balears (BOIB)&lt;/em&gt;, davant el Tribunal Superior de Justícia de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
