    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Transcorregut el termini d'exposició pública de l'acord adoptat pel Ple de l'Ajuntament des Castell de data 4 de novembre de 2020 d'aprovació provisional de l'Ordenança fiscal reguladora de les taxes dels serveis municipals d'ensenyament, cultura i esports, i no havent-se presentat reclamacions ni suggeriments al mateix, s'eleva a definitiu l'esmentat acord conforme el que disposa l'article 49 de la Llei 7/1985, de 2 d'abril, reguladora de les Bases de Règim Local, i l'article 102 de la Llei 20/2006, de 15 de desembre, Municipal i de règim local de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Que aquesta aprovació definitiva així com el text definitivament aprovat mitjançant el present es publiquin al BOIB a l'efecte del seu general coneixement així com de la seva entrada en vigor, en compliment del que assenyala l'article 103.1 de la Llei&amp;nbsp; 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Fonament i naturalesa&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La present ordenança es dicta en base a les facultats concedides pels articles 133.2 i 142 de la Constitució i per l'article 106 de la Llei 7/1985, de 2 d'abril, reguladora de les Bases de Règim Local, i tenint en compte els articles 15 a 19 del Real Decret Legislatiu 2/2004 de 5 de març, del Text Refós de la Llei Reguladora de les Hisendes Locals i segons allò establert pels articles 57 i 20 a 27 de la mateixa, s'estableix la present taxa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aquesta ordenança té per finalitat la fixació de les taxes dels serveis municipals d'ensenyament, cultura i esports.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 2. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Fet imposable.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Constitueix el fet imposable d'aquestes taxa la prestació dels serveis municipals d'ensenyament, cultura i esports, incloses en aquesta ordenança, que es refereixin, afectin o beneficiïn de forma particular al subjecte passiu i no siguin prestats pel sector privat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 3. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Subjecte passiu.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Són subjectes passius en concepte de contribuents, les persones físiques i jurídiques i les Entitats a les que es refereix l'article 36 de la Llei General Tributària, que sol·licitin, gaudeixin o utilitzin els serveis o activitats prestats a que es refereix a l'article segon.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 4. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Responsables&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1.- Respondran solidàriament de les obligacions tributàries del subjecte passiu les persones físiques i jurídiques a les que es refereix l'article 42 de la Llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.- Seran responsables subsidiaris de les obligacions tributàries els administradors de les societats i els síndics, interventors o liquidadors de fallides, concursos, societats i entitats en general, en els supòsits i amb l'abast que assenyala l'article 43 de la Llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Juntament amb la instància de sol·licitud de bonificació d'escoleta, s'haurà de presentar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els justificants dels ingressos i rendes de la unitat familiar, d'almenys els darrers sis mesos: nòmina, certificat del SEPE, pensió, etc.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Declaracions de l'IRPF de la unitat familiar i/o certificat negatiu.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Vida laboral.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Qualsevol altre document que ajudi a valorar la situació de la persona o unitat familiar. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;6.2. Quotes reduïdes per a activitats esportives i culturals:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a. Unitats familiars amb dos o més usuaris inscrits: 20% de reducció en inscripcions i mensualitats per a cada usuari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b. Famílies més desfavorides soci-econòmicament: reducció segons barem i condicions del punt 6.1. anterior d'aquesta ordenança. 	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Llibre de família.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Justificant d'abonament del dipòsit i la primera mensualitat.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;I de tots els membres de la unitat familiar majors de 16 anys:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els justificants dels ingressos i rendes de la unitat familiar, d'almenys els darrers sis mesos: nòmina, certificat del SEPE, pensió, etc.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Declaracions de l'IRPF de la unitat familiar i/o certificat negatiu.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Vida laboral.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Qualsevol altre document que ajudi a valorar la situació de la persona o unitat familiar.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Les reduccions previstes en aquest apartat 2 del present article, no seran compatibles entre sí, per la qual cosa s'aplicarà aquella que resulti més avantatjosa econòmicament per a l'interessat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 7. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Meritació.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7.1 L'obligació de contribuir neix quan s'inicia la prestació del servei o la realització de l'activitat, sense perjudici que s'exigesqui l'abonament previ del seu import, total o parcial, en el moment de la inscripció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 8. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Règim de declaració i ingrés.&lt;/strong&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;8.1 Escola infantil&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a. L'import de la matrícula anual a liquidar, es podrà abonar mitjançant targeta de crèdit i de manera presencial a l'oficina de Cultura, prèvia cita, o bé mitjançant transferència bancària al compte que s'indicarà, lliurant el justificant de pagament juntament amb la documentació requerida. Es realitzarà sempre abans de l'inici del curs escolar, excepte si l'alta es realitza amb el curs ja iniciat, en que es realitzarà en el moment de l'alta. Excepte casos excepcionals o per motius de salut de l'alumne/a que impedesquin la seva incorporació a l'escoleta, no es retornarà l'import abonat en concepte de matrícula.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b. Les quotes es liquidaran mensualment i anticipadament. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;c. Tota vegada s'han liquidat les quotes mensuals no seran prorratejables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;d. Les mensualitats s'abonaran mitjançant càrrec en compte bancari; amb aquesta finalitat el subjecte passiu haurà d'estendre la corresponent ordre bancària, domiciliant el pagament en el moment de la inscripció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;e. Quan, per causes no imputables a l'obligat al pagament de la taxa, l'escola no es desenvolupi o celebri, es procedirà a la devolució de l'import corresponent.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;strong&gt;8.2 Activitats esportives i culturals. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;a. Per inscriure's a les activitats culturals i esportives, s'haurà d'abonar, juntament amb la primera mensualitat, un dipòsit d'una mensualitat, que servirà per a cobrir les possibles despeses d'un mes impagat. En cas de no produir-se cap manca de pagament, el dipòsit es compensarà amb l'import de la darrera mensualitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El dipòsit i la primera mensualitat s'abonaran mitjançant targeta de crèdit i de manera presencial a l'oficina de Cultura, prèvia cita, o bé mitjançant transferència bancaria al compte que s'indicarà, lliurant el justificant de pagament juntament amb l'imprès d'inscripció-domiciliació o a través de la carpeta ciutadana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;b. La quota mensual s'abonarà durant els deu primers dies de cada mes, mitjançant càrrec en compte bancari; amb aquesta finalitat, l'usuari haurà d'estendre la corresponent ordre bancària, domiciliant el pagament en el moment de la inscripció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Article 9. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Normes generals de gestió.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Les sol·licituds de baixa s'hauran de tramitar davant el Servei municipal corresponent abans del dia 25 del mes anterior a aquell en què hagin de tenir efecte. A aquest efecte, caldrà omplir un Full de baixa que es podrà descarregar de la web de l'Ajuntament o es podrà recollir al Servei corresponent. Aquest full omplert s'haurà d'entregar presencialment o via correu electrònic als correus que sindiquen als fulls d'inscripció.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'obligació de pagament persisteix fins que l'usuari no causi baixa voluntària del servei i tindrà efectes el dia primer del mes següent. Aquesta obligació persisteix si per causes justificades no assisteixen al centre, ja que la matrícula inclou compromís d'assistència al centre i el pagament de les quotes mensuals. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Es gestionarà la cobrança mitjançant la domiciliació bancària al llarg dels primers dies del mes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'impagament o retorn de rebuts domiciliats en els terminis establerts a l'efecte, podrà donar lloc al cessament de la prestació del servei, sense perjudici de la tramitació dels corresponents expedients de constrenyiment per a la recaptació de les quotes meritades.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Amb caràcter general, per inscriure's a qualsevol activitat s'haurà d'estar al corrent del pagament de les quotes de totes les activitats compreses en aquesta ordenança. Així mateix, la manca de pagament de les quotes de dues mensualitats comportarà la baixa automàtica en l'activitat, sens perjudici de l'obligació d'atendre al pagament d'aquestes quotes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;DISPOSICIÓ ADDICIONAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Tot el que no estigui previst en aquesta ordenança fiscal es regirà pel Real Decret Legislatiu 2/2004, regulador de les Hisendes Locals, la Llei General Tributària i el Reglament General de Recaptació.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;DISPOSICIÓ DEROGATÒRIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;A partir de la data d'entrada en vigor d'aquesta Ordenança Fiscal queden derogades totes aquelles altres versions que de la mateixa havien estat objecte d'aprovació per part municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;DISPOSICIÓ FINAL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La present ordenança tindrà efectes a partir del dia següent a la seva publicació al BOIB, i fins a la seva modificació o derogació expressa. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra aquest acord es pot interposar contenciós administratiu davant la Sala del Tribunal contenciós administratiu de les Illes Balears, en el termini de dos mesos comptats a partir de la publicació d'aquest edicte en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
