    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Una vegada finalitzat el termini d'exposició pública sense que s'hagin presentat al·legacions, ha resultat aprovada definitivament l'Ordenança fiscal reguladora de la taxa per a la recollida, tractament i eliminació de residus sòlids. Es publica el text íntegre de la mateixa, per a la seva entrada en vigor i aplicació, en compliment del previst a l'article 103 de la Llei 20/2006, de 15 de desembre, municipal i de règim local, que és el següent: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;“ORDENANÇA FISCAL REGULADORA DE LA TAXA PER A LA RECOLLIDA, TRACTAMENT I ELIMINACIÓ DE RESIDUS SÒLIDS &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Article 1. Fonament i Naturalesa&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;En ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l'article 106 de la Llei 7/85 de 2 d'abril, reguladora de les bases de Règim Local; a l'empara del que preveu els articles 57 i 20. 4, s) del Reial Decret Legislatiu 2/2004 de 5 de març pel qual s'aprova el Text Refós de la llei Reguladora de les Hisendes Locals i de conformitat amb el que es disposen els articles 15 a 19 del citat text Refós, i articles 100 i següents de la Llei 20/2006, de 15 de desembre municipal i de règim local de les Illes Balears, aquest Ajuntament estableix la taxa per la prestació del servei de recollida, tractament i eliminació de residus sòlids, que es regirà per aquesta Ordenança Fiscal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Article 2. Fet imposable&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;1. Constitueix el fet imposable de la taxa la prestació del servei de recepció obligatòria de recollida, tractament i eliminació de residus sòlids procedents dels habitatges, locals i establiments on s'exerceixin activitats comercials, professionals, industrials i de serveis, situats en les zones de prestació del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;2. És de caràcter general i obligatori la prestació del servei de recollida d'escombraries.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;3. A aquest efecte, es consideren fems domiciliaris i residus sòlids urbans les restes i les deixalles alimentaries o els detritus que procedeixen de la neteja normal de locals i habitatges i s'exclouen d'aquest concepte els residus de tipus industrial, enderrocs d'obres, els detritus humans, les matèries i els materials contaminats, corrosius, perillosos o els que la seva recollida o abocament requereixin l'adopció de mesures especials higièniques, profilàctiques o de seguretat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;4. L'obligació de contribuir naixerà per la simple existència de la prestació del servei, que per ser general i de recepció obligatòria s'entendrà prestat a favor dels habitatges, locals, establiments, negocis i altres especificats en el quadre de tarifes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Article 3. Subjectes passius&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;1. Són subjectes passius contribuents de la Taxa per la prestació de serveis de recepció obligatòria d'arreplegada, tractament i eliminació de residus sòlids, les persones físiques i jurídiques i les entitats a què la normativa tributària imposa el compliment d'obligacions tributàries segons el que disposa l'article 35 de la Llei 58/2003 de 17 de desembre, General Tributària, que ocupen, utilitzen o siguin titulars dels&amp;nbsp;habitatges, locals o negocis, sitis en places, carrers, vies públiques o zones de domini públic on es presta el servei, bé sigui a títol de propietari o d'usufructuari, d'inquilí, arrendatari, concessionari o, inclòs a precari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;2. Tindran la consideració de subjectes passius substituts del contribuent i, en conseqüència estaran obligats a complir amb les prestacions materials i formals de les obligacions tributàries, els propietaris dels habitatges, locals i establiments, els que podran repercutir si és procedent les quotes satisfetes sobre els respectius beneficiaris.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;3. Quan un mateix subjecte passiu tingui distintes activitats en un mateix local la superfície computable als efectes de la taxa serà la major de les declarades i la tarifa a aplicar serà la major de les activitats gravades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;4. Quan en un mateix local realitzen activitats distints subjectes passius, tributarà cadascun d'ells per la superfície computable a l'activitat que realitzi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Article 4. Responsables &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;1. Són responsables tributaris les persones físiques o jurídiques determinades com a tal en la Llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;2. La derivació de responsabilitat requerirà que, prèvia audiència de l'interessat, es dicti acte administratiu, en els termes previstos en la Llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;3. Respondran solidàriament de les obligacions tributàries del subjecte passiu les persones físiques o jurídiques que es refereixen els articles 38.1 i 39 de la llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;4. Seran responsables subsidiaris els administradors de les societats i els síndics interventors o liquidadors de fallides, concursos, societats i entitats en general, en els supòsits i amb l'abast que assenyala l'article 40 de la llei General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Article 5. Quota Tributària&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;1. La quota Tributària consistirà en una quantitat fixa, per unitat, que es determinarà en funció de la naturalesa i l'ús o destí dels immobles en els quals es desenvolupa l'activitat generadora del residu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;2. A l'efecte s'aplicaran les tarifes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;3. Les quotes assenyalades en la tarifa tenen caràcter irreductible i corresponen a una anualitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Article 6. Meritació&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;1. La taxa es merita i neix l'obligació de contribuir des del moment en que s'inicia la prestació del servei, que s'entendrà iniciat, atesa la seva naturalesa de recepció obligatòria, quan estigui en funcionament el servei municipal de recollida de residus sòlids urbans en els carrers, places, camins o llocs on es troben els habitatges o locals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;2. El període impositiu coincideix amb l'any natural, meritant-se el tribut l'1 de gener de cada any, essent les quotes irreductibles, excepte en els supòsits següents :&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;a) En el supòsit d'altes en l'activitat econòmica de locals, que es prorratejaran pels trimestres naturals que resten fins a la finalització de l'any amb inclusió del propi de l'alta o sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;b) En el supòsit de baixes en l'activitat econòmica de locals es prorratejaran per semestres naturals; si es produeix la finalització de l'ús durant el primer semestre de l'exercici pagarà el primer semestre com a local amb l'activitat que causa baixa, i el segon semestre pagarà com a local no relacionat al punt 2.a. de l'ordenança. En el cas que es donés d'alta com una altra activitat, passarà a pagar el que li correspongui com aquesta altra activitat . Si la finalització de l'ús es produeix dins del segon semestre no procedirà devolució de cap quantitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;3. En el cas d'edificacions de nova planta, la meritació començarà el dia de l'emissió de la cèdula d'habitabilitat o de l'expedició del certificat de final d'obra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;4. Els canvis de titularitat en la propietat dels immobles, així com les variacions dels titulars en l'activitat econòmica que es tracte i en l'ús dels locals, produiran efecte en l'exercici següent i hauran de ser acreditats per mitjà de còpia d'escriptura, contracte d'arrendament, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Article 7. Règim de declaració i ingrés&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;1. Dins del trenta dies hàbils següents a la data en què es meriti per primera vegada la taxa, el subjectes passius formalitzaran la seva inscripció en la matrícula i presentaran a l'efecte, la declaració d'alta corresponent, i ingressaran simultàniament, la quota que els correspongui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;2. Quan es conegui, d'ofici o per comunicació dels interessats qualsevol variació de les dades que figuren en el padró, s'efectuarà les modificacions corresponents, que tindran efecte a partir de l'exercici següent al de la data en què s'hagi realitzat la declaració, o s'hagi produït la variació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;3. El cobrament de les quotes s'efectuarà anualment, per mitjà de rebut en el període que determini l'Ajuntament, excepte en el supòsit d'altes, que es farà per mitjà d'autoliquidació que presentarà el subjecte passiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;4. Per a l'exacció de la taxa es formarà i aprovarà anualment el corresponent Padró, comprensiu de la relació de tots els obligats al pagament, en el termes establerts en la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Article 8. Infraccions i sancions&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;En tot el que es refereix a la qualificació d'infraccions tributàries, així com de les sancions que a les mateixes corresponguin en cada cas,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;s'estarà al que disposa el Títol IV de la Llei 58/2003 de 17 de desembre General Tributària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Aquesta ordenança fiscal començarà a vigir a partir de dia 1 de gener de 2021, i deroga qualsevol altra que existís i estigui en contradicció amb aquesta.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
