660 643740 2021-01-12 CAIB 40 195 662 ca text/html CAIB ca ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aprovada inicialment pel ple d'aquest Ajuntament de 4 de novembre de 2020, l<em>'Ordenança fiscal reguladora de la taxa per la prestació de servei d'escoleta municipal d'educació infantil de primer cicle</em><span style="color:black">, </span>exposada al públic mitjançant la publicació de l'anunci corresponent en el BOIB núm. 194, de data 12 de novembre de 2020 pel termini de trenta dies per a la presentació de reclamacions i suggeriments sense que se'n hagin presentat, i vist l'informe sobre l'impacte de gènere de l'Institut Balear de la Dona de 15 de desembre de 2020, es publica el text íntegre de l'esmentada ordenança.</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ORDENANÇA FISCAL REGULADORA DE LA TAXA PER LA PRESTACIÓ SERVEI D'ESCOLETA MUNICIPAL D'EDUCACIÓ INFANTIL DE PRIMER CICLE</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 1. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonament legal</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fent ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l'article 106 de la Llei 7/1985, de 2 d'abril, reguladora de les Bases de Règim Local, i de conformitat amb el que disposen els articles 15 al 19 del RDL 2/2004, de 5 de març, pel que s'aprova el Text Refós de la Llei reguladora de les Hisendes Locals, aquest Ajuntament estableix la taxa per la prestació del servei d'escoleta municipal infantil, que es regirà per aquesta ordenança fiscal, les normes de la qual s'atenen al que disposa l'article 57 de l'esmentat Llei RDL 2/2004. </span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 2. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fet imposable</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constitueix el fet imposable de la taxa la prestació del servei d'escoleta municipal infantil.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 3. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Subjectes passius</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Són subjectes passius i obligats al pagament de la taxa regulada en aquesta Ordenança, les persones que es beneficiïn dels serveis o activitats prestats o realitzats per aquest Ajuntament, als quals fa referència l'article anterior.</span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 4. </strong></span></p> <p style="margin-bottom:0px; margin-left:0px; font-size:12px">Tendran preferència per l'ocupació de les places de les escoletes municipals les nines i els nins empadronats al municipi de Santanyí</span></p> <p><span style="font-family:Times New Roman,Times,serif; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Article 5. </strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Exempcions i bonificacions</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Bonificacions:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.Tendran una bonificació del 20% de la quota i matrícula, les famílies que tenguin dos o més fills i/o filles matriculats a les escoles municipals. Per tant pagaran una tarifa especial del 80% de la quota mensual i matrícula per cada fill o filla.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. Tendran una bonificació del 10% de la quota i matrícula, les famílies nombroses, tant de categoria general com de categoria especial, segons la legislació vigent, i/o quan la tutoria recaigui damunt els padrins o altres parents. O sigui, pagaran una tarifa especial del 90% de la quota mensual i matrícula per cada fill o filla.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. Tendran una bonificació del 10% de la quota i matrícula, les famílies monoparentals amb un sol fill o filla menor. I del 20% en cas de tenir dos fills i/o filles menors o més. La justificació es farà amb el llibre de família o qualsevol altre document admès en via procedimental.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4. Gaudiran d'una bonificació del 100% aquells alumnes provinents de famílies amb problemàtica socioeconòmica accentuada, i que hagin estat prèviament derivats pels serveis socials municipals.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Aquestes ajudes són acumulables en cas de concórrer les esmentades condicions.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Les bonificacions s'aplicaran únicament als obligats al pagament que estiguin empadronats al terme de Santanyí.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Article 6. </strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Obligació de pagament</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Neix des de que s'inicia la prestació del servei. Estan obligats al pagament les persones que exerceixin la pàtria potestat, persona que tengui la tutela o representants legals dels infants beneficiats.</span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Article 7. </strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Normes de gestió i meritació</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. El pagament de les taxes indicades s'efectuarà pels interessats mitjançant rebut mensual domiciliat. L'import corresponent a la matrícula es pagarà el primer mes que es rebin els serveis mitjançant domiciliació bancària, independentment de si es fa el curs complet o no.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. Les altes que es produeixin dins els primers cinc dies de cada mes causaran la meritació de la quota mensual, que serà satisfeta dins els deu dies següents. Les que es produeixin després del dia cinc de cada mes, causaran meritació de quotes pels dies que restin fins a final de mes, i es liquidaran aplicant la proporció corresponent dins els deu primers dies del mes següent juntament amb les quotes del propi mes. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">3. Les baixes en la prestació del servei dels infants inscrits s'hauran de notificar a l'administració de l'escoleta infantil, almanco amb quinze dies d'antelació. Si causen baixa dins els primers quinze dies, se'ls farà la part proporcional. En canvi, si és posterior meritarà tot el mes. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">4.
