    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;El Ple de l'Ajuntament en sessió celebrada el dia 19 d'octubre acordà aprovar provisionalment la modificació de l'ordenança&amp;nbsp; 05.POD reguladora del Preu Públic per la prestació del servei d'escola municipal de música i dansa i conservatori municipal de música per a l'exercici 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;El Ple de l'Ajuntament en sessió de dia 29 d'octubre de 2020 acordà rectificar l'acord aprovat en data 19 d'octubre per una errada i aprovar provisionalment el text rectificat de la modificació de l'ordenança&amp;nbsp; 05.POD reguladora del Preu Públic per la prestació del servei d'Escola Municipal de música i dansa i Conservatori Municipal de música per a l'exercici 2021, en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;«Acord:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;1. Rectificar l'Acord núm 4 de la proposta en els següents termes:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;On diu:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;4. Aprovar inicialment la modificació de l'article 6, en el sentit d'eliminar l' apartat 1, relatiu al pagament de la matrícula, modificant-se per tant l'estructura de l'article, i introduir l'apartat 2 per al cas que la modalitat presencial s'hagi de veure substituïda per altres modalitats en base a les indicacions de les autoritats competents i els canvis no coincideixin amb el període de pagament mensual, es prorratejarà el pagament per dies, distingint entre els dies en que s'ha pogut impartir els ensenyaments presencialment i aquells en que s'hagi hagut de fer amb altres modalitats, quan sigui el cas i sempre que així s'informi per part de l'Escola al departament de Gestió tributària a s'hora d'emetre els corresponents padrons mensuals. En aquests casos, el departament de Gestió Tributària emetrà els padrons mensuals en base a l'informe del Director de l'Escola de Música en el qual s‘indicarà el temps concret (dies) en que s'hagi d'aplicar la tarifa corresponent a cada una de les modalitats, per al cas en que el temps de confinament o mesures restrictives d'aforament imposin una modalitat o una altra. Així mateix, s'elimina l'apartat 5 d'aquest article 6, atès que s'han eliminat les tarifes per a persones no empadronades;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Ha de dir:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;4. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;1.El pagament de la matrícula es farà en el moment de la seva formalització, i el pagament de les quotes es realitzarà mensualment per l'import detallat a l'article 3 dins la segona quinzena del mes.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les matriculacions que es produeixin una vegada iniciat el curs escolar, i sempre que siguin conformades per l'Escola de Música en funció de la prestació del servei, seran objecte de prorrateig trimestral, computant-se el trimestre natural en què es matriculi l'alumne/a.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;2.Una vegada realitzades les liquidacions seran presentades al cobrament mitjançant càrrecs de 9 períodes mensuals (període 1, correspondrà al mes de octubre, i així fins al període 9 que correspondrà al mes de juny)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Per al cas que la modalitat presencial s'hagi de veure substituïda per altres modalitats en base a les indicacions de les autoritats competents i els canvis no coincideixin amb el període de pagament mensual, es preveu el prorrateig del pagament per dies, distingint entre els dies en que s'ha pogut impartir els ensenyaments presencialment i aquells en que s'hagi hagut de fer&lt;/em&gt;&lt;em&gt; &lt;/em&gt;&lt;em&gt;amb altres modalitats, quan sigui el cas i sempre que així s'informi per part de l'Escola al departament de Gestió tributària a s'hora d'emetre els corresponents padrons mensuals. En aquests casos, el departament de Gestió Tributària emetrà els padrons mensuals en base a l'informe del Director de l'Escola de Música en el qual s‘indicarà el temps concret (dies) en que s'hagi d'aplicar la tarifa corresponent a cada una de les modalitats, per al cas en que el temps de confinament o mesures restrictives d'aforament imposin una modalitat o una altra.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;3.Les baixes que es produeixin en el curs escolar s'hauran de formalitzar per escrit per part de les persones usuàries i/o dels seus/de les seves responsables legals. Una vegada comprovades per la direcció de l'escola i tramitada la documentació escaient, es remetrà informe al Departament de Gestió Tributària i es donarà lloc a la baixa de la quota de les mensualitats restants del curs escolar.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;em&gt;4. En cas de què la prestació del servei no es realitzi per causes imputables a l'Administració, les persones usuàries i/o els seus/les seves responsables legals podran sol·licitar la devolució de l'import de la matrícula o quota pertinent»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Conclòs el debat, se sotmet a votació i la proposta s'aprova per onze vots a favor (MÉS-Esquerra, Grup Municipal Socialista i Unides Podem), cap vot en contra i deu abstencions (Partit Popular, El PI Manacor i AIPC/SYS)».&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;Dit acord fou publicat en el Tauler d'anuncis de la Seu Electrònica en data 1 de novembre de 2020 i al BOIB núm. 189 de data 3 de novembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;Transcorregut el termini d'exposició pública sense que s'hagin interposat reclamacions, el referit acord s'eleva a definitiu, de conformitat amb l'article 49 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases de Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;De conformitat amb l'informe de la Tècnica de gestió tributària, de 17 de desembre de 2020, el text de la modificació pot ser aprovat sense més tràmit, atès que l'informe sobre l'impacte de gènere emes per l'Institut Balear de la Dona en data 20 de novembre de 2020 conclou que en la redacció de la norma no s'ha detectat cap situació de desigualtat per qüestió de gènere, i es considera que la seva aplicació no produirà efectes diferenciadors sobre les dones i els homes, ni incidirà en la possible situació de desigualtat en que es trobin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;Les modificacions de les ordenances entraran en vigor dia 1 de gener de 2021, prèvia publicació en el Butlletí Oficial de les Illes Balears, d'acord amb l'article 70.2 i 65.2 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases de Règim Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

FONAMENT LEGAL&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;De conformitat amb l'article 41 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel RDL 2/2004, de 5 de març, s'estableix el preu públic per a la prestació dels serveis i realització d'activitats a l'Escola Municipal de Música.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;ARTICLE 2. OBLIGATS AL PAGAMENT&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:115%"&gt;Estan obligades al pagament del preu públic les persones que es beneficiïn dels serveis que ofereix l'Escola. En el seu defecte, els familiars que tinguin l'obligació legal o pactada d'atendre els usuaris d'aquests serveis.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;En la modalitat semipresencial de les ensenyances no reglades de música, l'alumnat assistirà a classe en setmanes alternes i rebrà les classes restants de manera telemàtica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;En la modalitat a distància de les ensenyances no reglades de música, l'alumnat rebrà les classes de manera telemàtica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTICLE 4. BENEFICIS&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.a Famílies nombroses:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformitat amb l'article 12.1b) de la Llei 4/2003, de 18 de novembre, de protecció a les famílies nombroses s'estableix una bonificació del 20% de la quota a favor de les persones integrants de famílies nombroses.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.b Ingressos unitat familiar:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per ingressos anuals per capita inferior a 4.000€: 30% de reducció del preu de la quota.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per ingressos anuals per capita inferior a 3.500€: 50% de reducció del preu de la quota.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per a l'aplicació d'aquests beneficis s'ha d'aportar la documentació següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Imprès de sol·licitud de reducció de matrícula.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Certificat de convivència.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-Fotocòpia de la declaració de la renda del darrer exercici, de tots els membres de la unitat familiar.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;-En cas de no estar obligats a fer declaració de renda s'ha d'acreditar amb un certificat de l'Agència Tributària acompanyat d'una declaració responsable dels ingressos anuals per càpita obtinguts.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;ARTICLE 5. ACREDITAMENT&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es merita el preu públic, i sorgeix l'obligació de pagament en el moment de la sol·licitud dels serveis o activitats relacionats.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;ARTICLE 6. NORMES DE GESTIÓ&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;1.El pagament de la matrícula es farà en el moment de la seva formalització, i el pagament de les quotes es realitzarà mensualment per l'import detallat a l'article 3 dins la segona quinzena del mes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Les matriculacions que es produeixin una vegada iniciat el curs escolar, i sempre que siguin conformades per l'Escola de Música en funció de la prestació del servei, seran objecte de prorrateig trimestral, computant-se el trimestre natural en què es matriculi l'alumne/a.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;2.Una vegada realitzades les liquidacions seran presentades al cobrament mitjançant càrrecs de 9 períodes mensuals (període 1, correspondrà al mes de octubre, i així fins al període 9 que correspondrà al mes de juny)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;Per al cas que la modalitat presencial s'hagi de veure substituïda per altres modalitats en base a les indicacions de les autoritats competents i els canvis no coincideixin amb el període de pagament mensual, es preveu el prorrateig del pagament per dies, distingint entre els dies en que s'ha pogut impartir els ensenyaments presencialment i aquells en que s'hagi hagut de fer amb altres modalitats, quan sigui el cas i sempre que així s'informi per part de l'Escola al departament de Gestió tributària a s'hora d'emetre els corresponents padrons mensuals. En aquests casos, el departament de Gestió Tributària emetrà els padrons mensuals en base a l'informe del Director de l'Escola de Música en el qual s‘indicarà el temps concret (dies) en que s'hagi d'aplicar la tarifa corresponent a cada una de les modalitats, per al cas en que el temps de confinament o mesures restrictives d'aforament imposin una modalitat o una altra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;3.Les baixes que es produeixin en el curs escolar s'hauran de formalitzar per escrit per part de les persones usuàries i/o dels seus/de les seves responsables legals. Una vegada comprovades per la direcció de l'escola i tramitada la documentació escaient, es remetrà informe al Departament de Gestió Tributària i es donarà lloc a la baixa de la quota de les mensualitats restants del curs escolar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;4. En cas de què la prestació del servei no es realitzi per causes imputables a l'Administració, les persones usuàries i/o els seus/les seves responsables legals podran sol·licitar la devolució de l'import de la matrícula o quota pertinent»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
