![CDATA[Resolució de la consellera d’Afers Socials i Esports, de concessió d’ajudes a l’empara de l’Ordre de dia 10 d’agost de 2020 per la qual s’estableixen les bases reguladores i la convocatòria extraordinària d’ajuts a la conciliació destinats a pal·liar els efectes de la COVID-19 (Línia D)]] text/html CAIB ca ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">La directora general d'Infància, Joventut i Famílies ha formulat la proposta de resolució següent:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Fets</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Les persones que figuren a l'annex d'aquesta proposta han presentat a la Conselleria d'Afers Socials i Esports una sol·licitud de subvenció en relació amb la Línia D prevista a l'Ordre de la consellera d'Afers Socials i Esports de dia 10 d'agost de 2020 per la qual s'estableixen les bases reguladores i la convocatòria extraordinària d'ajuts a la conciliació destinats a pal·liar els efectes de la COVID-19 (BOIB núm. 139, de 11 d'agost). Aquesta Línia tenia com a objectiu finançar les despeses d'inscripció a menors d'entre 3 i 14 anys en activitats de temps lliure infantil i juvenil organitzades per persones diferents a les potencials beneficiàries de la Línia A.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Dia 3 de desembre de 2020 es va publicar a la seu electrònica de l'Administració de la Comunitat Autònoma de les Illes Balears la cinquena proposta de resolució de la directora general d'Infància, Joventut i Famílies, de concessió i denegació de subvencions, dictada a l'empara de l'Ordre citada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. D'acord amb l'article 8.6 de l'Ordre que regula les bases i la convocatòria, les persones interessades havien de comunicar a l'òrgan instructor l'acceptació de la proposta de resolució per mitjà d'un correu electrònic dirigit a l'adreça joventut@caib.es.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">En qualsevol cas, l'acceptació s'entén produïda automàticament si en el termini de vuit dies naturals comptadors des de l'endemà de la publicació de la proposta de resolució a la seu electrònica, no es fa constar el contrari.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. L'article 8.10 de l'Ordre que regula les bases i la convocatòria, preveu la possibilitat de dictar resolucions parcials i successives de concessió o denegació, a mesura que l'òrgan instructor formuli les propostes corresponents.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">5. Pel que fa als expedients que figuren a la relació de persones beneficiàries d'aquesta proposta de resolució, l'òrgan instructor ha examinat les sol·licituds i està conforme amb els aspectes següents:</span></span></span></p> <ul> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Les persones sol·licitants, per la seva naturalesa, poden ser beneficiàries de la subvenció objecte de la convocatòria.</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Les persones beneficiàries han presentat les sol·licituds dins el termini i en la forma escaient, i han adjuntat la documentació exigida per la convocatòria.</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Les persones beneficiàries han declarat estar al corrent de les seves obligacions amb la Seguretat Social i amb l'Administració Tributària, d'acord amb allò previst a l'article 11, apartat f) <em>in fine</em>, del Text refós de la Llei de Subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre. </span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Les persones beneficiàries han acceptat la proposta de resolució de manera expressa, o ha transcorregut el termini establert a l'article 8.6 de l'Ordre de bases reguladores i convocatòria per entendre que l'acceptació s'ha produït tàcitament.</span></span></span></li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">6. La subvenció es distribueix en les quanties especificades a l'annex, per persona beneficiària, i hi ha crèdit adequat i suficient a la partida pressupostària 17201 413G01 48000 00 (famílies i institucions sense ànim de lucre) dels pressuposts generals de la Comunitat Autònoma de les Illes Balears per a l'any 2020.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Fonaments de dret</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. <span style="background-color:#ffffff">La Llei 39/2015, d'1 d'octubre, </span><span style="background-color:#ffffff">d</span><span style="background-color:#ffffff">el procediment administratiu comú de les administracions públiques, </span><span style="background-color:#ffffff">que té per objecte, entre d'altres, regular els requisits de validesa i eficàcia dels actes administratius i el procediment administratiu comú a totes les administracions públiques.</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el text refós de la Llei de subvencions.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">3. L'Ordre de la consellera d'Afers Socials i Esports de dia 10 d'agost de 2020 per la qual s'estableixen les bases reguladores i la convocatòria extraordinària d'ajuts a la conciliació destinats a pal·liar els efectes de la COVID-19.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. La proposta de resolució de la directora general d'Infància, Joventut i Famílies de dia 3 de desembre de 2020.</span></span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Proposta de resolució</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Propòs a la consellera d'Afers Socials i Esports que dicti una Resolució en els termes següents:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1. Aprovar un tercer llistat de concessió d'ajuts a famílies que hagin inscrit els seus fills i filles en activitats d'educació en el temps lliure infantil i juvenil de Mallorca promogudes per la iniciativa privada, en el marc de la Línia D, prevista a l'Ordre de la consellera d'Afers Socials i Esports de dia 10 d'agost de 2020 per la qual s'estableixen les bases reguladores i la convocatòria extraordinària d'ajuts a la conciliació destinats a pal·liar els efectes de la COVID-19 a les persones beneficiàries que figuren en l'annex.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">2. Autoritzar i disposar la despesa; reconèixer l'obligació, i proposar el pagament </span><span style="color:#000000">global de </span><span style="color:#000000">1.120,00</span><span style="color:#000000"> </span><span style="color:#000000">€</span><span style="color:#000000"> a favor de les persones beneficiàries que figuren </span><span style="color:#000000">a l'annex, per l'import individual que aquest annex disposa, amb càrrec a la partida 17201 413G01 48000 00 dels pressuposts generals de la Comunitat Autònoma de les Illes Balears per a 2020.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3. Recordar l'obligació de les persones beneficiàries de comunicar la sol·licitud o obtenció d'altres subvencions per a la mateixa finalitat. Aquesta comunicació s'ha de fer dins el termini de tres dies hàbils des de la sol·licitud o l'obtenció de la subvenció recurrent. Així mateix, aquestes persones beneficiaries han de comunicar, en els mateixos termes , l'obtenció d'aquesta subvenció a l'altra administració o entitat subvencionadora.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4. Notificar a les persones beneficiaries aquesta Resolució mitjançant la seva publicació a la seu electrònica de la Comunitat Autònoma de les Illes Balears i en el <em>Butlletí Oficial de les Illes Balears</em>.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Resolució</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Interposició de recursos</strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Contra aquesta Resolució -que exhaureix la via administrativa- es pot interposar un recurs potestatiu de reposició davant l'òrgan que l'ha dictada en el termini d'un mes comptador des de l'endemà d'haver-se publicat, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Que els fills i filles causants compleixen amb els requisits d'edat prevists a la convocatòria.</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">Que el temps de participació en les activitats queda integrat dins el període subvencionable (de dia 1 de juliol a dia 31 d'agost de 2020).</span></span></span></li> <li><span style="font-family:Times New Roman,Times,serif;
