    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;ACORD DE JUNTA DE GOVERN DE DIA 3 DE DESEMBRE DE 2020 PER APROVAR DE LES BASES I CONVOCATÒRIA PER LA CONCESSIÓ DE SUBVENCIONS A EMPRESES DEL MUNICIPI DE PUIGPUNYENT DESTINADES A PROTEGIR L'ACTIVITAT&amp;nbsp; ECONÒMICA LOCAL DE L'IMPACTE ECONÒMIC DE LA COVID19 &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La situació d'excepcionalitat derivada de l'emergència de salut pública ocasionada per la COVID-19 demanda de les Administracions Públiques la urgent adopció i posada a la disposició de la ciutadania dels recursos disponibles per a afrontar una situació d'excepcionalitat inèdita. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Aquesta excepcionalitat ja es contempla en l'Exposició de Motius del Reial Decret 463/2020, de 14 de març, pel qual es declara l'estat d'alarma per a la gestió de la situació de crisi sanitària ocasionada per la COVID-19, reconeix que la situació derivada de la COVID-19 és “&lt;em&gt;una crisi sanitària sense precedents i d'enorme magnitud, tant pel molt elevat nombre de ciutadans afectats com per l'extraordinari risc pels seus drets&lt;/em&gt;”, i que d'això se'n deriva una situació “&lt;em&gt;greu i excepcional&lt;/em&gt;”. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;També a l'Exposició de Motius del Reial Decret-Llei 11/2020, de 31 de març, pel qual s'adopten mesures urgents complementàries en l'àmbit social i econòmic per fer front a la COVID-19, reconeix que la crisi sanitària que estem patint està tenint “&lt;em&gt;un impacte directe en l'economia i en la societat&lt;/em&gt;”, i que les mesures sanitàries de contenció suposen “&lt;em&gt;reduir l'activitat econòmica i social de forma temporal pel teixit productiu i social, restringint la mobilitat i paralitzant l'activitat a nombrosos sectors [econòmics], amb important pèrdues de rendes a les llars, autònoms i empreses&lt;/em&gt;”. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Un dels col·lectius que més han patit els efectes de la situació és el de les persones que s'hagin vist afectades pel tancament dels seus negocis i no hagin pogut mantenir el seu nivell de facturació per altres vies.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Així, amb motiu de la crisi sanitària provocada per la COVID-19, el Govern de l'Estat va declarar mitjançant el Reial decret 463/2020, l'estat d'alarma on es van establir les mesures de contenció en del comerç. Per part seva, el Reial decret llei 7/2020, de 12 de març, pel qual s'adopten mesures urgents per a respondre a l'impacte econòmic del COVID19, va establir la interrupció de determinades activitats comercials com a mesura de contenció sanitària. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;A més de l'absència o disminució d'ingressos durant aquest període, molts d'ells es poden veure abocats a un tancament definitiu de l'activitat si no s'atalla la problemàtica específica, la qual cosa sens dubte danyarà el teixit industrial i activitat econòmica del nostre municipi. Els Ajuntaments no podem ser aliens a aquesta precària situació, que danya el benestar del desenvolupament econòmic local, la qual cosa obliga a aprovar accions amb la promptitud i urgència necessària. D'una banda, l'article 25.1 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local estableix que el municipi, per a la gestió dels seus interessos i en l'àmbit de les seves competències, pot promoure activitats i prestar els serveis públics que contribueixin a satisfer les necessitats i aspiracions de la comunitat veïnal en els termes que preveu aquest article. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Per un altre, i amb base en l'art. 32.1 del Decret Llei 8/2020, de 13 de maig de mesures urgents i extraordinàries per a l'impuls de l'activitat econòmica i la simplificació administrativa en l'àmbit de les administracions públiques de les Illes Balears per a pal·liar els efectes de la crisi ocasionada per la COVID-19, aquest Ajuntament vol exercir la competència pròpia atribuïda per l'article 29.2.t) de la Llei 20/2006, municipal i de règim local de les Illes Balears, en matèria de “Desenvolupament econòmic local i promoció turística del seu territori”. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Sobre això, és de destacar que l'article comentat permet als municipis de les Illes Balears fer ús dels instruments de foment previstos en aquesta norma, com a manifestació de l'exercici de la seva pròpia competència, i en concret destaca que “poden atorgar ajudes o subvencions a les persones o entitats afectades i, en general, acordar totes les accions de foment que estimin pertinents amb la finalitat de coadjuvar a la recuperació econòmica en els termes municipals respectius”. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Aquest Decret-Llei 8/2020, en la seva Exposició de Motius, aclareix que “els ajuntaments poden emprar els instruments de foment previstos en aquest decret-llei, com a manifestació de l'exercici de la seva pròpia competència en els termes que resulten de la lletra t) de l'apartat segon de l'article 29 de la Llei 20/2006, de 15 de desembre, municipal i del règim local de les Illes Balears, sense perjudici de l'exercici, en qualsevol moment, d'aquesta competència i de les altres que els són pròpies d'acord amb la normativa local”. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Per tant, aquest Ajuntament, entre altres mesures que ha adoptat per a pal·liar els efectes de la pandèmia, vol aprovar una línia de subvencions que té per objecte pal·liar i actuar de manera immediata, davant les conseqüències derivades de la crisi econòmica provocada per la COVID-19, i impulsar l'activitat econòmica en el terme municipal de Puigpunyent atorgant liquiditat a les empreses del municipi per a contribuir a facilitar el compliment de les seves obligacions empresarials, el manteniment de l'activitat i ocupació, i també a esmorteir la reducció dràstica d'ingressos. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;En definitiva, el que es pretén és protegir l'interès general que suposa la prestació de serveis, per persones físiques i jurídiques, en el nostre municipi, donant suport a les empreses per a minimitzar l'impacte produït per la crisi econòmica provocada per la COVID-19 i aconseguir que es produeixi al més aviat possible una reactivació de l'economia del nostre municipi actuant directament sobre les persones físiques i jurídiques més afectades. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Atès que el pressupost municipal 2020 compta amb crèdit, per a afrontar la despesa d'aquesta convocatòria, en la partida pressupostària 23148004.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;Per tot l'anterior, i en vista de la situació de necessitat contemplada anteriorment, aquesta Alcaldia dicta la següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&lt;strong&gt;RESOLUCIÓ &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Primer&lt;/strong&gt;.- Aprovar les Bases per a la concessió de subvencions a empreses del municipi de Puigpunyent per a protegir l'activitat econòmica local de l'impacte econòmic de la COVID-19 (s'incorpora el seu text íntegre com a Annex a la present resolució, formant part de la mateixa). &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Segon.- &lt;/strong&gt;Publicar l'anunci d'aprovació de la Bases i convocatòria amb el text íntegre de les mateixes en el Butlletí Oficial de les Illes Balears, en la pàgina web municipal i en la Base de dades Nacional de Subvencions &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;Tercer.- &lt;/strong&gt;Donar trasllat de la present Resolució als departaments afectats, perquè en prengueu coneixement i altres efectes oportuns. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;1.- Objecte i finalitat &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;1.1 L'objecte &lt;/strong&gt;de la present convocatòria és atorgar diverses ajudes destinades a preservar l'activitat econòmica del municipi de Puigpunyent dels efectes adversos que hagi pogut originar la situació derivada de les mesures adoptades para contenir la difusió de la COVID-19. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En concret, estableix el procediment per la concessió d'ajudes amb destinació a sufragar despeses de naturalesa no inventariable en què hagin incorregut els subjectes que puguin adquirir la condició de persones beneficiaries, sempre que els mateixos estiguin orientats a promoure l'estabilitat i perdurabilitat de l'empresa, així com la continuïtat dels productes i serveis que presti (o la millora dels mateixos), o la seva possible diversificació per canals alternatius als tradicionals.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.2&lt;strong&gt; La finalitat &lt;/strong&gt;d'aquestes subvencions és ajudar als empresaris del Municipi de Puigpunyent a afrontar els efectes econòmics adversos derivats de la COVID-19 que hagin pogut sofrir. La crisi sanitària provocada pel brot de COVID-19 s'està transmetent a l'economia i a la societat, afectant tant a l'activitat productiva com a la demanda i al benestar dels ciutadans. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es per això que aquest Ajuntament, en aquest context, té com a prioritat absoluta en matèria econòmica protegir, preservar y donar suport al teixit productiu i social per minimitzar l'impacta i aconseguir que, ja finalitzada l'alarma sanitària, es produeixi al més aviat possible una normalització en l'activitat econòmica local. Per això s'ha dotat un fons per la prestació d'aquestes subvencions, davant el tancament obligatori dels seus establiments i del cessament de les seves activitats (total o parcial) que hagin patit, per haver estat considerades no essencials.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1.3 D'acord amb el que es preveu en l'article 29.2.t) de la Llei 20/2006 Municipal i de Règim Local de les Illes Balears, en relació amb l'article 25.1. y 5 de la Llei 7/1985 de Bases de Règim Local i l'article 32 del Decret Llei 8/2020, l'Ajuntament pot atorgar les presents subvenciones com a mesura de foment que coadjuvi a la recuperació econòmica.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2.- Persones beneficiaries i requisits &lt;/strong&gt;&amp;nbsp;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.1 Podran ser beneficiaries de la subvenció les següents persones/entitats.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;1 - Les persones físiques o jurídiques que tinguin un establiment obert al públic i l'activitat es trobés recollida dins de les obligades al tancament obligatori dels establiments disposat en el Reial Decret 465/2020, de 17 de març, que modifica l'article 10 del Reial Decret 463/2020 de 14 de març.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;2 - Les empreses i autònoms l'activitat de la qual s'hagi vist interrompuda per no trobar-se la mateixa qualificada com a servei essencial en l'annex del Reial Decret-llei 10/2020, de 29 de març.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp; 3 - Les empreses i autònoms la facturació dels quals durant el període per al qual se sol·licita l'ajuda s'hagi vist reduïda, almenys, en un 50 % en relació amb la mitjana de facturació del semestre anterior. Quant la persona física o jurídica no porti d'alta els 6 mesos naturals exigits per acreditar la reducció dels ingressos, la valoració es durà a terme tenint en compte el període d'activitat. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el cas que el sol·licitant de l'ajuda hagués suspès l'activitat presencial o d'obertura al públic per causes alienes a la situació de fet derivada de les mesures per contenir la COVID-19 no es podrà beneficiar de les ajudes previstes en aquesta convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3.- Despeses subvencionables &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1 -&lt;/strong&gt; Les persones beneficiaries podran optar, &lt;strong&gt;amb caràcter excloent&lt;/strong&gt;, únicament a una de les següents línies d'ajudes, amb les condicions i límits que s'indiquen posteriorment. En cas de que s'opti per totes dues en la sol·licitud, s'atorgarà únicament aquella que suposi un major import a favor del sol·licitant &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Línia 1: despeses en concepte d'arrendament del local comercial. &lt;/strong&gt;Haurà de ser un establiment fix de titularitat privada, amb accés directe i independent des del carrer. El contracte d'arrendament haurà d'estar a nom del sol·licitant de la subvenció, i ser anterior a la declaració de l'estat d' alarma. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Línia 2: despeses corrents destinades al desenvolupament, millora o manteniment de l'activitat. &lt;/strong&gt;Es podran subvencionar les següents: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;strong&gt;Despeses d'assegurances vinculats a l'activitat empresarial (responsabilitat civil, accident de vehicle, etc.) &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;strong&gt;Despeses per llicencies d'us d'eines i/o aplicacions informàtics per l'impuls i desenvolupament del teletreball o el comerç electrònic per Internet vinculats a l'activitat empresarial. &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Despeses per el disseny Web de pàgina destinada a la promoció comercial I/o venta de productes, despeses de domini, actualització, manteniment i revisió de dita Web, així com actualització de la presència de l'empresa en xarxes socials i plataformes de comerç electrònic. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;strong&gt;Combustible i despeses de manteniment de vehicles: &lt;/strong&gt;Despeses ocasionades per la compra de combustibles per la realització de l'activitat econòmica donada d'alta en l'Epígraf 721.2. Els Serveis de manteniment de vehicles han d'estar realitzats per talleres autoritzats.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;strong&gt;Despeses en subministres d'energia elèctrica, aigua i comunicacions (Internet, telefono, etc) &lt;/strong&gt;vinculats al local comercial on se desenvolupi l'activitat. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;strong&gt;Despeses de préstecs hipotecaris d'immobles vinculats a l'activitat empresarial&lt;/strong&gt;: Imports pagats a entitats bancàries per l'adquisició d'un local on s'exerceixi l'activitat principal.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;strong&gt;Rènting de maquinària o vehicles.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2.- L Les despeses anteriors deuran, de manera indubtable, respondre a la naturalesa i objecte de l'activitat subvencionada, i haver-se abonat efectivament prèviament a la sol·licitud de subvenció pel beneficiari. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4.- Requisits de les persones sol·licitants &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les persones/entitats interessades en aquesta subvenció deuran de complir els següents requisits: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A ) Deuran de tenir el seu domicili fiscal i la seva activitat en el municipi de Puigpunyent. S' entendrà per “domicili fiscal” l'últim que figuri com a tal en l'Impost d'Activitats Econòmiques (Apartat I del model 840, casella 122 dels models 036/037, etc.).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;B ) Comptar con el corresponent títol habilitant municipal para exercir l'activitat, o haver-lo sol·licitat abans de l'inici de l'estat d'alarma. En el cas d'arrendaments o despeses d'hipoteca, ha de ser per el que es sol·liciti la subvenció. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;C ) Haver presentat declaració censal d'alta en l'Impost sobre Activitats Econòmiques i en el Règim Especial de la Seguretat Social dels Treballadors per Compte Pròpia, en la data de la declaració de l'estat d'alarma. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D ) En el cas d'arrendament del local o establiment, estar al corrent del pagament del lloguer amb anterioritat a la sol·licitud de les ajudes, i no haver-se acollit a la moratòria arrendatícia establerta en els arts. 1 a 5 del Reial Decret-llei 15/2020, de 21 d'abril, de mesures urgents complementaries per donar suport a l'economia i l'ocupació. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;E ) El representant legal de l'entitat no ha trobar-se inhabilitat per contractar amb les administracions públiques, o per obtenir subvenció de les mateixes, i ha d'estar facultat per actuar en nom de l'entitat. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;F ) Estar al corrent del pagament de les obligacions tributaries locals, autonòmiques i estatals, tant en el moment de la sol·licitud com en el moment del pagament de l'ajuda. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;G ) &amp;nbsp;Haver justificat qualsevol subvenció que li hagi estat concedida amb anterioritat per l'Ajuntament de Puigpunyent, sempre que hagi finalitzat el corresponent termini de justificació. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5.- Període subvencionable i quantia &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.1 - El període subvencionable serà el comprès entre 14 de març de 2020 (declaració de l'estat d'alarma) y el 31 de desembre de 2020. En aquelles despeses abonades de forma anticipada, però de llarga duració, es tindrà en compte el seu prorrateig en mesos dins del període subvencionable. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.2 - Els possibles beneficiaris podran sol·licitar fins el 100% del total de les despeses subvencionables, incloses aquelles taxes i imposts que no pugui compensar o recuperar, fins un import màxim individualitzat per persona o entitat beneficiaria de: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1 &amp;nbsp;&lt;strong&gt;Línia 1 &lt;/strong&gt;(lloguer): 600 euros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2 &amp;nbsp;&lt;strong&gt;Línia 2 &lt;/strong&gt;(despeses corrents): 400 euros &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5.3 - El Crèdit pressupostari total màxim per la subvenció és de 10.000 euros, que figura consignat en la partida 23148004 de despesa «Fons social municipal per fer front a les dificultats econòmiques a causa del COVID-19».&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquest import es podrà augmentar fins el límit del crèdit pressupostari disponible, sense que impliqui l'obertura d'un nou termini per presentar les sol·licituds ni l'inicio d'un nou còmput de termini per resoldre. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6.- Termini i forma de presentació de les sol·licituds &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.1 - El termini per la presentació de sol·licituds serà de 15&lt;strong&gt; dies hàbils&lt;/strong&gt;, a contar des de el dia següent de la publicació de las presents bases i convocatòria en la pàgina web municipal. Donada l'especificitat de la subvenció, s'opta per aprovar conjuntament les bases i la convocatòria. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Els models normalitzats, així com les bases i la resta de documentació associada a l'expedient, estarà disponible en la pàgina web de l'Ajuntament de Puigpunyent. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.2 - Només s'atendrà una sol·licitud per empresa (persona física o jurídica) i activitat econòmica afectada, independentment de que realitzin més d'una activitat econòmica, o de què disposi, de un o més establiments o locals per l'exercici de la o les activitats. Si diverses persones físiques o jurídiques comparteixen el mateix establiment, només una podrà optar por l'ajuda. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6.3 - Les sol·licituds es formalitzaran per escrit en model normalitzat de sol·licitud que s'acompanya com Annex 1, dirigides a la Batlia-Presidència i aniran acompanyades de la documentació indicada en la base següent. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per aquells obligats a relacionar-se a través de mitjans electrònics&amp;nbsp;amb les Administracions Públiques, la sol·licitud es presentarà de forma telemàtica&amp;nbsp;en la seu electrònica de l'Ajuntament de Puigpunyent&amp;nbsp;&amp;nbsp;(https://puigpunyent.sedelectronica.es/info.0), en la qual es disposarà la informació de la convocatòria, model de sol·licitud, així com les publicacions de la resolució de les ajudes, es publicarà en la pàgina web municipal. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'acord amb l'article 14 de la Llei 39/2015, de 1 d'octubre, del Procediment Administratiu Comú de las Administracions Públiques (LPACAP), estaran obligats a presentar la documentació a través de mitjans electrònics els següents subjectes: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A ) Las persones jurídiques. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;B ) Las entitats sense personalitat jurídica.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;C ) Els qui exerceixin una activitat professional per la que es requereixi col·legiació obligatòria en l'exercici de dita activitat professional.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D ) Els qui representin a un interessat que estigui obligat a relacionar-se electrònicament amb l'Administració &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les sol·licituds també podran ser presentades de forma presencial en el Registre General o les Oficines Municipals d'Atenció al Ciutadà (OAC) de l'Ajuntament de Puigpunyent, o bé utilitzant qualsevol dels mitjans establerts en l'article 16.4 LPACAP).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La mera presentació de la sol·licitud suposa l'acceptació de les bases que regeixen la convocatòria, i el compromís del sol·licitant de complir amb les obligacions i deures derivats de les mateixes. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7.- Documentació a acompanyar a la sol·licitud &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.1 - Documentació relativa al sol·licitant (segons procedeixi) &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A ) Fotocòpia del CIF de la empresa o DNI/NIE del sol·licitant.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;B ) Fotocòpia del DNI/NIE del signant. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;C ) Poder de representació del signant de la sol·licitud, en cas d'actuar per mitjà de representant.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D ) Representació per la realització per mitjans telemàtics del tràmit del procediment.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;E ) En el cas de societats, escriptura pública o contracte privat de constitució de l'entitat, així com fotocòpia d'escriptura de poder de representació suficient de qui actuï en el seu nom, quant es tracti de persones jurídiques.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;F ) Compte bancària on realitzar el pagament de l'ajuda concedida, en la que haurà de figurar la persona o entitat sol·licitant com a titular de la mateixa. Si mai ha estat perceptor d'ajudes de l'Ajuntament de Puigpunyent, o les dades no coincideixen amb les que obrin en les bases de dades municipals, haurà d'ajuntar-se el Certificat bancari de titularitat de compte (Annex 4)&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;G ) En el seu cas, declaració responsable (Annex 2) &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.2 - Documentació relativa a l'activitat econòmica &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A ) &lt;strong&gt;Justificant d'alta en el Règim Especial de Treballadors autònoms i en l'Impost de Activitats Econòmiques a data de l'estat d'alarma&lt;/strong&gt;.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;B ) Certificat d'estar al &lt;strong&gt;corrent de pagament front a la Seguretat Social &lt;/strong&gt;(TGSS).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;C ) &lt;strong&gt;Autoritzacions per la consulta &lt;/strong&gt;interactiva por part de l'òrgan gestor dels requisits &lt;strong&gt;de trobar-se al corrent en el compliment de les obligacions tributaries &lt;/strong&gt;amb l'Agència estatal de l'Administració tributaria (AEAT), amb la Tresoreria municipal, i a la consulta de la situació censal (Annex 5).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas de no autoritzar u oposar-se a la comprovació d'aquest requisits, haurà d'aportar-se per el sol·licitant la documentació acreditativa.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.3 - Documentació justificativa de la subvenció &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A ) Respecte a les &lt;strong&gt;despeses derivades de l'arrendament &lt;/strong&gt;del local de negocis, si el/la sol·licitant de l'ajuda tenen el local o establiment llogat: Contracte de lloguer i declaració responsable de no tenir mensualitats pendents de pagament.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;B ) Respecte a les &lt;strong&gt;despeses corrents&lt;/strong&gt;, factura i justificant de pagament dels mateixos (transferències bancàries, resguard de pagaments amb targetes, còpia de talons, extractes bancaris, etc.) No s'acaptaran aquelles factures que hagin estat abonades en efectiu. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;C ) En el cas de &lt;strong&gt;tancament de l'activitat&lt;/strong&gt;, declaració responsable conforme l'activitat ha estat aturada indicant la data d'inici del tancament i la data de reobertura de la mateixa si està ja s'ha produït (veure Annex 2)&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D ) En el caso de &lt;strong&gt;descens en la facturació&lt;/strong&gt;, ha de presentar-se declaració responsable amb el percentatge de la reducció dels ingressos (veure Annex 2) Per comprovar les dades anteriors l'Ajuntament de Puigpunyent podrà sol·licitar l'entrega de còpia de qualsevol dels següents llibres:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- De registre de factures emeses i rebudes &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Diari d'ingressos i despeses. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Registre de ventes i ingressos. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Compres i despeses. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Quan la persona física o jurídica no estigui obligada a dur els llibres anteriors, que es demostri per qualsevol mitjà de prova admès en Dret la reducció de la facturació. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.4 - Justificació de les despeses subvencionables &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En tractar-se d'una subvenció que s'abona a posteriori, la justificació ha de fer-se amb la sol·licitud. Per això el sol·licitant presentarà un model simplificat de memòria explicativa i compte justificativa de les despeses subvencionables realitzades (Annex 3). &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Conjuntament a l'Annex 3 s'aportaran les factures o documents equivalents acreditatius de les despeses efectivament realitzats per el beneficiari de la subvenció, i que necessàriament hauran de correspondre al període subvencionable recollit en la Base 5.1. Es considerarà ‘'despesa realitzada'' el que hagi estat expedit al beneficiari de la subvenció i efectivament pagat per ell amb anterioritat a la sol·licitud de la subvenció. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les despeses s'acreditaran amb la següent documentació:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Mitjançant factures i altres documents de valor probatori equivalent, amb validesa en el tràfic jurídic mercantil o amb eficàcia administrativa. Les factures hauran de complir els requisits establerts en el Reial Decret 1.619/2012, de 30 de novembre, por el que s'aprova el Reglament pel qual es regulen les obligacions de facturació. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Hauran de presentar-se originals, deixant-se constància de que han estat utilitzades com a justificant de la subvenció rebuda, especificant la seva utilització per la justificació de la subvenció de la convocatòria corresponent. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Les factures hauran d'estar datades en l'exercici econòmic per el que s'hagi concedit la subvenció.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tant, no s'admetran com a justificants de despeses els albarans, les notes d'entrega ni les factures pro-forma. En el caso de justificants emesos en moneda estrangera s'indicarà el tipus de canvi aplicat. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7.4 - L'Ajuntament podrà sol·licitar qualsevol altra documentació complementaria a la prevista en les presents bases, per completar o aclarir el dret a subvenció o la documentació presentada. En el cas de que no s'aporti la documentació establerta, o la sol·licitada posteriorment, es donarà als sol·licitants per desistits del procediment, amb l'obligació de reintegrar de la subvenció percebuda en el seu caso. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;8.- Procediment, resolució i pagament de la subvenció &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.1 - El procediment de concessió es tramitarà en règim de concurrència competitiva, segons l'establert en l'article 22.1 de la Llei 38/2003, de 17 de novembre.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La gestió de les ajudes contemplades en la present convocatòria es subjectarà als principis de publicitat, transparència, objectivitat, igualtat i no discriminació, així com la eficàcia en el complimento de objectius i eficiència en l'assignació i utilització dels recursos públics. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.2 - L'òrgan competent per l'ordenació e instrucció del procediment de concessió de les ajudes previstes en la present convocatòria serà&lt;span style="color:black"&gt; &lt;strong&gt;la Junta de Govern amb l'assessorament de la Comissió Tècnica&lt;/strong&gt;, que instruirà els procediments, comprovant el compliment dels requisits exigits en aquestes bases &lt;/span&gt;i convocatòria. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La composició de la Comissió Tècnica &lt;span style="color:black"&gt;està formada per:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- Batle,&amp;nbsp; o&amp;nbsp; el&amp;nbsp; Regidor&amp;nbsp; o&amp;nbsp; Regidora&amp;nbsp; en&amp;nbsp; qui&amp;nbsp; delegui.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- La&amp;nbsp; Secretària Interventora o funcionari en qui delegui.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;- El Treballador&amp;nbsp; Social&amp;nbsp; de&amp;nbsp; l'Ajuntament de&amp;nbsp; Puigpunyent,&amp;nbsp; que actuarà com a instructor del procediment.&lt;/span&gt; &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas de ser necessari, requerirà als sol·licitants perquè aportin quanta documentació i informació complementaria s'estimi oportuna per fonamentar el seu dret, així com perquè es procedeixi a l'esmena dels defectes apreciats en la sol·licitud, en el termini de deu dies hàbils. També podrà realitzar d'ofici quantes actuacions estimi necessàries i convenients per la determinació, coneixement i comprovació de les dades que figurin en las sol·licituds. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'òrgan instructor, realitzades les actuacions anteriors, emetrà un informe, amb la totalitat o un número determinat de les sol·licituds presentats, en el que s'indiqui: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;- Les sol·licituds que han d'estimar-se&lt;/strong&gt;. S'inclourà una relació dels beneficiaris i les quanties de les subvencions corresponents a cada un d'ells, i s'indicarà que de la informació disponible es desprèn que els beneficiaris compleixen amb tots els requisits necessaris per ser admesos a la convocatòria. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- &lt;strong&gt;Las sol·licituds que han de desestimar-se&lt;/strong&gt;, amb indicació de les causes. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las subvencions es concediran a tots els sol·licituds que compleixin els requisits establerts en la convocatòria, sense que sigui necessari realitzar una comparació i prelació de sol·licituds presentades en un moment concret i únic del procediment. En cas que l'import total sol·licitat per tots els interessats sigui major que el crèdit disponible, l'import a concedir es prorratejarà de manera proporcional entre tots els sol·licitants amb dret a l'ajuda, segons l'import de subvenció que els hagués hagut de correspondre. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.3 - Una vegada realitzat l'informe anterior, el mateix s'elevarà a la Junta de Govern&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquesta Junta de Govern es reunirà dins dels cinc dies hàbils a la remissió de l'informe de l'òrgan instructor, examinarà els expedients remesos així com aquest informe, i elaborarà el seu propi informe expressant la quantitat que es proposa (en el cas de ser l'informe favorable), o indicant les causes per les quals es desestimen la resta. Aquest informe servirà com a base per l'elaboració de la proposta de resolució, i s'informarà a l'òrgan competent per concedir la subvenció en un termini de dos dies a partir de l'emissió del seu propi informe. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquesta proposta de resolució provisional, degudament motivada, serà notificada mitjançant publicació en la pàgina web de l'Ajuntament de Puigpunyent. Si no figuren en el procediment ni son tinguts en compte altres fets ni altres al·legacions i proves que les adduïdes pels interessats, es prescindirà del tràmit d'audiència, i la proposta de resolució formulada tindrà el caràcter de definitiva. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas contrari, es donarà audiència als interessats per un termini de deu dies hàbils, perquè els interessats presentin les al·legacions que estimin pertinents. Si no es formulessin al·legacions la proposta de resolució esdevindrà definitiva. En cas contrari, es realitzarà una nova proposta de resolució, que s'elevarà a l'òrgan competent, amb: la resolució de les al·legacions presentades, la relació de sol·licitants i la quantia concedida. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.4 - L'òrgan competent per resoldre i concedir la subvenció serà la Junta de Govern . La resolució de concessió determinarà la quantia concedida i incorporarà, si escau, las condicions i obligacions a les que està subjecte el beneficiari de las mateixes. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquesta resolució definitiva es notificarà als beneficiaris mitjançant anunci publicat en la pàgina web de l'Ajuntament de Puigpunyent. Els terminis de recursos es comptaran a partir del dia següent a aquell en que tingui lloc aquesta publicació. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La resolució també donarà per justificada la subvenció, reconeixerà l'obligació (import justificat) a favor de les persones beneficiaries i ordenarà el pagament de les obligacions reconegudes mitjançant transferència bancària, en la compte corrent assenyalat per la persona beneficiaria. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No podrà realitzar-se el pagament de la subvenció en tant la persona beneficiaria no es trobi al corrent de les obligacions tributaries (AEAT, Administració Tributaria de les Illes Balears i Hisenda Local) i front a la Seguretat Social, és a dir deutor per resolució de procedència de reintegrament. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.5 - El pagament d'aquestes subvencions es realitzarà en un pagament únic a cada beneficiari per la totalitat de l'import concedit, mitjançant transferència bancària, a partir de la data de la resolució de concessió, sense que sigui necessària la constitució de garanties. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas de que el beneficiari tingués deutes pendents amb la hisenda municipal, l'Ajuntament podrà saldar prèviament d'ofici les deutes pendents de cobrament, per compensació amb el total o part de la subvenció reconeguda. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8.6 - El/la sol·licitant podrà desistir de la seva sol·licitud, o renunciar al seu dret a l'ajuda, en qualsevol moment i mitjançant escrit dirigit a l'Ajuntament. L'Ajuntament dictarà una resolució en que expressi les circumstancies que concorren, amb indicació dels fets produïts i les normes legals. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;9.- Obligacions de les persones beneficiaries &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.1 - Els beneficiaris de les ajudes hauran, excepte per motius de salut pública degudament justificats, &lt;strong&gt;reiniciar l'activitat suspesa en el termini de 1 mes &lt;/strong&gt;després de la finalització del període de tancament obligatori. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas de que no es pugui reobrir l'activitat en aquest termini, ha de presentar-se sol·licitud justificant dels motius i el termini previst per iniciar les activitats. L'òrgan competent per resoldre podrà acordar l'ampliació del termini inicialment previst si ho estima motivat. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.2 - També serà obligació dels interessats proporcionar a l'Ajuntament de Puigpunyent la informació necessària per dur a terme les actuacions de comprovació i control financer previstes per la normativa en matèria de subvencions. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.3 - També haurà de comunicar qualsevol alteració de les condicions i/o requisits tinguts en compte per la concessió de la subvenció establerta en les presents bases. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;10.- Justificació de las obligacions &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.1 - L'Ajuntament de Puigpunyent podrà requerir a la persona beneficiaria perquè presenti la següent documentació, en el termini que es fixi en el requeriment: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Per les persones jurídiques, certificat actualitzat de Situació Censal que indiqui l'activitat econòmica en la data d'alta, el domicili fiscal i el local de desenvolupament de l'activitat. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Per les persones físiques, certificació o equivalent d'estar d'alta en el Règim corresponent de la Seguretat Social. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.2.- L'interessat podrà presentar la renuncia a la subvenció en qualsevol moment previ a la justificació, i en aquest cas haurà de procedir al reintegrament de les quantitats en el seu cas percebudes. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;11.- Compatibilitat amb altres subvencions &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11.1 - Aquesta línia d'ajudes serà compatible amb les ajudes, subvenciones, ingressos o recursos que altres Administracions o ens, públics o privats puguin posar en marxa, sempre i quant no es percebi més subvenció que l'import de les despeses subvencionables. En aquest cas, es posarà en marxa un procediment per reintegrar l'excés subvencionat, segons el procediment establert en la Llei General de Subvencions. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11.2 - El sol·licitant de la subvenció haurà de declarar en la memòria justificativa totes les ajudes que hagin sol·licitat o obtingut, pel que s'estarà al que es disposa en els articles 33 i 34 del Reglament de la Llei General de Subvencions (Reial decret&amp;nbsp;&amp;nbsp;&amp;nbsp; 887/2006,&amp;nbsp; de 21 de juliol)&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;12 - Incompliments &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'incompliment de les condicions imposades en aquestes bases podrà donar lloc al reintegrament total o parcial de las quantitats percebudes, en els termes que preveu el Tìtol II del Reglament de la Llei General de Subvencions (Reial decret&amp;nbsp;&amp;nbsp;&amp;nbsp; 887/2006,&amp;nbsp; de 21 de juliol).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;13 - Tractament de dades de caràcter personal &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformitat amb el que es preveu en la Llei Orgànica 3/2018, de 5 de desembre, de Protecció de Dades Personals i garantia dels drets digitals: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Responsable del tractament de les seves dades: Ajuntament de Puigpunyent (CIF: P0704500H , C/ SaTravessía, 37 – 07194 Puigpunyent, Illes Balears), únic destinatari de la informació aportada voluntàriament. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Finalitat del tractament de les dades: Gestionar la sol·licitud de subvenció per atenuar l'impacte econòmic del COVID-19 en el municipi de Puigpunyent. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Temps de conservació de les dades: Durant el termini de vigència d'aquest expedient. No obstant, les dades seran conservades amb fins d'arxiu d'interès públic o fins estadístics.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Legitimació per el tractament de los dades: Exercici dels poders públics o competències pròpies.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cessió a terceres persones: Les dades cedides NO seran cedits a terceres persones alienes al Ajuntament de Puigpunyent, tret que hagin de ser comunicats a altres entitats públiques per imperatiu legal.&amp;nbsp; &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Drets: Dret d'accés a les seves dades, sol·licitar la seva rectificació o, en el seu caso, cancel·lació, oposició o sol·licitar la seva supressió. Podrà sol·licitar la limitació del tractament de les seves dades o, en el seu cas, oposares al tractament de les mateixes. Per exercir els expressats drets podrà fer-ho a través dels següents mitjans: &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;- Per correu postal&lt;/strong&gt;, adjuntant una fotocopia del DNI o document equivalent, dirigit a “Ref. Protecció de Dades”, Ajuntament de Puigpunyent, Carrer Sa Travessía, 37, 07194 Puigpunyent, Illes Balears. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;- Presencialment&lt;/strong&gt;, mitjançant escrit presentat en el Registre General de l'Ajuntament de Puigpunyent, o a través de qualsevol dels mitjans establerts en l'art. 16.4 de la Llei 39/2015. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Per la seu electrònica.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;14.- Legislació supletòria i interpretació de les bases &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;14.1 - En tot allò no previst en les presents bases regirà el que es disposa el Reglament de la Llei General de Subvencions (Reial decret&amp;nbsp;&amp;nbsp;&amp;nbsp; 887/2006,&amp;nbsp; de 21 de juliol).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:0cm; margin-right:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Igualment, li seran aplicables els preceptes bàsics de la Llei 38/2003, de 17 de novembre, General de Subvencions, la Llei 39/2015, de 1 de octubre, del Procediment Administratiu Comú de les Administracions Públiques, i la Llei 40/2015, de 1 d'octubre, de Règim Jurídic del Sector Públic, així com la resta de disposicions legals i reglamentaries que siguin d'aplicació. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:1"&gt;La present autorització s'atorga exclusivament als efectes del reconeixement, seguiment i control dels requisits establerts en el procediment administratiu mencionat anteriorment i en aplicació de lo que disposa l'article 95.1 k) de la Llei 58/2003, General Tributaria, que permet, prèvia autorització de l'interessat, la cessió de les dades tributaries que precisin les Administracions Públiques per el desenvolupament de les seves funciones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
