Aprovar la reorganització del departament de personal que s'adjunta al present acord i les modificacions de la Relació de Llocs de Treball de l'Ajuntament de Palma que figuren a les propostes adjuntes MF-688-689-690-691 relatives a canvis d'adscripció, denominació i funcions de determinats llocs de treball, així com la creació de nous llocs de treball.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Establir com a data d'efectes la del dia següent de la seva aprovació.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:150%"><span style="line-height:150%">3. ( amb la gestió de la relació de llocs de treball).</span></p> </li> </ol> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La modificació a la que s'ha fet referència va implicar l'assumpció de noves tasques per part del lloc de Cap de servei de selecció, provisió i gestió, que va quedar de la següent manera, a més a més de les funcions genèriques de cap de Servei: ( es subratllen les funcions amb que es van incrementar com a conseqüència de la reestructuració):</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">- Redactar i dur a terme els tràmits adients per l'aprovació de les bases de les convocatòries d'accés a la funció pública i de la provisió de llocs de treball relativa al personal municipal que no pertany a l'Àrea delegada de Seguretat Ciutadana., executant els acords adoptats en relació amb les convocatòries d'accés a la funció pública i de provisió de llocs de treball.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Donar suport als òrgans de selecció i valoració en els procediments d'accés a la funció pública i de la provisió de llocs de treball relativa del personal municipal que no pertany a l'Àrea delegada de Seguretat Ciutadana.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">-Dirigir, gestionar i controlar els procediments de gestió de totes les borses de treball del personal municipal que no pertany a l'Àrea delegada de Seguretat Ciutadana.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Mantenir actualitzada la relació de llocs de treball del personal eventual i dels òrgans directius, així com l'estructura orgànica de l'Ajuntament referida al personal municipal que no pertany a l'Àrea delegada de Seguretat Ciutadana.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Dur un seguiment de les incidències generades pels usuaris de les DMS i DMI de Qualitat, així com de les incidències generades pels usuaris del Portal que afectin al seu Servei.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Col·laborar amb l'atenció al públic presencial i per mitjans telemàtics.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Com es pot observar, la modificació del lloc, incloent la gestió de la relació de llocs de treball i la secció de gestió va incrementar les seves funcions en un 50% respecte a les que ja tenia assignades.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Posteriorment, A més s'ha de tenir en compte que des d'agost de l'any 2019, l'Àrea de Seguretat Ciutadana, que fins el moment tenia assumides les competències en matèria de personal, les ha transferides novament a l'àrea de Funció Pública, assumint les competències en matèria de selecció i provisió del col·lectiu de personal policia i del Cos de bombers.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Des de l'aprovació de la modificació a la que s'ha fet referència, s'ha constat que les necessitats organitzatives del departament de Personal han anat canviant i per tal de prestar el servei de la manera més eficaç possible, tenint en compte la complexitat que suposa la gestió de la relació de llocs de treball i la coordinació i control de la negociació sindical i, amb la finalitat de gestionar correctament el nombre de procediments que es porten a terme en la gestió diària del departament, fan necessària la creació d'un nou Servei en el que s'inclogui la gestió de la relació de llocs de treball i la provisió de llocs de treball.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Conseqüència de l'exposat, es proposa la creació del lloc de Cap de servei de selecció i&nbsp; font-size:12px">D'altra banda, l'assumpció de les competències de funció pública en matèria de Seguretat Ciutadana, fan necessari així mateix, una adaptació de la plantilla per tal de recollir la realitat actual a la relació de lloc de treball. En aquest sentit, ja es va aprovar el decret núm. 18.671 de 27 de setembre de 2019, mitjançant el qual es va procedir a la modificació de la dependència orgànica i funcional, de determinats llocs de feina com a conseqüència de l'Acord de Junta de Govern de data 31 de juliol de 2019, publicat al BOIB núm. 109, de 8 d'agost de 2019, de delegació de competències en les regidories de les àrees i àrees delegades.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Dit decret, no es va reflectir a la relació de llocs de treball prèvia la corresponent negociació sindical, per la qual cosa, s'ha de portar a terme la mateixa, per tal de tancar la reorganització pretesa al present informe seguint amb allò establert a la normativa aplicable, concretament allò establert a l'article 91 de la llei 3/2007, de 27 de març, de la Funció Pública de la comunitat autònoma de les Illes Balears, que regula els canvis d'adscripció de llocs de treball concretant que:</span></p> <p><em>“El Consell de Govern, a proposta de la persona titular de la conselleria competent en matèria de funció pública, per reestructuració de l'Administració o per necessitats del servei o funcionals, i a l'efecte d'assignar de manera eficient els recursos humans, pot acordar l'adscripció de llocs de treball i del personal que provisionalment o definitivament els ocupa a unitats, conselleries o ens del sector públic instrumental amb personificació pública, distints d'aquells als quals estava adscrit.</em></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black"><em>2. Els canvis d'adscripció han de respectar en tot cas les retribucions, les condicions essencials de treball i l'illa de residència del personal afectat. Si escau, s'ha de modificar l'adscripció del lloc proveït provisionalment o definitivament per la persona funcionària afectada. “</em></span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Aquest canvi d'adscripció afectarà als següents llocs de feina:</span></p> <ol class="circle"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">F30170021, Cap de departament de l'Àrea de Seguretat Ciutadana que canviarà d'adscripció, passant al departament de personal.</span></p> </li> </ol> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Per tal d'adaptar a la nova estructura i a les noves funcions encomanades, s'ha de portar a terme una adequació del lloc de </span><strong>Cap de departament de RRHH de l'Àrea de Seguretat Ciutadana.</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La denominació d'aquest lloc de treball passarà a ser </span><strong>Cap de departament adjunt de Personal,</strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> </span>de qui dependrà directament la Secció de Gestió de Personal<span style="font-family:&quot;Times New Roman&quot;,Times,serif"> (que&nbsp;
