&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.En data 26 de juliol de 2013 el Ple de la CMAIB acordà atorgar l'autorització ambiental integrada a &lt;span style="color:#000000"&gt;la CT de Formentera&lt;/span&gt;, promoguda per GAS Y ELECTRICIDAD GENERACIÓN SAU, (BOIB núm. 159 de 19/11/2013).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.En compliment de l'art. 10 del Reial Decret Legislatiu 1/2016, de 16 de desembre, el titular d'una instal·lació que pretengui dur a terme una modificació de la mateixa haurà de comunicar-ho a l'òrgan competent per atorgar l'AAI, indicant raonadament, en atenció als criteris descrits a l'esmentat article, si es considera que es tracta d'una modificació substancial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Tramitació&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.En data 25 de juny de 2020 (RE al SAA núm. 737 de 30/06/2020) el Sr. Antonio Cantarellas Fontanet, en nom i representació de GAS Y ELECTRICIDAD GENERACIÓN SAU, sol·licita la modificació no substancial consistent en una nau per als grups electrògens.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.La instal·lació està inclosa a l'annex 1, apartat 1.1.a, del RDL 1/2016, de 16 de desembre pel que s'aprova el text refós de la Llei de prevenció i control integrats de la contaminació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3.En data 30 de juny de 2020 es sol·licita informe sobre aquesta modificació al Consell Insular de Formentera (RS de la CMAiT núm. L30S5083/2020 de 02/07/2020) i al Servei de Transport i Distribució d'energia (RS de la CMAiT núm. 5194 de 06/07/2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.En data 06 de juliol de 2020 es rep plànol de distribució dels grups electrògens dins la nau, per part de GAS Y ELECTRICIDAD GENERACIÓN SAU.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5.En data 06 de juliol de 2020 es rep escrit del Servei de Transport i Distribució d'Energia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6.En data 08 de juliol de 2020 (RS del CIF núm. 2020/4620 de 08/07/2020) es reben informes dels Serveis Tècnics del Departament d'Urbanisme i Ordenació del Territori i dels Serveis Tècnics de Medi Ambient del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7.En data 08 de juliol de 2020 s'emet informe jurídic i tècnic per part del Departament d'Avaluacions Ambientals relatiu a la competència del president de la CMAIB d'atorgar, per raons d'urgència, la modificació no substancial de l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8.En data 09 de juliol de 2020 (RS núm. 200111342154 de 09/07/2020) es rep per part de GAS Y ELECTRICIDAD GENERACIÓN SAU. nova versió del projecte i l'estudi geotècnic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Descripció del projecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Es tracta del PROYECTO DE EJECUCIÓN DE ESTRUCTURA METÁLICA EN&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;CENTRAL DE ENERGÍA SITUADA EN AVENIDA DEL CA MARÍ, 3565. CP – 07871. PLAYA DE MIGJORN. FORMENTERA (ISLAS BALEARES) signat al juny de 2020 per l'arquitecte tècnic Pedro R.de la Peña Benítez.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Com a mesura per tal de minimitzar les emissions de renous a l'exterior per part dels grups electrògens que s'instal·len cada any a l'època estival &lt;/span&gt;&lt;span style="color:#000000"&gt;a la CT Formentera&lt;/span&gt;&lt;span style="color:#000000"&gt;, s'ha projectat la construcció d'una nau envolvent &lt;/span&gt;&lt;span style="color:#000000"&gt;amb una estructura de coberta &lt;/span&gt;&lt;span style="color:#000000"&gt;plana &lt;/span&gt;&lt;span style="color:#000000"&gt;metàl·lica de 1.135,72 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;superfície. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'estructura quedaria instal·lada de forma permanent, malgrat els grups electrògens s'instal·lin només durant una part de l'any, per cobrir la demanda elèctrica a l'illa de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Consideracions tècniques&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Es justifica que es tracta d'una modificació no substancial segons el que estableix l'article 14 del Reial Decret 815/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a.Qualsevol ampliació o modificació que assoleixi, per si sola, els llindars de capacitat establerts, quan n'hi hagi, a l'annex 1, o si ha de ser sotmesa al procediment d'avaluació de l'impacte ambiental d'acord amb la normativa sobre aquesta matèria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Si bé la instal·lació pertany a l'annex 1 del RD 815/2013, la modificació sol·licitada no produeix cap canvi en els llindars de capacitat establerts ni ha de ser sotmesa a procediment d'avaluació d'impacte ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b.Un increment de més del 50% de la capacitat de producció de la instal·lació en unitats de producte o servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La instal·lació d'una nau envoltant per als grups electrògens no suposa en cap moment un augment en la capacitat de producció de la central.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;c.Un increment superior al 50% de les quantitats autoritzades en el consum d'aigua, primeres matèries o energia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La modificació sol·licitada no produirà cap increment en les quantitats autoritzades d'aigua, matèries primeres o energia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;d.Un increment superior al 25% de l'emissió màssica de qualsevol dels contaminants atmosfèrics que figurin en l'autorització ambiental integrada o del total de les emissions atmosfèriques produïdes a cadascun dels focus emissors. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No s'espera cap increment en l'emissió màssica derivat de la modificació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;e.Un increment de l'emissió màssica o de la concentració d'abocaments de qualsevol dels contaminants o del cabal d'abocament que figuri en l'autorització ambiental integrada, així com la introducció de nous contaminants en quantitats significatives. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La modificació sol·licitada no suposarà cap increment en els abocaments de la instal·lació ni la introducció de nous contaminants. f.Un increment de l'emissió màssica superior al 25% o del 25% de la concentració d'abocaments de qualsevol de les substàncies prioritàries d'acord amb la normativa d'aigües o del 25% del cabal d'abocament que figuri en l'autorització ambiental integrada, així com la introducció de noves substàncies prioritàries d'acord amb la normativa d'aigües, quan el seu destí no és el domini públic hidràulic. La modificació sol·licitada no suposarà cap increment en els abocaments de la instal·lació ni la introducció de noves substàncies prioritàries al medi receptor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;g.La incorporació al procés de substàncies o preparats perillosos no previstos en l'autorització original, o el seu increment, sempre que, com a conseqüència d'això, sigui necessari elaborar o revisar l'informe de seguretat o els plans d'emergència que regula el Reial decret 1254/1999, de 16 de juliol, pel qual s'aproven mesures de control dels riscos inherents als accidents greus en què hi intervinguin substàncies perilloses, així com l'increment d'aquells en qualsevol quantitat pel seu ús habitual i continuat en el procés productiu, quan estiguin subjectes a convenis o acords internacionals per a la seva disminució o eliminació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Des del punt de vista de la incorporació o augment de substàncies perilloses pot qualificar-se com una modificació no substancial ja que no es produeix variació ni en les quantitats ni en els tipus de substàncies utilitzades. Per tant, tampoc implicarà elaboració o revisió de l'informe de seguretat o dels plans d'emergència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;h.Un increment en la generació de residus perillosos de més de 10 tones l'any sempre que es produeixi una modificació estructural del procés i un increment de més del 25% del total de residus perillosos generats calculats sobre la quantitat màxima de producció de residus perillosos autoritzada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Pel que fa als residus perillosos, no es generarà cap residus nou ni una modificació estructural del procés i se seguiran tractant tal com s'estableix en la Llei 22/2011 de residus i sòls contaminats i la nova Llei 8/2019 de 19 de febrer, de residus i sòls contaminats de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;i.Un increment en la generació de residus no perillosos de més de 50 tones l'any sempre que representi més del 50% de residus no perillosos, inclosos els residus inerts, calculats sobre la quantitat màxima de producció de residus autoritzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No hi haurà canvis en les quantitats ni en la tipologia dels residus no perillosos generats, i els residus generats en la instal·lació se seguiran tractant tal com s'estableix a la Llei 22/2011 de residus i sòls contaminats i la nova Llei 8/2019 de 19 de febrer, de residus i sòls contaminats de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;j.El canvi en el funcionament d'una instal·lació d'incineració o coincineració de residus dedicada únicament a el tractament de residus no perillosos, que la transformi en una instal·lació que comporti la incineració o coincineració de residus perillosos i que estigui inclosa en l'annex 1, epígraf 5.2. No aplica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;k.Una modificació en el punt d'abocament que impliqui un canvi en la massa d'aigua superficial o subterrània a què va ser autoritzat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Des del punt de vista de la modificació en la massa d'aigua superficial o subterrània, pot qualificar-se com una modificació no substancial ja que no es produeix variació en aquesta massa d'aigua autoritzada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Per tant, es tracta d'una modificació no substancial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. L'escrit de GAS Y ELECTRICIDAD GENERACIÓN SAU. de data 06 de juliol posa de manifest que el projecte de la nau garanteix el compliment de l'AAI vigent pel que fa a immissions acústiques i millora l'apantallament acústic que s'ha muntat fins ara.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. A l'escrit del Servei de Transport i Distribució d'Energia i Generació Tèrmica de 06 de juliol de 2020, ens comuniquen que no tenen competència sobre el tema constructiu i de renous, i ens fan arribar la Resolució sobre l'autorització temporal i provisional per als grups electrògens de Formentera (BOIB núm. 115 de 27 de juny de 2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. L'informe dels Serveis Tècnics de Medi Ambient del Consell Insular de Formentera de 08 de juliol de 2020 és favorable, sempre que es compleixin els següents requisits:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Es refaci el Pla de gestió de residus del projecte de la nau, tal qual s'especifica al punt corresponent de consideracions anteriorment exposat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Aportar estudi geotècnic realitzat, en vistes a un possible anàlisi de les vibracions transmeses al terreny, i si s'escau, es reconsiderin les mesures d'atenuació de vibracions derivades de l'entrada en funcionament dels grups electrògens.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Definir i justificar l'objecte de construcció de la nau, que no és altre que l'atenuació acústica de soroll provinent del funcionament dels grups electrògens, aportant l'estudi d'impacte acústic associat al projecte de construcció de la nau on es comprovi l'eficàcia de l'execució de la nau en l'atenuació dels nivells de soroll emesos pels grups electrògens, que asseguri el compliment de la normativa vigent en matèria d'immissió sonora en les parcel·les veïnals confrontants a la Central.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Presentació d'un mapa de renou corresponent a la petjada acústica generada degut al funcionament dels grups electrògens. Aquesta impremta acústica generada pels grups i atenuada per la construcció de la nau ha de quedar reflectida per garantir la reducció del renou, i es presentarà una vegada finalitzada la construcció de la nau, com a garant del compliment de l'objectiu de construcció de la mateixa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Si s'excedeixen els objectius de qualitat acústica sobre el perímetre de la nova parcel·la industrial que ocupa i amb respecte a les residencials confrontants, així com els nivells d'immissió exterior sobre les façanes dels habitatges més properes, s'haurà de realitzar un apantallament acústic al perímetre de la central que n'asseguri el compliment del nivells d'immissió sonora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;6. L'informe del&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;s Serveis Tècnics del Departament de Territori del&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; Consell &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;Insular &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;de Formentera de &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;08 &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;de juliol&lt;/span&gt; de 2020 fa consideracions en referència al PTI i la Llei 12/2017 LUIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;7. L'informe jurídic i tècnic del Departament d'Avaluacions Ambientals de 08 de juliol de 2020, considera que existeixen raons d'urgència per què s'autoritzi la modificació no substancial de l'AAI de la CT de Formentera consistent en la instal·lació d'una nau envoltant per als grups electrògens.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;8. El Pla de gestió de residus de la nova versió del projecte enviat per GAS Y ELECTRICIDAD GENERACIÓN SAU, en data 09 de juliol de 2020, esmena les deficiències detectades pel Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9. GAS Y ELECTRICIDAD GENERACIÓN SAU fa arribar en data 09 de juliol de 2020, l'Estudi geotècnic al qual fa referència el projecte i que no s'aportava amb la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10. GAS Y ELECTRICIDAD GENERACIÓN SAU ha de presentar, una vegada finalitzada l'obra&lt;/span&gt;&lt;span style="color:#000000"&gt; i&lt;/span&gt;&lt;span style="color:#000000"&gt; quan els grups electrògens estiguin en funcionament, &lt;/span&gt;&lt;span style="color:#000000"&gt;un estudi acústic&lt;/span&gt;&lt;span style="color:#000000"&gt; que permeti analitzar si la construcció de la nau es suficient per tal de &lt;/span&gt;&lt;span style="color:#000000"&gt;complir&lt;/span&gt;&lt;span style="color:#000000"&gt; els nivells de sorolls d'immissió exigits a l'AAI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot l'anterior, i ATÈS &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1.Que GAS Y ELECTRICIDAD GENERACIÓN SAU ha sol·licitat una modificació no substancial de l'AAI consistent en una nau per als grups d'emergència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2.Que la documentació aportada justifica que es tracta d'una modificació no substancial, en compliment de l'art. 14 del Reial Decret 815/2013.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3.Que l'informe jurídic i tècnic del Departament d'Avaluacions Ambientals de 08 de juliol de 2020, considera que existeixen raons d'urgència per què s'autoritzi la modificació no substancial de l'AAI de la CT de Formentera consistent en la instal·lació d'una nau envoltant per als grups electrògens.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4.Que l'article 10.1.d) del Decret 4/2018, de 23 de febrer, estableix que és competència del president de la CMAIB exercir, per raons d'urgència degudament acreditada, les competències que corresponen al Ple de la Comissió de Medi Ambient de les Illes Balears, amb els informes previs tècnic i jurídic, i donar-ne compte posteriorment a l'òrgan col·legiat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5.Que s'han sol·licitat informes als diferents organismes afectats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;ES CONCLOU&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot el que s'ha exposat, i vist l'informe amb proposta de resolució de data 09 de juliol de 2020, dict la següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Resolució&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer.&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;-&lt;/strong&gt; &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;Exercir &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;per raons d'urgència, d'acord amb l'informe tècnic i jurídic de 08 de juliol de 2020 , la &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;compet&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;è&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;nci&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;a&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; que &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;d'acord amb l'article 9.1.a.1 del Decret 4/2018, &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;correspon al Ple de la CMAIB, &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;en relació a l'atorgament de la &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;modificació&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt; no substancial de l &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;l'Autorització Ambiental Integrada de CT &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;de Formentera&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;, &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;consistent en una nau per als grups d'emergència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon.-&lt;/strong&gt; Atorgar la modificació no substancial de l'Autorització Ambiental Integrada de CT de Formentera, consistent en una nau per als grups d'emergència &lt;span style="background-color:#ffffff"&gt;amb subjecció a les següents condicions i/o modificacions a l'AAI:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1- On diu:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Objecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Cada un dels grups electrògens està situat al l'interior d'un contenidor insonoritzat fins 75 dBa a 7 metres a 40&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;o&lt;/sup&gt;C&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Totes les sortides provinents de cada grup electrogen, estan conduïdes a únic focus d'emissió canalitzat (xemeneia),&lt;/span&gt;&lt;span style="color:#000000"&gt; el qual te una altura mínima de 5m i disposa d'un punt de mostreig segons les prescripcions de la norma UNE-EN 15259:2008.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La instal·lació es categoritza dins l'epígraf 1.1.a de l'annex 1 de la Llei 16/2002.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Cada un dels grups electrògens està situat al l'interior d'un contenidor insonoritzat fins 75 dBa a 7 metres a 40&lt;sup&gt;o&lt;/sup&gt;C.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Els grups electrògens estaran situats dins d'una nau d'estructura metàl·lica plana de 1135 m&lt;sup&gt;2&lt;/sup&gt; de superfície, &lt;/span&gt;&lt;span style="color:#000000"&gt;segons el &lt;/span&gt;&lt;span style="color:#000000"&gt;PROYECTO DE EJECUCIÓN DE ESTRUCTURA METÁLICA EN &lt;/span&gt;&lt;span style="color:#000000"&gt;CENTRAL DE ENERGÍA SITUADA EN AVENIDA DEL CA MARÍ, 3565. CP – 07871. PLAYA DE MIGJORN. FORMENTERA (ISLAS BALEARES) signat &lt;/span&gt;&lt;span style="color:#000000"&gt;al&lt;/span&gt;&lt;span style="color:#000000"&gt; juny de 2020 pe&lt;/span&gt;&lt;span style="color:#000000"&gt;r&lt;/span&gt; &lt;span style="color:#000000"&gt;l'arquitecte tècnic Pedro R. de la Peña Benítez.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Totes les sortides provinents de cada grup electrogen, estan conduïdes a únic focus d'emissió canalitzat (xemeneia),&lt;/span&gt;&lt;span style="color:#000000"&gt; el qual te una altura mínima de 5m i disposa d'un punt de mostreig segons les prescripcions de la norma UNE-EN 15259:2008.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La instal·lació es categoritza dins l'epígraf 1.1.a de l'annex 1 de la Llei 16/2002.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2- Incloure a l'apartat 9.3. Contaminació Acústica i Vibracions de l'AAI el següent redactat:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercer.-&lt;/strong&gt; &lt;span style="background-color:#ffffff"&gt;GAS Y ELECTRICIDAD GENERACIÓN SAU &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;presentar&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;à&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;, una vegada finalitzada l'obra&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; i&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; quan els grups electrògens estiguin en funcionament, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;un estudi acústic&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; que permeti analitzar si la construcció de la nau &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;é&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;s suficient per tal de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;complir&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; els nivells de sorolls d'immissió exigits a l'AAI.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quart.-&lt;/strong&gt; &lt;span style="color:#000000"&gt;En compliment de l'article 82 de la Llei 7/2013, de 26 de novembre, de règim jurídic d'instal·lació, accés i exercici d'activitats a les Illes Balears, per a l'inici i exercici de l'activitat, el titular haurà de presentar una declaració responsable d'inici i exercici de l'activitat davant la &lt;/span&gt;&lt;span style="color:#000000"&gt;Comissió de Medi Ambient de les Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt;, acreditativa de les obres realment executades i, si cal, les variacions entre el projecte presentat en la sol·licitud i allò realment executat. La declaració responsable s'haurà d'acompanyar del certificat final d'obra del tècnic director, així com de la resta de documentació enumerada a l'apartat 2 d'aquest article.&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
