&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;Arran de l'aprovació &lt;/span&gt;&lt;span style="color:#000000"&gt;de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, la fórmula de&lt;/span&gt; &lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;'acció concertada, &lt;/span&gt;&lt;span style="color:#000000"&gt;com a &lt;/span&gt;&lt;span style="color:#000000"&gt;figura de col·laboració entre el sector públic i el privat, &lt;/span&gt;&lt;span style="color:#000000"&gt;es postula com la &lt;/span&gt;&lt;span style="color:#000000"&gt;més adequa&lt;/span&gt;&lt;span style="color:#000000"&gt;da&lt;/span&gt;&lt;span style="color:#000000"&gt; als principis que han de regir el sistema de serveis socials. &lt;/span&gt;&lt;span style="color:#000000"&gt;Així doncs, a&lt;/span&gt; &lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;'article 2 d&lt;/span&gt;&lt;span style="color:#000000"&gt;e l'esmentada&lt;/span&gt;&lt;span style="color:#000000"&gt; Llei, es preveu que les administracions competents de les Illes Balears, per complementar el sistema públic i garantir una adequada equitat i qualitat de les prestacions incloses en la cartera de serveis o del servei d'orientació professional, poden encarregar la prestació d'aquests serveis de la seva competència, mitjançant el sistema d'acció concertada, a entitats sense ànim de lucre del tercer sector social, tal com es defineixen en els articles 3 i 4 de la Llei 3/2018, de 29 de maig, del tercer sector d'acció social, o, si escau, a entitats privades, preferentment del tercer sector social, quan existeixin anàlogues condicions d'eficàcia, qualitat i costs, d'acord amb els requisits que estableix aquesta Llei i amb respecte als principis de publicitat, transparència i no-discriminació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;En data&lt;/span&gt;&lt;span style="color:#000000"&gt; 2&lt;/span&gt;&lt;span style="color:#000000"&gt;8&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;setembre&lt;/span&gt;&lt;span style="color:#000000"&gt; de 2020&lt;/span&gt;&lt;span style="color:#000000"&gt;, el &lt;/span&gt;&lt;span style="color:#000000"&gt;cap del Servei d'Infància i Família amb el vist i plau de la &lt;/span&gt;&lt;span style="color:#000000"&gt;director&lt;/span&gt;&lt;span style="color:#000000"&gt;a&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;insu&lt;/span&gt;&lt;span style="color:#000000"&gt;l&lt;/span&gt;&lt;span style="color:#000000"&gt;ar d'Infància i Família, ha e&lt;/span&gt;&lt;span style="color:#000000"&gt;mès&lt;/span&gt;&lt;span style="color:#000000"&gt; el pertinent informe sobre el cost i la necessitat&lt;/span&gt;&lt;span style="color:#000000"&gt; de concertar &lt;/span&gt;&lt;span style="color:#000000"&gt;els &lt;/span&gt;&lt;span style="color:#000000"&gt;següents&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;serveis &lt;/span&gt;&lt;span style="color:#000000"&gt;de programes de mediació i intervenció familiar, &lt;/span&gt;&lt;span style="color:#000000"&gt;inclosos a la &lt;/span&gt;&lt;span style="color:#000000"&gt;Cartera Insular de Serveis Socials i dels Serveis a Menors i Família de Mallorca:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;-P&lt;/span&gt;&lt;span style="color:#000000"&gt;rograma B1: &lt;/span&gt;&lt;span style="color:#000000"&gt;s&lt;/span&gt;&lt;span style="color:#000000"&gt;ervei &lt;/span&gt;&lt;span style="color:#000000"&gt;d'acolliment familiar permanent en família &lt;/span&gt;&lt;span style="color:#000000"&gt;pròpi&lt;/span&gt;&lt;span style="color:#000000"&gt;a, en família externa &lt;/span&gt;&lt;span style="color:#000000"&gt;(NIU)&lt;/span&gt;&lt;span style="color:#000000"&gt;, servei de seguiment preadoptiu i postadoptiu.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- P&lt;/span&gt;&lt;span style="color:#000000"&gt;rograma B2: servei d'intervenció familiar de treball del vincle parental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- P&lt;/span&gt;&lt;span style="color:#000000"&gt;rograma B4: servei d'intervenció familiar en el domicili.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;El Servei Juridicoadministratiu ha emès el corresponent &lt;/span&gt;&lt;span style="color:#000000"&gt;informe jurídic favorable a la seva tramitació. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Fonaments de Dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;La Llei orgànica 1/2007, de 28 de febrer, de reforma de l'Estatut d'Autonomia de les Illes Balears, en especial el seu article 70.8 que estableix que el Consell de Mallorca exerceix les competències pròpies en matèria de tutela, guarda, acolliment familiar i adopció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;2.&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;La Llei 9/2019, de 19 de febrer, de l'atenció i dels drets de la infància i adolescència de les Illes Balears &lt;span style="color:#000000"&gt;(BOIB núm. 26 de 28 de febrer de 2019)&lt;/span&gt;, regula a l'article 73 les competències dels Consells Insulars.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;3. La Llei 8/1997, de 18 de desembre, d'atribució de competències als consells insulars en matèria de tutela, acolliment i adopció de menors.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;4&lt;/strong&gt;. L'Institut Mallorquí d'Afers Socials, com a organisme autònom creat pel Consell de Mallorca, adscrit al Departament de Drets Socials del Consell de Mallorca, és l'organisme que exerceix les competències atribuïdes per qualsevol títol al Consell de Mallorca en matèria de serveis socials i menors, de conformitat a l'article 2 dels Estatuts de l'Institut Mallorquí d'Afers Socials (BOIB núm. 67, de 18 de maig de 2019) aprovat per acord del Ple del Consell de Mallorca de data 11 d'abril de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;5&lt;/strong&gt;. D'acord amb el títol IV de la Llei 9/2019, de 19 de febrer, de l'atenció i dels drets de la infància i adolescència de les Illes Balears es regula el &lt;span style="color:#000000"&gt;conjunt de mesures i actuacions de prevenció, detecció, intervenció i reparació de situacions de risc, de desemparament i de conductes inadaptades o problemes de conducta en què l'infant o l'adolescent o, si n'és el cas, el concebut es pot trobar, tendents a garantir-ne el ple desenvolupament i autonomia personal, així com la integració familiar i social, i promoure'n la inserció en un context social i familiar normalitzat, amb la prevalença, en tot cas, de l'interès superior de la persona menor d'edat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;6&lt;/strong&gt;. La Llei orgànica 1/1996, de 15 de gener, de protecció jurídica del menor (reformada per la Llei orgànica 8/2015, de 22 de juliol i Llei 26/2015, de 28 de juliol, de reforma del sistema de protecció de la infància i la adolescència).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;7.&lt;/strong&gt; L'article 37.k) de la mateixa Llei 4/2009 estableix que correspon als Consells Insulars &lt;span style="color:#000000"&gt;&lt;em&gt;“concertar la gestió de serveis socials, en el seu àmbit territorial, amb entitats públiques o privades,...&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;”.&lt;/span&gt; A l&lt;span style="color:#000000"&gt;'&lt;/span&gt;&lt;span style="color:#000000"&gt;article 89.1 es disposa que &lt;em&gt;“les administracions públiques de les Illes Balears, en l'àmbit de les seves competències, poden organitzar la prestació dels serveis del Catàleg de Prestacions i Serveis Socials de les Illes Balears a través de les fórmules següents: gestió directa, règim de concert previst en aquesta Llei, gestió indirecta en el marc de la normativa de contractació de les administracions públiques i convenis amb entitats sense ànim de lucre&lt;/em&gt;”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.&lt;/strong&gt; La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears (BOIB núm. 146 de 22 de novembre de 2018), regula al Capítol I el «Règim de col·laboració privada en la gestió de serveis socials per a les persones mitjançant l'acció concertada» (en endavant Llei 12/2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9.&lt;/strong&gt; Segons l'article 2.1 de la Llei 12/2018, les administracions competents de les Illes Balears, per complementar el sistema públic i garantir una adequada equitat i qualitat de les prestacions incloses en la cartera de serveis o del servei d'orientació professional, poden encarregar la prestació d'aquests serveis de la seva competència, mitjançant el sistema d'acció concertada, a entitats sense ànim de lucre del tercer sector social, tal com es defineixen en els articles 3 i 4 de la Llei 3/2018, de 29 de maig, del Tercer Sector d'Acció Social, o, si escau, a entitats privades, preferentment del tercer sector social, quan existeixin anàlogues condicions d'eficàcia, qualitat i costs, d'acord amb els requisits que estableix aquesta llei i amb respecte als principis de publicitat, transparència i no-discriminació.&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;A més, d'acord amb l'establert a l'article 2.2 de la Llei 12/2018, s'entén per règim d'acció concertada la prestació per tercers de serveis socials inclosos en la cartera de serveis socials i del servei d'orientació professional recollit en la cartera comuna del Sistema Nacional d'Ocupació, el finançament, l'accés i el control administratiu dels quals són públics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;10.&lt;/strong&gt; &lt;span style="color:#000000"&gt;L'article 4.1 de la Llei 12/2018 estableix que, amb una periodicitat anual, les administracions de les Illes Balears competents en matèria social i d'ocupació, com a part de les competències en planificació, han de fer una previsió de les prestacions i els serveis que pretenen que siguin objecte d'acció concertada, juntament amb una taxació del cost i un informe justificatiu de la mancança de mitjans propis per a la gestió, de la idoneïtat de la modalitat de gestió elegida i de la planificació establerta per dotar-se de mitjans propis per a la gestió directa d'aquestes prestacions o serveis quan sigui previsible que s'hagin de prestar permanentment i, a més, siguin essencials per a l'efectivitat dels drets socials. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. &lt;/strong&gt;El Decret 48/2017, de 27 d'octubre, (BOIB número 132 de 28 d'octubre de 2017) pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials (en endavant Decret 48/2017), la vigència del qual s'ha vist parcialment afectada per la Llei 12/2018 i, en conseqüència, resta en vigor en tot allò que no contradigui ni s'oposi al que disposa aquesta llei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;En Ple del Consell de Mallorca del 13 de juliol de 2017 es dona aprovació definitiva al reglament pel qual s'aprova la Cartera Insular de Serveis Socials i dels Serveis a Menors i Família de Mallorca (BOIB núm. 87, de 18 de juliol de 2017 i correcció d'errades materials publicada BOIB núm. 161, de 30 de desembre de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; L'òrgan competent per aprovar aquesta resolució és la Presidència de l'IMAS, d'acord amb l'article 7.&lt;/span&gt;&lt;span style="color:#000000"&gt;3&lt;/span&gt;&lt;span style="color:#000000"&gt; dels Estatuts de l'IMAS (BOIB núm. 67, de 18 de maig de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14.&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;La Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d'octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;RESOLC,&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Primer.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; APROVAR la previsió dels serveis &lt;/span&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;de programes de mediació i intervenció familiar&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; de la Direcció Insular d'Infància i Família de l'IMAS que s'han de concertar durant el segon semestre de l'any 2020, detallats en l'annex I de la present resolució.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Quart.&lt;/strong&gt; &lt;span style="color:#000000"&gt;P&lt;/span&gt;&lt;span style="color:#000000"&gt;UBLICAR&lt;/span&gt;&lt;span style="color:#000000"&gt; aquesta Resolució en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears, &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;així com&lt;/span&gt;&lt;span style="color:#000000"&gt; a l&lt;/span&gt;&lt;span style="color:#000000"&gt;'apartat de &lt;/span&gt;&lt;span style="color:#000000"&gt;Transparència del &lt;/span&gt;&lt;span style="color:#000000"&gt;web de l'IMAS i a la Seu Electrònica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Aquesta resolució no posa fi a la via administrativa i contra ella es pot interposar, d'acord amb l'article 28.1 dels Estatuts de l'IMAS &lt;span style="color:#000000"&gt;aprovats per Acord del Ple del Consell de Mallorca d'11 d'abril de 2019 &lt;/span&gt;(BOIB núm. 67, de 18 de maig de 2019), recurs d'alçada davant el Consell Executiu del Consell Insular de Mallorca, dins el termini d'un mes, comptador a partir del dia següent al de la notificació de la present resolució.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Contra la desestimació expressa del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors a partir del dia següent al de la notificació de la desestimació de l'esmentat recurs.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Contra la desestimació per silenci del recurs d'alçada podrà interposar-se recurs contenciós administratiu davant el Jutjat Contenciós Administratiu, en qualsevol moment a partir del dia següent a la desestimació presumpta (tres mesos des de la interposició del recurs sense que s'hagi notificat la resolució).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;No obstant l'anterior, es pot exercitar, si n'és el cas, qualsevol altre recurs que s'estimi pertinent.
