font-size:12px">Aprovació de l'oferta pública d'ocupació per a l'exercici de 2020, i <span style="color:black">&nbsp;rectificació d'errors materials, de fet, o aritmètics de la resolució d'alcaldia núm. 2020-1231 de 25.09.2020 que aprovà</span> l'Oferta Pública d'Ocupació per a l'exercici de 2020.</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Emissora: RCS</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Fem públic que per resolució d'alcaldia número 2020-1312, de data 6 d'octubre de 2020, s'ha resolt: «Atès que el passat dia 25.09.2020 mitjançant resolució d'alcaldia núm 2020-1231 es va aprovar&nbsp; l'oferta pública d'ocupació per l'any 2020.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atès que a l'esmentada resolució es va detectar un error&nbsp; material en la transcripció de&nbsp; la part dispositiva de la&nbsp; mateixa.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atès que les Administracions públiques podran rectificar en qualsevol moment d'ofici o a instàncies dels interessats, els errors materials, de fet, o aritmètics existents en els seus actes. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Vist l'informe jurídic emès al respecte per part del TAE assessor jurídic, de data 2.10.2020, el qual es troba incorporat a l'expedient, i que fonamenta el següent:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><em>«FONAMENTS JURÍDICS</em></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><strong>Primer</strong>.- Quant a la interpretació d'error material podem acudir a la jurisprudència del Tribunal Suprem que, entre unes altres, en la seva sentència de 15 de febrer de 2006 indica el següent:</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>«L'error material o de fet es caracteritza per ser ostensible, manifest i indiscutible, implicant, per si solament, l'evidència d'aquest, sense necessitat de majors raonaments, i exterioritzant-se "primera facie" per la seva sola contemplació (enfront del caràcter de qualificació jurídica, seguida d'una declaració basada en ella, que ostenta l'error de dret), per la qual cosa, per poder aplicar el mecanisme procedimental de rectificació d'errors materials o de fet, es requereix que concorrin, en essència, les següents circumstàncies: Que es tracti de simples equivocacions elementals de noms, dates, operacions aritmètiques, o transcripcions de documents, que l'error s'apreciï tenint en compte exclusivament les dades de l'expedient administratiu en el qual s'adverteixi, que sigui patent i clar, sense necessitat d'acudir a interpretacions de normes jurídiques aplicables, que no es procedeixi d'ofici a la revisió d'actes administratius ferms i consentits, que no es produeixi una alteració fonamental en el sentit de l'acte (doncs no existeix error material quan la seva apreciació impliqui un judici valoratiu o exigeixi una operació de qualificació jurídica), que no pateixi la subsistència de l'acte administratiu és a dir, que no generi l'anul·lació o la revocació d'aquest, quan creador de drets subjectius, produint-se un de nou sobre bases diferents i sense les degudes garanties per a l'afectat, doncs l'acte administratiu rectificador ha de mostrar idèntic contingut dispositiu, substantiu i resolutori que l'acte rectificat, sense que pugui l'Administració, sota pretext de la seva potestat rectificatoria d'ofici, encobrir una autèntica revisió, i que s'apliqui amb profund criteri restrictiu».</em></span></p> <p><em style="font-family:&quot;Times New Roman&quot;,Times,serif"><strong>Segon.-&nbsp;</strong> La Legislació aplicable és la següent:</em></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>—<em> </em>Els articles 40 i 109 de la Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.</em></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>—<em> </em>Els articles 21 i 22 de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><strong>Tercer.-&nbsp; </strong>L'error material o de fet es caracteritza per ser ostensible, manifest, indiscutible i evident per si mateix, sense necessitat de majors raonaments, i per exterioritzar-se prima facie per la seva sola contemplació, per la qual cosa, per poder aplicar el mecanisme de la rectificació d'errors materials o de fet requereix que concorrin les següents circumstàncies:</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>1) Que es tracti de simples equivocacions elementals de noms, dates, operacions aritmètiques o<strong> transcripcions de documents</strong>;</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>2) Que l'error s'apreciï havent de compta exclusivament les dades de l'expedient administratiu en el qual s'adverteix;</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>3) Que l'error sigui patent i clar, sense necessitat d'acudir a interpretacions de normes jurídiques aplicables;</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>4) Que no es procedeixi d'ofici a la revisió d'actes administratius ferms i consentits;</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>5) Que no es produeixi una alteració fonamental en el sentit de l'acte (doncs no existeix error material quan la seva apreciació impliqui un judici valoratiu o exigeixi una operació de qualificació jurídica);</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>6) Que no pateixi la subsistència de l'acte administratiu és a dir, que no generi l'anul·lació o la revocació d'aquest, quan creador de drets subjectius, produint-se un de nou sobres basis diferents i sense les degudes garanties per a l'afectat, doncs l'acte administratiu rectificador ha de mostrar idèntic contingut dispositiu, substantiu i resolutori que l'acte rectificat, sense que pugui l'Administració, sota pretext de la seva potestat rectificatoria d'ofici, encobrir una autèntica revisió; i</em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>7) Que s'apliqui amb un profund criteri restrictiu.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><strong>Quart.- </strong>&nbsp;&nbsp;Pel que fa a l'òrgan competent per resoldre&nbsp; en aquest cas el l'alcalde d'acord&nbsp; amb els articles s'ha d'atendre a l'article 21 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local. </em></span></p> <p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif"><em>CONCLUSIONS</em></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>D'acord amb amb l'abans exposat, la documentació&nbsp; obrant a l'expedient de personal municipal de la que s'ha pogut tenir coneixement i accés, i la normativa que és d'aplicació, qui subscriu no veu inconvenient jurídic que l'alcalde aprovi una resolució en el següent sentit: </em></span></p> <p><span style="font-family:Times New Roman,Times,serif;
