BDNS: 499065</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El conseller executiu del Departament de Promoció Econòmica i Desenvolupament Local, en data d'11 de setembre de 2020, ha dictat la següent:</span></p> <p style="text-align:center"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">« Resolució de rectificació d'errada material de la resolució de concessió de subvencions de la convocatòria de subvencions per dur a terme activitats o projectes de participació ciutadana i suport a l'acció voluntària per a l'any 2020</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedents</strong></span></p> <ol> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 26 d'agost de 2020, el conseller executiu del Departament de Promoció Econòmica i Desenvolupament Local va dictar resolució de concessió de la convocatòria de subvencions per dur a terme activitats o projectes de participació ciutadana i suport a l'acció voluntària per a l'any 2020.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;A l'apartat primer de la part dispositiva de la resolució, “Aprovar i concedir la subvenció”, es detallaven les quanties concedides a cada entitat beneficiària, segons les línies de subvenció diferenciades per objecte i per destinatari que establia la convocatòria.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A la línia 1, destinada a projectes de participació d'entitats d'administració local, per una errada material, a les entitats locals de Santa Eugènia, Algaida i Palmanyola,&nbsp; que havien sol·licitat una quantia menor a la quantia màxima a què tenien dret, es va transcriure la quantia màxima establerta a la convocatòria i no la quantia realment concedida.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">No obstant, tenint en compte que la quantia global sol·licitada és menor a la prevista inicialment per a aquesta línia de subvenció, l'errada no afecta les altres entitats locals beneficiàries.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">D'acord amb l'informe de la tècnica jurídica de 9 de setembre de 2020.</span></p> </li> </ol> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fonaments de dret</strong></span></p> <ol style="list-style-type:upper-roman"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. (BOE núm. 236, de 02/10/2015)&nbsp;Art. 109.2&nbsp; «Les administracions públiques podran, així mateix, rectificar en qualsevol moment, d'ofici o a instàncies dels interessats, els errors materials, de fet o aritmètics existents en els seus actes»</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ordenança general de subvencions del Consell de Mallorca, aprovada pel Ple del Consell en sessió de dia 23 de desembre de 2016 (BOIB núm. 21, de 18 de febrer de 2017), en la qual s'estableix la regulació de les subvencions que atorgui la corporació.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Convocatòria de subvencions per dur a terme activitats o projectes de participació ciutadana i suport a l'acció voluntària per a l'any 2020, aprovada per resolució del conseller de Promoció Econòmica i Desenvolupament Local, de data 3 de març de 2020 (BOIB núm. 34, de 14 de març de 2020) i modificada per resolució d'1 de juny de 2020 (BOIB núm. 103 de 6 de juny de 2020).</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El conseller executiu és l'òrgan competent per dictar la resolució d'esmena d'errada material de conformitat amb el Decret de la presidenta del Consell de Mallorca, de dia 9 de desembre de 2019, pel qual es determina l'organització del Consell Insular, modificat pel decret de dia 6 de març de 2020, pel decret de dia 22 de maig de 2020 i pel decret de dia 9 de juliol de 2020. Article 1 Atribucions genèriques dels consellers executius i de les conselleres, apartat k) « Les facultats que dimanen de la Llei de règim jurídic de les administracions públiques i del procediment administratiu comú sobre inici i ordenació del procediment, facultats que, en particular, es concreten en les següents: ampliar terminis per resoldre, aplicar la tramitació d'urgència, fer requeriments d'esmena i millora de la sol·licitud d'iniciació i assenyalar tràmits que s'han de dur a terme.
