font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Fent ús de les facultats concedides pels articles 133.2 i 142 de la Constitució i per l'article 106 de la llei 7/1985, de 2 d'abril, reguladora de les bases de Règim Local, i de conformitat amb el que disposen els articles 15 a 19 del Real Decret Legislatiu 2/2004, de 5 de març, pel que s'aprova el text refós de la llei reguladora de les hisendes locals, aquest ajuntament estableix la taxa d'expedició de documents administratius, que se regirà per aquesta ordenança fiscal, normes de la qual atenen el que preveu l'article 57 del citat RDL 2/2004, de 5 de març.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 2n</span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">&nbsp;Fet imposable.</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.- Constitueix el fet imposable de la taxa, l'activitat administrativa desenvolupada amb motiu de la tramitació, a instància de part, de tota classe de documents que expedeixi&nbsp; i d'expedients que realitzi l'Administració o les Autoritats Municipals.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.- A aquests efectes, s'entendrà tramitat a instància de part, qualsevol documentació administrativa que hagi estat provocada per la persona particular o redundi en el seu benefici malgrat no hagi mediat sol·licitud expressa de la persona interessada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3.- No estarà subjecte a aquesta Taxa la tramitació de documents i expedients necessaris per al compliment&nbsp; d'obligacions fiscals, així com les consultes tributàries, els expedients de devolució d'ingressos indeguts, els recursos administratius contra les resolucions municipals de qualsevol índole i els relatius a la prestació de serveis o realització d'activitats de competència municipal i a la utilització privativa o l'aprofitament especial de béns del domini públic municipal, els quals estan gravats per una altra Taxa Municipal o pels que s'exigeixi un preu públic per aquest Ajuntament.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Article 3r</span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Subjecte passiu. </span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Són subjectes passius contribuents les persones físiques i jurídiques i les entitats a les quals fa referència l'article 33.4 de la Llei General Tributària que sol·licitin, provoquin o en interès del qual redundi la tramitació del document o expedient de què es tracti.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Responsable.</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.- Respondran solidàriament de les obligacions tributàries del subjecte passiu les persones físiques i jurídiques a les quals fan referència l'article 42 de la Llei General Tributària.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.- Seran responsables subsidiaris les persones responsables de l'administració de les societats, Sindicatura, Intervenció o Liquidació de pèrdues, concursos, societats i entitats en general, en els suposats i amb l'assoliment que assenyala l'article 43 de la Llei General Tributària.</span></span></span></p> <p style="margin-bottom:0px; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1.- La quota tributària es determinarà per una quantitat assenyalada segons la naturalesa dels documents o expedients a tramitar, d'acord amb la tarifa que conté l'article següent.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.- La quota de tarifa correspon a la tramitació completa, en cada instància, del document o expedient de què es tracti , des del seu inici fins a la seva resolució final, inclosa la certificació i notificació a l'interessat de l'acord recaigut. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3.- Les quotes resultants per aplicació de les tarifes anteriors s'incrementaran un 50 per 100 quan les persones interessades sol·licitin amb caràcter d'urgència la tramitació dels expedients que motivin el dret a percebre.</span></span></span></p> <p style="margin-bottom:0px; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.- En els casos als quals fa referència el número 2 de l'article 2n, el dret a percebre es produeix quan tenguin lloc les circumstàncies que proveeixin l'actuació municipal d'ofici o quan aquesta s'iniciï sense prèvia sol·licitud de l'interessat però redundi en el seu benefici.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2.- Els escrits rebuts pels conductes als quals fa referència l'article 66 de la Llei de Procediment Administratiu, que no venguin degudament reintegrats, seran admesos provisionalment, però no es podrà donar-los curs sense que s'esmeni la deficiència, a fi del qual es requeria a la persona interessada perquè, en el termini de deu dies aboni les quotes corresponents amb l'apercebiment que, transcorregut l'esmentat termini sense efectuar-lo, es tindran els escrits per no presentats i serà arxivada la sol·licitud.</span></span></span></p> <p style="margin-bottom:0px; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En tot el relatiu a la qualificació d'infraccions tributàries, així com de sancions que a les mateixes corresponguin en cada cas, s'estarà al disposat a la Llei General Tributària. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
