    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de 17 d'agost&amp;nbsp;de 2020, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;1.En data de 16 de juliol de 2015, es va publicar en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries. &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185), en data 22 de juny de 2016, (BOIB núm. 81) &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;i 26 de juny de 2018 (BOIB núm. 80)&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;2.En data 7 de maig de 2019, es resol favorablement la concessió de l'ajuda a favor de Francina dels Àngels Mateu Juan (R24). Publicat en el BOIB núm. 72, de 30 de maig del 2019. Amb una inversió aprovada de 104.116,50 €.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Dins el termini legalment establert, la persona interessada presenta la sol·licitud de pagament, informant d'una inversió per valor de 77.032,50 € (49.507,50 € en tancaments, solera de formigó i mur; 27.525,00 € en barreres metàl·liques).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.El 6 de setembre de 2019, s'emet l'Informe / Proposta provisional de resolució d'exclusió i de revocació total, en base a l'Informe de moderació de costs emès pel tècnic gestor de la línia en què proposa com a preus de mercat: 25.556,65 € per les partides de tancaments, solera de formigó i mur; i 13.047,50 € per a les partides de barreres metàl·liques, que s'adjunta com a annex d'aquest Informe/Proposta provisional de resolució d'exclusió i de revocació total.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.L'Informe/proposta provisional de resolució esmentat dicta la revocació total de l'ajuda i&amp;nbsp;l'exclusió de la mesura 4.1, Inversions a les explotacions agràries per incompliment de compromisos bàsics avaluables, d'acord amb el que preveu l'apartat 2.3 de l'annex VIII de la convocatòria abans esmentada. La diferència entre els preus justificats i els de mercat denota incompliment greu, falsedat, i demostra intencionalitat i negligència en el compliment dels compromisos bàsics, amés, tenint en compte els preus de mercat de les inversions justificades, no es demostra la realització del 50 % de l'import d'inversió aprovat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.En data 24 de setembre de 2019, Francina dels Àngels Mateu Juan presenta al·legacions a l'Informe/Proposta provisional de resolució d'exclusió i de revocació total de 6 de setembre del 2019, en què manifesta que en el pressupost sol·licitat s'inclouen els conceptes de transport i col·locació de les barreres, ara bé, una vegada revisat el pressupost presentat es comprova que no es varen sol·licitar aquests conceptes de manera específica. Per tant, no es va concedir cap ajuda pel transport i la col·locació de les barreres, únicament per la compra d'aquestes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.En data 30 de setembre de 2019, es publica al web del FOGAIBA l'Informe/proposta provisional de resolució d'exclusió i revocació.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.En data de 25 d'octubre de 2019, presenta al·legacions, justificant els sobrecost de l'execució de les obres.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.En data de 22 de juny de 2020, es va realitzar una visita ocular i es va comprovar que efectivament existeix una orografia que dificulta i encareix els treballs de tancament i de col·locació de barreres executats.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10.Per aquest motiu, es reformula la moderació de cost, incorporant aquest nous criteris a tenir en compte, resultant una minoració de l'ajuda a la que establien les primeres moderacions, i per tant no essent necessària cap exclusió ja que és justifica quasi tot l'executat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;11. L'article 43 del Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;12. El 20 de juliol de 2020, es notifica a la beneficiària, mitjançant la publicació al web del FOGAIBA l'Informe/proposta provisional de revocació parcial de dia 13 de juliol de 2020, per la qual es revoquen 26.392,20 €, atès l'Informe de moderació de costs de dia 13 de juliol de 2020 que &lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;fixa en una minoració de 16.903,00 € la valoració de la inversió realitzada, el valor de mercat del producte és inferior a l'import que s'ha justificat. Amés, no es dur a terme la inversió de recol·lectora de fruits secs (27.084,00)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. Una vegada transcorreguts els 10 dies hàbils, la persona interessada no ha presentat cap al·legació.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;em&gt;13. S'ha considerat l'Infome/proposta provisional de resolució de 13 de juliol de 2020, de revocació parcial de l'ajuda concedida a Francina dels Àngels Mateu Juan, amb NIF ***1905**.&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/span&gt;&lt;em&gt;Resolució de 10 de juliol de 2015 del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries modificada mitjançant les resolucions de 17 de desembre de 2015, 22 de juny de 2016 i 26 de juny de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3.
