    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-top:6,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;L'apartat 8.4. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) d' 1 de febrer&amp;nbsp;de 2018&amp;nbsp;per la qual s'aprova la convocatòria de les ajudes, per al foment de l'agricultura ecològica, per l'any 2018&amp;nbsp;especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques . &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresident en matèria agrària del FOGAIBA, en data 25&amp;nbsp;d'agost&amp;nbsp;de 2020, va signar la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.En data 26 de febrer de 2015, es va publicar en el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.En data 1 de febrer de 2018 es va publicar, en el BOIB núm. 15, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per a l'any 2018 de les ajudes destinades al Foment de l'Agricultura Ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.En data 13 de desembre de 2018 es va publicar, en el BOIB núm. 156, una modificació de la Resolució citada anteriorment per la qual es modifiquen els crèdits i els cofinançaments.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.En data 24 d'agost de 2019 es va publicar, en el BOIB núm. 166, una resolució de denegació als interessats assenyalats a l'&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Annex I per no complir els requisits exigits per poder ser beneficiaris d'aquesta ajuda. .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.A un dels interessats, el senyor Jaume Seguí Colomar &amp;nbsp;amb DNI &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;8155&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**, li varen denegar la sol·licitud d'ajuda per no estar inscrit en el CBPAE, d'acord amb l'escrit del CBPAE de data 31 d'octubre de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-right:-14,3000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;7.En data 22 d'abril de 2020, el CBPAE, ens informa que donat a una errada administrativa, aquest expedient aquest titular Si que estava inscrit.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,0000pt; margin-right:-14,3000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;8.En data 15 de maig de 2020, es publica en la pagina web del FOGAIBA la proposta de modificació de la resolució de denegació del vicepresident de dia 24 d'agost de 2019.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17.Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;BOIB núm. 082 de 2007&lt;/em&gt;&lt;/span&gt;&lt;em&gt;; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;18.Llei 39/2015, d'1 d'octubre, de Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;D'acord amb l'article&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de la&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;Llei 39/2015,&amp;nbsp;d'1 d'octubre, del procediment administratiu comú, les administracions públiques podran rectificar en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,9500pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Concedir l'ajuda sol·licitada al senyor &amp;nbsp;Jaume Seguí Colomar &amp;nbsp;amb DNI ***8155** pels imports i amb els terminis detallats a l'Annex I, , que suma un import total (3anys) de &amp;nbsp;TRES MIL &amp;nbsp;TRES-CENTS SEIXANTA-SIS EUROS AMB SETANTA-NOU CENTIMS(3.366,79€), relativa a la línia d'ajudes “Foment de l'Agricultura Ecològica. AECU 2018”, amb càrrec al pressupost del FOGAIBA i finançat amb el Fons per afavorir el Turisme Sostenible de l'any 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,9500pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Autoritzar i disposar la despesa assenyalada al beneficiaris amb càrrec als pressuposts i percentatges de cofinançament detallats a l'Annex I . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,9500pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Determinar la superfície compromesa per beneficiari i grup de cultiu detallats a l' Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:0,9500pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Determinar que, d'acord amb el que estableix la convocatòria de referència, les obligacions dels beneficiaris seran les indicades a l'Annex II.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Mantenir sense disminuir la superfície compromesa a nivell de grup de cultiu, independentment que pugui variar la ubicació del cultiu dins de les parcel·les que integren l'explotació agrària o dels canvis de les parcel·les on s'ubica el conreu. Aquest compromís es considera complit amb una tolerància màxima de disminució de la superfície compromesa de 0,1 ha en grups de cultiu que tenguin fins a 0,5 has de superfície compromesa i un 10% en aquells de més de 0,5 has de superfície compromesa.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Complir a les parcel·les el que estableixen les normes genèriques i específiques de cada cultiu sobre producció ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Mantenir i actualitzar el quadern d'explotació específic per a l'agricultura ecològica on s'inscriuran operacions de cultiu i actuacions realitzades ( adob, fitosanitaris, conreu, etc) a cada una de les parcel·les ( o grup de parcel·les en cas de ser el mateix cultiu), amb indicació de la data de realització i les incidències, si n'hi hagués.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Participar, durant el període de compromís, en activitats de formació relacionades amb l'agricultura ecològica. Per això, haurà de justificar l'assistència a algun curs o activitat de formació tècnica, relacionats amb la matèria, d'un mínim de 25 hores.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Sotmetre's a les actuacions de comprovació i de control que siguin procedents de l'Administració autonòmica, estatal i comunitària, la Sindicatura de comptes o altres òrgans de control extern, necessaris per comprovar la correcta concessió de l'ajuda i el posterior manteniment dels compromisos.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Complir, a la seva explotació, els requisits legals de gestió, així com les bones condicions agràries i mediambientals establertes en els articles 91, 92, 93, 94 i 95 del Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Mantenir els requisits &amp;nbsp;i condicions exigibles &amp;nbsp;respecte a l'explotació i a la persona beneficiària.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Els beneficiaris es comprometen i obliguen, durant un període de 5 anys, inclòs el de la sol·licitud d'ajuda, a estar inscrits en el registre d'operadors del consell Balear de la Producció Agrària Ecològica (CBPAE) com a titulars de les parcel·les inscrites.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- S'informa als beneficiaris que els seus expedients es troben a la seva disposició i consulta al Servei d'Ajudes al Desenvolupament Rural del FOGAIBA (carrer de Reina Constança, núm. 4 de Palma).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
