&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;19&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;d&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;'agost&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;de 2020, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;En data de 30/04/2016 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 54, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) que modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de 10 de setembre de 2015, per la qual es convoquen, per als anys 2015 a 2019, subvencions per a la creació d'empreses de joves agricultors.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:18,0000pt; margin-right:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;2.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Es va dictar la Resolució de concessió (de 12 de juny de 2019) del expedient CEJA 2018/113, a nom de Rafael Adrover Pons, que es va publicar al BOIB núm. 85, de 27 de juny de 2019.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;3.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;El sol·licitant indicat anteriorment va sol·licitar el desistiment de l'ajuda concedida, amb data 23 de juliol de 2020.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;4.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;L'article 21.1 de la Llei 39/2015, de 1 d'octubre, del procediment administratiu comú de les administracions públiques estableix l'obligació de l'Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l'objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; margin-left:0,0000pt; margin-right:0,0000pt; margin-top:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;5.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Atès tot això, s'informa favorablement i es proposa acceptar el desistiment i fer la revocació total de l'ajuda. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant la consellera de Medi Ambient, Agricultura i &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Pesca&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015 del Procediment Administratiu Comú de les Administracions Públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
