    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) &lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="color:#212121"&gt;de 10 de juliol de 2015, per la qual es convoquen subvencions per a inversions a les explotacions agràries,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#212121"&gt;&amp;nbsp;corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la publicació al &lt;/span&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;&lt;em&gt;Butlletí&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&amp;nbsp;&lt;em&gt;&lt;span style="color:#212121"&gt;&lt;em&gt;Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#212121"&gt;, d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;span style="color:#212121"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresidenten matèria agrària del FOGAIBA, en data 18 d'agost&amp;nbsp;de 2020, va signar la Resolució següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Antecedents&amp;nbsp;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;1. El 16 de juliol de 2015 es va publicar en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2016 (BOIB núm. 185), de 22 de juny de 2016 (BOIB núm. 81) i de 26 de juny de 2018 (BOIB núm. 80).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;2. El 23 d'octubre de 2019, el vicepresident del FOGAIBA va dictar una Resolució de concessió d'ajudes per a inversions a les explotacions agràries (R47), que es va publicar al Butlletí Oficial de les Illes Balears número 153, de 9 de novembre de 2019, en la qual hi figurava una concessió a favor de Delia Ungureanu, amb NIF ***7942**, amb un import d'ajuda concedida de 29.828,25 €, amb un finançament 100 % de la CAIB i un termini de 6 mesos, amb número d'expedient INEA 2017_1/343.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;3. Atesa la resolució de concessió de l'ajuda esmentada i, d'acord amb el que estableix l'apartat desè de la convocatòria abans esmentada, la persona beneficiària s'obliga, entre d'altres, a realitzar les inversions o activitats auxiliades en el termini establert. Això és, la data de notificació mitjançant el BOIB va ser el 9 de novembre de 2019, amb un termini de 6 mesos, per tant el termini per justificar la inversió realitzada, finalitzava el 9 de maig de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;em&gt;4.Una vegada finalitzat el termini abans esmentat, el beneficiari no ha presentat la sol·licitud de pagament (annex II) ni ha justificat la despesa relacionada amb les inversions dins de la data límit, que figura en l'annex I, per la qual cosa les inversions no poden ser objecte de subvenció per no haver estat realitzades, pagades i notificades pel beneficiari en el termini legalment establert.&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. Atès això, el 29 de juny de 2020 es va publicar al web del FOGAIBA el requeriment perquè presentés en el termini de 15 dies hàbils la sol·licitud de pagament corresponent, d'acord amb l'article 70.3 del Reglament de la Llei de subvencions, aprovat pel Reial decret 887/2006, de 21 de juliol.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. El termini per presentar la documentació requerida (això és la sol·licitud de pagament) va finalitzar el 20 de juliol de 2020. El 21 de juliol de 2020 (atès que el dia 20 era festa a Sa Pobla) va presentar un escrit amb RGE núm. 17626 (no la sol·licitud model) mitjançant el qual sol·licitava el pagament, sense cap document justificatiu.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. Posteriorment, el 27 de juliol de 2020, amb RGE núm. 17884, la persona interessada va presentar el seu desistiment de l'ajuda concedida, ja que la inversió realitzada no arriba al 50 % del total.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;8. &lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Correspon acceptar per complet el desistiment i declarar conclús el procediment.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;9. L'acceptació del desistiment de la sol·licitud d'ajuda ja concedida comporta la revocació de l'import concedit, detallat en l'annex «Imports que s'han de revocar».&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;Fonaments de dret&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;1. Resolució de 10 de juliol de 2015 del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries modificada mitjançant les resolucions de 17 de desembre de 2015, 22 de juny de 2016 i 26 de juny de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;2. Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;3. Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;em&gt;Per tot això, s'informa favorablement i es proposa al vicepresident en matèria agrària del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;1.Acceptar el desistiment de la sol·licitud d'ajuda detallada en l'annex d'aquesta resolució, que conté un total d'1 expedient que comença i acaba amb Delia Ungureanu&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;2.Revocar la ajuda concedida en la resolució del vicepresident del FOGAIBA de 23 d'octubre de 2019 (R47), corresponent a l'expedient INEA2017_1/343 i per l'import indicat en l'annex d'aquesta resolució.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;3.Declarar conclòs el procediment i arxivar l'expedient.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;em&gt;&lt;em&gt;4.Notificar aquesta Resolució a la persona interessada, mitjançant la publicació en el Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant la consellera d'Agricultura, Pesca i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i l'a&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;rticle 68.1 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
