2020-06-29 230 21087 CAIB 635932 21088 ca ![CDATA[<p><strong>Antecedents</strong></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1.- El dia 18 de juny de 2020 es va publicar en el BOIB núm. 110 la Resolució del director general del Servei de Salut de les Illes Balears de 15 de juny de 2020 per la què s'aproven les llistes definitives de persones candidates i de persones excloses del concurs de trasllats voluntari per proveir places bàsiques vacants de la categoria de facultatiu/facultativa especialista d'àrea de medicina intensiva</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2.- S'han apreciat errors en la mencionada resolució que s'han de corregir.</span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><strong>Fonaments de dret</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. L'article 109.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú estableix que les administracions públiques poden rectificar, així mateix, en qualsevol moment, d'ofici o a instància dels interessats, els errors materials, de fet o aritmètics existents en els seus actes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. L'article 56 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears disposa que la revocació dels actes de gravamen o desfavorables i la rectificació dels errors materials, aritmètics i de fet en actes i disposicions administratives correspon a l'òrgan que ha dictat l'acte o la disposició</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Per tot això dict la següent</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong>Resolució</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">1. Rectificar els errors de la Resolució del director general del Servei de Salut de les Illes Balears de de 15 de juny de 2020 per la què s'aproven les llistes definitives de persones candidates i de persones excloses del concurs de trasllats voluntari per proveir places bàsiques vacants de la categoria de facultatiu/facultativa especialista d'àrea de medicina intensiva.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">2. Publicar aquesta resolució en el <em>Butlletí Oficial de les Illes Balears</em> i en el portal web <em>www.ibsalut.es</em></span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm"><strong>Interposició de recursos</strong></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">Contra aquesta resolució, que esgota la via administrativa, pot interposar-se un recurs de reposició davant l'òrgan que la dicta en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, en relació amb l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.</span></span></p> <p style="margin-bottom:10pt; margin-left:0cm; margin-right:0cm; margin-top:0cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal">També pot presentar-se directament un recurs contenciós-administratiu davant qualsevol dels jutjats contenciosos administratius de Palma en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb els articles 8.2 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.</span></span></p> <p style="margin-bottom:10pt;
