TRANSPARÈNCIA</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">ANNEX: objectius específics, programes i línies d'ajuda</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">1.- INTRODUCCIÓ</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">1.1- CONSIDERACIONS PRÈVIES</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ajuntament de Sant Josep de sa Talaia ha considerat oportú aprovar un Pla estratègic de subvencions per al període 2020-2022 incrementant en un any l'estratègia prevista en l'anterior, passant d'una previsió per a dos anys a un Pla estratègic amb una previsió de tres anys, tal com ve establert a l'article 11 de RD 887/2006, de 21 de juliol, pel qual s'aprova el reglament de la Llei general de subvencions (en endavant RLGS). Aquest canvi permetrà un desenvolupament més dinàmic i eficient de les subvencions que l'integren. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El règim de seguiment i avaluació continu permetrà, amb l'ús dels indicadors, conèixer l'estat de la situació i dels progressos aconseguits en el compliment dels objectius respectius. En aquest sentit, el Pla ha de permetre que aquelles línies de subvencions que no assoleixin el nivell de consecució d'objectius desitjat puguin ser modificades o substituïdes per altres de més eficaces o eficients o, si fos el cas, eliminar-les.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">La legislació vigent en matèria de subvencions, Llei 38/2003, de 17 de novembre, general de subvencions (d'ara endavant, LGS), i Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el seu reglament (d'ara endavant, RLGS), té com a objectiu que l'activitat pública, tradicionalment coneguda com de foment i promoció, es desenvolupi dins els paràmetres que la mateixa llei imposa, establint els mecanismes de control previ i avaluació posterior i sotmetent aquesta activitat als principis de:</span></span></p> <ul> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Publicitat, transparència, concurrència, objectivitat, igualtat i no discriminació.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Eficàcia en el compliment dels objectius fixats per l'Administració atorgant.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Control de la discrecionalitat administrativa.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Eficiència en l'assignació i utilització dels recursos públics.</span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Per això, la llei introdueix la necessitat d'elaborar en cada administració un pla estratègic de subvencions que permeti relacionar els objectius a assolir i efectes que es pretenen aconseguir, amb els costos previstos i el seu finançament, amb l'objecte d'adequar amb caràcter previ a la concessió, les necessitats públiques que es pretén cobrir mitjançant les subvencions amb els recursos disponibles. Una major informació sobre les subvencions facilita la complementarietat i coherència de les actuacions de les diferents administracions públiques, evitant qualsevol tipus de solapament.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">En virtut de la potestat de programació o planificació atribuïda a les entitats locals per l'art. 4<em>c</em> de la Llei 7/1985 RBRL, s'ha elaborat el present Pla estratègic, amb la participació de totes les àrees, centres de gestió i unitats administratives responsables de la gestió de subvencions de l'Ajuntament de Sant Josep de sa Talaia.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">1.2- NATURALESA JURÍDICA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El Pla estratègic de subvencions es configura com un instrument de gestió de caràcter programàtic, de planificació, que no té caràcter normatiu i el seu contengut no crea drets ni obligacions, no suposa una incidència directa a l'esfera dels particulars, ni genera drets ni obligacions per a l'Administració.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El Pla estratègic no suposa la generació de cap dret a favor dels potencials beneficiaris, que no podran exigir indemnització o compensació en cas que el Pla no es porti a la pràctica. El Pla es presenta com una guia que, dins el marc normatiu preestablert, marca la pauta a seguir en la línia de foment d'activitats d'interès general. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">L'establiment de subvencions queda supeditat al compliment dels objectius d'estabilitat pressupostària, de manera que les consignacions pressupostàries que s'aprovin i les bases reguladores de la concessió s'han d'acomodar en cada moment a aquests objectius.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'efectivitat del pla queda supeditada a l'aprovació de les bases reguladores i les convocatòries, tant per al cas de subvencions amb concurrència competitiva i no competitiva com per al cas de subvencions directes concedides a través d'acord, decret, resolució o conveni, i per descomptat a les disponibilitats pressupostàries en cada exercici d'execució.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">1.3- COMPETÈNCIA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'òrgan competent per a l'aprovació del Pla estratègic de subvencions és el Ple Municipal, atès que es tracta d'un instrument de planificació estratègica de l'activitat subvencional o de foment i de gestió econòmica, d'acord amb el que preveu l'article 22.2<em>e</em> de la Llei de bases de règim local. No obstant això, els òrgans competents per concedir les subvencions seran la Junta de Govern Local, l'alcalde i, en el seu cas, les Regidories delegades.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">1.4- ÀMBIT SUBJECTIU</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">El present Pla estratègic de subvencions inclou totes les subvencions concedides directament per aquest Ajuntament.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">1.5 VIGÈNCIA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">L'àmbit temporal del present Pla estratègic de subvencions serà triennal, ja que s'hi inclouen les subvencions previstes per als anys 2020, 2021 i 2022 i quedarà prorrogat fins a l'aprovació del següent pla.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">2.- ASPECTES ESTRATÈGICS DEL PLA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">2.1.- PRINCIPIS</span></strong></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:#222222">a</span></em><span style="color:#222222">) <strong>Publicitat i lliure concurrència</strong> mitjançant convocatòria prèvia en la qual es garanteixi la concurrència i igualtat en la distribució de fons públics, <strong>sens p</strong><strong>erjudici de la possible concessió directa</strong> que, de conformitat amb el que estableix la norma aplicable, haurà de comptar amb les degudes disponibilitats pressupostàries, amb caràcter previ.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:#222222">b</span></em><span style="color:#222222">) <strong>Objectivitat</strong> en el procés d'assignació de fons públics. La subvenció es concedirà d'acord amb criteris objectius prèviament establerts a la convocatòria per tal de garantir-ne el coneixement previ pels potencials beneficiaris.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:#222222">c</span></em><span style="color:#222222">) <strong>Igualtat i no discriminació</strong> entre la ciutadania, entre els diferents sectors i entre els col·lectius.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:#222222">d</span></em><span style="color:#222222">) <strong>Transparència</strong> en el procés d'assignació de recursos públics, tant en el procés de concessió, com en la publicació dels resultats.</span></span></p> <p style="margin-bottom:0px; font-size:12px"><strong><span style="color:#222222">2.2.- OBJECTIUS</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Són objectius generals del present Pla estratègic els següents:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:#222222">b</span></em><span style="color:#222222">) <strong>Establir i normalitzar els principis i bases d'execució comuns a totes les subvencions</strong>, incrementant els nivells d'eficàcia i eficiència en la gestió de la despesa pública subvencional.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:#222222">c</span></em><span style="color:#222222">) <strong>Optimitzar l'accés dels ciutadans al fet subvencional </strong>amb garanties de transparència, uniformitat de criteri municipal i de lliure concurrència, facilitant als ciutadans totes les dades, quanties, objectius, criteris i procediments per poder ser beneficiari de subvencions.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:#222222">d</span></em><span style="color:#222222">) <strong>Racionalitzar</strong> la gestió municipal de les subvencions <strong>amb la valoració dels aspectes de transversalitat, eficàcia i eficiència en la gestió de les diferents línies d'ajudes.</strong></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:#222222">e</span></em><span style="color:#222222">) <strong>Impulsar la simplificació administrativa i la transparència</strong>.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">3.- CONTENGUT DEL PLA</span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A l'annex es desglossa l'activitat de l'Ajuntament de Sant Josep de sa Talaia, establint les diferents línies de subvenció, l'import màxim, les partides pressupostàries assignades, els objectius i efectes, el termini per a la seua consecució i els destinataris. </span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:#222222">4.- BENEFICIARIS </span></strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#222222">Les subvencions es concediran en els termes i amb l'amplitud que estableix l'art. 11 de la LGS per als beneficiaris, mitjançant convocatòria pública o mitjançant concessió directa, o per la signatura de convenis de col·laboració, a favor de persones físiques o jurídiques, públiques o privades, comunitat de béns o qualsevol altre tipus d'unitat econòmica o patrimoni separat que, encara mancant de personalitat jurídica, pugui dur a terme els projectes, activitats o comportaments que es trobin en la situació que motiva la subvenció.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5.- GESTIÓ I EFICÀCIA</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per a la consecució dels objectius és necessari que cada àrea, centre de gestió, unitat administrativa o organisme depenent sigui qui gestioni en el seu àmbit la concessió de les subvencions en els termes que s'assenyalen a la LGS, i correspon a Intervenció Municipal la fiscalització, la qual cosa comporta la necessitat de coordinar les accions.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.- COSTOS PREVISIBLES I FINANÇAMENT</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Prèviament a la concessió de qualsevol tipus de subvenció es tramitarà l'autorització de la despesa corresponent. No podran atorgar-se subvencions per quantia superior a la que es determini pressupostàriament. Els crèdits pressupostaris tenen caràcter limitador i vinculant, per la qual cosa no es podran adquirir compromisos de despeses superiors al seu import.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7.- CONTROL I SEGUIMENT DEL PLA ESTRATÈGIC</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El control i seguiment del present Pla estratègic es realitzarà de forma anual, en dos aspectes.</span></p> <ol style="list-style-type:lower-alpha"> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Control econòmic i financer </strong>de les subvencions concedides. Està encomanat a la Intervenció General de l'Ajuntament de Sant Josep de sa Talaia, i es realitzarà en les condicions recollides a la legislació vigent.</span></p> </li> <li> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Control i seguiment del Pla</strong>. S'encomana a la Junta de Govern Local. Per això, cada una de les àrees, centre de gestió, unitat administrativa o organisme depenent que gestionen les subvencions, remetrà en el primer quadrimestre de cada exercici memòria justificativa amb les següents especificacions:</span></p> </li> </ol> <ul style="margin-left:40px"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:12.0pt">Objecte, entitat beneficiària i import subvencionat.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:12.0pt">Subvencions concedides, justificades, renunciades i reintegrades o en procediment de reintegrament.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:12.0pt">El grau de compliment dels objectius específics, del termini de consecució, concretant el nombre de ciutadans als quals ha aconseguit l'acció subvencionada.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:12.0pt">Els costos efectius en relació amb els previsibles.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:12.0pt">Conclusions globals en les quals consti la valoració quant als objectius perseguits i la procedència del manteniment o supressió del programa.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:12.0pt">Suggeriments per a l'elaboració del següent Pla estratègic de subvencions.</span></span></p> </li> </ul> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8.- COMISSIÓ DE SEGUIMENT</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per al seguiment i avaluació del Pla estratègic de subvencions es designa la Junta de Govern Local.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>9.- TRANSPARÈNCIA</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Totes les subvencions concedides per l'Ajuntament seran publicades en el web municipal, indicant l'entitat receptora, quantia i projecte o acció a la qual va destinada. El termini màxim per a aquesta publicació serà d'un mes des de la concessió de la subvenció.
