    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;DECRET RELATIU A LES CONDICIONS DE L'EXERCICI DE LA PUBLICITAT DINÀMICA AL TERME MUNICIPAL DE CALVIÀ&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La &lt;strong&gt;Llei 5/1997,de 8 de juliol&lt;/strong&gt;, per la qual es regula la publicitat dinàmica a les Illes Balears (BOCAIB núm 88 de 15/7/1997; corregida en BOCAIB núm 89 de 17/07/1997) defineix aquest tipus de publicitat, en el seu &lt;strong&gt;article 1&lt;/strong&gt;,de la següent manera:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;“Se entiende por publicidad dinámica aquella forma de comunicación llevada a cabo por personas físicas o jurídicas, ya sean públicas o privadas, en el ejercicio de una actividad comercial, industrial, artesanal, social o profesional, encaminada a la finalidad de promover la contratación de bienes o servicios de toda clase, hasta decretos y obligaciones, o a la difusión de mensajes de naturaleza social, cultural, política o cualquier otra; realizada por medio del contacto directo de los agentes publicitarios con los posibles usuarios o clientes y con la utilización preferente, para su práctica, de zonas de dominio público, vías y espacios libres públicos y zonas privadas de concurrencia pública”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Entre les competències municipals reconegudes en aquesta llei estan:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1r.- Establir el nombre màxim d'agents permesos (&lt;strong&gt;article 11&lt;/strong&gt;)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2º.- Delimitar les zones en què es pot desenvolupar l'activitat publicitària (&lt;strong&gt;article 12&lt;/strong&gt;)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3r.- Establir l'horari en què es es pot dur a terme (&lt;strong&gt;article 13&lt;/strong&gt;)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;D'acord amb &lt;strong&gt;l'article 3&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de l'esmentada &lt;strong&gt;Llei 5/1997&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;“1.- Los ayuntamientos de las Illes Balears son la Administración competente para el otorgamiento de las autorizaciones relativas al ejercicio de la publicidad dinámica que haya de realizarse en su término municipal, así como para ejercer las actividades de control, adoptar las medidas correctoras o complementarias que sean necesarias y ejercer la potestad sancionadora en la materia, con pleno respeto a los principios contenidos en esta norma legal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Para el ejercicio de las funciones que implica la competencia a que se refiere el apartado anterior, los ayuntamientos podrán dictar la correspondiente ordenanza municipal o, en su defecto, aplicar directamente la presente ley”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;L'Ordenança municipal de publicitat&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;del terme municipal de Calvià, aprovada en el BOIB núm 99 de 10/07/2012 i modificada en el BOIB núm 78 de 26/05/2015, regula en el capítol V, del seu títol II, la publicitat dinàmica (articles 51 al 56).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En &lt;strong&gt;l'article 55&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de publicitat s'assenyala que “la Alcaldía o Teniente de Alcalde en quien haya delegado podrá delimitar la zona de actuación donde exclusivamente puedan ejercer su actividad los agentes de propaganda manual y/o oral”. Asimismo señala que “el horario del ejercicio de la actividad de propaganda manual y/o oral será el que establezca en cada caso la Alcaldía o Teniente de Alcalde en que éste haya delegado”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En &lt;strong&gt;l'article 56&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de publicitat, en relació a les zones en què es pot desenvolupar l'activitat, s'assenyala que “la Alcaldía o Teniente de Alcalde en que éste haya delegado queda facultada para fijar las zonas en las que se podrá realizar la actividad publicitaria, en atención a circunstancias relativas a los establecimientos afectados, conflictos de intereses u otras causas análogas que así lo hagan aconsejable”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Al BOIB núm. 41 de 30/03/2019 es va publicar el Decret amb les condicions per a l'exercici de la publicitat dinàmica, exercida de manera manual i / o oral, al terme municipal de Calvià durant l'any 2019. La vigència de l'esmentat Decret va expirar el 31/12/2019 pel qual és necessari aprovar un nou decret que reguli l'activitat de publicitat dinàmica a partir d'ara. El nou Decret té voluntat de permanència en el temps pel qual no es limita la seva vigència a aquest any natural.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En base a l'anterior, i en exercici de les competències que m'han estat atribuïdes,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primer.-&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;APROVAR les següents condicions per a l'exercici de la publicitat dinàmica, exercida de manera manual i / o oral, al municipi de Calvià:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;I .- NÚM. D'AGENTS:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Tal com estableix &lt;strong&gt;l'article 52&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de &lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;el nombre d'agents ve delimitat per les següents tres condicions:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.- Un per cada 100m2&lt;span style="color:#000000"&gt; &lt;/span&gt;efectius de local.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2.- Quan el sol·licitant sigui una empresa, un per cada set treballadors (&lt;strong&gt;article 11.3&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de la &lt;strong&gt;Llei &lt;/strong&gt;5/1997,de 15 de juliol, de publicitat dinàmica de la CAIB).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.- Un nombre màxim en funció del tipus d'activitat:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.1.- Dos (2) per a restaurants, cafeteries, cafès o bars (Grup I segons &lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;reguladora dels horaris de tancament d'establiments i espectacles públics i activitats recreatives).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.2.- Quatre (4) per cafès-concert, pubs, bars musicals i anàlegs (Grup II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.3.- Deu (10) per a discoteques, sales de ball, sales de festa i anàlegs (Grup V).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;S'entendrà per superfície efectiva del local la superfície útil destinada a ús públic. Es computarà tant la superfície interior o tancada com l'exterior destinada a l'activitat. En els casos en què no hi hagi memòria o plànols del local en els arxius municipals, la superfície efectiva es calcularà prenent la superfície construïda establerta en el Cadastre (sense computar la superfície d'elements comuns que pogués haver) i calculant, a partir d'ella , la superfície útil. Seguint el criteri establert a la Instrucció 2/2018, de 18 de juny, de la directora de l'Agència Tributària de les Illes Balears, la superfície útil serà el resultat del quocient entre la superfície construïda i el coeficient 1,18.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'Ajuntament expedirà carnets d'agent publicitari tenint en compte el nombre màxim permès per les condicions anteriorment descrites. El sol·licitant podrà proposar persones per ser titulars i altres per ser suplents, perquè aquestes puguin exercir l'activitat en el cas de malaltia, vacances, etc., de les primeres. Tots els agents proposats hauran de complir els requisits establerts en l'Ordenança Municipal. Hi haurà l'obligatorietat que només pugui exercir l'activitat publicitària un agent, el titular o el suplent, però no tots dos al mateix temps. Per evitar això, el carnet a lliurar serà únic per a totes dues persones. A l'anvers apareixeran les dades del titular (amb la seva fotografia) i al revers les dades del suplent. En el mateix sentit, únicament es lliurarà una armilla per a tots dos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;II.- ZONES SITUADES DAVANT DE L'ESTABLIMENT:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'article &lt;strong&gt;56.1&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de &lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de Publicitat estableix que, amb caràcter general, només s'autoritza un agent davant de l'establiment per al qual s'exerceix l'activitat. Cal entendre per "davant", la projecció de la façana de l'esmentat establiment sobre la vorera confrontant. En cap cas es pot exercir l'activitat a la calçada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;S'autoritza que els establiments puguin disposar de més d'un agent davant de l'establiment. El nombre màxim permès vindrà determinat pel nombre d'agents autoritzats per l'Ajuntament, en funció del que assenyala &lt;strong&gt;l'article 52.2&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de &lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;de publicitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;III.- ZONES COMUNS:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Per als agents de publicitat dels establiments pertanyents a el Grup V (discoteques, sales de ball, sales de festa i altres anàlogues), segons definició de &lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;reguladora dels horaris de tancament d'establiments i espectacles públics i activitats; s'estableixen les següents zones comunes en les quals es podrà exercir la publicitat:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;MAGALUF:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;M1.- Intersecció entre l'avinguda de Magaluf, el carrer Blanc i el carrer Contraalmirall Ferragut.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;M2.- Rotonda situada entre el Camí de Sa Porrassa, l'Avinguda Notari Alemany, l'Avinguda de Magaluf i l'avinguda de s'Olivera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;M3.- Intersecció entre l'avinguda de Magaluf amb el carrer Contraalmirall Riera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;M4.- Intersecció entre l'avinguda de Son Maties, el carrer Marina, el carrer Cala Blanca i l'avinguda Pere Vaquer.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SANTA PONÇA:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;SP1.- Final del carrer Ramon de Montcada, connexió amb carrer Santa Ponça i carrer Huguet des Far.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PEGUERA:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;P1 Intersecció entre el bulevard de Peguera i el carrer Malgrat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Aquestes zones comunes s'assenyalen en els plànols adjunts a escala 1: 1000.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No es pot exercir l'activitat de publicitat a la calçada, únicament en zones de trànsit de vianants.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El nombre màxim d'agents per cada establiment en cada zona comuna serà de dos (2). La publicitat exercida en aquestes zones és complementària a la qual s'exerceix davant de l'establiment.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;IV.- HORARIS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Els horaris seran, en funció de el grup a què pertanyi l'establiment d'acord amb el que assenyala &lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;reguladora dels horaris, els següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Grup I (Restaurants): De 12:00 a 15:00 hores i de 18:00 a 23:00 hores&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Grup I (Cafeteries, cafès o bars): De 20:00 a 02:00 hores&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Grup II (cafès-concert, pubs, bars musicals i anàlegs): De 20:00 a 02:00 hores&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Grup V (Discoteques, sales de ball, sales de festes i altres anàlogues): de les 14:00 a 18:00 hores i de 21:00 a 03:00 hores&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A les zones comunes (únicament autoritzats per als establiments de el grup V ) l'horari serà: de les 14:00 a 18:00 hores i de 21:00 a 03:00 hores&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;V.- PECES DE VESTIR&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;S'estableix l'obligatorietat que els agents de publicitat portin armilles que, en funció del tipus d'establiment d'acord amb el que assenyala &lt;strong&gt;l'Ordenança&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;reguladora d'horaris, seran de el següent color:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;i.- Azulina: per als establiments del Grup V (discoteques, sales de ball, sales de festa i anàlegs).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;ii.- Blau marí: per als establiments del grup I i II.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;L'Ajuntament farà lliurament d'aquests armilles una vegada concedida la llicència i efectuat el pagament de la taxa corresponent. Els agents hauran de portar el carnet d'agent publicitari en el lloc assignat de l'armilla. Es lliurarà una armilla per cada carnet expedit. Per tant, tant el titular com el suplent hauran d'emprar la mateixa armilla.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon.-&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;ORDENAR la publicació d'aquest Decret en el Butlletí Oficial de les Illes Balears (BOIB) juntament amb els plànols de situació de les zones comunes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra aquesta Resolució, que posa fi a la via administrativa, podrà interposar amb caràcter potestatiu recurs de reposició davant el Batle de l'Ajuntament de Calvià en el termini d'un (1) mes, de conformitat amb el que disposen els &lt;strong&gt;articles 123&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;i &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;124&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de la&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Llei &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques, o recurs contenciós administratiu davant els Tribunals competents en el termini de dos (2) mesos comptats des de l'endemà de el de la seva publicació al Butlletí Oficial de les Illes Balears, d'acord amb el que disposen els &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;articles 10&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;i &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;45&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;i &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;següents&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de la &lt;strong&gt;Llei &lt;/strong&gt;29/1998,de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
