![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">El Ple de l'L'Ajuntament d'Alcúdia, en sessió ordinària de data 4 de juny de 2.020, va aprovar definitivament l'Ordenança reguladora de la prestació patrimonial pública no tributària derivada de la prestació del servei públic de proveïment domiciliari d'aigua potable dels abonats de l'entitat Font de Son Sant Joan, S.L.U. (FUSOSA) en el terme municipal d'Alcúdia.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">De conformitat amb allò establert als articles 70.2 de la Llei Reguladora de les Bases del Règim Local -LRBRL-, s'insereix a continuació el text íntegre de l'ordenança que entrarà en vigor el dia següent al de la finalització del termini assenyalat en l'article 113 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, romanent en vigor fins a la seva modificació o derogació expressa.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Contra l'acord d'aprovació definitiva i el contingut de l'ordenança podrà interposar-se directament recurs contenciós administratiu davant la Sala Contenciosa administrativa del Tribunal Superior de Justícia de les Illes Balears, en el termini de dos mesos, comptadors des de la data de la publicació al BOIB de l'acord d'aprovació definitiva. Tot això sense perjudici que les persones interessades puguin interposar aquells altres recursos que considerin procedents.</span></span></span></p>

<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">PREÀMBUL</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">L'Ajuntament de Alcúdia , d'acord amb l'article 25 i 26 de la Llei 7/1985 de 2 d'abril, reguladora de les bases de règim local, porta a terme la prestació del servei d'abastament domiciliari d'aigua potable, servei que en l'actualitat es gestiona de forma indirecta d'acord amb l'article 85.2.B) de la Llei 7/1985 de 2 d'abril, reguladora de les bases de règim local.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">La Llei 9/2017, de 8 de novembre, de Contractes de Sector Públic, per la qual es traslladen a l'ordenament jurídic espanyol les directives del Parlament Europeu i del Consell 2014/23 / UE i 2014/24 / UE, de 26 de febrer de 2014, estableix un conjunt de modificacions d'àmbit fiscal i tributari que afecten -entre d'altres- a la naturalesa de les contraprestacions econòmiques derivades de la prestació de servei públic de proveïment domiciliari d'aigua potable.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">De conformitat amb la disposició addicional quaranta-tresena de dita llei, <em>Les contraprestacions econòmiques establertes coactivament que es percebin per l'explotació d'obres públiques o la prestació de serveis públics, de manera directa mitjançant personificació privada o gestió indirecta, tenen la condició de prestacions patrimonials de caràcter públic no tributari d'acord amb el que preveu l'article 31.3 de la Constitució "</em></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Cal assenyalar que d'acord amb l'article 20.6 del real decret legislatiu 2/2004, de 5 de març pel qual s'aprova el Text refós de la Llei Reguladora de les Hisendes Locals, en la nova redacció donada per la disposició final dotzena de la Llei 9/2017, de 8 de novembre, les contraprestacions econòmiques a què es refereix aquest apartat (20.6.t) i r)) es regularan mitjançant ordenança. Durant el procediment d'aprovació d'aquesta ordenança les entitats locals han de sol·licitar informe preceptiu d'aquelles administracions públiques a les quals l'ordenament jurídic els atribuís alguna facultat d'intervenció sobre aquestes.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">L'articulat de l'ordenança recull el règim jurídic de les esmentades prestacions, establint les actuacions subjectes a tarifació, la seva quantificació, les persones obligades al pagament de tarifes, la meritació i forma de pagament de les tarifes i el procediment de gestió o cobrament.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 1.- Objecte</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">L'objecte d'aquesta ordenança és la regulació de les tarifes a satisfer per les persones abonades al servei d'abastament domiciliari d'aigua potable del municipi de Alcúdia que es troben dins de l'àmbit territorial on presta el servei l'entitat concessionària Font de Son Sant Joan, SLU ( Fusosa).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Aquest àmbit territorial afecta a la urbanització Llac Esperança i - de manera provisional - polígon Ca Na Lloreta. Aquest àmbit territorial es troba descrit i/o grafiat en detall en l'annex I de la present ordenança. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 2.- Naturalesa de les tarifes.</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Les tarifes i altres drets econòmics per la prestació dels serveis de proveïment d'aigua o per la realització d'obres i activitats connexes a aquests, tenen la condició de prestacions patrimonials de caràcter públic no tributari, d'acord amb l'article 20.6 de el text refós de la Llei Reguladora de les Hisendes Locals, aprovat mitjançant Reial decret legislatiu 2/2004, de 5 de març, en redacció donada per Llei 9/2017, de 8 de novembre, de Contractes de Sector Públic.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 3.- Fet imposable</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Constitueix el fet imposable de la contraprestació econòmica la prestació de servei públic de proveïment domiciliari d'aigua potable, que comprèn:</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">La prestació del servei de proveïment d'aigua a domicili, el qual inclou la captació, tractament i conducció d'aigües potables fins als punts de connexió amb les instal·lacions interiors dels abonats, amb independència que es faci un ús efectiu d'aigua pels abonats o es limiti únicament a la disponibilitat d'aigua.</span></span></span></p>

<li>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Connexió d'escomeses des de les instal·lacions interiors dels abonats fins a les xarxes de distribució d'aigua.</span></span></span></p>
</li>
<li>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">La col·locació, lloguer, utilització, manteniment i desmuntatge de comptadors i instal·lacions anàlogues. </span></span></span></p>

</ol>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 4.- Base imposable i liquidable</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">La Base Liquidable vindrà determinada pel mesurament en metres cúbics del volum d'aigua subministrat en cada període impositiu, les lectures del qual han de fer els agents lectors. A la base liquidable s'inclourà com a concepte específic la tarifa per quota de servei.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 5.- Quota</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">La quota de l'ingrés patrimonial regulat en aquesta ordenança es determinarà d'acord amb les tarifes contingudes en l'apartat següent.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">En aquestes Tarifes no es troba inclòs l'IVA.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 6.- Tarifes</span></strong></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 7.- Bonificacions. </span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">1. Les persones abonades tenen dret de forma general a l'aplicació de la bonificació sobre l'import del cànon de sanejament d'aigües, en els termes, requisits i condicions establerts en l'article 9 del Text Refós de la Llei Reguladora del cànon de sanejament d'aigües, aprovat per Decret Legislatiu 1/2016, de 6 de maig, de la CAIB. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">2. Així mateix i sense perjudici de l'anterior, s'estableixen les bonificacions de caràcter social que a continuació s'indicaran, per a les següents situacions familiars, segons venen definides en l'article 5 de la Llei 8/2018, de 31 de juliol, de suport a les famílies:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">a) Bonificació per a famílies monoparentals, llevat de les definides a l'article 7.2.a) de la Llei 8/2018, que no s'hi entenen incloses dins la bonificació. S'estableix una bonificació de la quota en les tarifes de consum domèstic de fins a 25 m3/mes, i de la quota de servei per comptadors de fins a 15mm, del 50%.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">b) Bonificació per a famílies en risc social, víctimes de violència masclista o en situació d'especial vulnerabilitat econòmica. S'estableix una bonificació de la quota en les tarifes de consum domèstic de fins a 25 m3/mes, i de la quota de servei per comptadors de fins a 15mm, del 50%.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 8.- Obligats al pagament de les tarifes.</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Estan obligats al pagament de les tarifes, les persones físiques o jurídiques i les entitats a què es refereix l'article 35 de la Llei general tributària, que siguin titulars del contracte de subministrament i aquelles sol·licitants o destinatàries dels serveis. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Seran responsables subsidiaris del pagament les persones propietàries dels immobles, les quals podran repercutir si escau, les quotes sobre els respectius beneficiaris del subministrament o serveis regulats en aquesta ordenança.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 9.- Naixement de l'obligació de pagament.</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">L'obligació de pagament neix quan s'iniciï la prestació de servei o la realització de l'activitat.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Es reporta la prestació patrimonial no tributària i neix l'obligació de pagament quan s'iniciï l'activitat de prestació de servei, entenent-se iniciada la mateixa:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">a) En el subministrament d'aigua, per l'atorgament del corresponent contracte i iniciació de subministrament.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">b) En l'ús d'aparells comptadors, per la seva instal·lació i posada en funcionament. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">c) En les escomeses, per la seva realització, o increment de posteriors usos, prèvia sol·licitud i, si escau, concessió de la corresponent llicència.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Article 10.- Normes de gestió, liquidació ingrés i recaptació:</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">La gestió i la recaptació de les tarifes correspondrà a les empreses concessionàries o que presten el servei d'abastament domiciliari d'aigua potable.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Les quotes de servei i de consum d'aigua han de ser objecte de facturació bimensual, mentre que la resta de les quotes ho seran en el moment de realitzar-se la prestació.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">La liquidació, ingrés i recaptació de la prestació patrimonial de caràcter públic no tributari que és objecte d'aquesta Ordenança, obeirà a les següents normes: </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">1.- Consum d'aigua: mitjançant lectura periòdica de l'aparell comptador, facturant el consum als preus de tarifa en rebut bimestral.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Les persones abonades d'ús domèstic i no domèstic amb grans consums podran optar per substituir la lectura i facturació bimestral per altres de periodicitat mensual, prèvia sol·licitud al concessionari o prestador de servei, modificant-se el contracte de subministrament.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">2.- El pagament del rebut unificat d'aigua i quota de servei s'efectuarà preferentment mitjançant domiciliació bancària.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">3. La falta de pagament per la persona abonada, podrà donar lloc a la suspensió del subministrament, en els termes assenyalats en la normativa aplicable. La seva reconnexió s'efectuarà un cop pagada per la persona abonada tot el deute pendent, així com les despeses originades pel tall i reposició.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">Sense perjudici de l'anterior, els rebuts impagats seran recaptats per la via administrativa de constrenyiment.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">4.- El cessament en el subministrament per clausura o demolició dels edificis o, per desocupació dels habitatges o locals, haurà de ser comunicat per la persona interessada que sol·licitarà la corresponent baixa en el servei. En cas contrari, la persona abonada continuarà subjecte al pagament de la prestació i a les altres responsabilitats que puguin derivar-se de l'ús del servei.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">5.- Les persones abonades al servei estaran obligades a facilitar el pas a les persones treballadores de l'entitat concessionària a l'efecte de realitzar les corresponents lectures de comptador.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">6. Les tarifes establertes en aquesta ordenança no inclouen l'Impost sobre el Valor Afegit (IVA) que els serà aplicable en cada cas d'acord amb la normativa vigent.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><strong><span style="color:#000000">Disposició final</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:normal"><span style="color:#000000">La present Ordenança entrarà en vigor, una vegada publicada íntegrament en el BOIB, el dia següent al de la finalització del termini assenyalat en l'article 113 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears, romanent en vigor fins a la seva modificació o derogació expressa.</span></span></span></p>
