font-size:12px"><strong>“ORDENANÇA Nº 29</strong></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>&nbsp;</strong></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>REGULADORA DEL PREU PÚBLIC PER LA PRESTACIÓ DE SERVEIS SOCIOEDUCATIUS</strong></span></p> <p><strong>Article 1 - Naturalesa, objecte i fonament</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Fent ús de les facultats concedides per l'article 117 del RDL 2/2004, de 5 de març, regulador de les hisendes locals, i per l'article 105 de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, aquest Ajuntament estableix el preu públic per la prestació de serveis municipals, que s'han de regir per la present Ordenança les normes de la qual atenen allò que s'ha previstes en els articles 41 a 48 del RDL 2/2004.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 2 – Objecte </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constitueix l'objecte del preu públic la prestació, per part de l'Ajuntament, de serveis socioeducatius.&nbsp;&nbsp;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 3 - Obligats al pagament </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Són subjectes obligats al pagament les persones o entitats sol·licitants de les prestacions del servei o, si no és així, els pares o tutors dels menors beneficiats.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 4 - Obligació de pagament </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'obligació de pagar els preus públics regulats en aquesta Ordenança, neix:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) En les activitats de taller, formatives o d'ensenyament, que no tinguin la consideració d'activitats socials bàsiques en el començament del curs.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Els drets d'inscripció en les activitats infantils s'han de meritar amb la formalització de la matrícula.</span></p> <p><strong>Article 5 – Base de gravamen</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">S'adopta com a base del present preu públic el nombre de persones que es beneficiïn de la prestació dels serveis.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 6 – Quota </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 7 – Exempcions </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ajuntament podrà eximir del pagament dels preus públics regulats en aquesta Ordenança a les persones beneficiàries de la prestació dels serveis, en aquells casos en què els usuaris compleixin objectius de prevenció específica o de reinserció social, amb un informe previ tècnic previ que els justifiquen.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 8 – Bonificacions </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.S'estableix una bonificació del 10 % a les quotes de l'escoleta d'estiu, sempre que es matriculin dos membres de la mateixa família; i d'un 30 % si són tres els membres matriculats.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.L'Ajuntament de Son Servera, de manera excepcional, davant situacions derivades de força major,&nbsp;&nbsp; podrà bonificar per un període de temps determinat, fins a un 50% les quotes, sempre que el Ple de la Corporació, a proposta de la Batlia, ho aprovi per vot favorable de la majoria simple dels seus membres.*</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">*Aquesta bonificació es practicarà ( o no) simultàniament amb altres previstes en aquesta Ordenança.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>NORMES DE GESTIÓ </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 9 - Cobrament de quotes </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 11 – Bestretes </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Ajuntament pot exigir, igualment, l'anticipació o dipòsit previ del import total o parcial del preu públic.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Article 12 - Lloc de pagament </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El pagament del preu públic s'ha de realitzar pels beneficiaris dels serveis o activitats a través de les entitats bancàries designades per l'Ajuntament.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>DISPOSICIÓ FINAL </strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La present Ordenança, la redacció definitiva de la qual ha estat aprovada pel Ple de la</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Corporació en sessió celebrada el dia 19 de juliol de 2012, entrarà en vigor un cop efectuada la seva publicació definitiva en el Butlletí Oficial de les Illes Balears (BOIB nº 152 de 18 d'octubre de 2012), i romandrà en vigor fins a la seva modificació o derogació expresses. “</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>SEGON</strong><strong>.</strong>&nbsp; Aprovar inicialment, en els termes i continguts que consta íntegrament en aquesta proposta, la modificació de l'ordenança número 29, per majoria simple, d'acord amb el que assenyalen els articles 47.1 i 70.2 <span style="color:black">&nbsp;de la Llei 7/85, de 2 d'abril, reguladora de les bases de règim local i 102 de la Llei&nbsp; 20/2006.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>TERCER. </strong>Sotmetre l'acord a informació pública (inserció d'un anunci en el tauler d'anuncis de l'Ajuntament) i publicar l'aprovació inicial al BOIB, per termini de 30 dies, d'acord amb el que assenyala l'article 49 <span style="color:black">de la Llei 7/1985, de 2 d'abril, reguladora de les bases de règim local, per a la presentació de reclamacions i suggeriments, i resolució de les presentades dins el termini per part del Ple d'aquesta corporació.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
