&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. En data 9 de març de 2020, el director general d'Atenció a la Dependència va emetre un informe justificatiu relatiu a la convocatòria del concert del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2020-2021&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. En data&lt;/span&gt;&lt;span style="color:#000000"&gt; 9 de març de 2020&lt;/span&gt;&lt;span style="color:#000000"&gt;, la consellera d'Afers Socials i Esports va resoldre iniciar l'expedient de concertació del &lt;/span&gt;&lt;span style="color:#000000"&gt;servei &lt;/span&gt;&lt;span style="color:#000000"&gt;de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2020-2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. La Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. La Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. El Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4. El Decret 66/2016, de 18 de novembre, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2017-2020 i s'estableixen principis generals per a les carteres insulars i locals.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. El Decret 86/2010, de 25 de juny, pel qual s'estableixen els principis generals i les directrius de coordinació per a l'autorització i l'acreditació dels serveis socials d'atenció a persones grans i persones amb discapacitats, i es regulen els requisits d'autorització i acreditació dels serveis residencials de caràcter suprainsular per a aquests sectors de població.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. El Decret 9/2019, de 2 de juliol, de la presidenta de les Illes Balears, pel qual es determina la composició del Govern i s'estableix l'estructura de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. El Decret 21/2019, de 2 d'agost, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8. L'Acord del Consell de Govern de 21 de febrer de 2020 pel qual s'aprova la previsió de les prestacions i els serveis que s'han de concertar durant l'any 2020 i es declaren els serveis d'interès econòmic general (BOIB núm. 23, de 22 de febrer), rectificat per l'Acord del Consell de Govern de 28 de febrer de 2020 (BOIB núm. 26, de 29 de febrer).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1. Convocar l'acció concertada i establir el procediment de la convocatòria per al &lt;/span&gt;&lt;span style="color:#000000"&gt;servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2020-2021,&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;d'acord amb l'annex.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;2. Aprovar el &lt;/span&gt;&lt;span style="color:#000000"&gt;Plec general de condicions tècniques per a la concertació, entre la Conselleria d'Afers Socials i Esports i entitats del tercer sector, del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2020-2021, &lt;/span&gt;&lt;span style="color:#000000"&gt;que es pot consultar a la Seu Electrònica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3. Publicar aquesta Resolució en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant la consellera d'Afers Socials i Esports en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;També es pot interposar un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.1. S'estableix el procediment de convocatòria &lt;/span&gt;&lt;span style="color:#000000"&gt;d&lt;/span&gt;&lt;span style="color:#000000"&gt;el&lt;/span&gt;&lt;span style="color:#000000"&gt; concert del &lt;/span&gt;&lt;span style="color:#000000"&gt;servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu, per als anys 2020-2021,&lt;/span&gt;&lt;span style="color:#000000"&gt; i es dicta a l'empara de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, i del Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;1.2. Se subjecten a aquest procediment els concerts de places del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu a les Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;span style="color:#000000"&gt;Aquest servei està recollit en el punt 2.6.4 de l'annex del Decret 66/2016, de 18 de novembre, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2017-2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. Òrgan instructor&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;L'òrgan instructor del procediment és la Direcció General d'Atenció a la Dependència&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. Lloc i termini de presentació de sol·licituds&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3.1. El termini per presentar les sol·licituds és d&lt;/span&gt;&lt;span style="color:#000000"&gt;e set dies hà&lt;/span&gt;&lt;span style="color:#000000"&gt;bils comptadors des de l'endemà que s'hagi publicat aquesta convocatòria en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;3.2. D'acord amb el que estableix l'article 16.4 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, els documents es poden adreçar als òrgans de l'Administració autonòmica mitjançant els canals següents (entre d'altres):&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) De manera telemàtica, per mitjà del Registre electrònic comú (REC) de l'Administració General de l'Estat (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;https://rec.redsara.es&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) (obligatòriament per als subjectes obligats a relacionar-se electrònicament amb les administracions d'acord amb l'article 14.2 i 14.3 de la Llei 39/2015, i opcionalment per a les persones físiques). Per poder dur a terme un registre mitjançant el REC, cal disposar d'un certificat electrònic o de DNI electrònic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) De manera presencial, a la seu del Servei d'Atenció a la Discapacitat, ubicat al carrer d&lt;/span&gt;&lt;span style="color:#000000"&gt;e Joan Crespí, 11, de Palma, o a qualsevol dels llocs que estableixen l'article 37.1 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i l'article 16.4 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Per correu postal. En aquest cas, s'han de presentar els documents dins un sobre obert, a fi que el personal de l'oficina de correus hi pugui indicar, mitjançant el segell oficial, el lloc, la data i l'hora exacta en què s'ha efectuat el registre. Aquestes dades també quedaran anotades en el resguard justificatiu de la presentació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Si la sol·licitud es presenta a un lloc diferent de la seu del Servei d'Atenció a la Discapacitat, s'ha d'enviar el full de la sol·licitud, amb el segell de registre d'entrada, al Servei d'Atenció a la Discapacitat, &lt;/span&gt;&lt;span style="color:#000000"&gt;per &lt;/span&gt;&lt;span style="color:#000000"&gt;correu electrònic (&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;atenciodiscapacitat@dgad.caib.es&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;), en el termini màxim de les 24 hores següents a la fi del termini hàbil de presentació. De la mateixa manera, si s'envia per correu certificat, s'ha d'envi&lt;/span&gt;&lt;span style="color:#000000"&gt;ar per correu electrò&lt;/span&gt;&lt;span style="color:#000000"&gt;nic el full de la sol·licitud, datat i segellat per l'oficina de correus, en què consti que s'ha tramès dins el termini hàbil de presentació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. Requisits de les entitats&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4.1. Els requisits que han de complir les entitats que es presentin a la convocatòria d'aquest concert social són els següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Tenir el servei acreditat de&lt;/span&gt;&lt;span style="color:#000000"&gt; conformitat amb el Decret 86/2010, de 25 de juny, pel qual s'estableixen els principis generals i les directrius de coordinació per a l'autorització i l'acreditació dels serveis socials d'atenció a persones grans i persones amb discapacitats, i es regulen els requisits d'autorització i acreditació dels serveis residencials de caràcter suprainsular per a aquests sectors de població, i&lt;/span&gt;&lt;span style="color:#000000"&gt; la normativa complementària insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) Tenir una experiència mínima d'un any en matèria de &lt;/span&gt;&lt;span style="color:#000000"&gt;serveis de suport a l'habitatge per a persones amb diagnòstic de salut mental en l'àmbit dels serveis socials de les Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Tenir el &lt;/span&gt;&lt;span style="color:#000000"&gt;caràcter d'entitat del tercer sector social, de conformitat amb el que estableix l'article 5.1 de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;4.2. Així mateix, les entitats han de complir els requisits mínims que s'estableixen en desplegament del títol VII de la Llei 4/2009, d'11 de juny, de serveis socials de les Illes Balears, així com els requisits que fixen l'article 5 de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears, i l'article 4.2 del Decret 48/2017, de 27 d'octubre, pel qual s'estableixen els principis generals als quals s'han de sotmetre els concerts socials.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. Documentació que s'ha de presentar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.1. Les entitats interessades que compleixin els requisits que estableix el punt 4 d'aquesta convocatòria han de formular una sol·licitud, que ha de signar la persona representant legal de l'entitat. El model de sol·licitud es troba disponible &lt;/span&gt;&lt;span style="color:#0000ff"&gt;&lt;span style="color:#000000"&gt;a la Seu Electrònica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.2. Les entitats han de presentar una sol·lici&lt;/span&gt;&lt;span style="color:#000000"&gt;tud per al servei de &lt;/span&gt;&lt;span style="color:#000000"&gt;suport a l'habitatge&lt;/span&gt;&lt;span style="color:#000000"&gt; que gestionin i han&lt;/span&gt;&lt;span style="color:#000000"&gt; d'indicar el nombre de places que ofereixin per concertar amb l'Administració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.3. A la sol·licitud s'ha d'adjuntar la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Certificat d'acreditació del servei per concertar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b)&amp;nbsp; Acreditació de l'experiència mínima &lt;/span&gt;&lt;span style="color:#000000"&gt;d'un any en matèria de se&lt;/span&gt;&lt;span style="color:#000000"&gt;rveis de suport a l'habitatge per a persones amb diagnòstic de salut mental en l'àmbit dels serveis socials de les Illes Balears&lt;/span&gt;&lt;span style="color:#000000"&gt;, mitjançant la resolució d'autorització del servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Declaració responsable que l'entitat no està sotmesa a les prohibicions de contractar amb l'Administració, d'acord amb l'article &lt;/span&gt;&lt;span style="color:#000000"&gt;71 de la Llei 9/2017, de 8 de novembre, de contractes del sector públic, &lt;/span&gt;&lt;span style="color:#000000"&gt;ni a cap dels supòsits de prohibició per ser beneficiària de subvencions, establerts en els apartats 1 i 2 de l'article 10 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;d) Declaració responsable de no incórrer en cap de les prohibicions que estableix l'article 11 de la Llei 11/2016, de 28 de juliol, d'igualtat de dones i homes, i de no haver estat sancionada per resolució ferma en els darrers quatre anys per la comissió d'infraccions greus o molt greus en matèria de relacions laborals, ocupació, empreses usuàries d'empreses de treball temporal, seguretat social, emigració, moviments migratoris i treball d'estrangers.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;e) Acreditació de solvència financera, segons el document disponible a la Seu Electrònica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;f) Acreditació de solvència tècnica, segons el document disponible a la Seu Electrònica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;g) Certificat d'estar al corrent en les obligacions tributàries i de la Seguretat Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;h) Declaració del nombre&lt;/span&gt;&lt;span style="color:#000000"&gt; total&lt;/span&gt;&lt;span style="color:#000000"&gt; de places &lt;/span&gt;&lt;span style="color:#000000"&gt;acreditades&lt;/span&gt;&lt;span style="color:#000000"&gt;, signad&lt;/span&gt;&lt;span style="color:#000000"&gt;a per la direcció del servei, &lt;/span&gt;&lt;span style="color:#000000"&gt;amb la diferenciació entre&lt;/span&gt;&lt;span style="color:#000000"&gt; disponibles i no disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;i) Acreditació del caràcter d'entitat del tercer sector social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;j) Declaració, signada pel responsable de l'entitat, que el servei compleix la normativa general o específica aplicable, tant per la naturalesa jurídica de &lt;/span&gt;&lt;span style="color:#000000"&gt;l'entitat com pel tipus de servei objecte de concertació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;k) Acreditació de la disposició dels mitjans i els recursos suficients per garantir el compliment de les condicions previstes en l'acord d'acció concertada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;l) Comunicació, a l'efecte de l'acreditació preceptiva, dels canvis d'accionariat o de titularitat, per preservar la identitat institucional que hagi justificat l'acord.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;5.4. La presentació de la sol·licitud suposa que l'entitat autoritza els tècnics de la Direcció General d'Atenció a la Dependència perquè puguin demanar a altres administracions qualsevol documentació, les dades i els informes que considerin necessaris per tramitar l'expedient.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tramitació dels concerts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.1. Els serveis tècnics de la Direcció General d'Atenció a la Dependència han d'examinar les sol·licituds i la documentació adjunta per determinar si compleixen els requisits que estableix la convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.2. &lt;/span&gt;&lt;span style="color:#000000"&gt;En el cas que les sol·licituds no compleixin els requisits legals o els que exigeix aquesta convocatòria o no incorporin la documentació esmentada en l'apartat anterior, es requerirà l'entitat interessada perquè, en el termini de deu dies hàbils, esmeni el defecte o aporti la documentació que hi manca, amb la indicació que, si no ho fa, es considerarà que desisteix de la seva petició, amb la resolució prèvia que s'ha de dictar en els termes que disposa l'article 21 de la Llei 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;6.3. S'ha de resoldre e&lt;/span&gt;&lt;span style="color:#000000"&gt;l procediment de concertació d'acord amb els criteris següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Si el còmput total de places que ofereixen les entitats segons cada nivell d'intensitat no supera el nombre total màxim de places previstes en el servei i, per tant, hi ha disponibilitat pressupostària suficient per atendre tota l'oferta, les places s'adjudicaran directament a les entitats sol·licitants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Si el còmput total de places que ofereixen les entitats segons cada nivell d'intensitat supera la disponibilitat pressupostària, s'actuarà segons els criteris de preferència que preveu la Llei 12/2018 en l'article 6.3.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) En cas que es produeixi una renúncia per part d'alguna entitat, les places que hagi ofert es distribuiran de la mateixa manera entre la resta d'entitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. Formalit&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;zació dels concerts&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7.1. Els concerts que s'estableixin a l'empara d'aquesta convocatòria s'han de formalitzar mitjançant un document administratiu denominat &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;acord d'acció concertada&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;, &lt;/span&gt;&lt;span style="color:#000000"&gt;en el qual es faci constar el contingut mínim previst en l'article 8 de la Llei 12/2018, així com les característiques concretes del servei i altres circumstàncies derivades de la Llei 4/2009, de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Llei 12/2018, de la normativa&lt;/span&gt;&lt;span style="color:#000000"&gt; de desplegament i del Plec general de condicions tècniques del concert. Els acords d'acció concertada s'han de publicar en el &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt; de conformitat amb el que estableix la lletra &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f)&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; de l'article 3 de la Llei 12/2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;7.2. En el moment de formalitzar el concert, s'ha de presentar una declaració responsable que es continuen complint els requisits per poder concertar el servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. Places del servei i distribució territorial&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8.1. La previsió del nombre total màxim de places per concertar és de 149 (80 de baixa intensitat i 69 d'alta intensitat) a l'illa de Mallorca per a un període d'un any&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Vigència del concert&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El règim del concert s'iniciarà l'1 de juliol de 2020 i finalitzarà el 30 de juny de 2021.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Pressupost i preu màxim del servei&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10.1. L'import màxim estimat per assignar és de 2.453.589,60 €&lt;/span&gt;&lt;span style="color:#000000"&gt; (exemp&lt;/span&gt;&lt;span style="color:#000000"&gt;t d'I&lt;/span&gt;&lt;span style="color:#000000"&gt;VA), que es distribuirà entre les anualitats de 2020 i 2021. En tot cas, aquest valor estimat té caràcter orientatiu i no vinculant. La despesa real quedarà limitada pel nombre total de places que ofereixi l'entitat i pels serveis que requereixi efectivament l'Administració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10.2. Aquest import s'indica únicament a efectes de publicitat i no suposa cap compromís de despesa. Per això, no consta cap consignació pressupostària, que s'ha d'acreditar en el moment en què es materialitzi el servei de concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;10.3. El cost estipulat és de 1.013,50 €/mes per plaça de baixa intensitat i de 1.788,20 €/mes per plaça d'alta intensitat, d'acord amb la Resolució de la consellera d'Afers Socials i Esports de 3 de setembre de 2019 per la qual s'actualitzen els preus dels serveis concertats, derivada dels increments salarials en els convenis col·lectius pels quals es calculen els preus d'aquests serveis (BOIB núm. 122, de 5 de setembre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. Condicions tècniques d'execució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;11.1. &lt;/span&gt;&lt;span style="color:#000000"&gt;Les condicions tècniques d'execució s'han d'ajustar al Decret 86/2010, de 25 de juny, pel qual s'estableixen els principis generals i les directrius de coordinació per a l'autorització i l'acreditació dels serveis socials d'atenció a persones grans i persones amb discapacitats, i es regulen els requisits d'autorització i acreditació dels serveis residencials de caràcter suprainsular per a aquests sectors de població, al Decret 66/2016, de 18 de novembre, pel qual s'aprova la Cartera bàsica de serveis socials de les Illes Balears 2017-2020 i s'estableixen principis generals per a les carteres insulars i locals, i a la normativa insular complementària.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;11.2. &lt;/span&gt;&lt;span style="color:#000000"&gt;El Plec general de condicions tècniques detalla l'objecte, els drets i les obligacions d'ambdues parts, els serveis que s'han de prestar, els criteris d'intervenció amb els usuaris, els mitjans que ha d'aportar l'entitat concertada i el sistema de coordinació amb l'Administració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;11.3. Les aplicacions informàtiques del Servei d'Atenció a la Discapacitat són les úniques vàlides per gestionar les places del servei i per a qualsevol ús aplicable que es derivi de l'execució d'aquest concert.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. Seguiment&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;12.&lt;/span&gt;&lt;span style="color:#000000"&gt;1. &lt;/span&gt;&lt;span style="color:#000000"&gt;Els tècnics del servei &lt;/span&gt;&lt;span style="color:#000000"&gt;de suport a l'habitatge per a persones amb diagnòstic de salut mental greu&lt;/span&gt;&lt;span style="color:#000000"&gt; són els responsables del seguiment dels casos atesos i s'han de coordinar amb el &lt;/span&gt;&lt;span style="color:#000000"&gt;Servei d'Atenció a la Discapacitat&lt;/span&gt;&lt;span style="color:#000000"&gt; i els serveis socials comunitaris bàsics, de salut, educatius o d'altres que es requereixin.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;12.2. Els tècnics del&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Servei d'Atenció a la Discapacitat&lt;/span&gt;&lt;span style="color:#000000"&gt; po&lt;/span&gt;&lt;span style="color:#000000"&gt;den fer visites de comprovació del funcionament del servei i requerir-ne documentació quan ho considerin necessari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;12.3. L'entitat concertada ha de facilitar les actuacions de seguiment i comprovació que dugui a terme la Direcció General d'Atenció a la Dependència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;12.4. Així mateix, l'entitat concertada ha de facilitar tota la informació que li requereixin l'òrgan instructor, la Intervenció General de la Comunitat Autònoma de les Illes Balears, la Sindicatura de Comptes o altres òrgans de control extern.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. Obligacions de les entitats concertades&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Mitjançant el concert social, les entitats que prestin el servei s'obliguen a complir el Plec general de condicions tècniques, que estableix les obligacions de les entitats concertades, i les normes establertes en el títol VII de la Llei 4/2009, en el capítol I de la Llei 12/2018 i en els decrets de desplegament i d'aplicació corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14. Penalitats&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'incompliment de les condicions previstes per a la prestació del servei pot donar lloc a la imposició de penalitzacions, d'acord amb el Plec general de condicions tècniques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15. Criteris d'accés dels usuaris i llista d'espera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;15.1. Els criteris d'accés dels usuaris i la llista d'espera del servei de suport a l'habitatge per a persones amb diagnòstic de salut mental greu es regeixen d'acord amb els capítols II i III del Decret 7/2016, de 12 de febrer, pel qual es regulen l'accés al servei ocupacional per a persones amb discapacitat per trastorn mental greu i la gestió de la llista d'espera de les places d'aquest servei.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;15.2. Les persones que hagin sol·licitat l'accés al servei de suport a l'habitatge i que formen part de la llista d'espera per iniciar el nou servei seran valorades pels professionals del Servei d'Atenció a la Discapacitat i derivades a l'entitat prestadora del servei, amb respecte al principi de lliure elecció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16. Publicitat&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;16.1. Les entitats d'iniciativa privada acollides al concert social, juntament amb la seva denominació, han de fer constar en la documentació, en totes les comunicacions (informes, fulls, documents, tríptics de difusió, missatges electrònics, webs, insercions en premsa, articles a diaris i a revistes especialitzades) i en la publicitat l'adscripció funcional del servei a la xarxa pública de serveis socials, &lt;/span&gt;&lt;span style="color:#000000"&gt;segons les indicacions del &lt;em&gt;Manual d'identitat corporativa&lt;/em&gt; que els facilitarà l'Administració, sempre amb el vistiplau de la Conselleria d'Afers Socials i Esports.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;16.2. Les entitats d'iniciativa privada acollides al règim de concert social han de &lt;/span&gt;&lt;span style="color:#000000"&gt;col·locar en un lloc visible de les seves instal·lacions la indicació &lt;/span&gt;&lt;span style="color:#000000"&gt;«Servei de suport a l'habitatge concertat amb el Govern de les Illes Balears» amb el logoti&lt;/span&gt;&lt;span style="color:#000000"&gt;p corresponent, que els proporcionarà la Conselleria d'Afers Socials i Esports. Així mateix, s'ha de fer referència a aquesta circumstància en les comunicacions i en les relacions que estableixin per escrit amb les persones usuàries del servei concertat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;17. Prerrogatives de l'Administració&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;17.1. L'òrgan instructor del procediment de concertació té la prerrogativa d'interpretar-lo i resoldre'n els dubtes que sorgeixin durant el compliment. D'altra banda, l'òrgan competent per resoldre el procediment té, a més, la prerrogativa de modificar-lo per raons d'interès públic, acordar-ne la resolució i determinar-ne els efectes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;17.2. Els acords que adopti l'òrgan resolutori a partir de les prerrogatives esmentades posen fi a la via administrativa i són immediatament executius.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;18. Causes d'extinció&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Són causes d'extinció de l'acord d'acció concertada les que estableix l'article 9 de la Llei 12/2018, de 15 de novembre, de serveis a les persones en l'àmbit social a la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19. Jurisdicció competent&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;​​​​​​​&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La jurisdicció contenciosa administrativa és la competent per resoldre les qüestions litigioses relatives a la formalització d'aquesta acció concertada i també les sorgides entre les parts sobre la interpretació, la modificació, el compliment, els efectes i l'extinció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
