margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El Consell Insular de Menorca l'any 2009 va crear una borsa de bombers, la qual ha quedat exhaurida. </span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En data 25 de febrer de 2019 el Consell Executiu del Consell Insular de Menorca va aprovar una nova convocatòria del procediment de selecció de personal funcionari interí per cobrir places de bomber al Consell Insular de Menorca, la qual encara no està resolta.</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dia 14 de març de 2020 es va declarar l'estat d'alarma a tot Espanya (Reial decret 463/2020, BOE núm. 67 de 14 de març) a causa de la crisi sanitària provocada per la COVID-19, declarada pandèmia per l'OMS dia 11 de març.</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El Reial decret 463/2020, de 14 de març, recull un seguit de mesures extraordinàries d'efecte immediat a tot l'Estat, entre les quals s'han de destacar la restricció de la llibertat de circulació i la suspensió de tots els termes i terminis administratius.</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Aquesta circumstància va provocar la suspensió dels terminis administratius, amb la consegüent paralització pel fa que a la resolució de la convocatòria del procediment de selecció de personal funcionari interí per cobrir places de bombers, que no estarà resolta abans de començar la temporada d'estiu.</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">No obstant l'anterior, i atès que la disposició addicional tercera del Reial decret 463/2020, de 14 de març, modificada per l'RD 465/2020, de 17 de març, en el seu punt 4 preveu que, malgrat la suspensió general de termes i terminis aprovada d'ençà l'entrada en vigor de la declaració de l'estat d'alarma, les entitats del sector públic poden acordar motivadament la continuació dels procediments administratius referits a situacions estretament vinculades als fets justificatius de l'estat d'alarma, o bé que siguin indispensables per a la protecció de l'interès general o per al funcionament bàsic del serveis.</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">A causa de les jubilacions que van tenir lloc l'any passat al Servei de Prevenció i Extinció d'Incendis i Salvament, es fa necessari cobrir aquestes vacants i és recomanable convocar els esmentats llocs pel procediment de comissió de serveis.</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Atès que es considera que es donen unes circumstàncies de necessitat i excepcionalitat i que és necessari cobrir les vacants per jubilació de forma temporal, sobretot davant la proximitat de la temporada d'estiu, circumstàncies que aconsellen avançar en la tramitació de l'expedient d'aprovació del procediment de comissió de serveis;</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Vist l'informe justificatiu del Servei de Gestió de Persones de la necessitat de tramitar aquest procediment de comissió de serveis;</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Vist l'informe justificatiu del Servei d'Extinció, Prevenció d'Incendis i Salvaments de la necessitat de contractar bombers;</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Atès que, d'acord amb aquests informes, es considera que, en aquests moments excepcionals, es donen unes circumstàncies de necessitat i excepcionalitat que perjudiquen en especial la plantilla de bombers i en general l'illa de Menorca, sobretot durant la temporada d'estiu en què es preveu que pugui haver-hi mes intervencions i amb conseqüències més greus, així com la possibilitat que el personal de la plantilla dels bombers que s'exposi a baixes per la la COVID-19;</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Atès que totes aquestes circumstàncies aconsellen avançar en la tramitació de l'expedient d'aprovació del procediment de comissió de serveis per al bon funcionament d'aquest servei públic i per l'interès general que suposa per a la població de Menorca que aquest organisme, destinat a la prevenció i extinció d'incendis i salvament i a actuacions en matèria d'emergències que puguin sorgir, estigui en disposició de tornar a funcionar a ple rendiment tant durant l'estat d'alarma com una vegada hagin desaparegut les condicions especials provocades per la COVID-19;</span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">D'acord amb el que preveu l'article 82 de la Llei 3/2007, de 27 de març, de la funció pública de la Comunitat Autònoma de les Illes Balears, modificat pel Decret llei 2/2013, de 14 de juny, que regula la comissió de serveis ordinària voluntària, la cap del Servei de Gestió de Persones va emetre l'informe núm. 2020/43, de data 27 d'abril de 2020. </span></span></p> <p style="margin-bottom:0.2cm; margin-top:0.2cm; text-align:justify"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Atesa la proposta del conseller executiu del Departament de Serveis Generals el Consell Executiu, adopta l'acord següent:</span></span></p> <p style="margin-bottom:0.2cm;
