    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen subvencions per a&lt;strong&gt; &lt;/strong&gt;les explotacions a les explotacions agràries, per als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El vicepresident en matèria agrària del FOGAIBA, en data de 26 de març de 2020, signa la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;em&gt;“&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Resolució de revocació parcial&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Antecedents&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1. Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions en les explotacions agràries. La Resolució esmentada es va modificar en data 17 de desembre de 2015 (BOIB núm. 185) i en data 22 de juny de 2016, (BOIB núm. 81).&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;2. Una vegada analitzada tota la documentació presentada, el vicepresident del FOGAIBA va resoldre favorablement la concessió de l'ajuda a favor de Pedro Jorge Llabrés Pocoví, entre d'altres, que figuren en l'annex de la Resolució de concessió, R10 de 30 de juliol de 2019 (BOIB núm. 120, de 31 d'agost de 2019) amb les dades i els imports corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;3. Atesa la Resolució de concessió de l'ajuda esmentada, i d'acord amb el que estableix el punt 8 de l'apartat dotzè de la convocatòria abans esmentada, en els casos en els quals es produeixin desviacions entre la inversió realitzada i l'aprovada s'ajustarà l'ajuda total concedida a l'import de la inversió realitzada, sempre que la finalitat de la subvenció, atesa la seva naturalesa, sigui susceptible de satisfacció parcial, i sempre que s'acostin de manera significativa al compliment total dels objectius prevists.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;4. Dins el termini legalment establert per a la justificació de les inversions aprovades, l'interessat presenta la sol·licitud de pagament, com també la documentació exigida, però, una vegada revisada aquesta, es comprova que el rasclet hilerador adquirit és POTTINGER model TOP 422 per un import de 26.800,00 euros; un model diferent al model del rasclet hilerador concedit CLAAS LINER 2600 amb un cost elegible de 26.800,00 euros, atès aquest canvi es va emetre l'informe de moderació de costs amb data 22 de febrer de 2020, que determina que l'import del rasclet hilerador POTTINGER model TOP 422 és de 8.635,00 euros, el valor de mercat del producte és inferior a l'import que s'ha justificat. No es duu a terme la inversió del motocultor d'un import de 1.372,00 euros.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;5. &lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;L'article 43 del Text refós de la Llei de subvencions, aprovat per Decret legislatiu 2/2005, de 28 de desembre, disposa que “Pertoca la revocació de la subvenció quan, posteriorment a la resolució de concessió vàlida i ajustada a dret, el beneficiari incompleix totalment o parcialment les obligacions o els compromisos contrets als quals està condicionada l'eficàcia de l'acte de concessió de la subvenció. Com a conseqüència de la revocació de la subvenció, queda sense efecte, totalment o parcialment, l'acte de concessió i pertoca el reintegrament de les quantitats percebudes indegudament”. A més a mes, amb motiu d'aquest control, l'import admissible és susceptible d'una reducció atès que l'import sol·licitat (101.558,24 €) supera l'import determinat (89.752,80€) en més del 10 %, per la qual cosa s'aplica una reducció igual a la diferència entre els dos imports, això d'acord amb el punt 1 de l'annex VIII de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 abans esmentada.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;6. En data 9 de març de 2020 es notifica a la persona interessada, mitjançant la publicació al web, l'Informe/Proposta provisional de resolució de revocació parcial de 2 de febrer de 2020, &lt;span style="background-color:white"&gt;ja que l'actuació subvencionable no s'ajusta al que estableix el punt 2.b de l'apartat quart de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, a l'efecte de complir amb el tràmit d'audiència per dur a terme les al·legacions. &lt;/span&gt;Una vegada transcorregut els 10 dies hàbils, la persona interessada no ha presentat cap al·legació, així s'admet informe de moderació de costs de data 22 de febrer de 2020 i no s'aplica la reducció abans esmentada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;7. &lt;span style="background-color:white"&gt;S'ha considerat l'Informe/Proposta provisional de resolució de 2 de febrer de 2020, de revocació parcial de l'ajuda concedida a Pedro Jorge Llabres Pocovi, amb NIF ***9027**.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Fonaments de dret&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

Ordre del conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;em&gt;&lt;span style="line-height:115%"&gt;3. &lt;/span&gt;&lt;span style="background-color:white"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Resolució&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1. Revocar parcialment la resolució d'ajuda concedida al beneficiari per l'import i amb les dades detallades en l'annex d'aquesta resolució, que és un total d'1 expedient i que comença amb &lt;/span&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Pedro Jorge Llabrés Pocoví i acaba amb Pedro Jorge Llabrés Pocoví, que suma un import total de 7.083,26 euros, relativa a la línia d'ajuda “Inversions en les explotacions agràries”, ja que la justificació de la despesa ha estat inferior a l'aprovada.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;2. Notificar aquesta resolució a la persona beneficiària mitjançant la publicació al Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Interposició de recursos&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;Contra aquesta resolució - que no exhaureix la via administrativa - es pot interposar recurs d'alçada davant la consellera d'Agricultura, Pesca i Alimentació, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears, i els articles 121 i 122, de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
