Que el Consell de Mallorca gestiona de manera directa el servei d'Inspecció Tècnica de Vehicles a l'illa de Mallorca, i té la voluntat de simplificar el compliment de les obligacions formals i materials que se'n deriven i els procediments de liquidació de la taxa per a la prestació d'aquest servei. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. Que l'article 27.2 del Real Decret Legislatiu 2/2004, de 5 de març, pel que s'aprova el text refós de la Llei Reguladora de las Hisendes Locals estableix que les entitats locals poden establir Convenis de col·laboració amb entitats, institucions i organitzacions representatives dels subjectes passius de les taxes, amb la finalitat de simplificar el compliment de les obligacions formals i materials que se'n deriven o els procediments de liquidació o recaptació.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Que l'article 7 de l'Ordenança fiscal reguladora de la taxa per a la prestació del servei d'ITV aprovada provisionalment pel Ple del Consell de Mallorca de data 13 de febrer de 2020 (BOIB núm. 21 de 18 de febrer de 2020) preveu la possibilitat que les administracions territorials i administracions institucionals dependents, així com les persones físiques i jurídiques que disposin a nom seu en el permís de circulació d'un nombre de vehicles subjectes a la prestació del servei igual o superior a vint, puguin acollir-se al règim de liquidació, mitjançant la subscripció del present Conveni.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">4. font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El present Conveni se circumscriu a la taxa per prestar el servei de la ITV a qualsevol de les estacions de Mallorca.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Tercera </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Condicions d'accés al sistema de liquidacions</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'accés al sistema de liquidació implica que el contribuent assumeix el sistema de notificació electrònica de les resolucions d'aprovació de les liquidacions i dels documents d'ingrés necessaris per fer el pagament.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Quarta </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Obligacions generales i específiques del Consell Insular de Mallorca</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Correspon al Consell de Mallorca la prestació del servei i la liquidació al contribuent amb la periodicitat següent:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Si el contribuent és una administració territorial o una administració institucional dependent de les anteriors, la liquidació i notificació del tribut s'efectuarà trimestralment.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Si el contribuent és una persona física o jurídica titular de vint vehicles o més, la liquidació i notificació del tribut s'efectuarà mensualment.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les notificacions al contribuent derivades de la gestió de la liquidació s'efectuarà, en tot cas, de forma telemàtica.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Cinquena </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Obligacions del contribuent</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'administració, ens dependent i/o empresa privada, assumeix les obligacions següents:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Complir amb els pagaments, prèvia emissió i notificació telemàtica de la liquidació respectiva. Les liquidacions s'hauran d'ingressar en els terminis assenyalats a l'art. 6.2 de la Llei 58/2003 General Tributària, i l'ingrés es realitzarà a les entitats financeres col·laboradores amb el Consell de Mallorca. </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Proporcionar, potestativament, una adreça de correu electrònic perquè s'avisi que tenen una notificació electrònica a la seva disposició.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Comunicar la flota de vehicles subjectes a la prestació del servei de què disposen i mantenir actualitzada aquesta informació, així com les dades fiscals completes i qualsevol altra informació que el prestador del servei hagi de conèixer.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">-&nbsp;Col·laborar amb el Consell de Mallorca en la detecció, el diagnòstic i la resolució de les incidències relacionades amb les liquidacions emeses, incloent si escau, actuacions que assegurin la reducció del temps de resolució de les incidències.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">- Adoptar i complir les mesures de seguretat necessàries per protegir degudament la informació i els sistemes associats a les solucions tecnològiques incloses en el Conveni esmentat, i acceptar la política de seguretat comuna que s'estableixi.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"> </p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Sisena</span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Mesures de seguiment</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El seguiment del present Conveni es durà a terme per la Direcció insular d'Inspecció Tècnica de Vehicles i Activitats Classificades del Consell de Mallorca, amb domicili al carrer del General Riera, 113, i telèfons &nbsp;971 173 905 / 971 173 558, </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">liquidacions_flotes@conselldemallorca.net // liquidacions_aapp@conselldemallorca.net</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Setena </span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Règim econòmic</span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Aquest Conveni de col·laboració no comporta obligacions econòmiques al marge de les respectives liquidacions per a les parts firmants.</span></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Vuitena</span></strong></span></span></p> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">Procediment d'adhesió </span></strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">1. El Consell de Mallorca, a través de la seva Direcció insular d'ITV, permetrà l'adhesió a aquest Conveni a totes les administracions territorials i administracions institucionals dependents, així com a les persones físiques i jurídiques que disposin a nom seu, en el permís de circulació, d'un nombre de vehicles subjectes a la prestació del servei igual o superior a vint.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">2. El sistema per adherir-se a aquest Conveni es farà mitjançant notificació telemàtica, a la qual s'adjuntarà còpia d'aquest Conveni tipus, i sol·licitud d'adhesió al mateix. Aquests documents estaran publicats a la seu electrònica del Consell de Mallorca.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">3. Un cop que la Direcció insular d'ITV rebi la sol·licitud d'adhesió al Conveni, el conseller executiu dictarà resolució estimant, procedent o no,&nbsp; la petició d'adhesió sol·licitada.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">4. La resolució estimant procedent l'adhesió al Conveni implicarà acollir-se automàticament al règim de liquidació de la taxa per a la prestació del servei d'ITV i al sistema de notificació telemàtica en relació als tràmits derivats de la gestió del tribut.</span></span></span></p> <p style="margin-bottom:0px;
