&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;1. Mitjançant una resolució del conseller d'Educació i Cultura de 21 de maig de 2010 (BOIB núm. 86, de 8 de juny) s'autoritzà l'obertura i el funcionament del centre d'educació infantil privat de primer cicle Baberitos, des Coll d'en Rabassa (Palma), amb el codi de centre 07014648 i tres unitats en funcionament. La titularitat del centre era d'Antònia Palmer Tomás.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;2. Mitjançant una resolució del conseller d'Educació i Universitat de 4 de desembre de 2015 (BOIB núm. 184, de 19 de desembre) s'autoritzà l'obertura i el funcionament del centre d'educació infantil privat de primer cicle Baberitos Tenis, de Palma, amb el codi de centre 07015501 i tres unitats en funcionament. La titularitat del centre era d'Antònia Palmer Tomás.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;3. El 25 de febrer de 2020, la senyora Antònia Palmer Tomás, com a titular del centre, va presentar una sol·licitud de canvi de titularitat dels centres d'educació infantil privats de primer cicle Baberitos i Baberitos Tenis, de Palma, a la qual va adjuntar la documentació següent: l'escriptura de constitució de la societat de responsabilitat limitada Baberitos Kids, SL, els estatuts de la societat i la targeta acreditativa del número d'identificació fiscal B16641508.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;4. El 13 de març de 2020, la cap del Departament de Planificació i Centres va emetre un informe favorable sobre l'autorització del canvi de titularitat dels centres d'educació infantil privats de primer cicle Baberitos i Baberitos Tenis, de Palma. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="background-color:null"&gt;A l'informe s'hi especifica que tal i com disposa la disposició transitòria primera del Decret 60/2008, els centres docents ja autoritzats per impartir educació infantil de primer cicle aban&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;s de l'entrada en vigor d'aquest Decret,&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;s'han d'adaptar al que hi preveu pel que fa al nombre màxim de places escolars, relació professor-unitat i titulació i acreditació dels professionals docents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Aquest és el cas del CEI Baberitos, per la qual cosa es necessari adaptar les ràtios d'aquest centre a la normativa vigent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;5. El 16 de març de 2020, el director general de Planificació, Ordenació i Centres va formular una proposta de resolució sobre l'autorització del canvi de titularitat dels centres d'educació infantil privats de primer cicle Baberitos i Baberitos Tenis, de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;1. La Llei orgànica 8/1985, de 3 de juliol, reguladora del dret a l'educació (BOE núm. 159, de 4 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;2. La Llei orgànica 2/2006, de 3 de maig, d'educació (BOE núm. 106, de 4 de maig).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;3. La Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 44, de 3 d'abril).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;4.&lt;span style="line-height:100%"&gt; El Decret 60/2008, de 2 de maig (BOIB núm. 63, de 8 de maig), pel qual s'estableixen els requisits mínims dels centres de primer cicle d'educació infantil, modificat pel Decret 78/2008, d'11 de juliol (BOIB núm. 100, de 19 de juliol), i pel Decret 58/2019, de 26 de juliol (BOIB núm. 103, de 27 de juliol).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;5. &lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;L'Estatut d'autonomia de les Illes Balears, aprovat per la Llei orgànica 1/2007, de 28 de febrer (BOE núm. 52, de 16 de març), el qual estableix en l'article 36.2 que, en matèria d'ensenyament, correspon a la Comunitat Autònoma de les Illes Balears la competència de desenvolupament legislatiu i d'execució de l'ensenyament en tota la seva extensió, nivells i graus, modalitats i especialitats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;6. &lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;El Decret 21/2019, de 2 d'agost, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;Per tot això, i d'acord amb la proposta formulada per la Direcció General de Planificació, Ordenació i Centres el 16 de març de 2020, dict la següent &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:center"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;1. Autoritzar, amb efectes des de l'1 de novembre de 2109, el canvi de titularitat dels centres d'educació infantil privats de primer cicle Baberitos i Baberitos Tenis, de Palma, que era d'Antònia Palmer Tomás i passa a ser de Baberitos Kids, SL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;2. Determinar que, com a conseqüència d'aquesta modificació, els centres queden configurats de la manera següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Inscriure aquesta autorització en el Registre de centres docents (RCD) de la Direcció General de Planificació, Ordenació i Centres.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;4. Fer avinent al centre esmentat que resta obligat a complir la legislació vigent i a sol·licitar la revisió oportuna de la seva configuració quan s'hagi de modificar qualsevol de les dades que figuren en aquesta Resolució.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;5. &lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller d'Educació, Universitat i Recerca en el termini d'un mes comptador des de l'endemà de la publicació en el BOIB, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;També s'hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació en el BOIB, d'acord amb els articles 10 i 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
