&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Antecedents&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. En data 21 de maig de 2015, va tenir entrada en el registre de Ports de les Illes Balears un escrit del Marina de Bonaire, S.L: &amp;nbsp;mitjançant el qual sol·licitava l'ampliació del termini concessional, fins arribar al termini màxim de 35 anys.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.&lt;strong&gt; &lt;/strong&gt;Forma part de l'expedient administratiu la valoració dels terrenys, de les instal·lacions i de les aigües realitzada per part de l'Àrea Econòmicofinancera de Ports de les Illes Balears d'11 de març de 2019 que inclou la taxació realitzada per l'entitat Tasaciones Inmobiliarias SAU (TINSA&lt;em&gt;)&lt;/em&gt;, sobre el valor de la concessió del port esportiu Marina de Bonaire per un període de 35 anys, de la qual resulta:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Denominació: port esportiu Marina de Bonaire&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Localització: Alcúdia (Mallorca)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Superfície de terra: 19.371,72 m²&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Mirall d'aigua: 22.640,39 m²&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Valoració: 1.803.541,13 €&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. De conformitat amb el que disposa l'article 212.2.&lt;em&gt;b)&lt;/em&gt; de la Llei 11/1998, de 14 de desembre, sobre el règim específic de taxes de la Comunitat Autònoma de les Illes Balears, aquesta valoració se sotmet a informació pública per un període de vint dies, mitjançant un anunci en el BOIB núm. 67, de 18 de maig de 2019.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. En data 5 de desembre de 2019, la Conselleria d'Hisenda i Relacions Exteriors va emetre un informe que conclou que el procediment per al càlcul del valor és correcte.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5.&lt;strong&gt; &lt;/strong&gt;En data 13 de febrer de 2020, el Servei Jurídic de la Conselleria de Mobilitat i Habitatge, competent en matèria de ports, va emetre un informe en el qual s'informa favorablement respecte del procediment seguit de valoració dels terrenys, les instal·lacions i les aigües del port esportiu Marina de Bonaire, en el terme municipal d'Alcúdia, i que, en conseqüència, Ports de les Illes Balears pot elevar la proposta de resolució corresponent al conseller de Mobilitat i Habitatge de les Illes Balears, perquè l'aprovi.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Consideracions jurídiques&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. L'article 212 de la Llei 11/1998, de 14 de desembre, sobre el règim específic de taxes de la Comunitat Autònoma de les Illes Balears, modificada per l'article 38.17 de la Llei 13/2005, de 27 de desembre, de mesures tributàries i administratives, amb relació al procediment de valoració de les concessions d'ocupació i explotació del domini públic portuari.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. L'article 73 i la disposició addicional vuitena de la Llei 6/2014, de 18 de juliol, de modificació de la Llei 10/2005, de 21 de juny, de ports de les Illes Balears, que disposa que els concessionaris de concessions per a la construcció o explotació de ports, dàrsenes, marines i instal·lacions nauticoesportives i recreatives, poden sol·licitar, en el termini d'un any, des de l'entrada en vigor d'aquesta disposició addicional, que el seu termini de concessió sigui de fins a 35 anys, i que en aquest cas el cànon s'ha de calcular o actualitzar tenint en compte el nou període resultant de la concessió.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per tot l'anterior, vists els informes de la Conselleria d'Hisenda i Relacions Exteriors de 5 de desembre de 2019 i del Servei Jurídic de la Conselleria de Mobilitat i Habitatge de 13 de febrer de 2020, prèviament a la informació pública de la valoració corresponent, a proposta de Ports de les Illes Balears, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Proposta de resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Propòs al conseller de Mobilitat i Habitatge que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Aprovar, als únics efectes d'ampliar el termini concesional per 5 anys conforme a la DA 8 de la Llei 6/2014, la valoració de la concessió per un període de 35 anys dels terrenys, de les instal·lacions i les aigües del port esportiu Marina de Bonaire, del terme municipal d'Alcúdia (Mallorca), en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Denominació: port esportiu Marina de Bonaire&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Localització: Alcúdia (Mallorca)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Superfície de terra: 19.371,72 m²&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Mirall d'aigua: 22.640,39 m²&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;— Valoració: 1.803.541,13 €&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2.&lt;strong&gt; &lt;/strong&gt;Aquesta valoració no és susceptible de recurs autònom, sens perjudici dels recursos que pugui interposar el titular de la concessió contra la notificació individual conjunta, del valor i de la nova quantia de la taxa que s'ha d'abonar, d'acord amb el que disposa l'article 212.2 de la Llei 11/1998, de 14 de desembre, sobre règim específic de taxes de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3.&lt;strong&gt; &lt;/strong&gt;Ordenar la publicació d'aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Manifestar la conformitat amb la proposta de resolució i dictar una resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
