    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En relació amb l'assumpte de referència, i d'acord amb l'establert a &lt;/span&gt;l'article 41.3 de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental&lt;span style="color:#000000"&gt;, es publica l'Acord del Ple de la CMAIB, en sessió de 3 de març de 2020,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;DECLARACIÓ D'IMPACTE AMBIENTAL &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El projecte objecte del present informe està inclòs al Grup 2 “Indústria extractiva” punt 1. “Pedreres: restauració i/o extracció” de l'Annex I “Projectes sotmesos a avaluació d'impacte ambiental ordinària” de la Llei 12/2016, de 17 d'agost, d'avaluació ambiental a les Illes Balears (BOIB núm. 106 de 20 d'agost de 2016). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Segons Resolució del conseller de Treball, Comerç i Indústria de data 1 de gener de 2019, al projecte li és d'aplicació la DT2ª de la Llei 10/2014, d'1 d'octubre, d'ordenació minera de les Illes Balears, règim transitori d'obtenció de la declaració d'impacte ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;A més, l'article 12 de la Revisió del Pla Director Sectorial de Pedreres de les Illes Balears (aprovat mitjançant el Decret 61/1999, de 28 de maig) estableix que els Plans de Restauració de les pedreres requereixen informe preceptiu i vinculant de la Comissió Balear de Medi Ambient, actualment CMAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Informació del Projecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El promotor és Pedrera Mitjorn, S.L. i l'òrgan substantiu el Servei de Mines de la DG de Política Industrial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'explotació minera s'ubica a la parcel·la 519 del polígon 31, terme municipal de Felanitx. S'accedeix des del p. k. 8 de la via Ma 4012, per un camí sense asfaltar. Es localitza a menys de 2 km del nucli urbà de Portocolom.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La superfície autoritzada és de 35.000 m&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; dels quals, 29.776,97 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; s'han explotat i dels que 22.622,56 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; estan restaurats. Per tant, només resten 7.154,41 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; sense restaurar que es correspon amb la superfície on es troben l'establiment de benefici (2.689,92 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;), zona d'apilament (4.464,49 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;) i pàrquing.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Segons consta a la documentació, actualment no es realitzen tasques d'explotació però sí que es troba en funcionament l'establiment de benefici, aquest es proveeix de blocs de pedra de Santanyí procedents de la pedrera Sayma (517), amb la qual Griñan forma una unitat d'explotació. La pedrera Sayma es localitza uns 1.400 metres al sud-est de la pedrera Griñan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Les instal·lacions auxiliars que disposa l'explotació són: instal·lacions d'higiene i benestar, taller, dipòsit de gasoil i un sondeig per la captació d'aigües subterrànies (AAS_5466) d'ús industrial. També hi ha fossa sèptica buidada periòdicament per gestor autoritzat. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les edificacions existents són: edifici d'oficines (54 m&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;), nau de tall, magatzem i vestidor (265 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;) i nau de classificació (93 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt;). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'establiment de benefici o planta de tall, està format per un disc pont de tall i dues talladores que s'ubiquen a l'interior d'una nau industrial tancada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Finalment, la maquinària mòbil està formada per dos carretons elevadors i un camió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Revisió del Pla de restauració&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El pla de restauració aprovat preveu el rebliment del buit miner a cota original, el recobriment amb terra vegetal i la plantació posterior d'ametllers.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Actualment el rebliment ha conclòs i la terra vegetal està reposada en la seva totalitat amb l'excepció de la zona d'establiment de benefici i zona d'apilament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La diferència fonamental respecte del pla de restauració aprovat és que ara es planteja una plantació d'herbàcies (cultiu de cereal o altres) en lloc dels ametllers previstos inicialment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Les fases projectades a la revisió del pla de restauració són les següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Fase 1: reposició d'una superfície de 22.600 m&lt;sup&gt;2&lt;/sup&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; amb terra vegetal (30 a 40 cm de gruix), es manté sense coberta una zona de 8.500 m&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;sup&gt;2&lt;/sup&gt; pel desenvolupament de l'activitat minera. Aquesta fase ja es troba executada. Es realitzà al llarg de l'any 2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Fase 2: consisteix en l'activitat de l'establiment de benefici i la sembra de herbàcies (cereal o altres) en la zona limitada i ja restaurada. Es realitzarà de l'any 2015 fins al 2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Fase 3: consisteix en el desmantellament de la maquinària minera però mantenint les edificacions existents atès que es preveu el seu ús posterior com a magatzem agrícola i casa d'eines. També es preveu la disposició de terra vegetal. Es realitzarà al llarg de l'any 2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Les dades de superfícies i anys per a cadascuna de les fases projecta&lt;/span&gt;des es mostra al següent quadre: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La pedrera Griñan pertany a la unitat d'explotació Sayma-Griñan (517-481), és a dir, l'establiment de benefici de la unitat es troba a l'explotació Griñan i això fa que la vida de Griñan estigui condicionada a la vida de Sayma. D'aquesta manera la restauració de Griñan finalitzaria a l'any 2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Tot i això, l'empresa explotadora anticipa el tancament de l'explotació Griñan com a conseqüència d'un canvi en l'estratègia d'explotació, el que suposa una modificació del calendari de restauració previst anteriorment. Així, la data de finalització de la restauració es redueix en 7 anys i passa a març de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Manteniment de la situació actual amb l'establiment de benefici en marxa fins al final de la seva vida útil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Alternativa 1. Execució del pla de restauració actualment aprovat consistent en el rebliment a cota, la plantació d'ametllers i el desmantellament de totes les edificacions existents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Alternativa 2. Difereix de l'anterior en què la plantació d'ametllers es substitueix per un altra d'herbàcies, de més fàcil conreu, atès que permet el seu mecanitzat. També romandran les edificacions i les instal•lacions elèctriques i sanitàries com a suport de l'activitat agrícola prevista. S'opta per aquesta alternativa atès que resulta la millor valorada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es realitza un inventari ambiental que té en compte el medi biòtic, abiòtic i socioeconòmic. Es valoren els possibles impactes associats a l'execució del projecte i es preveuen tot un seguit de mesures protectores en relació als punts crítics ambientals identificats.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Finalment, hi ha un Programa de Vigilància Ambiental dins el qual es detalla l'elaboració d'informes amb diferent periodicitat en base al control d'emissions de pols, renou i vibracions, de l'estat dels dipòsits de combustible i de la fossa sèptica...etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Al BOIB núm. 115 de 18 de setembre de 2018 es realitza la informació pública de l'estudi d'impacte ambiental, projecte d'establiment de benefici i de restauració de l'explotació Griñan (núm. 481) per un termini de trenta dies comptadors a partir de l'endemà de la publicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Durant l'exposició pública es van consultar les següents Administracions afectades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei d'Estudis i Planificació. DG de Recursos Hídrics.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

DG de Salut Pública i Participació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Departament de Territori i Infraestructures. Consell Insular de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Servei de Mines, en el seu ofici de data 17 de desembre de 2018, indica que no té constància de la presentació d'al•legacions durant el tràmit d'exposició pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;A data de realització del present informe s'han rebut informes de:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Servei de Protecció d'Espècies, de data 10 de juliol de 2018 (informe favorable amb condicionant).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei d'Ordenació de Territori, de data 6 de setembre de 2018 (informe amb consideracions).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Ajuntament de Felanitx, de data 30 de novembre de 2018 (informe sense consideracions rellevants).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;- Servei d'Estudis i Planificació, de data 10 de febrer de 2020 (informe favorable).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No s'han realitzat consultes transfrontereres al no considerar-se necessari.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Elements significatius de l'entorn del projecte&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La superfície objecte del projecte de restauració es troba íntegrament en zona d'interès miner (ZIM). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;L'explotació està fora de zones protegides per la Llei 1/1991 d'espais naturals i règim urbanístic a les àrees d'especial protecció de les Illes Balears i fora de Xarxa Natura 2000. Es troba en zona amb vulnerabilitat d'aqüífers moderada i també dins els perímetres de restriccions màximes (250 m) de dos pous de captació d'aigua de proveïment urbà i dins el perímetre de restriccions moderades (1 km) d'altres tres pous de proveïment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;D'altra banda i consultat el Bioatles (quadrícula 1x1), és molt possible la presència d'exemplars de tortuga mediterrània (testudo hermanni) a la zona objecte de projecte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Consideracions tècniques &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. Segons la Resolució del Conseller de Treball, Comerç i Indústria de data 18 de gener de 2019, l'estat de l'explotació minera Griñan passa a ser de Restauració i la nova data de la fi d'autorització és l'11 de gener de 2020. A la Resolució de regularització es fa constar, respecte a la data de finalització, que actualment l'explotació es troba en tràmit ambiental i que pot ser condicionada al resultat de l'informe de l'òrgan ambiental.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. La disponibilitat actual dels terrenys afectats és fins al 28 de febrer de 2021, segons pròrroga del contracte d'arrendament presentat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. El rebliment de Griñan s'ha dut a terme mitjançant materials inerts de la pròpia pedrera, inerts procedents del tractament de la pedra natural en l'establiment de benefici, restes d'inerts de la pedrera Sayma amb la que forma una unitat d'explotació i, fraccions de terres d'excavació i desmunt de diverses obres de construcció.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Es justifica el canvi de plantació d'ametllers, previst al pla de restauració aprovat (1990) per herbàcies per petició de la persona propietària de la finca, com a conseqüència de les infeccions per Xylella fastidiosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. A la parcel·la hi ha un pou autoritzat per a ús industrial (AAS_5466). Així mateix, les aigües d'ús sanitari es subministren amb camió i s'emmagatzemen en dipòsit aeri.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;5. Respecte de les emissions a l'atmosfera, l'explotació està inscrita com a activitat potencialment contaminant de l'atmosfera (APCA 0098).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. Les instal·lacions associades a l'explotació (establiment de benefici, dipòsits de combustible i fosa sèptica) així com les edificacions que es preveien mantenir inicialment, ara es desmantellen, per tant no podran considerar-se com a element discordant a efectes d'integració paisatgística una vegada finalitzada la restauració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. Pel que fa a l'annex d'incidència paisatgística, es realitza una anàlisi d'acord amb una conca visual de 5 km de radi, resultant una visibilitat de l'explotació del 4,80%. S'inclouen imatges de l'estat que es preveu tingui la parcel•la al finalitzar la restauració en comparació amb l'estat actual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;8. El Servei d'Estudis i Planificació en el seu informe de data 10 de febrer de 2020 considera, respecte dels perímetres de restriccions dels pous de proveïment, que la restauració definitiva minimitza el risc de contaminació de l'aqüífer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;9. En base a tot l'anterior i tenint en compte que l'objectiu de la restauració plantejada es la restitució de la situació topogràfica inicial (rebliment a cota) i l'eliminació de totes les instal•lacions i edificacions associades, es considera que la solució adoptada és la més favorable respecte de las plantejades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. Conclusions&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Per tot l'exposat es proposa formular la declaració d'impacte ambiental favorable a la realització del pla de restauració de la pedrera Griñan (núm. 481), que forma part de la parcel·la 519, polígon 31 del terme municipal de Felanitx promogut per Pedrera Mitjorn, S.L., al concloure's que previsiblement no es produiran impactes adversos significatius sempre que es compleixen les mesures incloses en l'EIA, en la documentació complementària i els condicionants següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Les emissions de pols i renou, tant al camí d'accés a la finca com a l'interior de la pròpia parcel·la hauran d'estar dins els llindars establerts per la normativa vigent. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-En el cas que durant el desmantellament de les edificacions que resten es detecti algun exemplar de tortuga mediterrània (testudo hermanni) haurà de traslladar-se a un altre lloc proper de característiques ambientals semblants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-El programa de vigilància ambiental haurà d'ajustar-se a la situació actual de la pedrera, en restauració, fent especial incidència en el control i seguiment ambiental una vegada finalitzada la restauració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-Tal i com s'estableix a l'article 18.1 del Decret 61/1999, de 28 de maig, d'aprovació definitiva de la revisió del Pla director sectorial de pedreres de les Illes Balears, la devolució de la fiança se formalitzarà per la DG d'Indústria previ informe de la CMAIB, sempre que els treballs de restauració hagin complert els objectius previstos al pla de restauració.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-En base al que estableix l'article 52.2 de la Llei 21/2013, de 9 de desembre, d'avaluació ambiental, s'haurà d'informar a la CMAIB respecte a la finalització de cadascuna de les fases de restauració a fi de realitzar les comprovacions que es consideren necessàries per tal de verificar el compliment del condicionat de la DIA.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Es recorda que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-L'ús d'inerts externs pel rebliment que provinguin de residus de construcció-demolició (RCDs), desmunts i terres no contaminades, s'haurà de comunicar al Consell Insular de Mallorca tal i com estableix la disposició addicional 3ª del Pla Director Sectorial per a la Gestió de Residus de Construcció-Demolició, Voluminosos i Pneumàtics Fora d'Ús de l'Illa de Mallorca (BOIB núm. 141 de 23 de novembre de 2002) encara vigent tal i com estableix la disposició derogatòria 2ª del vigent Pla Director Sectorial de Residus No Perillosos de l'Illa de Mallorca (PDSRNPMA, BOIB núm. 81 de 18 de juny de 2019). També s'haurà de comunicar al Servei de Residus i Sòls Contaminants, d'acord amb l'article 5 de l'ordre APM/1007/2017, de 10 d'octubre (BOE núm. 254 de 21 d'octubre de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;-La resolució d'autorització del sondeig vigent AAS_5466 fa constar que: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;[...] qualsevol modificació del cabal màxim instantani o ús de les aigües implicaria la iniciació d'un expedient de nova autorització o de modificació de les característiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Aquesta DIA s'emet sense perjudici de les competències urbanístiques, de gestió o territorials de les administracions competents i de les autoritzacions o informes necessaris per a l'obtenció de l'autorització, a més a més compleix el que estableix l'article 12 del PDS de Pedreres de les Illes Balears (aprovat mitjançant Decret 61/1999, de 28 de maig).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
