    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Es fa públic que durant el període d'exposició pública de l'acord d'aprovació inicial de l'Ordenança reguladora del cementeri municipal&lt;span style="background-color:#f8fbfd"&gt; en el ple municipal de Deià&lt;/span&gt;, adoptat en sessió plenària de dia 30 de gener de 2020, BOIB nº 19, de 13 de febrer de 2020, no s'ha presentat cap al·legació, per la qual cosa es considera aprovat definitivament, procedint a la publicació del text íntegre de l'esmentat Reglament:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;“&lt;strong&gt;&lt;em&gt;ORDENANÇA REGULADORA DEL CEMENTERI MUNICIPAL&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;DISPOSICIÓ DE MOTIUS&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Atès que no existeix en aquest municipi de cap ordenança que reguli tot allò referent al Cementiri Municipal més enllà de la corresponent Ordenança Fiscal, de la necessitat de regular-ne tots els aspectes relacionats amb el seu funcionament segons els costums locals i la legislació vigent, es procedeix a l'aprovació d'aquesta ordenança.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;TÍTOL I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;DISPOSICIONS GENERALS &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 1 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;El cementeri municipal de Deià és un bé de servei públic que està subjecte a l'autoritat de l'Ajuntament, al qual correspon la seva administració, direcció i conservació, excepte en allò que sigui competència pròpia d'altres autoritats i organismes. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 2 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;També correspon a l'Ajuntament: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;a) L'organització, conservació i condicionament del cementiri, com també de les construccions funeràries, dels serveis i les instal·lacions. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;b) L' autorització a particulars per la realització al cementeri de qualsevol tipus d'obres o instal·lacions, com també la seva direcció i inspecció. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;c) L'atorgament de les concessions demanials i el reconeixement dels drets funeraris de qualsevol classe.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;d) L'autorització de les inhumacions, exhumacions i trasllats de cadàvers i restes que pretenguin realitzar-se en el cementiri municipal, així com la recepció de restes o cendres.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;e) La percepció dels drets i taxes que s'establiran legalment segons l'ordenança fiscal corresponent. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;f) El compliment de les mesures sanitàries i higièniques dictades o que es dictin en el futur. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 3 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Correspon a les empreses que realitzin els serveis funeraris d'aquesta localitat la prestació dels treballs propis del servei com també la conducció de cadàvers, trasllat de restes, subministrament de taüts, fins al moment de la inhumació de les restes mortals, amb submissió a allò previst a la legislació i normativa vigent. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;L'Ajuntament els autoritzarà l'accés lliure al Cementeri Municipal amb la finalitat que puguin prestar els serveis que desenvolupen. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;TÍTOL II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;POLÍTICA ADMINSTRATIVA I SANITÀRIA DEL CEMENTERI &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&amp;nbsp;L'ADMINISTRACIÓ DEL CEMENTIRI&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 4 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;L'Administració del cementeri serà a càrrec de l'Ajuntament. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 5 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Corresponen a l'Ajuntament, les competències següents: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;a) Expedir les autoritzacions d'inhumacions, exhumacions i trasllats. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;b) Dur els llibres-registre públic de totes les sepultures i les operacions que s'hi realitzin, així com de les incidències pròpies de la seva titularitat. Aquest registre comprendrà: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;1. Registre general de les sepultures&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;2. Registre d'inhumacions&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;3. Registre d'exhumacions i trasllats&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;c) Practicar les inscripcions corresponents a tots els llibres-registre.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;d) Expedir els títols i anotar les transmissions d'acord amb els acords municipals adoptats.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;e) Cobrar els drets i taxes per prestació dels serveis funeraris del cementeri, de conformitat amb l'ordenança fiscal corresponent. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;f) Expedir els informes que se sol·licitin i conformar les certificacions amb referència als llibres i altres documents que es portin en el servei. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 6 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Ni l'Ajuntament ni cap dels seus òrgans, inclòs el personal, assumiran cap tipus de responsabilitat respecte a robatoris, furts i desperfectes que puguin cometre tercers en les sepultures i els objectes que es col·loquin en el cementiri, fora dels casos previstos en la legislació vigent. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL II &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;ORDRE I GOVERN INTERIOR DEL CEMENTIRI &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 7 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Al cementiri hi haurà una ossera general per recollir les restes resultants de la neteja i el desallotjament de sepultures. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Atenent a raons d'investigació, estudi o altres de naturalesa anàloga, es podran recuperar restes de l'ossera mitjançant l'autorització escrita de l'Ajuntament, prèvia sol·licitud de l'entitat o persona interessada i, si fos necessària, del departament corresponent del Govern de les Illes Balears. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;No es podran reclamar restes de cadàvers enterrades en la fossa comuna per part de familiars del difunt o altres persones considerades interessades, llevat dels casos disposats per les autoritats judicials o sanitàries. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 8 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Durant la nit queda expressament prohibit realitzar enterraments i qualsevol altre tipus de treball dins el recinte del cementeri, excepte casos degudament justificats. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 9 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;L'Ajuntament tendrà cura dels treballs de conservació i neteja generals del cementeri. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;La neteja i conservació de sepultures i dels objectes i les instal·lacions aniran a càrrec dels particulars. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Si els particulars incomplissin el deure de neteja i conservació de sepultures, o se n'apreciàs un estat de deteriorament, es requerirà el titular del dret afectat per al seu arranjament i, si no realitzàs els treballs en el temps assenyalat, l'Ajuntament podrà realitzar-los de forma subsidiària, a càrrec de l'afectat. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 10&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Queden prohibides les flors i ornamentacions vegetals de plàstic o tela, excepte les condecoracions oficials. L'Ajuntament les retirarà d'ofici sense necessitat de requeriment al titular.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL III&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&amp;nbsp;INHUMACIONS, EXHUMACIONS I TRASLLATS&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 11 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Tota inhumació, exhumació o trasllat exigirà l'autorització municipal i de les autoritats sanitàries corresponents, en els casos que siguin necessàries. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 12 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En les peticions d'inhumació, l'interessat o interessada presentarà a les oficines municipals els documents següents: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;a. Títol funerari o autorització d'enterrament a la sepultura municipal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;b. Autorització d'inhumació. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;c. Llicència d'enterrament.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;d. Autorització judicial, en els casos diferents a la mort natural.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 13&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;A la vista de la documentació presentada es farà l'anotació corresponent al llibre de registre i en el cas de nova concessió, es formalitzarà l'atorgament de la concessió. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 14 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En el moment de presentar un títol per fer una inhumació, s'identificarà a la persona a favor de la qual s'hagi emès. En el cas que comparegui una persona diferent del titular, aquesta haurà de justificar la seva intervenció i legitimació. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 15 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Per efectuar la inhumació d'un cadàver que no sigui el propi titular, en els casos en què no es presentàs el títol, es requerirà la conformitat del titular i, si és absent, de qualsevol persona que tingui dret a succeir-lo en la titularitat. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 16 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Excepte que hi hagi una disposició general que ho autoritzi, no podran realitzar-se trasllats o remoció de restes fins que hagin transcorregut dos anys des de la inhumació i cinc si la causa de mort representàs un greu perill sanitari. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 17 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;L'exhumació d'un cadàver o de restes de cadàvers per la seva inhumació en un altre espai del cementeri o bé en el cementeri d'un altre terme municipal, requerirà la sol·licitud de titular de la sepultura final, acompanyada de la corresponent autorització municipal, o bé, del departament del Govern de les Illes Balears competent, havent-se de respectar els terminis previstos a l'article anterior. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 18 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Els enterraments en el cementiri municipal es faran sense cap discriminació per raons de religió o qualsevol altre tipus. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 19 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;El dret funerari comprèn les concessions de sepultures, entenent-se com a tals tombes, columbaris, nínxols i panteons del cementiri a que es refereix aquest títol. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Els drets seran atorgats i reconeguts per l'Ajuntament d'acord amb les prescripcions d'aquesta Ordenança i amb les normes generals sobre contractació local. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 20 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Tot dret funerari s'inscriurà al llibre de registre acreditant-se les concessions o autoritzacions mitjançant l'expedició del títol corresponent. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 21 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;El dret funerari implica tan sols l'ús de les sepultures del cementiri, la titularitat demanial de les quals correspon a l'Ajuntament de conformitat amb el que estableix l'article 1 d'aquesta ordenança. Tendrà per causa i finalitat el sepeli de cadàvers i restes humanes. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 22 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les tombes, columbaris, nínxols, panteons i qualsevol altre tipus de construcció que hi hagi al cementiri, així com els drets constituïts sobre aquests, es consideraran béns fora de comerç. En conseqüència no podran ser objecte de compravenda o permuta. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 23 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les obres de caràcter artístic i qualsevol altra instal·lació fixa que s'instal·lin a les sepultures revertiran a l'Ajuntament en finalitzar la concessió. Malgrat això, es podrà autoritzar la seva retirada durant la vigència de la concessió sempre que això no impliqui un deteriorament de les mateixes. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 24 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Quan mori el titular sense haver designat beneficiari ni atorgat testament i sense deixar cap parent, el dret funerari revertirà automàticament a l'Ajuntament. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL II &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;LES CONCESSIONS &lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 25 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;La titularitat d'un dret funerari només pot correspondre a persones físiques, neix per l'acte de la concessió i comportarà el pagament de la taxa o exacció establerts a la corresponents ordenança fiscal. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 26&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;La titularitat d'un dret funerari podrà correspondre a una o diverses persones.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En cas d'haver-hi diversos titulars hauran de contribuir una comunitat en la seva relació amb l'Ajuntament; en tot cas l'Ajuntament pot obligar-ho.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En cas de renúncia o extinció del dret funerari de qualque titular en comunitat, la resta conservaran la titularitat en proporció a l'antic repartiment.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 27 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les concessions de drets funeraris tendran una durada de 75 anys&lt;a href="#sdfootnote1sym#sdfootnote1sym" style="color:blue; text-decoration:underline"&gt;&lt;sup&gt;1&lt;/sup&gt;&lt;/a&gt;. Transcorregut aquest plaç el/s titular/s tendrà/n preferència a l'hora d'obtenir la nova concessió de la sepultura.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 28&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Beneficiaris són les persones designades pels titulars per a succeir-los com a tal després de la seva mort. La designació es durà a terme per mitjà de compareixença del concessionari davant el departament gestor, o en document notarial, i requerirà per a la seva eficàcia l'acceptació del/s beneficiari/s. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 29 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les concessions s'acreditaran mitjançant el corresponent títol, que serà expedit per l'administració municipal. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Als títols de concessió, s'hi farà constar: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;- Dades d'identificació de la sepultura.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;- Data de l'adjudicació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;- Nom, llinatges i DNI del/s titular/s.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 30 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En cas de deteriorament, subtracció, pèrdua o còpia del títol funerari, s'expedirà duplicat amb la sol·licitud prèvia de la persona interessada. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 31&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Els enterraments successius en un mateix columbari o nínxol, no alteraran el dret funerari preexistent. Si s'hagués de practicar una nova inhumació abans d'arribar el termini de la concessió, aquesta podrà ser prorrogada per un període de cinc (5) anys des de la data de la inhumació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL III&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&amp;nbsp;DE LA SEPULTURA MUNICIPAL&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 32&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;El dret d'enterrament a la sepultura municipal neix per l'acte de l'autorització i comportarà el pagament de la taxa o exacció establerts a la corresponents ordenança fiscal. La sepultura municipal no podrà ser objecte de concessió i el seu ús no reportarà cap altre dret.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 33&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;El dret d'enterrament a la sepultura municipal tendrà una durada de 5 anys, prorrogable en un màxim de 3 ocasions.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 34&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Transcorregut els termini de 5 anys i sempre que l'Ajuntament necessiti de l'espai, es traslladaran les restes a la fossa comuna, sense que els familiars o hereus de la persona difunta puguin reclamar-ne les despulles, llevat de en aquells casos on ho disposi l'autoritat judicial o sanitària.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL IV &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;LA TRANSMISSIÓ DELS DRETS FUNERARIS&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 35 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En el moment en què es produeixi la mort del titular d'un dret funerari, tendran dret a la transmissió al seu favor, per aquest ordre, els beneficiaris, els hereus testamentaris, el cònjuge supervivent, i si falta, les persones a qui correspongui la successió intestada. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;​​​​​​​&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 36 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Es considerarà vàlida qualsevol cessió del dret funerari sobre sepultures per actes intervius o mortis causa, entre el titular i un parent per línia directa o col·lateral. La cessió intervius es farà mitjançant la signatura dels documents de renúncia i acceptació que el cedent i receptor, estaran obligats a realitzar davant del servei municipal gestor. Tanmateix, el cedent haurà de fer lliurament del títol de la concessió transmesa al servei esmentat, que quedarà anul·lat i se n'emetrà un de nou a favor del receptor. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En el cas de mort del titular, la cessió haurà de quedar acreditada per qualsevol tipus de document de naturalesa testamentària. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Excepcionalment, l'Ajuntament podrà admetre la cessió en favor d'un tercer, sense cap vincle de parentesc amb el cedent, atenent a les circumstàncies concretes del cas. Totes aquestes cessions no alteren el termini per al qual va ser concedit el dret funerari. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 37 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les transmissions per actes mortis causa seran vàlides amb la formalitat següent: a la mort del titular d'un dret funerari, el/s beneficiari/s o en el seu defecte, la/les persona/es hereva/es, té/tenen dret a la transmissió al seu favor. Cas que una disposició testamentària posterior contradigui expressament la designació de beneficiari en relació amb el dret funerari, tendrà preferència el que resulti del testament. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL V&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&amp;nbsp;EXTINCIÓ DELS DRETS FUNERARIS&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 38&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Es decretarà l'extinció del dret funerari, donant lloc a la revocació o rescat de la concessió de la corresponent sepultura a favor l'Ajuntament en els casos següents: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;a) Per estat ruïnós de l'edificació, declarat per l'informe tècnic previ, i l'incompliment del termini que s'assenyali al/s titular/s per a la seva reparació i condicionament, prèvia tramitació de l'expedient amb audiència al/s interessat/s. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;b) Per abandonament de la sepultura. Es consideraran abandonament de la sepultura els dos supòsits següents: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;1. El transcurs de quatre (4) anys des de la mort del titular sense designar beneficiari, sense que els hereus o persones subrogades per herència o altres títols hagin instat l'Ajuntament el canvi de nom.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;2. La manca de pagament dels drets o taxes corresponents a un període quatre (4) anys. Una vegada iniciat l'expedient de revocació per aquesta causa caldrà liquidar la totalitat del deute per tal d'evitar l'extinció del dret.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;c) Per transcurs dels terminis per als quals va ser concedit el dret.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;d) Per circumstàncies sobrevingudes d'interès públic. En aquest cas, el rescat de la concessió suposarà l'abonament de la indemnització corresponent, i, si escau, es produirà el rescabalament dels danys produïts. L'import de la indemnització es determinarà d'acord amb la quota tributària de les concessions establertes a l'ordenança fiscal. Es calcularà en funció del número d'anys que resten a la concessió, prorratejant-se a la unitat superior les fraccions de temps. El límit màxim dels anys a considerar per calcular la indemnització serà de 99 anys. Si a la construcció hi haguessin restes per buidar, el cost acreditat del servei serà deduït de la indemnització.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 39 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;L'Ajuntament recuperarà la sepultura en el cas de renúncia expressa del titular. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;El titular d'un dret funerari podrà renunciar-hi, sempre que en la sepultura corresponent no hi hagi restes inhumades, mitjançant la corresponent sol·licitud a l'Ajuntament. Si hi existissin restes, i transcorregut els terminis previstos a l'article 16, es traslladarien a l'ossera general, quedant el nínxol a disposició de l'Ajuntament per tal que el pogués atorgar una nova concessió. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 40 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En els supòsits d'extinció de la concessió previstos a l'article 38, aquesta requerirà notificació personal al titular o als seus successors si se'n coneix el domicili, i en el seu defecte, sotmetre-la a informació pública, mitjançant anuncis al Butlletí Oficial de l'Estat, al taulell d'anuncis de l'Ajuntament de Deià i a l'Ajuntament corresponent al darrer domicili del titular o dels seus successors. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;TÍTOL IV&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&amp;nbsp;CONSTRUCCIONS&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&amp;nbsp;DE LES CARACTERÍSTIQUES GENERALS&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 41 &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;L'Ajuntament ha de construir per a les necessitats de la població una quantitat suficient de nínxols i tombes, d'acord amb les dades estadístiques, i en n'atorgarà el dret funerari en el casos d'inhumació i de trasllats de restes, ajustant-se a l'ordre rigorós de petició. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Queda prohibida la construcció de nous panteons.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 42&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les tombes han de seguir l'estètica tradicional de Deià, quedant prohibits els elements constructius verticals permanents, exceptuant les obres commemoratives promogudes per les administracions públiques que, tanmateix, hauran d'integrar-se al màxim en l'entorn.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 43&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les obres realitzades per particulars hauran d'efectuar-se en dies laborables, durant l'horari d'obertura al públic, i hauran de comptar amb la llicència i/o coneixement municipal. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;CAPÍTOL II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&amp;nbsp;DELS ELEMENTS ORNAMENTALS&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 44&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;La conservació i manteniment dels elements decoratius i accessoris que s'instal·lin en les sepultures aniran a càrrec dels titulars dels drets funeraris. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;&lt;strong&gt;Article 45&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;La col·locació d'epitafis i làpides només estarà permesa per a persones sepultades en el cementeri de Deià, i requerirà de coneixement municipal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;La col·locació d'epitafis i làpides, si envaeixen terrenys o espais d'altres sepultures, seran retirats a requeriment de la part afectada i es procedirà a l'execució forçosa dels acords que s'adoptin, si no són ateses per les persones interessades a les quals se'ls haguessin concedit. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Article 46&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Respecte a les operacions d'ornamentació dels columbaris, nínxols i panteons, una vegada finalitzades, les flors, les fulles i els objectes que es vulguin eliminar es dipositaran al lloc destinat a l'efecte, dins de l'espai del cementeri, i es deixarà totalment net l'espai frontal dels columbaris i nínxols i el perímetre dels panteons i de les sepultures. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En cas que l'ornamentació s'hagi deteriorat l'Ajuntament la retirarà d'ofici sense necessitat de requeriment al titular.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;DISPOSICIÓ ADICIONAL ÚNICA&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;En tot el que no estigui previst en aquesta Ordenança serà d'aplicació la legislació autonòmica i estatal. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;DISPOSICIÓ TRANSITÒRIA PRIMERA&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Amb caràcter general aquest Ajuntament ha vingut atorgant concessions indefinides fins al 27 de maig de 1980. Per tal de salvaguardar els interessos generals municipals i d'acord amb la normativa que fixa un límit temporal a les concessions de domini públic, s'estableix que totes les concessions indefinides o a perpetuïtat així com aquells títols de compra tendran una durada màxima de 75 anys&lt;a href="#sdfootnote2sym#sdfootnote2sym" style="color:blue; text-decoration:underline"&gt;&lt;sup&gt;2&lt;/sup&gt;&lt;/a&gt;, a comptar des de la data d'aprovació d'aquesta ordenança.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;DISPOSICIÓ TRANSITÒRIA SEGONA&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Les tombes que no compleixin amb l'estètica requerida a l'article 42 podran mantenir-la fins que s'acabi la concessió o el moment de realitzar-hi obres, en què s'haurà d'adaptar al previst al citat article. L'Ajuntament també podrà oferir subvencions per a l'adaptació de sepultures amb la concessió vigent, d'acord amb el/s titular/s.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;em&gt;DISPOSICIÓ FINAL&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;em&gt;Aquesta Ordenança entrarà en vigor al dia següent de la seva publicació.”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
