    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;L&amp;apos;apartat 9.3 de la Resolució de el president de el Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 21 de desembre de 2018, per la qual es convoquen, per a l&amp;apos;any 2018, subvencions per a inversions en la prevenció dels danys causats en els boscos per incendis forestals, desastres naturals i catàstrofes, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d&amp;apos;acord amb els termes que preveu l&amp;apos;article 45.2 de la Llei 39/2015, de 1 d&amp;apos;octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l&amp;apos;article 43 de la Llei 30/2015, de 1 d&amp;apos;octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El vicepresident&amp;nbsp;en matèria agrària del FOGAIBA, amb data 4&amp;nbsp;de febrer&amp;nbsp;de 2020, va signar la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;1.El 29 de desembre de 2018 es va publicar al BOIB núm. 63, la Resolució del president del Fogaiba de data 21 de desembre de 2018, per la qual es convoquen, per a l&amp;apos;any 2018, subvencions per a inversions en la prevenció dels danys als boscos per incendis forestals, desastres naturals i catàstrofes.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;2.De conformitat amb l&amp;apos;apartat sisè de l&amp;apos;esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 28/02/2019.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;3.En data 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;5&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;d&amp;apos;octubre de 2019, es va dictar la Resolució de concessió de la Remesa &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;3&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;que inclou el expedient PIFO 2018_1/0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;65&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;a nom de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Marcus Heinrich Hermanns&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, amb NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;X0776810P, que es va publicar al BOIB núm. 148 el 31 d&amp;apos;octubre de 2019.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;4.L&amp;apos;interessat va sol·licitar, amb data &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de registre d&amp;apos;entrada 23&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gener&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, el desistiment de l&amp;apos;ajuda concedida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;5.L&amp;apos;article 21.1 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques estableix l&amp;apos;obligació de l&amp;apos;Administració a dictar resolució expressa i a notificar-la. En el seu paràgraf segon especifica que “En els casos de prescripció, renúncia del dret, caducitat del procediment o desistiment de la sol·licitud, així com la desaparició sobrevinguda de l&amp;apos;objecte del procediment, la resolució consistirà en la declaració de la circumstància que concorri en cada cas, amb la indicació dels fets produïts i les normes aplicables”.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;6.Atès tot això, s&amp;apos;informa favorablement i es proposa fer la revocació total de l&amp;apos;ajuda a petició de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l&amp;apos;interessat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
