![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'Agència d'Estratègia Turística de les Illes Balears (endavant AETIB) en virtut de l'establert al Decret 18/2018, de 22 de juny, té entre les seves finalitats, l'elaboració de l'estratègia turística per a la millora del posicionament internacional de les Illes Balears. Es per això, que un dels <span style="background-color:white">objectius de l'AETIB és crear una oferta diferenciada que creï valor i que es dirigeixi a segments específics, a més, les Illes Balears disposen d'actius turístics que han de ser recuperats, valorats i potenciats.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">Els patrocinis d'esdeveniments que es considerin singulars i que estan vinculats als productes prioritaris de les Illes Balears, es converteixen en una plataforma molt útil i versàtil que permet transmetre els valors inherents a les marques turístiques de Mallorca, Menorca, Ibiza i Formentera.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white">A efectes d'aquesta convocatòria, és consideren “Esdeveniments singulars” </span> aquells esdeveniments que presenten unes característiques especials i diferenciadores respecte a la resta i que per la seva notorietat i repercussió mediàtica destaquen per davant d'altres esdeveniments. Aquests hauran de tenir una clara vocació de continuïtat en el temps, és a dir que es realitzin o es vulguin realitzar de forma periòdica (anualment). Queden exclosos d'aquesta definició els esdeveniments que tinguin una duració que es prolongui en el temps i sigui superior a 10 dies. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">La voluntat de l'AETIB és que la participació en aquesta convocatòria per a la formalització de contractes privats de patrocini amb entitats privades estigui subjecta als principis de publicitat, transparència, cooperació i eficiència de la utilització dels recursos públics. La participació en aquestes convocatòries suposa l'acceptació dels termes i condicions establerts, que s'annexen a aquesta Resolució.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">L'objecte d'aquesta convocatòria, pública i oberta, és oferir la possibilitat de formalitzar contractes privats de patrocini amb entitats privades que duguin a terme esdeveniments singulars a les Illes Balears. Aquest han de tenir una repercussió mediàtica molt elevada, generant gran notorietat per a les marques que es vinculen. Així mateix s'han de celebrar des de l'1 d'abril al 30 de juny de 2020.</span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">L'àmbit territorial d'aquesta convocatòria es circumscriu als esdeveniments que es desenvolupen de forma efectiva al territori de les Illes Balears</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El pressupost que es reserva, per aquesta convocatòria, és d'un màxim de 420.000 € (impostos inclosos). D'aquesta quantitat un màxim de 320.000€ seran <span style="color:black"> finançats amb fons de l'Impost de Turisme Sostenible (ITS) 2019 </span>dins del PROGRAMA 1. Posicionament de les marques turístiques Mallorca, Menorca, Ibiza i Formentera del projecte anomenat “<em>Millora de la competitivitat del sector turístic de les Illes Balears, mitjançant el posicionament dels valors de les marques turístiques Mallorca, Menorca, Ibiza i Formentera, el desenvolupament del talent, el coneixement i la creació de producte”</em>, i 100.000€ a càrrec del Capítol VI –Inversions reals- al pressupost de l'AETIB per a l'exercici 2020.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Per aquest motiu les marques de destinació que s'inseriran a les publicacions, emissions, publicitat i accions promocionals hauran d'anar sempre vinculades a la marca d'ITS, a</span> més de la marca de destí a la qual es vincula l'esdeveniment.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Per tot això, amb l'autorització prèvia de la despesa per aquesta convocatòria autoritzada per resolució del conseller de Model Econòmic, Turisme i Treball de data 19 de febrer de 2020, s'aproven annexes a aquesta Resolució, els <span style="color:black">Plecs de condicions generals que han de regir la convocatòria pública pel patrocini d'esdeveniments singulars i la tramitació dels expedients de contractació que es derivin d'aquesta</span></span></p>
<p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolc</strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Primer</strong>.-Aprovar<span style="color:black"> els Plecs de condicions generals que han de regir la convocatòria publica per la formalització de contractes privats pel patrocini d'esdeveniments singulars </span>(ANNEX A).</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segon.</strong>- Ordenar la publicació en el BOIB d'aquesta Resolució i dels annexes que l'acompanyen. </span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aquesta resolució tindrà efectes des de l'endemà de la seva publicació en el BOIB.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposició de recursos</strong></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra aquesta resolució —que exhaureix la via administrativa— es pot interposar recurs potestatiu de reposició davant el president de l'AETIB en el termini d'un mes a comptar des de l'endemà de la seva publicació en el BOIB, d'acord amb el que estableixen l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears (BOIB núm. 44, de 3 d'abril) i l'article 123 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques (BOE núm. 236, de 2 d'octubre).</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">També es pot interposar recurs contenciós administratiu davant el jutjat contenciós administratiu, en el termini de dos mesos des de l'endemà de la publicació en el BOIB, d'acord amb el que estableix l'article 46 de la Llei 29/1998, de 13 de juliol, de la jurisdicció contenciosa administrativa.</span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">L'objecte d'aquesta convocatòria, pública i oberta, és oferir la possibilitat de formalitzar contractes privats de patrocini amb entitats privades que duguin a terme esdeveniments singulars a les Illes Balears. <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">D'acord amb l'estratègia desenvolupada pels Segments Estratègics de Turisme (SET's) tots els esdeveniments patrocinats per l'AETIB hauran d'estar vinculats a un dels productes estratègics.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Tots els esdeveniments han d'estar sempre vinculats, a més de la marca ITS, a una de les marques de destinació: Mallorca, Menorca, Ibiza i Formentera i/o Illes Balears. En el cas que l'esdeveniment es desenvolupi en més d'una illa, i compleixi amb els percentatges d'inversió indicats a l'apartat 3 d'aquest annex A, es considerarà que es promociona, i per tant, es vincula a la marca Illes Balears.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%">1.1 Requisits dels esdeveniments</span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Es consideren esdeveniments susceptibles d'obtenir patrocini aquells que compleixin tots els requisits generals següents:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">A) Que siguin esdeveniments que el seu promotor sigui una empresa/entitat privada. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">B) Que estiguin vinculats directament a alguns dels productes estratègics de l'AETIB.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">C) Que fomentin la creació, diversificació i comercialització d'alguns dels productes estratègics de l'AETIB.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">D) Que compleixin amb els requisits mínims de repercussió mediàtica i pressupost que es detallen a continuació. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">E) Que es desenvolupin des de l'1 d'abril de 2020 al 30 de juny de 2020.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">F) L'àmbit territorial d'aquesta convocatòria es circumscriu als esdeveniments que es desenvolupen de forma efectiva al territori de les Illes Balears. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Aquests esdeveniments han de complir uns requisits tècnics mínims per poder optar a aquesta convocatòria, que s'adaptarà segons la marca a què es vinculi l'esdeveniment. Els criteris són:</span></span></span></p>
<ul>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Repercussió mediàtica total de l'esdeveniment <em>(inversió publicitària –a preu de tarifa oficial- i clipping).</em></span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Repercussió mediàtica en mitjans nacionals i internacionals de l'esdeveniment <em>(inversió publicitària –a preu de tarifa oficial- i clipping). Fora de les Illes Balears.</em></span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">El pressupost total destinat a l'execució de l'esdeveniment.</span></span></span></li>
</ul>

<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Pla de reciclatge i classificació de residus.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Ús d'elements biodegradables, sostenibles o elements multi ús. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Ús d'energies renovables.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Estalvi en el consum d'aigua i electricitat. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Emprar la digitalització en lloc de la impressió.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f) Desenvolupar accions per afavorir i promoure la mobilitat sostenible.</span></span></span></p>

Queden exclosos d'aquesta convocatòria, aquells esdeveniments que no hagin assolit la totalitat de la quantia a justificar en alguna de les dos anualitats anteriors. </span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">2.PRINCIPIS GENERALS DE LA CONVOCATÒRIA</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Aquesta convocatòria pública es duu a terme sobre la base dels principis de publicitat, transparència, concurrència, objectivitat i eficiència per al desenvolupament de l'objecte de l'esdeveniment que millori la competitivitat turística de les Illes.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Aquesta convocatòria parteix de la base que són els promotors de l'esdeveniment qui n'assumeixen l'organització i els seus costos. Per això, sol·liciten una aportació per donar suport a la celebració de l'esdeveniment, ja que consideren que té repercussió turística i que l'aportació pública millora la rendibilitat, en concepte d'imatge i notorietat.</span></span></span></span></p>
<p><strong><span style="line-height:115%"><span style="color:black">3.PRESSUPOST DE LA CONVOCATÒRIA</span></span></strong></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La present convocatòria té un pressupost </span>màxim de 420.000 € (impostos<span style="color:black"> inclosos) finançats </span>de la següent forma:</span></span></span></p>

Posicionament de les marques turístiques Mallorca, Menorca, Ibiza i Formentera del projecte anomenat “<em>Millora de la competitivitat del sector turístic de les Illes Balears, mitjançant el posicionament dels valors de les marques turístiques Mallorca, Menorca, Ibiza i Formentera, el desenvolupament del talent, el coneixement i la creació de producte”.</em> Per aquest motiu les marques de destinació que s'inseriran a les publicacions, emissions, publicitat i accions promocionals hauran d'anar sempre vinculades a la marca d'ITS. </span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Un import màxim de 100.000 € (impostos inclosos) amb fons propis de l'AETIB a càrrec del Capitol VI –Inversions reals- al pressupost per a l'exercici 2020.</span></span></span></li>

<p><span style="font-family:"Times New Roman",Times,serif">El termini per poder presentar les sol·licituds romandrà obert fins dia 20 de març de 2020. Una vegada finalitzat el termini, es valoraran els esdeveniments presentats per orde d'entrada al registre de l'AETIB.</span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En cas que, una vegada obertes totes les sol·licituds, no s'haguessin sol·licitat prou patrocinis fins a exhaurir els percentatges per illes, el pressupost no adjudicat es destinarà als esdeveniments sol·licitants, al marge d'aquesta territorialització, per orde d'entrada a l'AETIB. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">4. ÀMBIT SUBJECTIU</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Poden ser beneficiaris d'aquesta convocatòria pública les persones jurídiques privades organitzadores dels esdeveniments presentats que s'ajustin a l'objecte i compleixin els requisits d'aquesta convocatòria.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En aquesta convocatòria, una mateixa entitat pot presentar fins a 2 esdeveniments per marca vinculada, però mai més d'una empresa o entitat pot sol·licitar patrocinis per al mateix esdeveniment.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el supòsit que dues entitats diferents sol·licitin el patrocini per a un mateix esdeveniment, tan sols es valorarà la primera de les propostes presentades, segons el registre d'entrada a l'AETIB, mentre que l'altra proposta en restarà exclosa.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el supòsit d'entitats que gestionin diversos esdeveniments, han de presentar una sol·licitud per a cadascun dels esdeveniments per què sol·licitin el patrocini, excepte si aquests conformen un programa únic de diverses actuacions.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">5. TERMINI I LLOC DE PRESENTACIÓ DE LA DOCUMENTACIÓ</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La convocatòria per a la presentació dels esdeveniments romandrà oberta des de l'endemà de la publicació d'aquesta Resolució al BOIB, </span>fins dia <strong>20 de març de 2020.</strong> </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Tot i que el termini de presentació és tancat, els expedients s'aniran resolvent d'acord amb la data d'entrada al registre. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">El lloc de presentació serà el registre de l'AETIB (Edifici AETIB C/ Rita Levi s/n -Parc Bit- 07121 Palma) o els llocs previstos en l'article 16 de la Llei 39/2015. En aquest últim supòsit, s'ha d'enviar el mateix dia una còpia de la sol·licitud en què hi consti el registre d'entrada, i així justificar la data d'enviament de la sol·licitud dins del termini establert. <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La resta de documentació que a continuació es relaciona s'ha de presentar també en el sobre 1:</span></span></span></span></p>

En el cas que es constatés l'existència de deutes pendents o la incorrecta justificació sense renúncia expressa prèvia a l'inici del període de justificació, es considerarà motiu d'exclusió de la participació en la convocatòria de patrocini.</span></span></span></span></li>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">En el cas de persones jurídiques no espanyoles amb activitat a Espanya:</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el supòsit que l'entitat pertanyi a un Estat membre de la UE, la capacitat jurídica de l'empresa s'acreditarà mitjançant la presentació de constitució de l'entitat d'acord amb la normativa del seu país, fent constar els estatuts de la mateixa i l'acreditació corresponent, així com fotocòpia acarada del CIF, tots dos traduïts per intèrpret jurat o traducció oficial i postil·lada d'acord amb el conveni de la Haia de 1961.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el cas que l'entitat pertanyi a un Estat que no és membre de la UE, la capacitat jurídica de l'entitat s'acreditarà, mitjançant la documentació relativa a la sucursal o filial a Espanya de l'entitat, degudament inscrita en el registre corresponent i fotocòpia acarada del CIF.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En qualsevol dels dos casos anteriors, s'haurà d'acreditar la capacitat de la persona que representa l'entitat sol·licitant legalment per actuar en nom seu, així com s'haurà de presentar una còpia acarada del seu passaport/DNI/NIE, traduït per intèrpret jurat o mitjançant una traducció oficial i postil·lada d'acord amb el conveni de la Haia de 1961.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Les empreses no espanyoles d'Estats membres de la Unió Europea i els restants empresaris estrangers hauran d'acreditar la documentació que es detalla:</span></span></span></span></p>

En cas que es tractés d'un agent autoritzat per actuar en nom de l'entitat no resident que operi mitjançant una oficina de representació, haurà d'aportar la corresponent certificació acreditativa d'estar al corrent de pagament amb l'Administració de l'Estat, l'autonòmica i la Seguretat Social, emesa per l'òrgan competent.</span></span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Declaració responsable conforme s'està al corrent de pagaments amb l'AETIB així com de la justificació de contractes de patrocini amb l'AETIB anteriors. <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Atesa la diversitat dels esdeveniments que es poden patrocinar, la definició o la versió definitiva dels continguts i l'abast de la seva publicació a mitjans de l'AETIB i del propi patrocinat, es fixaran una vegada realitzada la reunió de valoració (apartat 7.2 de l'Annex A) i previ a la signatura del contracte.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">7. PROCEDIMENT ADMINISTRATIU PER A LA FORMALITZACIÓ DELS PATROCINIS PRIVATS</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La tramitació administrativa per a la formalització dels contractes de patrocini es realitzarà d'acord amb l'establert a </span>la Instrucció 2/2018 del director gerent de l'ATB (actual AETIB) per la qual s'estableix la regulació específica i tramitació dels expedients dels contractes privats de patrocini que formalitzi l'ATB (actual AETIB) de 5 d'abril de 2018, amb la ratificació prèvia del consell de direcció de l'ATB (actual AETIB) de 5 d'abril de 2018.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el cas que la sol·licitud de patrocini sigui per un import inferior als 14.999,99 € (imposts exclosos), és a dir, 18.149,98€ (impostos inclosos) es procedirà d'acord amb </span>l'establert a l'article 118 de LCSP i la Instrucció 1/2019, del director de l'AETIB per la qual s'estableix la regulació específica i la tramitació dels expedients dels contractes menors que formalitzi l'AETIB.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el cas que la sol·licitud de patrocini sigui per un import igual o superior als 18.149,98</span>€ (impostos inclosos), es procedirà d'acord amb el que s'estableix a la Instrucció 2/2018 del director gerent de l'ATB (actual AETIB) per la qual s'estableix la regulació específica i la tramitació dels expedients dels contractes privats de patrocini que formalitzi l'ATB (actual AETIB).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="line-height:115%"><span style="background-color:white"><span style="line-height:115%">En aquest cas, s'haurà d'aportar per part del sol·licitant una declaració responsable que acrediti les raons tècniques o artístiques o els motius pels quals només pugui encomanar-se a un empresari determinat.</span></span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'àrea/tècnic assignat a l'expedient s'encarregarà de la revisió de les propostes tècniques, per determinar el compliment o no dels requisits tècnics exigits d'acord amb el que s'estableix en<span style="color:black"> aquests plecs.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Aquells expedients que necessitin valoració, juntament amb l'àrea/tècnic assignat i un representant de la Direcció de l'AETIB, es podrà convidar a un representant del consell insular que es determinarà en funció de les característiques de l'esdeveniment presentat.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">7.1 FASE ADMINISTRATIVA: revisió de la documentació administrativa</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Una vegada finalitzat el termini de presentació de les propostes, el departament jurídic de l'AETIB examinarà la documentació administrativa corresponent al sobre núm.1 segons l'ordre de registre d'entrada a l'AETIB de les sol·licituds.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el cas que sigui necessària l'esmena d'algun document de caràcter administratiu, la Direcció de l'AETIB requerirà a l'entitat interessada, la documentació administrativa que falti, concedint-li un termini de 3 dies naturals per a la presentació de la documentació requerida, amb l'advertiment exprés que, en cas de no fer-ho així, es considerarà desistida i s'arxivarà la seva sol·licitud, segons el que disposa l'article 68 de la Llei 39/2015.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">El requeriment de la documentació es realitzarà per mitjans electrònics, de manera que en quedarà constància a l'expedient.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">7.2 FASE TÈCNICA: revisió de la documentació tècnica</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Un cop finalitzada la revisió de la documentació administrativa, l'òrgan de contractació designarà l'àrea/tècnic encarregat de la revisió de la proposta tècnica, per determinar el compliment o no dels requisits tècnics exigits d'acord amb el que s'estableix en aquests plecs. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En el cas que l'import sol·licitat sigui igual o superior als 14.999,99 € (imposts exclosos), és a dir 18.149,98€ (impostos inclosos), l'àrea/tècnic assignat a l'expedient durà a terme la revisió de la proposta tècnica, per determinar el compliment o no dels requisits tècnics exigits d'acord amb el que s'estableix en aquests plecs. Tal com recull </span>la Instrucció 2/2018, es realitzarà un plec específic de patrocini en funció de l'esdeveniment <span style="color:black">a patrocinar, en el qual han de quedar recollides les contraprestacions que es proposa que rebi l'AETIB en funció de l'import que es sol·licita. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En cas que a la documentació tècnica es detectin deficiències, es requerirà per a la seva esmena, la qual s'haurà de realitzar en el termini de 3 dies naturals. En el cas que l'esmena no sigui correcta o que no s'esmeni la documentació requerida per l'àrea/tècnic assignat, la sol·licitud s'exclourà del procediment de contractació. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">El requeriment de la documentació es realitzarà per mitjans electrònics, de manera que en quedarà constància a l'expedient.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Una vegada revisat per l'àrea/tècnic que la proposta s'ajusta als plecs de la convocatòria, es convocarà al patrocinat, si n'és el cas, per a una reunió prèvia a l'adjudicació i formalització del contracte, en la qual es tractaran, entre altres assumptes, les contraprestacions proposades que rebrà l'AETIB, l'import sol·licitat i la repercussió de la presència de les marques. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En aquesta reunió la direcció de l'AETIB valorarà el patrocini sol·licitat, amb relació a l'import i les contraprestacions oferides per l'entitat privada. A aquesta reunió també hi participarà l'àrea econòmica i jurídica de l'AETIB. L'àrea/tècnic responsable de la revisió de la proposta haurà de ser informat dels acords que deixarà reflectits a l'expedient. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">7.3 ADJUDICACIÓ I FORMALITZACIÓ: del patrocini</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">D'acord amb l'establert </span>a les instruccions internes esmentades<span style="color:black">, l'òrgan de contractació realitzarà l'adjudicació del contracte privat, i posterior formalització del contracte en el qual hi constaran les obligacions d'ambdues parts, les contraprestacions que rebrà finalment l'AETIB i la forma de justificar el patrocini en funció de les característiques de l'esdeveniment. Al contracte hi constarà expressament la cessió a l'AETIB de les imatges de l'esdeveniment per a usos no comercials. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Així mateix, en el cas que l'adjudicació fos superior a 14.999,99 €, s'haurà de publicar al portal de contractació de l'AETIB.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Aquest contracte haurà de signar-se en el termini màxim d'un mes des de l'adjudicació del contracte<span style="color:black"> i sempre abans de l'inici de l'esdeveniment. En cas contrari, l'AETIB podrà resoldre no portar-lo a terme.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">El patrocinat facilitarà el seguiment i control del contracte signat i, concretament, de la presència de les marques a l'acció patrocinada. Per tant, s'ha de reflectir la presència de la marca/logotip d'ambdues entitats en tots els mitjans i materials corresponents a l'organització dels diferents actes i accions previstes a l'esdeveniment i que s'estableixen al contracte.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Les imatges de l'entitat, de les marques de destinació, de l'ITS i de l'AETIB podran figurar tant en els elements de promoció prèvia a l'esdeveniment, com en els de la promoció que es durà a terme durant el desenvolupament d'aquest, o en la repercussió posterior als diferents mitjans de comunicació.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">8. CONTRAPRESTACIÓ PER A L'AETIB</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">L'AETIB i l'entitat privada formalitzaran un contracte de patrocini privat en el qual es regularà la seva presència en tots els mitjans i materials corresponents a l'organització dels diferents actes i accions previstes en l'esdeveniment, com ara: invitacions, insercions publicitàries, panells o altres elements promocionals confeccionats amb motiu de l'esdeveniment presentat, en els quals se citarà la col·laboració de les entitats signants i reflectiran els seus respectius logotips corporatius i marques promocionals.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">L'entitat haurà d'especificar a la memòria que presenti amb la sol·licitud, quines serien les contraprestacions/accions on hi seran present les marques.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Així mateix, estan obligats a convidar a la direcció de l'AETIB a actes d'obertura i cloenda, rodes de premsa, presentacions i similars. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">L'ús de les marques/logo de l'AETIB s'ajustarà al que s'estableix a les <em>Directrius sobre l'ús de les marques </em><strong>(ANNEX A6) </strong>que formaran part del contracte. Si sorgeix qualsevol dubte, s'haurà de contactar amb el departament d'Imatge i Publicacions de l'AETIB <span style="color:null">(ip@aetib.caib.es).</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Totes les creativitats hauran d'integrar les següents marques/mencions:</span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En els casos que sigui possible, prèvia a la publicació del material gràfic/emissió del material audiovisual, es supervisarà per part de l'àrea d'Imatge i Publicacions de l'AETIB la ubicació de les marques/logotips i els esborranys de disseny, donant la conformitat. En cas de no remetre el material a l'àrea d'Imatge i Publicacions, serà l'entitat col·laboradora qui assumeixi la responsabilitat del mateix. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En cas que l'AETIB comuniqués discrepàncies respecte a l'aplicació de les seves marques/logo, l'entitat es compromet a realitzar les actuacions necessàries d'alteració o rectificació de la presència de marca.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En cas de no complir amb les <em>Directrius</em> establertes per part de l'AETIB l'acció publicitària/promocional no es tindrà en compte a efectes de justificació, i per tant, com a repercussió mediàtica de l'esdeveniment. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">9. JUSTIFICACIÓ I PAGAMENT DE L'ESDEVENIMENT</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La justificació tècnica de l'esdeveniment, s'haurà de presentar amb anterioritat a la presentació de la factura.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">L'aportació de l'AETIB es farà efectiva una vegada finalitzat l'esdeveniment objecte del patrocini i prèvia presentació per part de l'entitat privada d'una memòria justificativa de l'esdeveniment realitzat. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">L'entitat privada haurà d'acreditar, en qualsevol cas, el compliment de les condicions econòmiques i relatives a la presència de les marques mitjançant:</span></span></span></span></p>

També hauran de fer correspondre la mateixa numeració amb la documentació acreditativa relativa al concepte descrit.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La </span>repercussió mediàtica es comptabilitzarà de la següent forma<span style="color:black">: </span></span></span></span></p>
<p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">— <span style="color:black">Per a tots el suports/mitjans independentment de la seva cobertura: es tindrà en compte el 100% del valor de tarifa oficial impostos no inclosos.</span></span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En cas que l'import atorgat fos menor que el màxim estipulat a la taula, els imports mínims a justificar s'adequarien de forma proporcional.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">El valor econòmic de la repercussió mediàtica del patrocini ha de ser igual o superior a la quantitat mínima estipulada segons l'import adjudicat. Aquesta valoració es farà sobre el preu de tarifa oficial impostos no inclosos.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">En cas de no arribar als mínims establerts, s'estipula el següent procediment:</span></span></span></p>
<ul>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Justificar correctament fins al 80% dels mínims exigits: s'abonarà la part proporcional amb relació a l'import adjudicat, més impostos (a preu de tarifa oficial).</span></span></span></li>
<li><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Justificar menys del 80% dels mínims exigits: no s'abonarà cap quantia. </span></span></span></li>
</ul>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">No es procedirà al pagament al patrocinat fins que no s'hagi complert amb la presentació de la justificació i aquesta s'hagi conformat per l'AETIB.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">La justificació s'haurà de presentar en registre de l'AETIB o als llocs previstos en l'article 16 de la Llei 39/2015, en els <strong>90 dies naturals posteriors</strong> a la finalització del l'esdeveniment. En el cas que s'incompleixi aquest termini, el patrocini de l'AETIB quedarà sense efecte.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En cas que es detectin deficiències a la documentació justificativa lliurada, es requerirà per a la seva esmena, la qual s'haurà de realitzar en el termini de 10 dies naturals. Aquest procediment es farà per mitjans electrònics, de manera que quedarà constància a l'expedient. En cas que l'esmena no sigui correcta o que no s'esmeni la documentació requerida per l'àrea/tècnic assignat, es procedirà a la valoració de la repercussió mediàtica amb la informació que disposi el tècnic. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">L'AETIB es reserva la potestat de realitzar <em>a posteriori</em> una comprovació de la justificació econòmica.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En tot cas, la forma de presentar la justificació de les accions realitzades s'inclourà en el contracte que es formalitzi, adaptant-ho a la tipologia de l'esdeveniment a realitzar.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">L'acceptació del patrocini implica que el material gràfic, fotogràfic i audiovisual presentat a les justificacions, el podrà emprar l'AETIB per a la seva difusió i ús en activitats estratègiques.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">A més, tots els esdeveniments hauran de complir almenys dues de les següents mesures de sostenibilitat que s'acreditaran a la justificació:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">a) Pla de reciclatge i classificació de residus.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">b) Ús d'elements biodegradables, sostenibles o elements multi ús. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">c) Ús d'energies renovables.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">d) Estalvi en el consum d'aigua i electricitat. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">e) Emprar la digitalització en lloc de la impressió.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">f) Desenvolupar accions per afavorir i promoure la mobilitat sostenible.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">g) Ambient inclusiu (accessibilitat universal dels participants).</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">h) Ús de productes locals, ecològics, de temporada, tradicionals de les illes i/o de comerç just.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">i) Contractació d'empreses locals.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">j) Mesures sostenibles de protecció dels recursos naturals. Protecció de la flora i/o la fauna. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">k) Activitats directes amb els participants de conscienciació sobre la sostenibilitat.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">l) Destinar com a mínim un 3% de la recaptació de l'esdeveniment a projectes de caràcter ambiental, sostenible, cultural i/o social. </span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">m) Mesures destinades al foment de la igualtat i la integració social. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">En cas de no poder justificar les dues mesures exigides, no s'abonarà la quantia del patrocini. </span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Una vegada validada la justificació tècnica, l'àrea/tècnic encarregat del seguiment de l'esdeveniment ho comunicarà a l'adjudicatari per a la presentació de la factura corresponent.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">10. SUSPENSIÓ DEL PATROCINI</span></span></strong></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">11. PROTECCIÓ DE DADES</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">De conformitat amb la LO 3/2018, de 5 de desembre, de protecció de dades personal i garantia de drets digitals, els sol·licitants queden informats i accepten la incorporació de les dades que facilitin al fitxer que creï l'AETIB.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">Les entitats sol·licitants estan obligades al compliment de l'establert per la LOPD, en relació amb les dades personals a les quals tingui accés durant la vigència dels contractes que es realitzin en desenvolupament i execució d'aquesta convocatòria.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">12. CONFIDENCIALITAT</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Qualsevol informació confidencial revelada per l'AETIB a l'entitat amb la qual es formalitzin esdeveniments objecte d'aquesta convocatòria durant la seva vigència es mantindrà amb caràcter estrictament confidencial per al receptor, que es comprometrà a utilitzar aquesta informació únicament per a la finalitat per la qual li va ser revelada per l'emissor, excepte imperatiu legal.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">El receptor protegirà la informació confidencial de l'emissor contra qualsevol ús no autoritzat o revelació a tercers, de la mateixa manera que protegeix la seva informació confidencial. L'accés a aquesta informació quedarà restringit només a aquells empleats de l'entitat col·laboradora que hagin de conèixer-ho per complir amb l'esdeveniment a desenvolupar.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">13. LLENGÜES D'UTILITZACIÓ EN AQUEST PROCEDIMENT</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%"><span style="color:black">Tota la documentació administrativa i tècnica que s'ha de presentar en aquesta </span>convocatòria ha de ser en una de les dues llengües oficials de la CAIB. En cas que la justificació (certificats d'emissió, entre d'altres) es lliuri en un idioma diferent dels oficials de la CAIB, s'haurà d'aportar una traducció jurada. </span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong><span style="line-height:115%"><span style="color:black">14. RÈGIM JURÍDIC APLICABLE</span></span></strong></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">D'acord amb la Instrucció 2/2018 l'ATB (actual AETIB) considera com a regla general els patrocinis com un contracte privat, d'acord amb l'establert a l'article 26.2 de la Llei 9/2017, de 8 de novembre de contractes del sector públic i per aquest s'ha de regir quant a la preparació i adjudicació, en defecte de normes específiques, per la Secció 1 i 2 del Capítol I del Títol I del Llibre II d'aquest llei, i en les disposicions de desenvolupament, aplicant-se supletòriament les restants normes de dret administratiu o, si escau, les normes de dret privat, segons correspongui per raó del subjecte o entitat contractant. Quant als <span style="color:#0d0d0d">seus efectes</span> i extinció, es regirà pel dret privat.</span></span></span></p>
