	&lt;p&gt;&lt;span style="color:black"&gt;El 28 de desembre de 2019 es va publicar la convocatòria pública de subvencions per al foment d'instal·lacions d'energia solar fotovoltaica adreçada &lt;/span&gt;a particulars, entitats sense ànim de lucre, petites i mitjanes empreses i associacions empresarials &lt;span style="color:black"&gt;mitjançant la R&lt;/span&gt;&lt;span style="color:black"&gt;esoluci&lt;/span&gt;&lt;span style="color:black"&gt;ó del conseller de Transició Energètica i Sectors Productius de 23 de desembre de 2019&lt;/span&gt;.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;Les persones o entitats que figuren en l'annex 1 d'aquesta proposta varen presentar una sol·licitud de subvenció per a la instal·lació d'energia solar fotovoltaica i microeòlica.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;Els serveis tècnics de la Direcció General d'Energia i Canvi Climàtic han examinat les sol·licituds i han emès un informe favorable dels aspectes següents:&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;Les persones o entitats sol·licitants, per la seva naturalesa, poden ser beneficiàries de subvencions.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;Les persones o entitats han adjuntat la documentació prevista en la convocatòria.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;Les persones o entitats sol·licitants estan al corrent de les obligacions amb la Seguretat Social i amb l'Administració tributària, tant l'estatal com l'autonòmica.&lt;/p&gt;
	&lt;/li&gt;
&lt;/ul&gt;

&lt;ol start="4"&gt;
	&lt;li&gt;
	&lt;p&gt;Els serveis tècnics competents, en aplicació del procediment de concessió que estableix l'apartat setè de la Resolució esmentada, han informat favorablement sobre la concessió de les subvencions descrites en l'annex 1, les quals s'han calculat d'acord amb la Resolució de convocatòria d'aquests ajuts.&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;
	&lt;p&gt;El Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions (BOIB núm. 196, de 31 de desembre de 2005).&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;El Decret 75/2004, de 27 d'agost, pel qual es despleguen determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm. 122, de 2 de setembre de 2004).&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;L'Ordre de la consellera de Comerç, Indústria i Energia de 15 de maig de 2008 per la qual s'estableixen les bases reguladores per a la concessió de subvencions en matèria d'energia (BOIB núm. 72, de 24 de maig de 2008).&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;La Resolució del conseller de Transició Energètica i Sectors Productius d&lt;span style="background-color:white"&gt;e 23 de desembre de &lt;/span&gt;2019 per la qual s'aprova, mitjançant el procediment de despesa anticipada, la convocatòria pública de subvencions per al foment d'instal·lacions d'energia solar fotovoltaica i microeòlica adreçada a particulars, entitats sense ànim de lucre, petites i mitjanes empreses i associacions empresarials (BOI&lt;span style="background-color:white"&gt;B núm. 174, de 28 de desembre d&lt;/span&gt;e 2019).&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Proposta de resolució&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Propòs al conseller de Transició Energètica i Sectors Productius que dicti una resolució en els termes següents:&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;
	&lt;p&gt;Aprovar la concessió d'una subvenció als beneficiaris que figuren en l'annex 1 d'acord amb el concepte i l'import que figuren en l'annex esmentat.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;Autoritzar la possibilitat de dur a terme l'actuació amb una empresa vinculada, atès que la contractació es fa a preus de mercat.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;Autoritzar i disposar la despesa amb càrrec a la partida pressupostària indicada en l'annex 1 dels pressuposts vigents de la Comunitat Autònoma de les Illes Balears. Aquest ajut està cofinançat amb un 50&amp;nbsp;% a càrrec del Programa Operatiu FEDER 2014-2020 de les Illes Balears.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;Les inversions objecte de la sol·licitud s'han d'executar i pagar des del dia de la presentació de la sol·licitud fins al 30 de setembre de 2020.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;El termini per justificar la realització de les activitats subvencionades en cap cas pot ser &lt;span style="background-color:white"&gt;superior al 30 de setembre de 2020.&lt;/span&gt;&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-left:40px"&gt;El pagament s'ha de fer d'acord amb el que disposa l'apartat desè de la Resolució del conseller de Transició Energètica i Sectors Productius de&lt;span style="background-color:white"&gt; 23 de desembre de 2019&lt;/span&gt;.&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;S'ha d'acreditar el pagament dels justificants mitjançant document, extracte o certificat bancari.&lt;/p&gt;

&lt;ol start="6"&gt;
	&lt;li&gt;
	&lt;p&gt;Els beneficiaris estan obligats a complir el que disposa l'apartat onzè de la Resolució del conseller de Transició Energètica i Sectors Productius de 23 de desembre de 2019.&lt;/p&gt;
	&lt;/li&gt;
	&lt;li&gt;
	&lt;p&gt;Tota alteració de les condicions establertes per a la concessió de la subvenció, com també l'obtenció concurrent de subvencions o ajuts atorgats per altres administracions públiques o ens públics, nacionals o internacionals, dona lloc a la revisió parcial o total de la subvenció i, per tant, al reintegrament de la quantitat corresponent més els interessos de demora.&lt;/p&gt;
	&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;Contra aquesta Proposta de resolució podeu al·legar el que considereu convenient en el termini màxim de deu dies hàbils, comptadors des de l'endemà de la publicació en el BOIB. En cas contrari, s'entendrà que estau conforme amb el contingut de la Proposta.&lt;/p&gt;
