    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Per acord de Decret de la Batlia de data 12 de Febrer de 2020, s'aprova la convocatòria i bases del concurs per constituir una borsa de treball per proveir, amb personal funcionari interí, necessitats urgents existents en la policia local de l'Ajuntament de Banyalbufar, tal com disposa l'art. 49.2 de la Llei 3/2007, de 27 de març, de la funció pública de la comunitat autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;BASES ESPECÍFIQUES QUE REGIRAN LA CONVOCATÒRIA PER CONSTITUIR UNA BORSA DE TREBALL PER PROVEIR, AMB PERSONAL FUNCIONARI INTERÍ, NECESSITATS URGENTS EXISTENTS EN LA POLICIA LOCAL DE L'AJUNTAMENT DE BANYALBUFAR.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;PRIMERA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Objecte, procediment de selecció i normativa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;1. Aquesta convocatòria té per objecte la constitució d'una borsa de treball de personal funcionari interí de la categoria de Policia, per cobrir necessitats urgents a l'Ajuntament de Banyalbufar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;2. La selecció de les persones aspirants s'efectuarà mitjançant concurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;3. S'aplicaran a les presents proves selectives: la Llei 4/2013, de 17 de juliol, de coordinació de les policies locals de les Illes Balears; modificada per la Llei 11/2017, de 20 de desembre; Reial decret Legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'Estatut Bàsic de l'Empleat Públic; la Llei 3/2007, de 27 de març, de la Funció Pública de la Comunitat Autònoma de les Illes Balears; el Decret 28/2015, de 30 d'abril, pel qual s'aprova el Reglament marc de coordinació de les policies locals de les Illes Balears en tot el que no sigui contrari o incompatible amb la Llei 4/2013 modificada per la Llei 11/2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;4. Els nomenaments com a personal funcionari interí que s'efectuïn a les persones aspirants d'aquesta borsa seran conformes amb l'article de la Llei 4/2013, de 17 de juliol, de coordinació de les policies locals de les Illes Balears; modificada per la Llei 11/2017, de 20 de desembre; així com també de conformitat amb l'article 10.1 b (substitució transitòria dels titulars) del Reial decret Legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'Estatut Bàsic de l'Empleat Públic.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;De la mateixa manera, es podran dur a terme nomenaments per a la cobertura temporal de places vacants, regulat en l'article 10.1 apartat a) de la mateixa llei, sempre que no sigui possible la seva provisió amb personal funcionari de carrera, condició que estableix la Llei 11/2017, de 20 de desembre, de modificació de la Llei 4/2013, de 17de juliol, de coordinació de les policies locals de les Illes Balears, en el seu article trenta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;SEGONA. Requisits i condicions de les persones aspirants&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Per participar en aquesta convocatòria, les persones interessades han de complir, en la data d'expiració del termini assenyalat per a la presentació de sol·licituds, els requisits següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;1. Tenir la nacionalitat espanyola.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;2. Tenir 18 anys complerts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;3. Estar en possessió del diploma d'aptitud del curs de formació de la categoria de policia, expedit per l'EBAP i en plena validesa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;4. Estar en possessió, o en condicions d'obtenir-lo en la data en què finalitzi el termini de presentació d'instàncies, del títol acadèmic exigit a l'article 76 del Reial decret Legislatiu 5/2015, de 30 d'octubre, pel qual s'aprova el text refós de la Llei de l'Estatut Bàsic de l'Empleat Públic: Títol de Batxiller o Tècnic de formació professional o títols equivalents a efectes laborals, segons el que preveu la normativa d'educació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Als efectes laborals, segons article 4,3 de l'ordre EDU/1603/2009 serà vàlida la superació de la prova d'accés a la universitat per a majors de vint-i-cinc anys, sempre que s'acrediti algun dels requisits següents: estar en possessió del títol de Graduat en Educació Secundària Obligatòria o equivalent a efectes acadèmics o a efectes professionals, o bé haver superat almenys 15 crèdits ECTS dels estudis universitaris, tenir en compte DA5ª de l'Ordre EDU/1603/2009 modificat per l'Ordre EDU/520/2011.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;5. No patir malaltia ni defecte físic o psíquic, descrits en l'annex 5 (quadre d'exclusions mèdiques) del Decret 28/2015, de 30 d'abril, pel qual s'aprova el Reglament marc de coordinació de les policies locals de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;6. No haver estat separat mitjançant expedient disciplinari del servei de cap Administració Pública, ni trobar-se en inhabilitació absoluta o especial per a plaça o càrrecs públics per resolució judicial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:10.2pt"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;7. No tenir antecedents penals per delictes dolosos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;8. Compromís de portar armes i, si escau, utilitzar-les.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;9. Estar en possessió dels permisos de conducció de les classes A2 i B.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;10. No estar sotmès a cap causa d'incapacitat específica d'acord amb la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;11. Acreditar els coneixements de la llengua catalana del nivell B2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;12. Abans de prendre possessió de la plaça, la persona interessada haurà de fer constar que no ocupa cap lloc de treball ni du a terme cap activitat en el sector públic delimitat per l'article 1 de la Llei 53/1984, de 26 de desembre, d'incompatibilitats del personal al servei de les administracions públiques i que no percep pensió de jubilació, retir o orfandat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Si realitza alguna activitat privada, inclosa la de caràcter professional, haurà de declarar-ho en el termini de deu dies, comptadors des del dia de la presa de possessió, perquè la Corporació acordi la declaració de compatibilitat o d'incompatibilitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;TERCERA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Presentació de sol·licituds&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:112%"&gt;&lt;span style="line-height:112%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;1. Les sol·licituds per prendre part en el procés selectiu s'ajustaran al model normalitzat de sol·licitud (annex II) i es presentaran en el Registre General de l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;També podran presentar-se mitjançant les formes previstes en l'article 16.4 de la Llei 39/2015, d'1 d'octubre del procediment administratiu comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;2. El termini de presentació de sol·licituds serà de 15 dies hàbils des de l'endemà de la publicació d'aquesta convocatòria al Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;3. Juntament amb la sol·licitud emplenada adequadament, les persones aspirants han d'adjuntar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a)&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Còpia del document nacional d'identitat en vigor i/o el resguard de la sol·licitud de renovació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;b) Còpia del diploma d'aptitud del curs de formació bàsica, expedit per l'EBAP en plena validesa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;c) Còpia de la titulació exigida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:112%"&gt;&lt;span style="line-height:112%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;d) Declaració responsable de les persones aspirants conforme compleixen els requisits exigits a la base segona d'aquestes bases, referits sempre a la data d'expiració del termini assenyalat per a la presentació de sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;El fet de constar en la llista d'admesos no implica el reconeixement que les persones aspirants compleixin els requisits per participar en aquesta convocatòria. Les persones que superin el procés selectiu, hauran de presentar la documentació acreditativa dels requisits generals que s'indiquen a la base segona, amb caràcter previ al seu nomenament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:112%"&gt;&lt;span style="line-height:112%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;e) Certificat de nivell B2 de coneixements de català o superior Aquesta acreditació es pot realitzar mitjançant:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;- Certificat o document expedit per l'EBAP o la Direcció General de Política Lingüística del Govern dels Illes Balears o qualsevol dels certificats o documents considerats equivalents per l'Administració d'acord amb la normativa vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;g) La documentació acreditativa dels mèrits al·legats, en la forma establerta a la base cinquena d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Una vegada finalitzat el termini de presentació de sol·licituds, es publicarà en el termini màxim de deu dies hàbils, al tauler d'anuncis de l'Ajuntament i a la pàgina web, la resolució per la qual s'aprova la llista provisional de persones aspirants admeses i excloses, amb indicació del número del document nacional d'identitat. A les persones aspirants excloses se'ls farà indicació de la causa d'exclusió.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Les persones aspirants excloses o omeses comptaran amb un termini de cinc dies hàbils a comptar des de l'endemà de la publicació esmentada, per esmenar el defecte o adjuntar el document que sigui preceptiu, i se'ls advertirà que es considerarà no presentada la sol·licitud si no es compleix l'exigit.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Una vegada finalitzat el termini al qual fa referència el paràgraf anterior i esmenades, si escau, les sol·licituds, el batle en dictarà resolució, en el termini màxim de deu dies hàbils, que aprovarà la llista definitiva de persones admeses i excloses, amb indicació del número del document nacional d'identitat. Aquesta resolució es farà pública en els mateixos llocs indicats per a la resolució provisional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:9.9pt"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;CINQUENA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Acreditació dels mèrits&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;1.-El tribunal avaluarà els mèrits que les persones aspirants al·leguin i que justifiquin correctament, d'acord amb el barem de l'Annex I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;2.-Els mèrits que al·leguin les persones aspirants s'hauran d'acreditar mitjançant la presentació de l'original o de la còpia compulsada de la documentació següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;a) Curs de capacitació: certificat en vigor del EBAP d'haver superat el curs de capacitació de la categoria a la qual s'opta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;b) Serveis prestats: certificat expedit pels ajuntaments o administracions públiques corresponents.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;c) Estudis acadèmics oficials: còpia compulsada correctament del títol o del resguard acreditatiu (anvers i revers). En cas de presentació de títols d'estudis fets a l'estranger, haurà d'acreditar-se l'homologació concedida pel Ministeri d'Educació, Cultura i Esports.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;d) Coneixement de llengua catalana: certificats expedits per l'Escola Balear d'Administració Pública (EBAP), expedits o homologats per l'òrgan competent de la Conselleria d'Educació, Cultura i Universitats o reconeguts conforme a la normativa autonòmica vigent.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;3.-Els mèrits han d'acreditar-se amb referència a la data de finalització del termini de presentació de sol·licituds.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;SISENA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Òrgan de selecció&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;1. L'òrgan encarregat de la selecció és el tribunal qualificador. Aquest es determinarà per resolució de Batlia de l'Ajuntament de Banyalbufar, i la seva composició s'haurà de publicar, amb la llista definitiva d'admesos i exclosos, al tauler d'anuncis i a la pàgina web de l'Ajuntament.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;2. L'òrgan de selecció serà col·legiat i la seva composició s'ajustarà als principis d'imparcialitat i professionalitat dels seus membres, procurant així mateix la paritat entre dona i home. La seva composició serà predominantment tècnica i els membres hauran d'estar en possessió de la titulació o especialització igual o superior a l'exigida per a l'accés a les places convocades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;3. El personal d'elecció o de lliure designació política, els funcionaris interins i el personal eventual no podran formar part dels òrgans de selecció. Tampoc no poden formar part els representants dels empleats públics, sense perjudici de les funcions de vigilància del bon desenvolupament del procediment selectiu. Els representants sindicals que participin en el procediment selectiu, amb aquestes funcions de vigilància i vetlla, han d'estar acreditats i, com a màxim, en pot haver un per cada sindicat amb un màxim de quatre a cada procediment.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;4. La pertinença als òrgans de selecció serà sempre a títol individual no podent ostentar-se aquesta en representació o per compte de ningú.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;5. El tribunal qualificador estarà constituït per cinc membres, i pel mateix nombre de suplents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;a) President/a: designat/a per l'ajuntament convocant entre el personal funcionari de carrera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;b) Vocals: un membre vocal proposat per la Direcció general, competent en matèria de coordinació de policies locals, un altre proposat per l'Escola Balear d'Administració Pública i un designat per l'ajuntament convocant.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;c) Secretari/ària: designat per l'ajuntament convocant amb veu i vot.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;6. El tribunal podrà acordar la incorporació en les tasques de personal assessor o especialistes en totes o alguna de les proves, que poden actuar amb veu però sense vot.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;7. El tribunal no podrà constituir-se ni actuar sense l'assistència de més de la meitat dels seus membres, titulars o suplents indistintament, ni sense president/a ni secretari/ària, i les seves decisions s'adoptaran per majoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;8. Els membres del tribunal poden ser nomenats d'entre els membres de la Corporació convocant o d'entre el personal al servei de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;9. Els membres del tribunal hauran d'abstenir-se d'intervenir, i notificar-ho a l'autoritat convocant, quan concorri alguna de les circumstàncies previstes en l'article 23 de la Llei 40/2015, de l'1 d'octubre, de règim jurídic del sector públic&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;10. Les decisions adoptades pel tribunal es poden recórrer en les condicions que estableix l'article 121 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;11. Són funcions del tribunal qualificador:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;a) Valorar els mèrits al·legats i acreditats per les persones aspirants, en la forma establerta en aquestes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:10.2pt"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;b) Requerir, si escau, les persones aspirants que hagin acreditat mèrits amb defectes formals, a l'efecte de la seva esmena, o quan sigui necessari un aclariment d'algun dels mèrits acreditats en temps i en forma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:10.2pt"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;c) Confeccionar una llista, per ordre de prelació, de persones que formen part de la borsa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:10.2pt"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;d) Resoldre les reclamacions presentades, en el termini establert i en la forma escaient, per les persones aspirants.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:10.2pt"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;e)Elevar al batle la composició definitiva de la borsa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;f) Expedir, a petició de les persones aspirants, els corresponents justificants d'assistència.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;12. Els mèrits acreditats per les persones candidates es valoraran d'acord amb el barem que s'adjunta com a Annex I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:9.9pt"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;SETENA&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Concurs&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;1. La valoració de la fase de concurs es realitzarà tenint en compte el barem de mèrits estipulats en l'annex I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Una vegada conclosa la valoració dels mèrits, el tribunal qualificador publicarà, al tauler d'anuncis de l'ajuntament i a la pàgina web de l'ajuntament, una llista de les puntuacions obtingudes per les persones aspirants amb indicació del número de document nacional d'identitat. Aquesta llista es publicarà per ordre de major a menor puntuació total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;2. Les persones aspirants disposen d'un termini de cinc dies hàbils, comptadors des de l'endemà de la publicació de la llista, per al·legar les rectificacions pertinents sobre la valoració provisional dels mèrits del concurs.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;VUITENA. Publicació de la borsa definitiva&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;El tribunal qualificador elaborarà una llista definitiva de totes les persones aspirants que formin part de la borsa, per ordre de la puntuació obtinguda, que elevarà al batle perquè en dicti la resolució que correspongui.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;La borsa es publicarà al tauler d'anuncis i a la pàgina web de l'Ajuntament, així com al Butlletí Oficial de les Illes Balears, amb indicació de totes les persones integrants, l'ordre de prelació i la puntuació obtinguda de cada una, amb indicació del número de document nacional d'identitat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;La durada màxima de vigència de la borsa és de dos anys.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;NOVENA. Adjudicació&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Quan es doni algun dels supòsits prevists en la normativa per al nomenament d'un funcionari interí, s'haurà d'oferir el lloc a aquelles persones de la borsa que estiguin en la situació de disponible, d'acord amb l'ordre de prelació, sempre que compleixin els requisits que exigeix la relació de llocs de treball per ocupar-lo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;S'ha de comunicar a la persona aspirant a qui correspongui, el lloc i el termini en els quals s'ha de presentar. La persona interessada ha de manifestar la seva conformitat en el termini d'un dia hàbil- o en el segon dia hàbil següent si la trucada es fa en divendres- i la seva disposició a incorporar-se en el termini indicat pel Servei de Personal de l'Ajuntament. Aquest termini ha de ser, com a mínim, de tres dies hàbils i, com a màxim, de deu dies hàbils.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;DESENA. Renúncia i motius d'exclusió de la borsa&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Si la persona interessada no manifesta la seva conformitat amb la proposta de nomenament en el termini d'un dia hàbil - o en el segon dia hàbil següent si la trucada es fa en divendres- i la seva disposició a incorporar-se en el termini indicat pel Servei de Personal de l'Ajuntament, s'entén que renuncia a ocupar el lloc de treball.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;A les persones aspirants que renunciïn de forma expressa o tàcita, se les ha d'excloure de la borsa de treball, tret que al·leguin, en el termini establert per manifestar la seva conformitat, la concurrència d'alguna de les circumstàncies següents, que han de justificar-se documentalment en els tres dies següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Estar en període d'embaràs, de maternitat o paternitat, adopció o acolliment permanent o preadoptiu, la qual cosa inclou el període en què sigui procedent la concessió d'excedència per a cura de fills i filles per qualsevol dels supòsits anteriors.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:10.2pt"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Prestar servei com a funcionari interí de policia local en un altre municipi.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Patir malaltia o incapacitat temporal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;ONZENA. Reincorporació a la borsa&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Les persones interessades estan obligades a comunicar per escrit a l'Ajuntament la finalització de les situacions previstes en el punt 2 de la base desena, en un termini no superior a deu dies hàbils des que es produeixi, amb la justificació corresponent. D'aquesta manera tornaran a la situació de disponibles. La falta de comunicació en el termini establert determinarà l'exclusió de la borsa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;El personal funcionari interí que cessi en el lloc de treball, tret que sigui com a conseqüència de renúncia voluntària, s'incorpora automàticament a la borsa de la qual formi part en el lloc que li correspongui, d'acord amb la puntuació obtinguda al moment en què es va formar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:9.9pt"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;DOTZENA. Situació de les persones aspirants&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Estan en la situació de no disponible les persones integrants de la borsa de treball que no hagin acceptat el lloc ofert per trobar-se en alguna de les situacions previstes en el punt 2 de la base desena.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Mentre la persona estigui en la situació de no disponible en la borsa, no li serà ofert cap lloc de treball.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Estan en situació de disponibles la resta de persones integrants de la borsa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;TRETZENA. Comunicacions&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Les comunicacions entre l'ajuntament convocant i les persones aspirants es practicaran mitjançant els telèfons i/o correu electrònic aportats en el moment de la sol·licitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Als efectes que correspongui, l'ajuntament convocant confeccionarà un registre de comunicacions sobre l'adjudicació, renúncia, reincorporació i exclusió de les persones aspirants que formin part de la borsa definitiva. Tot això, sense perjudici de conservar físicament els documents que acreditin tota comunicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Aquest registre haurà de precisar: l'emissor, el destinatari, l'assumpte, el mitjà de comunicació, la data i el resultat de cada comunicació.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Les respostes i comunicacions de les persones aspirants que formin part de la borsa definitiva i que estiguin dirigides a l'ajuntament convocant, quedaran registrades d'acord al que recull l'anterior punt 2.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;CATORZENA. Recursos i impugnacions&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Tots els actes d'aquesta convocatòria que estiguin sotmesos a informació pública s'han de publicar al tauler d'anuncis i a la pàgina web municipal (www.ajbanyalbufar.net).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;En allò que no estigui previst en aquestes bases s'ha d'aplicar la normativa reguladora de funció pública definida en l'article 190 de la Llei 20/2006, de 15 de desembre, municipal i de règim local de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Contra la convocatòria i aquestes bases, que esgoten la via administrativa, les persones interessades poden interposar un recurs potestatiu de reposició en el termini d'un mes davant el mateix òrgan que les hagi aprovat, d'acord amb els articles 123 i 124 de la LPACAP. En cas de no interposar el recurs potestatiu de reposició, es pot interposar directament un recurs contenciós administratiu, segons l'article abans esmentat i el 45 i següents de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa, davant el Jutjat Contenciós Administratiu, en el termini de dos mesos, comptadors des de l'endemà de la publicació al BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;1.- Valoració del curs de capacitació&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Valoració del curs de capacitació de la mateixa categoria a la qual s'accedeix. Només es valoren els cursos expedits o homologats per l'Escola Balear d'Administració Pública (EBAP) que estiguin en vigor. La valoració de la nota obtinguda en el curs bàsic de capacitació per a l'accés a la categoria de policia és el resultat de multiplicar la nota per un coeficient d'1,20 * fins a un màxim de 8* punts. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;2.- Valoració dels serveis prestats&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Es valoraran els serveis prestats i reconeguts en la policia del municipi on es convoquin les proves i en altres municipis de Illes Balears. La valoració per als serveis prestats en altres municipis no pot ser inferior a la meitat de la prevista per al municipi on es convoquin les proves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;La puntuació màxima d'aquest apartat és de 24 punts, d'acord amb els següents criteris:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;a) Per cada mes complet de serveis prestats i reconeguts com a policia local o turístic en municipis de les Illes Balears: (0,30 punts) punts per mes, fins a un màxim de 15 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;b)&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;span style="color:#222222"&gt;&lt;span style="background-color:null"&gt;Per cada mes complet de serveis prestats i reconeguts en altres categories, en els cossos o forces de seguretat de l'Estat, policies locals d'altres comunitats autònomes, policies autonòmiques o exèrcit professional: (0,15 punts) punts per mes, fins a un màxim de 9 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;3.- Estudis acadèmics oficials&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Únicament es valoren els estudis acadèmics oficials amb validesa en tot el territori nacional. En cas de presentació de títols d'estudis fets a l'estranger, ha d'acreditar-se l'homologació concedida pel Ministeri d'Educació, Cultura i Esports.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Solament es valoraran els estudis acadèmics oficials de nivell superior als quals s'exigeixen per a la categoria a la qual s'accedeix. La valoració com a mèrit del títol implica que no es valori el de nivell inferior necessari per obtenir-ho o el primer cicle que sigui imprescindible per a la seva obtenció, excepte els títols de postgrau , màster i doctor, els quals s'acumularan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;La puntuació màxima d'aquest apartat és de 2 punts, d'acord amb els criteris següents:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;a) Per cada titulació acadèmica de tècnic de formació professional de grau superior, ensenyaments professionals d'arts plàstiques i disseny de grau superior i els ensenyaments esportius de grau superior, així com tots els títols que hagin estat declarats equivalents: 0,07 punts, fins a un màxim de 0,21 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;b) Per cada titulació acadèmica de diplomatura universitària, arquitectura tècnica, enginyeria tècnica o titulació declarada equivalent: 0,14 punts, fins a un màxim de 0,42 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;c) Per cada titulació acadèmica de grau universitari o grau de l'ensenyament artístic superior: 0,21 punts, fins a un màxim de 0,63 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;d) Per cada llicenciatura, arquitectura, enginyeria o titulació universitària equivalent: 0,29 punts, fins a un màxim de 0,87 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;i) Per cada màster oficial i altres estudis de postgrau oficial universitari: 0,04 punts per cada 30 crèdits ESCTS, fins a un màxim de 0,24 punts. Els estudis de grau amb càrrega lectiva de 300 crèdits ECTS, a més d'obtenir els punts de l'apartat c), obtindran 0,07 punts, d'acord amb l'article 12.10 del Reial decret 1393/2007, de 29 d'octubre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;f) Per cada títol de doctor: 0,21 punts, fins a un màxim de 0,63 punts.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Es valoren els certificats expedits per la EBAP, expedits o homologats per l'òrgan competent de la Conselleria d'Educació, Cultura i Universitats, o reconeguts d'acord amb la normativa autonòmica vigent fins a una puntuació màxima d'1 punts d'acord amb els següents criteris :&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;&lt;span style="background-color:null"&gt;Ha de valorar-se únicament el certificat que correspongui al nivell més alt aportat per la persona interessada. En el cas del certificat de coneixements de llenguatge administratiu, la puntuació s'acumula a la de l'altre certificat que s'acrediti.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
