    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;L&amp;apos;apartat 9.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 10 de juliol de 2015 per la qual es convoquen, subvencions per a inversions a les explotacions agràries, corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al &lt;em&gt;&lt;em&gt;Butlletí Oficial de les Illes Balears &lt;/em&gt;&lt;/em&gt;d&amp;apos;acord amb els termes que preveu l&amp;apos;article 45.2 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l&amp;apos;article 43 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;El vicepresident del FOGAIBA, en data 31&amp;nbsp;de gener&amp;nbsp;de 2020,&amp;nbsp;signa la següent resolució, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px; text-align: center"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;strong&gt;&lt;em&gt;“RESOLUCIÓ DE DENEGACIÓ&lt;/em&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;1.En data de 16 de juliol de 2015 es va publicar, en el Butlletí Oficial de les Illes Balears núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2015, 22 de juny de 2016 i 26 de juny de 2018.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;2.De conformitat amb l&amp;apos;apartat sisè de la Resolució esmentada, el termini per presentar les sol·licituds va acabar el dia 30 de juny de 201&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;8. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;3.Els òrgans gestors del Servei d&amp;apos;Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d&amp;apos;acord amb les normes reguladores d&amp;apos;aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;4.Una vegada avaluades les sol·licituds d&amp;apos;ajuda pels òrgans gestors, i d&amp;apos;acord amb els criteris d&amp;apos;elegibilitat establerts, els interessats assenyalats a l&amp;apos; &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Annex adjunt no compleixen amb algun dels requisits prevists a la convocatòria per poder ser beneficiaris de l&amp;apos;ajuda, pels motius indicats a l&amp;apos;esmentat annex.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;5.En el grup de denegació INEA 201&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;8&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;_1_&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;2&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;_PRO_NoRev del &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;10&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;gener&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&amp;nbsp;de 20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&amp;nbsp;el Servei d&amp;apos;Ajudes al Desenvolupament Rural ha emès el informe desfavorable i propost&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;a&amp;nbsp;provisional de denegació de l&amp;apos;ajuda als interessats relacionats a l&amp;apos;Annex .&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;6.&lt;/em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;En dat&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;13&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&amp;nbsp;d&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;e gener &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;de 20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;20&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;&amp;nbsp;es notificà, mitjançant publicació a la plana web &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;http://www.caib.es, l&amp;apos;&lt;/em&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;esmentada proposta provisional als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;2.Ordre del conseller d&amp;apos;Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;3.Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="text-align: center"&gt;&lt;strong&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;Resolució&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;Per tot això, s&amp;apos;informa desfavorablement i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar l&amp;apos;ajuda sol·licitada pels interessats que figuren a l&amp;apos;Annex, que són un total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expedients i que comença amb &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;PERE ANTONI PERICÀS CRESPÍ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;i acaba amb &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;SON OLIVAR S.L., relativa a la línia d&amp;apos;ajudes “Inversions a les explotacions agràries”, per no complir amb algun dels requisits que s&amp;apos;estableixen a la convocatòria i que s&amp;apos;especifiquen a l&amp;apos;esmentat annex.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;2.Declarar conclòs el procediment i procedir a l&amp;apos;arxiu dels expedients detallats a l &amp;apos;Annex I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0px; margin-left: 40px; margin-right: 0px; margin-top: 0px"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;3.Publicar aquesta resolució al Butlletí Oficial de les Illes Balears. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p&gt;&lt;strong&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;Interposició de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt; 
&lt;p&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d&amp;apos;alçada davant la consellera d&amp;apos;Agricultura, Pesca i Alimentació, en el termini d&amp;apos;un mes, comptador des de l&amp;apos;endemà de la notificació de la resolució, d&amp;apos;acord amb l&amp;apos;article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l&amp;apos;Administració de la comunitat autònoma de les Illes Balears, i l&amp;apos;a&lt;/em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;rticle 68.1 de la Llei 39/2015, d&amp;apos;1 d&amp;apos;octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
