    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En data 2 de gener de 2020, el cap del Servei de Servei d'UDIT, ITV i Registre Industrial ha formulat la proposta de Resolució següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fets&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Les tarifes vigents en l'any 2019 que varen percebre els laboratoris autoritzats i el laboratori oficial de les Illes Balears per a l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos eren les aprovades mitjançant la Resolució del conseller de Treball Comerç i Indústria de 14 de gener de 2019.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. L'article 8 del Decret 86/2009, de 1 de juliol, que desplega el Reglament de la Llei d'objectes fabricats amb metalls preciosos, estableix que és necessari actualitzar anualment aquestes tarifes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. L'article 39 de la Llei 19/2019, de 30 de desembre, estableix que, per a l'any 2020, les quotes fixes de les taxes i de les prestacions patrimonials de caràcter públic no tributàries s'han d'incrementar en la quantitat que resulta d'aplicar a la quantitat exigida durant l'any 2019 el coeficient derivat de l'augment de l'index de preus de consum de l'Estat espanyol corresponent a l'any 2018, que és de l'1,2%.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Llei 17/1985, d'1 de juliol, sobre objectes fabricats amb metalls preciosos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Reial decret 197/1988, de 22 de febrer, pel qual s'aprova el Reglament de la Llei d'objectes fabricats amb metalls preciosos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Reial decret 968/1988, de 9 de setembre, que modifica el Reial decret 197/1988, de 22 de febrer, pel qual s'aprova el Reglament de la Llei d'objectes fabricats amb metalls preciosos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Decret 86/2009, de 27 de novembre, que desplega el Reglament de la Llei d'objectes fabricats amb metalls preciosos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Llei 19/2019, de 30 de desembre, de pressupost generals de la comunitat autònoma de les Illes Balears per a l'any 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;​​​​​​​&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Proposta de resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per tot allò exposat, s'informa favorablement sobre l'actualització de les tarifes que han de percebre els laboratoris autoritzats i el laboratori oficial de les Illes Balears per a l'anàlisi i la contrastació d'objectes fabricats amb metalls preciosos, amb les propostes següents:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Que l'actualització sigui l'increment resultant d'aplicar a la quantitat exigida durant l'any 2019 el coeficient derivat de l'augment de l'index de preus de consum de l'Estat espanyol corresponent a l'any 2018, que és de l'1,2%, segons l'annex I del present informe.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Que s'inclogui en la Resolució la relació de laboratoris autoritzats per a l'anàlisi i contrastament d'objectes fabricats amb metalls preciosos, així com el laboratori oficial de les Illes Balears, per tal de complir l'article 21 del Decret 86/2009, segons l'annex II del present informe.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Les tarifes es componen de tres termes: un de fix, destinat a compensar el cost de l'anàlisi, un de variable, que depèn del pes del metall que es pretén contrastar, i un altre de manipulació, que s'aplica en funció del nombre de peces del lot.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller de Transició Energètica i Sectors Productius en el termini d'un mes comptador des de l'endemà de la notificació, d'acord amb l'article 124 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;També es pot interposar directament un recurs contenciós administratiu davant el Jutjat Contenciós Administratiu en el termini de dos mesos comptadors des de l'endemà de la notificació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;
