Núm.: </strong>7713/2019</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Feim public que el Ple de l'Ajuntament d'Alaior, en sessió extraordinària de dia 23 de desembre de 2019, ha acordat el que segueix:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">«<strong>PRIMER</strong>. Modificar el lloc de treball del qual és titular Rafael Mascaró Mercadal, identificat amb el codi d'ID núm. 44 i classificat com a lloc de funcionari de l'escala d'Administració especial, subescala Serveis especials, classe Policia Local, escala bàsica, categoria policia (subgrup C1), i reclassificar-lo com a lloc de funcionari de&nbsp;</span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">l'escala d'Administració especial, subescala serveis especials, classe Policia Local, escala bàsica, categoria policia en segona activitat (subgrup C1).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGON</strong>. Adscriure a Rafel Mascaró Mercadal, de manera definitiva, les tasques de suport administratiu divers tant a l'oficina d'atenció a la ciutadania com en altres centres de treball de l'Ajuntament d'Alaior. La seva jornada laboral serà la mateixa que es determini per a la resta de treballadors de l'Ajuntament d'Alaior, amb la disponibilitat que li correspongui, d'acord amb les retribucions pròpies del càrrec, i en cas que per raons d'organització dels serveis municipals s'hagués de modificar de forma puntual l'horari de la jornada, s'haurà de comunicar al treballador amb una antelació mínima de 15 dies. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">*Cal indicar a la part interessada que, de conformitat amb l'article 55.4 de la Llei 4/2013, de 17 de juliol (LCPLIB), els funcionaris i les funcionàries declarats en segona activitat amb destinació queden, fins que arribin a l'edat de jubilació, a disposició del batle o la batlessa com a regla general, exceptuant-ne el cas que existeixi algun impediment degut a la insuficiència de les aptituds psicofísiques, per cobrir les necessitats del servei de vigilància que es requereixi als edificis oficials dels ajuntaments amb la finalitat de limitar-ne la despesa. Així mateix, també quedaran a disposició del batle o la batlessa per dur a terme les funcions policials que se'ls puguin encomanar quan ho requereixin raons extraordinàries del servei i mentre aquestes raons persisteixin. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">*Cal indicar també que, de conformitat amb els apartats 3 i 4 de l'article 151 del Decret 40/2019, de 25 de maig, pel qual s'aprova el Reglament marc de coordinació de les policies locals de les Illes Balears, pel que fa a les funcions en segona activitat amb destinació:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. També és possible la ubicació en àrees relacionades amb seguretat o en qualsevol altre àrea de l'ajuntament respectiu sempre que correspongui a funcions i comeses relacionades amb el grup de titulació al qual pertany el personal funcionari afectat.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. Quan ho requereixin raons extraordinàries dels servei i mentre aquestes raons persisteixin quedaran a disposició del batle o batlessa per dur a terme les funcions policials que se'ls pugui encomanar.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">De conformitat amb l'article 60.4 de la Llei 4/2013, de 17 de juliol (LCPLIB), el personal funcionari afectat pel fet de passar a segona activitat amb destinació ha de percebre les retribucions pròpies del lloc de treball efectivament desenvolupat i se li han de garantir, en tot cas, les corresponents al seu darrer lloc de treball, incloses les actualitzacions. </span></span></p> <p style="margin-bottom:0px;
