    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-top:6,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;L'apartat 8.3. de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;30&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;de &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;gene&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;r de 201&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;7&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;per la qual es convoquen, &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;ajudes destinades al pagament compensatori en zones de muntanya a les Illes Balears, &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;per a l'any 201&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;7&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;, &amp;nbsp;especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 &amp;nbsp;d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt"&gt;&lt;span&gt;&lt;span style="line-height:114%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;El vicepresident del FOGAIBA, en data &lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;11&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;d&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;e desembre&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&amp;nbsp;de 201&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;9&lt;/span&gt;&lt;/span&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;, va signar la següent resolució,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;En data de 31 de gener de 2017 es va publicar, en el BOIB núm. 13, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per a l'any 2017 de les ajudes destinades al pagament compensatori en zones de muntanya a les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;2.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;En data 17 de març de 2018 es va publicar, en el BOIB núm. 34, una modificació de la Resolució citada anteriorment.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;3.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;De conformitat amb l'apartat sisè de l'esmentada Resolució i l'ordre AAA/872/2015 de 2 de maig, publicat al BOE núm.114 del 13/05/2015, el termini de presentació de sol·licituds de la convocatòria va acabar el dia 15/05/2017, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;les Illes Balears un total de 259 sol·licituds d'ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;4.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;5.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;En data&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;15 de gener de 2018 es notifica a l'interessat mitjançant publicació web la proposta provisional de denegació, per no complir la condició d'agricultor no pluriactiu, atorgant a l'interessat un termini de 10 dies per formular al·legacions, dins el termini establert l'interessat aporta documentació addicional. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;6.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;En data 21 de febrer de 2018, valorades les al·legacions i documentació aportada pel beneficiari, es publica Resolució de denegació de l'expedient per no complir el requisit d'agricultor no pluriactiu, ja que els ingressos declarats als IRPF del 2015 i 2016 eres sota els epígrafs 911 &amp;nbsp;i 3 (serveis agrícoles i ramaders i activitats artístiques respectivament), no corresponent aquestos a activitats agràries.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;7.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;Notificada la resolució, mitjançant publicació al BOIB núm. 28 de 3 de març de 2018, el sol·licitant, Pedro Vallori Reynes , interposa recurs d'alçada el dia 13 de març, aportant la declaració de renta IRPF 2015 i 2016 amb la modificació de l'epígraf corresponent a la activitat 2 modificada pel epígraf 2 , el qual fa referència a ingressos agraris.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;8.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;El 11/10/2018 es va publicar al BOIB núm. 125, la Resolució de concessió dels &amp;nbsp;beneficiaris de les ajudes, R1 de data 03 d'octubre del 2018, destinada al pagament compensatori en zones de muntanya a les Illes Balears, per a l'any 2017. Tenint en compte que el crèdit existent no cobreix la totalitat de les peticions d'aquesta convocatòria, s'ha d'aplicar l'apartat setè, resultant un percentatge de prorrateig del 96,37%.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;9.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;En data 28 de març del 2019, com a conseqüència de la presentació del recurs d'alçada, el Servei d'ajudes al desenvolupament rural remet còpia de l'expedient juntament amb un informe tècnic al Servei jurídic de la Direcció General de Medi rural i Marí &amp;nbsp;de la Conselleria de medi ambient, agricultura i pesca.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-left:-0,9000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;10.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;&amp;nbsp;En data 8 d'octubre del 2019, el Servei Jurídic d'Agricultura i Pesca ens notifica la resolució del recurs d'alçada del Sr. Vallori, estimant aquest recurs i retrotraient les actuacions al moment procedimental oportú. &amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-top:14,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;16.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span&gt;&lt;em&gt;Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:7,1000pt; margin-right:0,0000pt; margin-top:5,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:Calibri"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="line-height:120%"&gt;&lt;span&gt;&lt;em&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant el conseller de Medi Ambient, Agricultura i Pesca, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i els articles 114 i 115 de la Llei 30/92, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú, modificada per la Llei 4/99, de 13 de gener.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;a) Mantenir l'activitat agrària almenys durant la campanya, excepte en el cas de jubilació o força major; i mantenir els requisits i condicions exigibles respecte a les condicions d'explotació i beneficiari durant aquest període.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;b) Exercir l'agricultura sostenible, d'acord amb els requisits i compromisos de condicionalitat definits en el Reial decret 1078/2014, de 19 de desembre de 2014 i del Reglament (UE) núm. 1306/2013, del Parlament Europeu.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;c) Sotmetre's a les actuacions de comprovació i de control que siguin procedents per part de les administracions autonòmica, estatal i comunitària, la Sindicatura de comptes o altres òrgans de control extern, com també facilitar tota la informació que aquests òrgans els requereixin en relació a les ajudes concedides.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-top:5,1000pt"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;2. Aquestes obligacions s'entendran sense perjudici de l'obligació de complir amb la resta que preveu l'article 11 del Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions, i l'article 11 de l'Ordre del Conseller d'Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020, així com la resta que se'n deriven de la normativa estatal i comunitària d'aplicació.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-top:5,1000pt"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;3. El règim jurídic aplicable per l'incompliment d'aquestes obligacions és el que preveu el Decret legislatiu 2/2005, de 28 de desembre, pel qual s'aprova el Text refós de la Llei de subvencions i comprèn des del reintegrament de l'ajuda i el pagament de l'interès de demora fins a la imposició de les sancions corresponents.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-right:0,8500pt; margin-top:5,1000pt"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;S'informa als beneficiaris que els seus expedients es troben a la seva disposició i consulta al Servei d'Ajudes al Desenvolupament Rural del FOGAIBA (carrer Reina Constança, núm. 4 de Palma).&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
