    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom: 0, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;L&amp;apos;apartat 9.3 de la Resolució de el president de el Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 21 de desembre de 2018, per la qual es convoquen, per a l&amp;apos;any 2018, subvencions per a inversions en la prevenció dels danys causats en els boscos per incendis forestals, desastres naturals i catàstrofes, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la seva publicació en el Butlletí Oficial de les Illes Balears d&amp;apos;acord amb els termes que preveu l&amp;apos;article 45.2 de la Llei 39/2015 , d&amp;apos;1 d&amp;apos;octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), en compliment del que disposa l&amp;apos;article 43 de la Llei 30/2015, d&amp;apos;1 d&amp;apos;octubre, de procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;El vicepresident, amb data &lt;/span&gt;25&lt;span style="color: rgb(0, 0, 0)"&gt;&amp;nbsp;de novembre de 2019, va signar la següent resolució:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

El 29 de desembre de 2018 es va publicar al BOIB núm. 63, la Resolució del president del Fogaiba de data 21 de desembre de 2018, per la qual es convoquen, per a l&amp;apos;any 2018, subvencions per a inversions en la prevenció dels danys als boscos per incendis forestals, desastres naturals i catàstrofes. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;2. De conformitat amb l&amp;apos;apartat sisè de l&amp;apos;esmentada Resolució, el termini de presentació de sol·licituds va acabar el dia 28/02/2019.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;3. Els òrgans gestors del Servei d&amp;apos;Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d&amp;apos;acord amb les normes reguladores d&amp;apos;aquesta ajuda.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;4. El interessat Agropecuaria Sa Senalla sl, amb NIF B16529042 i núm. d&amp;apos;expedient PIFO 2018_1/016, ha presentat dins el termini establert i en la forma escaient, la documentació prevista a la convocatòria i s&amp;apos;ha comprovat que compleix amb els requisits exigits per poder ser beneficiaris d&amp;apos;aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;5. Una part de la inversió sol·licitada no és elegible atès que el preu pressupostat supera al de referència.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;6. La resolució provisional de concessió parcial es va comunicar als interessats mitjançant la publicació a la web del Fogaiba el passat 28 d&amp;apos;octubre. Es va enviar un sms al mòbil de cada sol·licitant informant d&amp;apos;aquesta publicació.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;7. Tenint en compte que el crèdit existent cobreix la totalitat de les peticions d&amp;apos;aquesta convocatòria no hi ha cap impediment per resoldre aquests expedients sense afectar el que disposa els apartats setè i vuitè de la convocatòria.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ordre del conseller d&amp;apos;Agricultura, Medi Ambient i Territori de 19 de febrer de 2015, per la qual s&amp;apos;estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;em&gt;3. Llei 35/2015 de 1 d&amp;apos;octubre de règim jurídic de les administracions públiques. Illes Balears, estableix a l&amp;apos;article 1 que el FOGAIBA assumeix l&amp;apos;execució de la política de la Conselleria d&amp;apos;Agricultura i Pesca referent a l&amp;apos;aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l&amp;apos;1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució de concessió&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això, s&amp;apos;informa favorablement i propòs al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;em&gt;1. Concedir l&amp;apos;ajuda sol·licitada al beneficiari Agropecuaria Sa Senalla sl, amb NIF B16529042 i núm. d&amp;apos;expedient PIFO 2018_1/016, per un import total de 9.828,80 euros, relativa a la línia d&amp;apos;ajuda “Prevenció dels danys en boscos produïts per incendis, desastres naturals i catàstrofes”. La part d&amp;apos;inversió no elegible és 2.559,30 €, atès que el preu pressupostat supera al de referència.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;em&gt;2. Autoritzar i disposar la despesa assenyalada a cada un dels beneficiaris amb càrrec al pressupost de l&amp;apos;anualitat del 2019 i amb finançament de l&amp;apos;Impost de Turisme Sostenible de la CAIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;em&gt;3. Determinar que, d&amp;apos;acord amb el que estableix la convocatòria de referència, les obligacions del beneficiari són les indicades a l&amp;apos;Annex I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;span style="line-height: 120%"&gt;&lt;em&gt;&lt;em&gt;4. Notificar la resolució al beneficiari.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;- A més, s&amp;apos;hauran de complir les normes d&amp;apos;informació i publicitat que preveu l&amp;apos;annex III del Reglament d&amp;apos;execució (UE) núm. 808/2014 de&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;la Comissió, de 17 de juliol de 2014, pel qual s&amp;apos;estableixen les disposicions aplicables del Reglament (UE) núm. 1305/2013 del Parlament&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Europeu i del Consell, relatiu a l&amp;apos;ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;- Aquestes obligacions s&amp;apos;entendran sens perjudici de l&amp;apos;obligació de complir la resta que preveuen l&amp;apos;article 11 del text refós de la Llei de&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;subvencions, aprovat pel Decret legislatiu 2/2005, de 28 de desembre, i l&amp;apos;article 11 de l&amp;apos;Ordre del conseller d&amp;apos;Agricultura, Medi Ambient i&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;Territori, de 19 de febrer de 2015, de bases reguladores de la concessió de subvencions en el marc del Programa de desenvolupament rural de les Illes Balears 2014-2020, així com les que es deriven de la normativa estatal i comunitària aplicable.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt; 
&lt;p style="margin-bottom: 0, 0pt; margin-left: 0, 0pt; margin-right: 0, 0pt; margin-top: 5, 0pt; text-align: justify"&gt;&lt;span style="font-family: Times New Roman, Times, serif; font-size: 12px"&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;- Sens perjudici de les exclusions i reduccions que preveu l&amp;apos;annex III de la convocatòria, el règim jurídic aplicable per incompliment&lt;/em&gt;&lt;/span&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;d&amp;apos;aquestes obligacions és el que preveu el Decret legislatiu 2/2005, de 28 de desembre, pel qual s&amp;apos;aprova el text refós de la Llei de&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;span style="color: rgb(0, 0, 0)"&gt;&lt;em&gt;subvencions i comprèn des del reintegrament de l&amp;apos;ajuda i el pagament d&amp;apos;interès de demora fins a la imposició de les sancions corresponents.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
