    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'apartat 8 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 26 de febrer de 2015, per la qual es convoquen subvencions «Foment de l'Agricultura Ecològica», especifica que la resolució es notificarà a les persones interessades mitjançant la seva publicació al Butlletí Oficial de les Illes Balears d'acord amb els termes que preveu l'article 45.2 de la llei 39/2015, de l'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'expedient ha estat tramitat pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresident, en data 26 de setembre de 2019, va signar la següent resolució:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;&lt;em&gt;Antecedents&lt;/em&gt;&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.En data 26 de febrer de 2015, es va publicar en el BOIB núm. 29 l'Ordre del conseller d'Agricultura, Medi ambient i Territori de 19 de febrer de 2015, per la qual s'estableixen les bases reguladores per a la concessió de subvencions en el marc del Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.En data de 28 de febrer de 2015 es va publicar, en el BOIB núm. 30, la Resolució del President del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual s'aprova la convocatòria per a l'any 2015 de les ajudes destinades al Foment de l'Agricultura Ecològica.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.En data 11 de juny de 2015 es va publicar, en el BOIB núm. 87, una modificació de la Resolució citada anteriorment, i el 30 de juny de 2016 es va tornar a modificar al BOIB núm. 86 de 7 de juliol de 2016.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.En data 22 de juliol de 2016, es publica en el BOIB núm. 65 de 28 de juliol de 2016 la Resolució del president del FOGAIBA per la qual es modifiquen els crèdits i els cofinançaments de diverses convocatòries de subvencions del FOGAIBA, corresponents a les mesures contemplades en el Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.De conformitat amb l'apartat sisè de l'esmentada Resolució i l'ordre AAA/872/2015 de 2 de maig, publicat al BOE núm.114 del 13/05/2015, el termini de presentació de sol·licituds de la convocatòria va acabar el dia 15/06/2015, i varen tenir entrada en el Registre del Fons de Garantia Agrària i Pesquera de les Illes Balears un total de 272 sol·licituds d'ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Els interessats assenyalats a l'Annex 3 adjunt, han presentat dins el termini establert i en la forma escaient, tota la documentació necessària prevista a la convocatòria per poder ser beneficiaris d'aquesta ajuda, per uns imports i dates de resolució senyalades en l'annex 3. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.En les dates assenyalades en l'annex III es varen aprovar els expedients pels imports detallats. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.Posteriorment varen presentar una sol·licitud de subrogació a favor dels interessats assenyalats a l'Annex I adjunt.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10.Tenint en compte que el crèdit existent cobreix la totalitat de les peticions d'aquesta convocatòria, no s'ha d'aplicar el apartat setè de la convocatòria.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 26 de febrer de 2015 per la qual s'aprova la convocatòria per a l'any 2015 de les ajudes destinades al foment de l'agricultura ecològica , la Resolució de 9 de juny de 2015 (modificació de la primera) i Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es modifica la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) de 26 de febrer de 2015, per la qual s'aprova la convocatòria, per a l'any 2015, de les ajudes destinades al “Foment de l'Agricultura Ecològica”.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA), de 22 de juliol BOIB núm. 95, de 28 de juliol de 2016, per la qual es modifiquen els crèdits i els cofinançaments de diverses convocatòries de subvencions del FOGAIBA, corresponents a les mesures contemplades en el Programa de Desenvolupament Rural de les Illes Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER) i pel qual es deroga el Reglament (CE) núm. 1698/2005 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013, sobre el finançament, gestió i seguiment de la Política Agrícola Comú, pel qual es deroguen els Reglaments (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 i (CE) núm. 485/2008 del Consell.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Reglament delegat (UE) núm. 640/2014 de la Comissió, d'11 de març de 2014, pel qual es completa el Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, pel que fa al sistema integrat de gestió i control i a les condicions sobre la denegació o retirada dels pagaments i sobre les sancions administratives aplicables als pagaments directes, a l'ajuda al desenvolupament rural i a la condicionalitat.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Reglament d'execució (UE) núm. 808/2014 de la Comissió, de 17 de juliol de 2014, pel qual s'estableixen disposicions d'aplicació del Reglament (UE) núm. 1305/2013 del Parlament Europeu i del Consell, relatiu a l'ajuda al desenvolupament rural a través del Fons Europeu Agrícola de Desenvolupament Rural (FEADER).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9.Reial decret 1078/2014, de 19 de desembre, pel qual s'estableixen les normes de condicionalitat que han de complir els beneficiaris que rebin pagaments directes o determinades primes anuals de desenvolupament rural, o pagaments en virtut dels programes de suport a la reestructuració i reconversió o de suport a la collita en verd, al sector vitivinícola.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10.Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11.Reial decret 887/2006, de 21 de juliol, pel qual s'aprova el Reglament de la Llei 38/2003, de 17 de novembre, general de subvencions.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16.Decret 65/2007, de 25 de maig, de constitució, organització i funcionament de l'Organisme Pagador de les despeses del Fons Europeu Agrícola de Garantia (FEAGA) i del Fons Europeu Agrícola de Desenvolupament Rural (FEADER), a la comunitat autònoma de les Illes Balears BOIB núm. 082 de 2007; en virtut de l'Ordre de la consellera d'Agricultura i pesca de 23 de desembre de 2005, per la qual es disposa l'assumpció de l'execució de la política de millora i foment dels sectors agrari i pesquer per part del Fons de Garantia Agrària i Pesquera de les Illes Balears, estableix a l'article 1 que el FOGAIBA assumeix l'execució de la política de la Conselleria d'Agricultura i Pesca referent a l'aplicació de les mesures de foment i millora dels sectors agrari i pesquer, a partir de l'1 de gener de 2006.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17.Llei 30/1992, de 26 de novembre de règim jurídic de les administracions públiques i del procediment administratiu comú.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Proposta de resolució de concessió&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Per tot això i d'acord amb l'apartat desè de la convocatòria, s'informa favorablement i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Aprovar la subrogació dels expedients detallats en l'Annex I .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Revocar parcialment l'ajuda concedida als beneficiaris pels imports detallats a l'Annex IV, que són un total d'1 expedient i que comença amb MARIA JESUS PONS FERRER amb DNI núm. 43019408R i acaba amb MARIA JESUS PONS FERRER amb DNI núm. 43019408R.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- Mantenir sense disminuir la superfície compromesa a nivell de grup de cultiu, independentment que pugui variar la ubicació del cultiu dins de les parcel·les que integren l'explotació agrària o dels canvis de les parcel·les on s'ubica el conreu. Aquest compromís es considera complit amb una tolerància màxima de disminució de la superfície compromesa de 0,1 ha en grups de cultiu que tenguin fins a 0,5 has de superfície compromesa i un 10% en aquells de més de 0,5 has de superfície compromesa.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- Complir a les parcel·les el que estableixen les normes genèriques i específiques de cada cultiu sobre producció ecològica.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- Mantenir i actualitzar el quadern d'explotació específic per a l'agricultura ecològica on s'inscriuran operacions de cultiu i actuacions realitzades ( adob, fitosanitaris, conreu, etc) a cada una de les parcel·les ( o grup de parcel·les en cas de ser el mateix cultiu), amb indicació de la data de realització i les incidències, si n'hi hagués.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- Participar, durant el període de compromís, en activitats de formació relacionades amb l'agricultura ecològica. Per això, haurà de justificar l'assistència a algun curs o activitat de formació tècnica, relacionats amb la matèria, d'un mínim de 25 hores.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- Sotmetre's a les actuacions de comprovació i de control que siguin procedents de l'Administració autonòmica, estatal i comunitària, la Sindicatura de comptes o altres òrgans de control extern, necessaris per comprovar la correcta concessió de l'ajuda i el posterior manteniment dels compromisos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- Complir, a la seva explotació, els requisits legals de gestió, així com les bones condicions agràries i mediambientals establertes en els articles 91, 92, 93, 94 i 95 del Reglament (UE) núm. 1306/2013 del Parlament Europeu i del Consell, de 17 de desembre de 2013.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- Mantenir els requisits &amp;nbsp;i condicions exigibles &amp;nbsp;respecte a l'explotació i a la persona beneficiària.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- Els beneficiaris es comprometen i obliguen, durant un període de 5 anys, inclòs el de la sol·licitud d'ajuda, a estar inscrits en el registre d'operadors del consell Balear de la Producció Agrària Ecològica (CBPAE) com a titulars de les parcel·les inscrites.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="line-height:114%"&gt;- S'informa als beneficiaris que els seus expedients es troben a la seva disposició i consulta al Servei d'Ajudes al Desenvolupament Rural del FOGAIBA (carrer de Reina Constança, núm. 4 de Palma).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
