    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Al no haver-se presentat reclamacions durant el termini d'exposició al públic, queda automàticament elevat a definitiu l'Acord plenari provisional de l'Ajuntament de Sant Joan de Labritja de data 30 de setembre de 2019, sobre la modificació de l'Ordenança fiscal reguladora de la taxa per la utilització de les instal·lacions esportives municipals, el text íntegre de les quals es fa públic en compliment de l'article 17.4 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel Reial decret legislatiu 2/2004, de 5 de març.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;EXPEDIENT 886/2019: PROPOSTA DE DICTAMEN SOBRE APROVACIÓ DE L'ORDENANÇA FISCAL&amp;nbsp; REGULADORA DE LA TAXA&amp;nbsp; PER LA UTILITZACIÓ D'INSTAL·LACIONS ESPORTIVES MUNICIPALS.-&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Per ordre de l'Alcaldia s'exposa al Ple Municipal la proposta dictaminada&amp;nbsp; per la Comissió Informativa Permanent Especial de Comptes, Economia, Hisenda i Resta d'Àrees de l'Ajuntament, que diu:&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Vist l'expedient 886/2019 tramitat per a la Modificació de l'Ordenança Fiscal Reguladora de la Taxa per la Utilització de les Instal·lacions Esportives&amp;nbsp; Municipals.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;Considerant que l'article 20.4.o) del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat per Reial decret legislatiu 2/2004, de 5 de març -TRLRHL-, permet exigir taxes per la prestació del servei de piscina, instal·lacions esportives i altres anàlegs.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Considerant que els municipis tenen competència en matèria de promoció de l'esport i instal·lacions esportives i d'ocupació del temps lliure, en virtut del que es disposa en l'article 25.2.l) de la Llei 7/1985, de 2 d'abril, Reguladora de les Bases del Règim Local -LRBRL-, en la seva redacció donada per la Llei 27/2013, de 27 de desembre, de racionalització i sostenibilitat de l'Administració Local -*LRSAL-, _&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Resultant que s'han incorporat a l'expedient tots els documents exigits pel Reial decret legislatiu 2/2004, de 5 de març, pel qual s'aprova el text refós de la Llei Reguladora de les Hisendes Locals i, especialment, l'estudi econòmic financer previst en el seu article 25 en la seva redacció donada per la Llei 2/2015, de 30 de març, de des indexació de l'economia espanyola._&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Considerant que el contingut de la Modificació de l'Ordenança Fiscal s'ajusta a l'exigit per l'article 16 del Reial decret legislatiu 2/2004, de 5 de març, pel qual s'aprova el text refós de la Llei Reguladora de les Hisendes Locals.__&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La Comissió Informativa Permanent Especial de Comptes, Economia, Hisenda i Resta d'Àrees de l'Ajuntament dictamina favorablement i proposa al ple l'adopció del següent ACORD:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Primer.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Aprovar la modificació de l'Ordenança Fiscal Reguladora de la&amp;nbsp; Taxa per la Utilització de les Instal·lacions Esportives Municipals, en els termes en què figura en l'expedient amb la redacció que a continuació es recull:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;MODIFICACIÓ DE L'ORDENANÇA FISCAL REGULADORA DE LA TAXA PER LA UTILITZACIÓ DE LES INSTAL·LACIONS ESPORTIVES MUNICIPALS.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Article 1&lt;sup&gt;r&lt;/sup&gt; - CONCEPTE.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;De conformitat amb el qual preveu l'article 58, en relació amb l'article 20.3, tots dos del RDL 2/2004, de 5 de març, pel qual s'aprova el Text Refós de la Llei Reguladora de les Hisendes Locals, l'Ajuntament de Sant Joan de Labritja estableix la taxa per a la utilització d'instal·lacions esportives municipals especificades a les Tarifes contingudes en l'apartat 2 de l'article 3r següent, que es regirà per a la present ordenança.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Article 2&lt;sup&gt;n&lt;/sup&gt; - OBLIGATS AL PAGAMENT.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Està obligat al pagament de la taxa regulada en aquesta ordenança qui es beneficiï dels serveis, instal·lacions o activitats prestades o realitzades per aquest Ajuntament, a què es refereix l'article anterior.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Estarà exempt del pagament de la taxa el personal funcionari, laboral i el personal interí de més d'un any d'antiguitat, cònjuges i fills.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;S'estableix una bonificació del 50% de reducció sobre les taxes fixades en tots els apartats de les instal·lacions esportives municipals per als Hotels Rurals i Agroturismes (del municipi), i una bonificació del 15% de reducció per a la resta d'establiments hotelers.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Article 3&lt;sup&gt;r&lt;/sup&gt; - QUANTIA.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La quantia de la taxa regulada en aquesta ordenança serà la fixada en la tarifa continguda en l'apartat següent, per cadascun dels diferents serveis o activitats.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; La tarifa d'aquesta taxa serà la següent:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Epígraf primer:&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Utilització d'instal·lacions esportives municipals.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Taxes per la utilització de les instal·lacions esportives municipals:&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A. &lt;strong&gt;&lt;em&gt;Camp de Futbol municipal.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- Per entrenament o partit (2 h.) amb llum diürna&amp;nbsp;&amp;nbsp; – 90,00€&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- Per entrenament o partit (2 h.) amb llum artificial – 120,00€&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;B. &lt;strong&gt;&lt;em&gt;Pistes de Tennis.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- Per usuari amb llum diürna (1 h. per persona) – 3,00€ residents / 4,00€ no residents&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;- Per usuari amb llum artificial (1 h. per pers.) – 6,00€ residents / 8,00€ no residents&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;C. &lt;strong&gt;&lt;em&gt;Pistes Poliesportives.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A. &lt;em&gt;Les persones i entitats interessades en la cessió d'ús i serveis del Saló d'Actes de l'Edifici Polivalent i altres instal·lacions del Camp Municipal d'Esports, l'hauran de sol·licitar per escrit al Sr. Alcalde-President. Juntament amb la sol·licitud s'haurà d'adjuntar la documentació pertinent (acreditació de residència o seu social, acreditació d'entitat no lucrativa, fotografies, memòria de l'activitat etc., segons els casos).&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;B. &lt;em&gt;La condició de resident al Municipi de Sant Joan de Labritja s'acreditarà mitjançant el certificat de l'últim Padró Municipal d'Habitants.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;C. &lt;em&gt;La condició d'entitat amb seu social al Municipi de Sant Joan de Labritja s'acreditarà mitjançant fotocòpia de l'escriptura de constitució degudament inscrita. La condició d'entitat no lucrativa s'acreditarà mitjançant fotocòpia dels estatuts degudament legalitzats.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D. &lt;em&gt;Les condicions per a la utilització de les instal·lacions i serveis per tercers seran fixades per l'Ajuntament que hauran de ser acceptades pels usuaris.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;E. &lt;em&gt;Els horaris i dies d'utilització i serveis seran fixats per l'Ajuntament de Sant Joan de Labritja, atenent-se en tots els casos a les necessitats prioritàries de les instal·lacions i serveis de l'Ajuntament.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;F. &lt;em&gt;Una vegada autoritzada la utilització de les instal·lacions o serveis es podrà fer efectiu l'import dels preus establerts a les oficines municipals. Les quotes s'abonaran abans d'entrar en el recinte o rebre el servei.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;1. Jubilats.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;S'estableix una quota amb dret a utilització de les instal·lacions esportives municipals per a usuaris jubilats a partir de 60 anys, amb una quota 50% de reducció sobre les taxes fixades en tots els apartats de les diferents instal·lacions esportives municipals.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;2. Famílies nombroses, Disminuïts Físics i Psíquics.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;S'estableix una quota amb el dret a la utilització de les instal·lacions esportives municipals pels usuaris que pertanyen a famílies nombroses i usuaris amb minusvalideses físiques o psíquiques, que consistirà en una reducció del 50% sobre les quotes fixades en tots els apartats de les diferents instal·lacions esportives municipals.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Per a l'aplicació de la reducció en el cas d'usuaris que pertanyen a família nombrosa hauran d'acreditar la seva condició i estar en possessió del carnet o document que especifiqui la seva pertinença a la família nombrosa.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;En el cas d'usuaris amb minusvalideses físiques o psíquiques se sol·licitarà certificat que acrediti la seva minusvalidesa per a l'aplicació de la reducció.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Article 4&lt;sup&gt;t&lt;/sup&gt; - NORMES DE GESTIÓ.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Tindran la consideració d'abonats de les instal·lacions els qui ho sol·licitin a l'Ajuntament mitjançant instància dirigida al Sr. Alcalde President fent constar edat i domicili.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vegada comprovat que la sol·licitud reuneix totes les condicions exigides es lliuraran dues fotografies format carnet per persona, i serà expedit el corresponent carnet.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Article 5&lt;sup&gt;è&lt;/sup&gt; - TRIBUTACIÓ.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;El tribut es considerarà meritat simultàniament a la utilització dels béns i serveis objecte d'aquesta ordenança, i les quotes, excepte les d'abonament, es recaptaran en el moment d'entrar en el recinte.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Article 6&lt;sup&gt;è&lt;/sup&gt; - INFRACCIONS I SANCIONS TRIBUTÀRIES.&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Les infraccions i fraus dels drets d'aquest tribut municipal se sancionaran amb multes en la quantia autoritzada per la Llei de Règim Local, Hisendes Locals i altres disposicions vigents.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;PARTIDES FALLADES&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Es consideraran partides fallades les quotes legalment imposades que no puguin fer-se efectives per procediment de constrenyiment. Per a la seva declaració s'instruirà l'oportú expedient, l'aprovació del qual serà competència del Ple.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;DISPOSICIÓ FINAL&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;La present Ordenança Fiscal va ser aprovada inicialment pel Ple de la Corporació en Sessió Ordinària celebrada...&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Segon.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Donar a l'expedient la tramitació i publicitat preceptiva, mitjançant exposició del mateix en el tauler d'anuncis d'aquest Ajuntament i en el *BOIB de trenta dies hàbils, dins dels quals els interessats podran examinar-lo i plantejar les reclamacions que estimin oportunes.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Així mateix, estarà a la disposició dels interessats en la seu electrònica d'aquest Ajuntament [http://santjoandelabritja.sedelectronica.es].&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;Tercer.-&lt;/em&gt;&lt;/strong&gt;&lt;em&gt; Considerar, en el cas que no es presentessin reclamacions a l'expedient, en el termini anteriorment indicat, que l'acord és definitiu, sobre la base de l'article 17.3 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel Reial decret legislatiu 2/2004, de 5 de març.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;EL PLE ACORDA PER UNANIMITAT APROVAR LA PRECEDENT PROPOSTA DE MODIFICACIÓ DE L'ORDENANÇA FISCAL REGULADORA DE LA TAXA PER LA UTILITZACIÓ DE LES INSTAL·LACIONS ESPORTIVES MUNICIPALS EN ELS TERMES EN què S'HA TRANSCRIT.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra el present Acord, conforme a l'article 19 del Text Refós de la Llei Reguladora de les Hisendes Locals, aprovat pel Reial decret legislatiu 2/2004, de 5 de març, es podrà interposar pels interessats recurs contenciós administratiu, en el termini de dos mesos comptats a partir de l'endemà al de la publicació d'aquest anunci en el Butlletí Oficial dels Illes Balears, davant el Tribunal Superior de Justícia de les Illes Balears.&lt;/span&gt;&lt;/p&gt;
