    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Antecedents&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Les Illes Balears posseeixen una estructura productiva clarament marcada per la preponderància del sector serveis, el qual constitueix més del vuitanta per cent del producte interior brut. Aquest tret diferenciador de l'economia de l'arxipèlag balear es basa fonamentalment en el pes dels sectors del comerç i l'hostaleria, ambdós directament relacionats amb l'activitat turística. A més, la nostra comunitat ha esdevingut una destinació de preferència en el mercat turístic europeu i mundial, i és la cinquena regió europea amb més pernoctacions totals (residents i no residents) i la tercera amb un nombre més elevat de pernoctacions fetes per turistes no residents, la qual cosa palesa la importància que té el turisme en l'economia balear.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El principal motor econòmic de les Illes Balears s'ha vist convulsat pel concurs de creditors de l'agència de viatges majorista Thomas Cook, una de les més antigues que hi operava, la qual cosa comporta a comunitat autònoma uns efectes socials i econòmics molt rellevants que han de ser abordats d'una manera urgent per les institucions. Són moltes les empreses i els treballadors afectats per aquest concurs de creditors, bé directament per pertànyer al grup empresarial o estar directament vinculats al grup, bé indirectament per l'efecte cascada que provoquen aquestes situacions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Per pal·liar aquest greu impacte per a les empreses afectades, el Govern considera prioritari i urgent establir ajuts i altres mesures per reduir, tant com sigui possible, els impactes econòmics d'aquest concurs de creditors. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La manca de liquiditat provocada per l'impagament de les factures pendents de l'agència esmentada pot tenir com a conseqüència que durant la temporada d'hivern 2019-2020 els establiments afectat no puguin realitzar inversions, instal·lacions o obres de modernització o d'adaptació a criteris de competitivitat i qualitat, un fet que pot repercutir en la futura competitivitat i qualitat dels serveis. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Consell de Govern, en la sessió de 15 de novembre de 2019 va acordar concedir l'autorització prèvia en matèria d'autorització i disposició de la despesa corresponent a la convocatòria, i va autoritzar, per raons d'interès públic, el pagament anticipat dels ajuts i l'exempció de garantia prèvia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Fonaments de dret&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;1. El Text refós de la Llei de subvencions, aprovat pel Decret legislatiu 2/2005, de&amp;nbsp;28 de desembre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;2. El Decret 21/2019, de 2 d'agost, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, disposa que les competències en matèria de modernització de les empreses i suport empresarial són exercides per la Conselleria de Model Econòmic, Turisme i Treball, mitjançant la Direcció General de Promoció Econòmica, Emprenedoria i Economia Social i Circular. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;3. L'Ordre de la consellera de Comerç, Indústria i Energia de 8 d'abril de 2008 estableix les bases reguladores per a la concessió de subvencions en matèria de comerç i serveis (BOIB núm.&amp;nbsp;52, de 17 d'abril) i preveu com a susceptibles de subvenció les activitats destinades a la modernització del comerç i el servei i l'adaptació a criteris de competitivitat i qualitat.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;4. Llei 14/2014, de 29 de desembre, de finances de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;5. El Decret 75/2004, de 27 d'agost, de desplegament de determinats aspectes de la Llei de finances i de les lleis de pressuposts generals de la Comunitat Autònoma de les Illes Balears (BOIB núm. 122, de 2 de setembre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;6. L'annex I del Reglament (CE) núm. 800/2008 de la Comissió, de 6 d'agost de&amp;nbsp;2008, pel qual es declaren determinades categories d'ajut compatible amb el mercat comú en aplicació dels articles 87 i 88 del Tractat (Reglament general d'exempció per categories), sobre la definició de microempreses, petites i mitjanes empreses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;7. Aquesta convocatòria està prevista en el punt I.7.1 de l'annex del Pla Estratègic de Subvencions de la Comunitat Autònoma de les Illes Balears per als exercicis&amp;nbsp;2018-2020, aprovat per l'Acord del Consell de Govern de 9 de març de&amp;nbsp;2018 (BOIB núm. 162, de 30 de novembre de 2019).&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;8. L'Acord del Consell de Govern de 15 de novembre de 2019 pel qual es concedeix l'autorització prèvia per exercir la competència en matèria d'autorització i disposició de la despesa corresponent a l'expedient de convocatòria d'ajuts a la microempresa, petita i mitjana empresa de les Illes Balears per cobrir les despeses derivades d'inversions, instal·lacions o obres de modernització o d'adaptació a criteris de competitivitat i qualitat realitzades als establiments d'entitats afectades pel concurs de creditors de l'agència de viatges majorista Thomas Cook i del seu grup.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Per tot això, d'acord amb el que disposen els preceptes abans esmentats, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Resolució&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;span style="color:black"&gt;1. &lt;/span&gt;Aprovar una convocatòria d'ajuts a la microempresa, petita i mitjana empresa de les Illes Balears per cobrir les despeses derivades d'inversions, instal·lacions o obres de modernització o d'adaptació a criteris de competitivitat i qualitat realitzades als establiments d'entitats afectades pel concurs de creditors de l'agència de viatges majorista Thomas Cook i del seu grup.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. &lt;/span&gt;&lt;span style="background-color:white"&gt;Aprovar les bases que regeixen aquesta convocatòria, que figuren en l'annex&amp;nbsp;1, així com el model de document per formular les sol·licituds (annex 2) i el model de compte justificatiu (annex 3).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. &lt;/span&gt;&lt;span style="background-color:white"&gt;Designar la Direcció General de Promoció Econòmica, Emprenedoria i Economia Social i Circular òrgan instructor del procediment de concessió de subvencions derivat d'aquesta convocatòria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;4. &lt;/span&gt;&lt;span style="background-color:white"&gt;Publicar aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Interposició de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es &lt;/span&gt;pot interposar un recurs potestatiu de reposició davant el conseller de Model Econòmic, Turisme i Treball en el termini d'un mes comptador des de l'endemà de la publicació, d'acord amb els articles 123 i 124 de la Llei 39/2015, d'1 d'octubre, de procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei&amp;nbsp;3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;També s'hi pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la publicació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquesta convocatòria té per objecte regular l'atorgament d'ajuts a les microempreses i a les petites i mitjanes empresa de les Illes Balears afectades pel concurs de creditors de l'agència de viatges majorista Thomas Cook i el seu grup, i que realitzin inversions, instal·lacions o obres de modernització als seus establiments, o d'adaptació a criteris de competitivitat i qualitat, i que s'integrin dins algun dels grups següents:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Línia I: empreses turístiques d'allotjament, empreses comercialitzadores de estades turístiques a habitatges i empreses de intermediació turística.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Línia II: empreses de comerç a l'engròs.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquests ajuts estan subjectes al compliment del compromís de mantenir l'activitat i els llocs de feina en les mateixes condicions durant dos anys.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Segon&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Beneficiaris i requisits&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Poden ser beneficiàries d'aquests ajuts les pimes, siguin persones físiques o jurídiques, de naturalesa privada, i les societats civils o comunitats de béns, amb establiment al territori de les Illes Balears ja existent i amb seu social a les Illes Balears, afectades directament pels concurs de creditors de l'agència de viatges majorista Thomas Cook o d'empreses que pertanyen al seu grup, amb factures directes no emparades per assegurances de crèdit o garanties equivalents, que estiguin compreses dins les categories esmentades en les línies I o II del punt anterior, i que puguin dur a terme les accions que es pretén fomentar.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. A afectes d'aquesta convocatòria, es considera &lt;em&gt;pime&lt;/em&gt; una empresa que compleix els requisits següents, d'acord amb l'annex I del Reglament (CE) núm. 800/2008 de la Comissió, de 6 d'agost, pel qual s'estableixen determinades categories d'ajut compatibles amb el mercat comú en aplicació dels articles 87 i&amp;nbsp;88 del Tractat (Reglament general d'exempció per categories):&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Tenir menys de 250 treballadors.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;Tenir una xifra de negoci anual no superior a 50.000.000&amp;nbsp;€ o un balanç anual no superior a 43.000.000&amp;nbsp;€.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c) &lt;/em&gt;No estar participades en un 25 % o més del seu capital o dels seus drets de vot per altres empreses o grups d'empreses que no compleixen els requisits anteriors.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En la categoria de pime, es considera petita empresa la que té menys de 50 treballadors i una xifra de negoci anual o un balanç general anual que no superen la quantia de 10.000.000 €.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'altra banda, en el grup de petites empreses, es considera microempresa la que té menys de deu treballadors i una xifra de negoci anual o un balanç general anual que no superen la quantia de 2.000.000 €.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Es considera que una empresa està afectada pels concurs de creditors de l'agència de viatges majorista Thomas Cook i el seu grup, quan té factures pendents de cobrar d'aquests per un import de, com a mínim, 28.000 €. Es consideren empreses del grup del Thomas Cook les que consten en l'annex 4 d'aquesta convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Aquestes subvencions són compatibles amb altres ajuts de qualsevol entitat atorgats per dur a terme el projecte d'internacionalització proposat, sempre que, aïlladament o conjuntament, no superin el cost total de l'activitat objecte de subvenció.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. De conformitat amb el que disposa l'article 27 de la Llei 12/2006, de 20 de setembre, per a la dona, no poden ser beneficiaris de les subvencions previstes en aquesta Resolució les persones físiques o jurídiques sancionades o condemnades per resolució administrativa o sentència judicial ferma per discriminació salarial, assetjament moral o qualsevol tipus de tracte desigual, per raó de sexe, en l'àmbit de les relacions laborals.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Les empreses que sol·licitin aquests ajuts han d'estar al corrent de les obligacions amb la Seguretat Social i de les obligacions tributàries amb l'Estat i amb la Comunitat Autònoma de les Illes Balears. La sol·licitud dels ajuts comporta l'autorització perquè la Conselleria de Model Econòmic, Turisme i Treball pugui comprovar d'ofici que l'entitat sol·licitant està al corrent d'aquestes obligacions, excepte en el cas de denegació expressa del consentiment, supòsit en què l'empresa sol·licitant ha d'aportar els certificats corresponents, juntament amb la sol·licitud dels ajuts.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tercer&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Projectes subvencionables, quantia mínima dels projectes, quantia dels ajuts i període d'execució dels projectes.&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Són actuacions subvencionables:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Les inversions per a la millora tecnològica encaminada a potenciar el comerç electrònic en establiments de venda presencial (aplicacions informàtiques, creació o millora del lloc web, allotjament, i adquisició d'equipament informàtic).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;Les inversions que impliquin un avenç cap a una economia baixa en carboni, la millora de l'eficiència energètica i la sostenibilitat (adquisició i instal·lació d‘aparells o sistemes d'il·luminació de baix consum, adquisició i instal·lació d'aparells de climatització o de conservació d'aliments que suposin una reducció del consum energètic, altres inversions que suposin una millora de la qualificació en el certificat d'eficiència energètica, instal·lació de punts de recàrrega per a vehicles elèctrics, i implantació de sistemes de gestió energètica).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c) &lt;/em&gt;Les inversions per millorar l'accessibilitat i per eliminar barreres arquitectòniques.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;d) &lt;/em&gt;L'adquisició i instal·lació de l'equipament necessari per a la modernització de l'establiment (mobiliari, maquinària, instal·lacions, sistemes d'alarma i seguretat, TPV).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;e) &lt;/em&gt;L'adquisició i instal·lació de l'equipament necessari per a la millora de la imatge de l'establiment (retolació comercial, interior i exterior). Per a aquest tipus d'inversions es recomana aplicar la &lt;em&gt;Guia de bones pràctiques per a la imatge exterior dels locals comercials&lt;/em&gt;, editada per l'Institut d'Innovació Empresarial de les Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;f) &lt;/em&gt;Les obres i reformes que comportin la millora i modernització de l'establiment.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. No són subvencionables les despeses de redacció de projectes tècnics per a la reforma, modernització i interiorisme dels establiments, ni l'adquisició o la instal·lació d'equipament de segona mà. Tampoc no són subvencionables els elements que es destinen a l'exposició dels productes (mobiliari de cuina, banys, electrodomèstics, materials per a la construcció, etc.), les inversions destinades a la venda automàtica o a expenedores de productes, l'adquisició de vehicles ni la telefonia mòbil. No és subvencionable el rènting, el lísing ni cap altre tipus de finançament.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Únicament són subvencionables les despeses que s'imputen al desenvolupament del projecte, perquè responen de manera inequívoca a la seva naturalesa, que s'hagin dut a terme durant el període d'execució de l'actuació i que el beneficiari ha pagat efectivament abans de la finalització del termini de presentació de la justificació econòmica.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El projecte o actuació presentat ha de tenir un cost elegible mínim de 28.000&amp;nbsp;€ (IVA exclòs).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. L'import dels ajuts serà de 28.000&amp;nbsp;€ per als sol·licitants que presentin projectes que compleixin els requisits establerts en la convocatòria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Els projectes per als quals se sol·liciten aquests ajuts s'han d'executar en el període comprès entre el 24 de setembre de 2019 i el 31 de març de 2020 (ambdós inclosos).&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Quart&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Import econòmic de la convocatòria &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Es destina a aquesta convocatòria un màxim de 3.000.000 €, que s'han de tramitar amb càrrec a la partida pressupostària 19301/761A02/77000/00 dels pressuposts de la Comunitat Autònoma per a l'any 2019. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;L'import s'ha de distribuir en dues línies diferents:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Línia 1: ajuts destinats empreses turístiques d'allotjament, empreses comercialitzadores d'estades turístiques a habitatges i empreses de intermediació turística: 2.600.000 €.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Línia 2: ajuts destinats a altres empreses a l'engròs: 400.000 €.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En el supòsit d'esgotament, aquestes quanties es poden ampliar sense necessitat d'una nova convocatòria, en funció de les disponibilitats pressupostàries, per mitjà d'una resolució del conseller. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cas que hi hagi un romanent en l'import d'alguna de les línies, aquest es pot passar a l'altra. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cinquè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Sol·licituds i forma de presentació&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Les sol·licituds han d'anar adreçades al conseller de Model Econòmic, Turisme i Treball i s'han de presentar al Registre de la Conselleria, al de les seves delegacions o a qualsevol altre lloc dels que estableix l'article 16 de la Llei&amp;nbsp;39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformitat amb l'article 14.2 de la Llei 39/2015, estan obligats a relacionar-se a través de mitjans electrònics amb les administracions per efectuar qualsevol tràmit d'aquest procediment administratiu, almenys, els subjectes següents:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Les persones jurídiques.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Les entitats sense personalitat jurídica.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Els qui representin un interessat que estigui obligat a relacionar-se electrònicament amb l'Administració.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformitat amb l'article 68.4 de la Llei 39/2015, si algun dels subjectes als quals fan referència els articles 14.2 i 14.3 presenta la seva sol·licitud presencialment, l'Administració pública ha de requerir l'interessat que l'esmeni mitjançant la presentació electrònica. A aquest efecte es considerarà com a data de presentació de la sol·licitud la data en què hagi estat presentada l'esmena.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Els sol·licitants han de presentar la documentació següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;&lt;span style="color:black"&gt;a) &lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt;El model normalitzat de sol·licitud i declaració responsable, que figura com a annex 2 d'aquesta Resolució i que està disponibles a l'enllaç &lt;span style="color:black"&gt;&lt;em&gt;http://www.caib.es/govern/organigrama/area.do?coduo=3828706&amp;amp;lang=ca&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Aquest ha d'incloure la declaració responsable del sol·licitant justificativa de l'afectació directa per la declaració concursal del proveïdor Thomas Cook o empreses del grup, de l'import del deute afectat, del fet que el deute objecte d'aquest finançament no està garantit per assegurança de crèdit o garantia equivalent, i del seu compromís irrevocable de mantenir l'activitat i els llocs de feina durant un mínim dos anys. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A aquests efectes, la declaració responsable s'ha d'acompanyar amb una relació i amb la còpia de les factures pendents amb el proveïdor Thomas Cook i/o amb empreses del grup en situació de concurs de creditors. &lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;D'acord amb el que disposa l'article 28.2 de la Llei 39/2015, l'interessat, amb la sol·licitud, autoritza a l'Administració de la Comunitat Autònoma de les Illes Balears perquè pugui consultar les seves dades d'identitat i la seva situació quant al compliment de les obligacions tributàries i amb la Seguretat Social, excepte en el cas que es marqui expressament que no s'autoritza l'Administració a fer aquestes consultes.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;&lt;span style="color:black"&gt;b) &lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt;Una memòria explicativa del projecte que s'ha de dur a terme, amb la valoració econòmica de les despeses corresponents, mitjançant l'aportació dels pressuposts o les factures proforma. En el cas de projectes realitzats amb anterioritat a la data de presentació de la sol·licitud, però inclosos dins el període d'elegibilitat, s'han de presentar les factures. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;&lt;em&gt;&lt;span style="color:black"&gt;c) &lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt;En el cas de persones jurídiques, s'ha de presentar també:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Una fotocòpia de l'escriptura de constitució de l'entitat.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Una fotocòpia del document que acrediti la representació, per qualsevol forma vàlida en dret, de la persona que actua en nom de l'organització sol·licitant.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Si la sol·licitud no compleix els requisits legals i els exigits en l'Ordre de bases reguladores i en aquesta convocatòria, s'ha de requerir la persona interessada que en el termini de deu dies esmeni la falta o aporti els documents preceptius, amb la indicació que, si no ho fa, es considerarà que desisteix de la petició, amb la resolució prèvia que s'ha de dictar en els termes que estableix l'article&amp;nbsp;21 de la Llei 39 /2015.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La Conselleria de Model Econòmic, Turisme i Treball, en qualsevol moment, pot sol·licitar als interessats la documentació i la informació complementària que consideri necessàries per resoldre l'expedient.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. En el supòsit que algun dels documents esmentats ja s'hagi presentat davant l'Administració actuant en ocasió de la tramitació d'altres expedients, no és necessari aportar-lo de nou, sempre que es facin constar la data i l'òrgan o dependència en què es varen presentar o, si s'escau, en què es varen emetre, sempre que no hagin transcorregut més de cinc anys des de l'acabament del procediment corresponent i que no hagin sofert modificacions.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Quan es tracti d'agrupacions de persones físiques o jurídiques privades sense personalitat jurídica, s'han de fer constar de manera explícita, tant en la sol·licitud com en la resolució de concessió, els compromisos d'execució assumits per cada membre de l'agrupació, com també l'import de la subvenció que ha d'aplicar cadascun d'aquests, que igualment tenen la consideració de beneficiaris. En tot cas, s'ha de nomenar un representant o apoderat únic de l'agrupació amb poders suficients per complir les obligacions que, com a beneficiari, corresponen a l'agrupació. Així mateix, aquesta no s'entén dissolta fins que no hagin transcorregut els terminis de prescripció que fixen l'article 24 de la Llei de finances de la Comunitat Autònoma de les Illes Balears i els articles 57 i 60 del Text refós de la Llei de subvencions.&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Sisè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Termini de presentació de sol·licituds&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El termini per presentar les sol·licituds és d'un mes a partir de l'endemà de la publicació d'aquesta Resolució en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;. Per tant, el termini finalitza el mateix dia de la publicació del mes següent.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Setè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Procediment per a concedir les subvencions i criteris de valoració&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. L'import dels ajuts, d'acord amb l'article 8 de les bases reguladores, és una quantia fixa de 28.000&amp;nbsp;€ per als sol·licitants que hagin presentat projectes que compleixin els requisits establerts en la convocatòria i que tenguin un import superior a aquest. Les sol·licituds de subvenció s'han d'anar resolent individualment, a mesura que entrin en el registre de l'òrgan competent, encara que no hagi acabat el termini de presentació, d'acord amb el que disposa l'article 7.3 de les bases reguladores i amb el que disposen els apartats 2 i 3 de l'article 17 de Llei de subvencions. Si s'exhaureixen els crèdits destinats a la convocatòria abans d'acabar el termini per presentar sol·licituds, s'ha de suspendre la concessió de nous ajuts mitjançant una resolució publicada en el &lt;em&gt;Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. No s'estableixen criteris per a la concessió dels ajuts, atès que aquesta s'ha de dur a terme mitjançant el sistema esmentat en el punt anterior.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Vuitè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Competència i resolució&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Direcció General de Promoció Econòmica, Emprenedoria i Economia Social i Circular és l'òrgan competent per instruir i tramitar els procediments i ha de fer d'ofici totes les actuacions que consideri necessàries per determinar, conèixer i comprovar les dades en virtut de les quals s'ha de determinar la concessió o denegació de la subvenció. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La directora general de Promoció Econòmica, Emprenedoria i Economia Social i Circular ha d'emetre les propostes de concessió o denegació dels ajuts, amb la indicació del motiu d'exclusió, si escau.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La resolució motivada i expressa del conseller de Model Econòmic, Turisme i Treball finalitza el procediment de concessió de la subvenció i s'ha de notificar als interessats.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La resolució de concessió ha d'especificar els aspectes següents: beneficiari, pressupost total de l'activitat que se subvenciona, import de la subvenció concedida, partida pressupostària a la qual s'aplica, termini per dur a terme l'activitat, justificació de les activitats objecte d'ajut, i termini per presentar els justificants.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Les resolucions del conseller de Model Econòmic, Turisme i Treball que concedeixin o deneguin la subvenció sol·licitada posen fi a la via administrativa i, contra aquestes, s'hi pot interposar un recurs potestatiu de reposició en el termini d'un mes, o bé un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors a partir de l'endemà que s'hagin notificat.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Els ajuts concedits s'han de publicar en la Base de dades nacional de subvencions (BDNS), en compliment de la Llei 38/2003, de 17 de novembre, general de subvencions, amb expressió de la convocatòria, del programa i crèdit pressupostari a què s'imputen, del beneficiari, de la quantitat concedida i de l'objectiu o la finalitat de la subvenció.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Novè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Pagament de la subvenció i justificació de les activitats subvencionades &lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El pagament de la subvenció s'ha de fer, com a bestreta, una vegada concedida la subvenció i d'acord amb l'article 17.2 de l'Ordre de bases.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Atès que l'import de la subvenció consisteix en una quantia fixa, s'ha de justificar l'import de la inversió subvencionada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El termini per justificar que les activitats s'han duit a terme finalitza el 30 de setembre de 2020.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Les factures per justificar la inversió subvencionada han d'estar incloses dins el període d'elegibilitat comprès entre el 24 de setembre de 2019 i el 31 de març de 2020. El pagament efectiu d'aquestes factures s'ha d'haver produït abans que finalitzi el termini de presentació de la justificació econòmica.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Per a la justificació de la subvenció s'ha de presentar la documentació següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Memòria d'actuació justificativa del compliment de les condicions imposades a la concessió de la subvenció, en què es descriguin de manera detallada el projecte que s'ha dut a terme i els resultats que s'han obtingut.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;Memòria econòmica justificativa del cost de les activitats, que ha de contenir:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Una llista classificada de les despeses de l'activitat, amb la identificació del creditor i del document, l'import, la data d'emissió i la data de pagament, d'acord amb el model que figura en &lt;span style="background-color:white"&gt;l'annex &lt;/span&gt;3, tot això acompanyat de les factures.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Una llista detallada d'altres ingressos o subvencions, amb la indicació de l'import i la procedència.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- En el cas de donar-se el supòsit previst en l'article 40.3 de la Llei de subvencions, s'han de presentar com a mínim tres ofertes de proveïdors diferents, sol·licitades amb caràcter previ a la contractació del compromís, sempre que la despesa no s'hagi efectuat abans de la sol·licitud de la subvenció o que no hi hagi un nombre suficient d'entitats que subministrin o prestin el servei.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c) &lt;/em&gt;Document de l'Administració concursal acreditatiu que l'empresa deutora pertany al grup Thomas Cook i de l'import del deute afectat.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Per justificar el pagament de les factures objecte de la subvenció s'ha de presentar la documentació següent:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;- Una còpia del document bancari que n'acrediti la transferència o el pagament, en què figurin la data, l'import i el concepte del pagament de tal manera que s'identifiqui aquest amb la factura, i també les dades de l'ordenant i del destinatari, que han de coincidir amb el beneficiari i amb l'emissor de la factura, respectivament.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Malgrat això, per a les factures inferiors a 500&amp;nbsp;€ és un justificant suficient el rebut de pagament signat pel proveïdor, el tiquet de caixa o qualsevol document que n'acrediti el pagament. No s'admeten les factures amb import de 500&amp;nbsp;€ o superior pagades en efectiu amb rebut de pagament del proveïdor.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No s'admeten factures justificatives inferiors a 100&amp;nbsp;€ (IVA inclòs).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. En el cas que s'observin defectes en la justificació, l'òrgan competent ha de sol·licitar al beneficiari que els esmeni dins els deu dies següents comptadors a partir de l'endemà d'haver rebut el requeriment d'esmena.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. Atès que la subvenció consisteix en una quantia fixa, quan l'import justificat sigui inferior a la subvenció concedida, s'haurà de reintegrar la quantia de la subvenció no justificada.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. Qualsevol alteració de les condicions que s'han tingut en compte per concedir la subvenció i, en tot cas, l'obtenció concurrent de subvencions o ajuts atorgats per altres administracions o ens, públics o privats, nacionals o internacionals, pot donar lloc a la modificació de la resolució de concessió.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. La falta de justificació en els termes i dins els terminis que estableixi la resolució d'atorgament de la subvenció, així com la modificació significativa del projecte presentat, a excepció del canvi de proveïdor que no suposi un canvi en l'execució i instal·lació de les accions subvencionables, sense que aquesta Conselleria l'hagi aprovada prèviament, i també la desviació de les subvencions o l'aplicació diferent a la que estableix la norma, determinen la revocació de la subvenció.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Desè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Revocació i reintegrament dels ajuts concedits&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La revocació de la subvenció s'ha de dur a terme mitjançant una resolució de modificació de la resolució de concessió, que n'ha d'especificar la causa, així com la valoració del grau d'incompliment, i ha de fixar l'import que, si pertoca, ha de percebre finalment la persona o entitat beneficiària. A aquest efecte, s'entén per resolució de modificació la resolució de pagament dictada en el procediment d'execució pressupostària que tengui tots aquests requisits. No obstant això, atès que en aquest cas es preveu l'abonament previ de la subvenció, si la entitat beneficiària ha de reintegrar la totalitat o una part de l'import abonat, no s'ha de dictar cap resolució de modificació i s'ha d'iniciar el procediment de reintegrament corresponent.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Les causes i l'import del reintegrament, total o parcial, de la subvenció, així com el procediment per exigir-lo, es regeixen pel que estableixen l'article 44 del Text refós de la Llei de subvencions i la normativa reglamentària de desplegament, i s'han de tenir en compte els criteris de gradació que estableix l'article 24.3 de l'Ordre de bases.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Onzè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Obligacions del beneficiari&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A més del que estableixen l'article 15 de l'Ordre de la consellera de Comerç, Indústria i Energia de 8 d'abril de 2008 i l'article 11 del Text refós de la Llei de subvencions, els beneficiaris estan obligats a:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;a) &lt;/em&gt;Acreditar davant la Conselleria de Model Econòmic, Turisme i Treball el compliment efectiu dels requisits i les condicions que s'exigeixen per concedir els ajuts.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;b) &lt;/em&gt;Comunicar a la Conselleria de Model Econòmic, Turisme i Treball si s'han sol·licitat altres ajuts per a les mateixes activitats davant qualsevol altra administració o organisme públic o privat i, si és el cas, si s'han concedit i la quantia.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;c) &lt;/em&gt;Comunicar a la Conselleria de Model Econòmic, Turisme i Treball l'obtenció de qualsevol altre ajut de minimis que s'hagi rebut durant els dos exercicis fiscals anteriors i durant l'exercici fiscal en curs.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;d) &lt;/em&gt;Sotmetre's a les actuacions de comprovació que faci la Conselleria de Model Econòmic, Turisme i Treball, i a les actuacions de control financer que duguin a terme la Intervenció General de la Comunitat Autònoma, la Sindicatura de Comptes i altres autoritats de control.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Dotzè&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Règim de minimis&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Als beneficiaris d'aquesta convocatòria se'ls ha d'aplicar la norma dels ajuts de minimis&lt;em&gt;,&lt;/em&gt; que determina que l'import total dels ajuts de minimis a una única empresa no pot ser superior a 200.000&amp;nbsp;€ durant qualsevol període de tres exercicis fiscals (article 3 del Reglament (CE) núm.1407/2013 de la Comissió, de 18 de desembre).&lt;/span&gt;&lt;/p&gt;
