    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En data 7 de novembre de 2019, el director general de Mobilitat i Transport Terrestre ha formulat la proposta de resolució següent:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fets&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El 7 de juny de 2019, l'Ajuntament d'Andratx va presentar a la Direcció General de Mobilitat i Transports una sol·licitud amb relació a la revisió de les tarifes del servei de transport urbà de viatgers amb taxi.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El 29 de juliol de 2019 se sol·licità a l'Ajuntament d'Andratx l'esmena de l'estudi aportat i en data 5 de setembre de 2019 el consistori va aportar les correccions sol·licitades.&amp;nbsp; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El 28 octubre de 2019, els tècnics de gestió econòmica del Consorci de Transports de Mallorca varen emetre un informe tècnic favorable a la proposta de revisió de les tarifes aprovades per l'Ajuntament d'Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. La Comissió de Preus de les Illes Balears, en la sessió de 6 de novembre de 2019, va examinar l'expedient i va adoptar l'acord següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Dictaminar favorablement sobre la revisió de les tarifes sol·licitada per l'Ajuntament d'Andratx amb relació als serveis de transport urbà de viatgers amb taxi per a l'any 2019, que és la següent:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El Reial decret 2695/1977, de 28 d'octubre, sobre normativa en matèria de preus (BOE núm. 260, de 31 d'octubre).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. El Decret 21/2019, de 2 d'agost, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 106, de 2 d'agost de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;7. El Decret 21/2019, de 2 d'agost, de la presidenta de les Illes Balears, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears, modificat pel Decret 22/2019, de 19 d'agost, de la presidenta de les Illes Balears, pel qual es rectifica el Decret 21/2019, de 2 d'agost, de la presidenta de les Illes Balears, pel qual es modifica el Decret 12/2019, de 2 de juliol, pel qual s'estableixen les competències i l'estructura orgànica bàsica de les conselleries de l'Administració de la Comunitat Autònoma de les Illes Balears (BOIB núm. 106, de 2 d'agost de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Proposta de resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Publicar la resolució en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Informar que la resolució entrarà en vigor l'endemà de la publicació en el Butlletí Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Per tot això, dict la següent&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Resolució &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Manifestar la conformitat amb la proposta de resolució i dictar-ne resolució en els mateixos termes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Contra aquesta Resolució, que exhaureix la via administrativa, es pot interposar un recurs potestatiu de reposició davant el conseller de Mobilitat i Habitatge en el termini d'un mes comptador des de l'endemà de la notificació, d'acord amb l'article 124 de la Llei 39/2015, d'1 de octubre, del procediment administratiu comú de les administracions públiques, i l'article 57 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;També es pot interposar directament un recurs contenciós administratiu davant la Sala Contenciosa Administrativa del Tribunal Superior de Justícia de les Illes Balears en el termini de dos mesos comptadors des de l'endemà de la notificació, d'acord amb l'article 46 de la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
