    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;L'apartat 9.3 de la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) &lt;span style="background-color:#ffffff"&gt;de 10 de juliol de 2015, per la qual es convoquen subvencions per a inversions a les explotacions agràries,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#212121"&gt; corresponents als anys 2015-2019, especifica que la resolució expressa es notificarà a les persones interessades mitjançant la publicació al &lt;/span&gt;&lt;span style="color:#212121"&gt;&lt;em&gt;Butlletí&lt;/em&gt;&lt;/span&gt; &lt;span style="color:#212121"&gt;&lt;em&gt;Oficial de les Illes Balears&lt;/em&gt;, d'acord amb els termes que preveu l'article 45.2 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;Els expedients han estat tramitats pel Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) en compliment del que disposa l'article 43 de la Llei 39/2015, d'1 d'octubre, del procediment administratiu comú de les administracions públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;El vicepresident, en data 4 d'octubre&lt;/span&gt;&lt;span style="color:#212121"&gt; de 2019, va signar la Resolució següent:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;En data de 16 de juliol de 2015 es va publicar, en el &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt; núm. 106, la Resolució del president del Fons de Garantia Agrària i Pesquera de les Illes Balears (FOGAIBA) per la qual es convoquen, per als anys 2015 a 2019, subvencions per a inversions a les explotacions agràries, modificada mitjançant les resolucions de 17 de desembre de 2015, 22 de juny de 2016 i 26 de juny de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;De conformitat amb l'apartat sisè de la Resolució esmentada, el termini per presentar les sol·licituds va acabar el dia 30 de juny de 2017. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;Els òrgans gestors del Servei d'Ajudes al Desenvolupament Rural han dut a terme el control administratiu de les sol·licituds i de la documentació aportada d'acord amb les normes reguladores d'aquesta ajuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;Una vegada avaluades les sol·licituds d'ajuda pels òrgans gestors, i d'acord amb els criteris d'elegibilitat establerts, els interessats assenyalats a l'&lt;span style="color:#212121"&gt; &lt;/span&gt;&lt;strong&gt;Annex I &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#212121"&gt;adjunt &lt;/span&gt;&lt;span style="color:#212121"&gt;&lt;strong&gt;no compleixen&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#212121"&gt; &lt;/span&gt;&lt;span style="color:#212121"&gt;amb algun dels requisits prevists a la convocatòria per poder ser beneficiaris de l'ajuda, pels motius indicats a l'esmentat annex..&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;En els grups de denegació INEA 2017_1_&lt;/span&gt;&lt;span style="color:#212121"&gt;3&lt;/span&gt;&lt;span style="color:#212121"&gt;_&lt;/span&gt;&lt;span style="color:#212121"&gt;PRO_NoRev del&lt;/span&gt;&lt;span style="color:#212121"&gt; &lt;/span&gt;&lt;span style="color:#212121"&gt;31&lt;/span&gt;&lt;span style="color:#212121"&gt; &lt;/span&gt;&lt;span style="color:#212121"&gt;de &lt;/span&gt;&lt;span style="color:#212121"&gt;maig&lt;/span&gt;&lt;span style="color:#212121"&gt; de 2019&lt;/span&gt;&lt;span style="color:#212121"&gt;,&lt;/span&gt;&lt;span style="color:#212121"&gt; &lt;/span&gt;&lt;span style="color:#212121"&gt;el Servei d'Ajudes al Desenvolupament Rural ha emès &lt;/span&gt;&lt;span style="color:#212121"&gt;els &lt;/span&gt;&lt;span style="color:#212121"&gt;informe&lt;/span&gt;&lt;span style="color:#212121"&gt;s&lt;/span&gt;&lt;span style="color:#212121"&gt; desfavorable&lt;/span&gt;&lt;span style="color:#212121"&gt;s&lt;/span&gt;&lt;span style="color:#212121"&gt; i propost&lt;/span&gt;&lt;span style="color:#212121"&gt;es&lt;/span&gt;&lt;span style="color:#212121"&gt; provisional&lt;/span&gt;&lt;span style="color:#212121"&gt;s de denegació de l'ajuda als interessats relacionats a l'Annex I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#212121"&gt;En &lt;/span&gt;&lt;span style="color:#212121"&gt;les &lt;/span&gt;&lt;span style="color:#212121"&gt;dat&lt;/span&gt;&lt;span style="color:#212121"&gt;es &lt;/span&gt;&lt;span style="color:#212121"&gt;29&lt;/span&gt;&lt;span style="color:#212121"&gt; &lt;/span&gt;&lt;span style="color:#212121"&gt;de &lt;/span&gt;&lt;span style="color:#212121"&gt;juliol de 2019&lt;/span&gt;&lt;span style="color:#212121"&gt; &lt;/span&gt;&lt;span style="color:#212121"&gt; es notific&lt;/span&gt;&lt;span style="color:#212121"&gt;à&lt;/span&gt;&lt;span style="color:#212121"&gt;, mitjançant publicació a la &lt;/span&gt;&lt;span style="color:#212121"&gt;plana&lt;/span&gt;&lt;span style="color:#212121"&gt; web http://www.caib.es&lt;em&gt;, &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#212121"&gt;l'esmentada proposta provisional als interessats, concedint-los un termini de 10 dies per presentar les al·legacions escaients.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Llei 39/2015, d'1 d'octubre, del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p style="margin-bottom:0.25cm; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;Resolució&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.15cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;Per tot això, s'informa desfavorablement i es proposa al vicepresident del FOGAIBA que dicti una resolució en els termes següents:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Denegar l'ajuda sol·licitada pels interessats que figuren a &lt;strong&gt;l'Annex I&lt;/strong&gt;, que són un total de&lt;span style="display:inline-block"&gt;&lt;span style="color:#000000"&gt; 1 expedient i que comença amb SUNIL BHARDWAJ CAPO i acaba amb SUNIL BHARDWAJ CAPO&lt;/span&gt;&lt;/span&gt; relativa a la línia d'ajudes “Inversions a les explotacions agràries”, per no complir amb algun dels requisits que s'estableixen a la convocatòria i que s'especifiquen a l'esmentat annex.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Declarar conclòs el procediment i procedir a l'arxiu dels expedients detallats a l 'Annex I.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="display:inline-block"&gt;Publicar aquesta resolució al &lt;em&gt;Butlletí Oficial de les Illes Balears&lt;/em&gt;&lt;/span&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p style="margin-bottom:0.25cm; text-align:left"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;strong&gt;Interposició de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0.15cm"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra aquesta resolució –que no exhaureix la via administrativa- es pot interposar recurs d'alçada davant la consellera d'Agricultura, Pesca i Alimentació, en el termini d'un mes, en el termini d'un mes, comptador des de l'endemà de la notificació de la resolució, d'acord amb l'article 58.4 de la Llei 3/2003, de 26 de març, de règim jurídic de l'Administració de la comunitat autònoma de les Illes Balears, i l'a&lt;span style="color:#000000"&gt;rticle &lt;/span&gt;&lt;span style="color:#000000"&gt;68.1&lt;/span&gt;&lt;span style="color:#000000"&gt; de la Llei &lt;/span&gt;&lt;span style="color:#000000"&gt;39&lt;/span&gt;&lt;span style="color:#000000"&gt;/&lt;/span&gt;&lt;span style="color:#000000"&gt;2015&lt;/span&gt;&lt;span style="color:#000000"&gt;, d&lt;/span&gt;&lt;span style="color:#000000"&gt;'1&lt;/span&gt;&lt;span style="color:#000000"&gt; d&lt;/span&gt;&lt;span style="color:#000000"&gt;'octubre&lt;/span&gt;&lt;span style="color:#000000"&gt;, del Procediment Administratiu Comú de les Administracions Públiques.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0cm; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;ANNEX II: OBLIGACIONS DEL BENEFICIARI&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;Realitzar les inversions o activitats auxiliades en el termini establert.&lt;/li&gt;
	&lt;li&gt;Justificar les despeses relacionades amb la inversió per a la recepció dels fons comunitaris en els termes i terminis determinats a la present Resolució.&lt;/li&gt;
	&lt;li&gt;Exercir l'activitat agrària en qualsevol explotació i mantenir les inversions realitzades durant almenys cinc anys, comptats des de la data de pagament de l'ajuda.&lt;/li&gt;
	&lt;li&gt;Complir les normes comunitàries aplicables a la inversió de la qual es tracti i les específiques que puguin assenyalar-se en funció del tipus d'explotació.&lt;/li&gt;
	&lt;li&gt;Incrementar un 5% els ingressos agraris inicials en un dels cinc anys següents al pagament de l'ajuda, excepte en els casos d'inici d'activitat contemplats en el punt 1.2 de l'apartat tercer.&lt;/li&gt;
	&lt;li&gt;Adoptar les mesures que siguin necessàries per proporcionar informació al públic i donar-ne publicitat.&lt;/li&gt;
	&lt;li&gt;Sotmetre's als controls que dugui a terme l'administració, necessaris per comprovar la correcta concessió de l'ajuda i el posterior manteniment dels compromisos.&lt;/li&gt;
	&lt;li&gt;Complir els compromisos adquirits per a la concessió de l'ajuda.&lt;/li&gt;
	&lt;li&gt;Mantenir els requisits i condicions exigibles respecte a l'explotació i a la persona beneficiària, als quals fa referència l'apartat tercer d'aquesta R&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;esolució.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;
